REGARDING A PROMISSORY NOTE AND A MORTGAGE FOR THE
PROPERTY LOCATED AT 755 OAKLAND AVENUE, IOWA CITY, IOWA.
Comment: The owners of the property located at 755 Oakland Avenue
received assistance through the City's Housing Rehabilitation Program for the
amount of ~ 11,000 on September 20, 1988. The financing was in the form
of a statement of life lien. The loan was paid off on October 19, 1999; thus
the lien can now be released.
(4) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN
AND THE CITY CLERK TO ATTEST THE RELEASE OF A LIEN

Comment: The owner of the property located at 242 Magowan Avenue
received assistance through the City's Housing Rehabilitation Program for the
amount of 95,481 on March 20, 1996. The financing was in the form of a
conditional occupancy loan. The loan was paid off on October 14, 1999;
thus the lien can now be released.

Comment: The owners of the property located at 817 Iowa Avenue received
assistance through the City's Rental Rehabilitation Program for 915,000 on
March 30, 1989 and for $6,000 on April 27, 1989 for a total of $21,000.
The financing was in the form of ten-year depreciation loans. The terms of
the loans have been satisfied; thus the liens can now be released.

CITY OF IOWA CITY AND MERCANTILE BANK, IOWA CITY, IOWA FOR
PROPERTY LOCATED AT 1551 DICKENSON LANE, IOWA CITY, IOWA.
Comment: Mercantile Bank, has requested that the City approve a
Subordination Agreement for 1551 Dickenson Lane. On May 1, 1998, the
owner of the property received HOME Investment Partnerships Program funds
in the form of a 15-year forgivable loan from the City of Iowa City.
Mercantile Bank has financed the construction loan with the property owner.
The property is appraised at $135,000 which provides enough equity to
cover the City's second lien position.

TO PUBLISH ADVERTISEMENTS FOR BIDS FOR CONSTRUCTION
OF THE IOWA CITY WATER FACILITY IMPROVEMENTS,
DIVISION 1: WATER TREATMENT PLANT, DIVISION 2: WELL HOUSES.
Comment: Receipt of bids for th ater Plant and Well House Construction
Project is currently set for ~ on December 7. Several contractors
have called and requested that bids be opened at 2:00 p.m. on December 7
to allow time on the day of bid to receive and finalize prices from suppliers
and subcontractors. Public Works desires to honor this request and
recommends approval of this resolution.

CONSIDER A RESOLUTION SETTING A PUBLIC HEARING FOR
NOVEMBER 23 ON PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND
ESTIMATE OF COST FOR THE CONSTRUCTION OF CONTRACT 3 - SOUTH
PLANT IMPROVEMENTS, WASTEWATER TREATMENT AND COLLECTION
FACILITY IMPROVEMENTS PROJECT, DIRECTING CITY CLERK TO PUBLISH
NOTICE OF SAID HEARING, AND DIRECTING THE CITY ENGINEER TO
PLACE SAID PLANS ON FILE FOR PUBLIC INSPECTION.
Comment: This project includes the construction of new wastewater
treatment facilities at the South Wastewater Treatment Plant. This project
will bring the City into compliance with Federal wastewater discharge limits
imposed on Iowa City, allow for improved treatment of the City's industrial
wastes, and continue the phase out of the aging North Plant Treatment
Facilities. This project is scheduled for bid letting in early February.
93 ON INTENT TO PROCEED WITH A PUBLIC IMPROVEMENT
PROJECT AND TO ACQUIRE PROPERTY RIGHTS FOR THE LONGFELLOW-
TWAIN PEDESTRIAN TUNNEL PROJECT, DIRECTING CITY CLERK TO
PUBLISH NOTICE OF SAID HEARING, AND DIRECTING THE CITY ENGINEER
TO PLACE DOCUMENTATION ON FILE FOR PUBLIC INSPECTION.
Comment: This project will provide a pedestrian crossing under the Iowa
Interstate Railroad that will link the Longfellow and Twain neighborhoods.
Under the provisions of House File 476, enacted during the 1999 legislative
session, notice of the City's intent to continue with the project and acquire
property therefore must be given to all property owners whose properties
may be affected. This is the second public hearing on this project. It is
needed because additional potentially affected property owners were
identified after the original public hearing.
(3) CONSIDER A MOTION SETTING A PUBLIC HEARING FOR NOVEMER 23 ON
IOWA CITY'S CONSOLIDATED PLAN FOR 2001-2006 (A.K.A. CITY STEPS).
Comment: This document is Iowa City's 5-year plan for housing, jobs and
services for low-income residents. A series of public meetings has been held
to receive citizen input regarding the strategies, goals and priorities detailed
within the plan. A 30-day public comment period started on November 5,
1999.

THE NORTHWEST SANITARY SEWER PROJECT, PHASE I1."

Comment: The City Code authorizes the City to adopt and implement,
following public hearing, project specific tap on fee ordinances to provide for
the equitable apportionment of costs associated with extension of public
utilities. The proposed ordinance will adopt a tap-on fee for the cost
associated with the construction of the Northwest Sanitary Sewer, Phase II,
which is the north fork of the northwest sanitary sewer constructed in 1991,
to serve the northerly area of the Clear Creek drainage basin.

the exterior design for the Court-Linn Building at 338-398 Linn Street. The Committee
approved the design with the condition that: 1) any exterior canopy and signage must
be submitted to the Design Review Committee for approval; and 2) the handrails and
balcony rails used be of one of the two alternate designs shown at the October 26
meeting or be of all vertical balusters and not the

QUIZNO'S PROJECT IN OLD CAPITOL MALL AT THE CLINTON AND COLLEGE
STREET ENTRANCE.
Comment: The Design Review Committee has reviewed the exterior design of the Old
Capitol mall Quizno's entrance at the Clinton Street entrance and the proposed
signage. The committee recommends approval of both the exterior entrance design

CONSIDER A RESOLUTION APPROVING A PURCHASE AGREEMENT BETWEEN THE
CITY OF IOWA CITY AND OLIN L. LLOYD FOR A 20.78 ACRE PARCEL OF REAL
ESTATE TO BE USED BY THE CITY AS A PUBLIC WORK SITE AND A .10 ACRE
PARCEL OF RIGHT-OF-WAY ALL ADJACENT TO GILBERT STREET AND SOUTH OF
NAPOLEON PARK.
Comment: City staff has negotiated a purchase agreement with Olin Lloyd for the
purchase of said property for $420,000. Said purchase agreement is subject to City
Council approval.

INDEMNITY AGREEMENTS FOR POLICE AND FIRE TRAINING ON PRIVATE

Comment: Private property owners have been willing to allow Iowa City police
officers to train on their property, including within buildings, warehouses, etc.,
provided the City of Iowa City indemnifies the property owner against property
damage and personal injuries which could arise from the training. This resolution
would allow the City Manager to execute such indemnity agreements after consulting
with the City Attorney and Risk Manager. ..

A RESOLUTION RESCINDING THE 1997 COMMERCIAL
LICENSE SUBSTANCE ABUSE PREVENTION PROGRAM FOR
AND ALCOHOL AND ESTABLISHING AN AMENDED
Comment: Following the Triennial Review by the Federal Transit Administration (FTA),
changes were required to fully meet FTA criteria for such programs. The revised
program incorporates all of these changes. Staff memorandum included in Council

CONSIDER A RESOLUTION AMENDING THE BUDGETED POSITIONS IN THE
COMMUNITY DEVELOPMENT DIVISION OF THE PLANNING AND COMMUNITY
DEVELOPMENT DEPARTMENT AND THE AFSCME PAY PLAN BY DELETING ONE
HOUSING REHAB OFFICER POSITION AND ADDING ONE HOUSING REHAB
SPECIALIST POSITION.
Comment: Following a review of the work assignments in the Community
Development Division Rehabilitation Program some job duties have been reallocated.
This reorganization of duties will best be accomplished by eliminating the position of
Housing Rehab Officer and establishing a position of Housing Rehab Specialist. See
memorandum included in Council packet.
Action:
CONSIDER A RESOLUTION RATIFYING SETTLEMENT OF PENDING LITIGATION.
Comment: This Resolution will confirm and ratify a proposed settlement agreement
involving pending litigation if the City Council approves of the settlement agreement
during the executive session scheduled for Monday, November 8, 1999.
