Comment: The City of Iowa City, through the Iowa City Housing Authority,
has created the Affordable Dream Home Opportunities Program ("ADHOP")
using funds received from the sale of public housing units. (The City is
required to reinvest such proceeds to expand affordable housing opportunities
in Iowa City.) The Housing Authority intends to build a single family home
under this program on a lot the City is in the process of purchasing located
on Dickinson Lane in Iowa City. Families who earn up to 80% of the median
income may qualify to purchase the home after it is completed. Staff will be
available at the work session on Monday, December 6, '1999 to answer any
questions you have.

Comment: This project consists of upgrading the existing site layout to
include more recycling and reclamation drop sites more conveniently situated
for customer access. It also includes a new facility building consisting of a
scale office, education room, personnel office, a product exchange store and
a chemical waste operation room.

Comment: This project consists of installing a gas collection system
throughout the entire landfill site to meet current state and federal landfill
rules. The system will collect all landfill gases from the site for treatment by
an enclosed flair before being released to the atmosphere.

STORMWATER AND GREENSPACE PROJECT, DIRECTING CITY CLERK TO
PUBLISH NOTICE OF SAID HEARING, AND DIRECTING THE CITY ENGINEER
TO PLACE DOCUMENTATION ON FILE FOR PUBLIC INSPECTION.
Comment: This project will enhance the drainage corridor south of Mt.
Prospect, Part 7 and Lakeside Subdivisions to the Snyder Creek Bottom
Wetlands and will provide a regional storm water facility to be used by
existing and future subdivisions. Under the provisions of House File 476,
enacted during the 1999 legislative session, notice of the City's intent to
proceed with the project and acquire property therefore must be given to all
property owners whose may be affected. This is the second public hearing
on this project. It is needed because the City is contemplating a modification
in the northern location of the project where the drainage corridor is being
enhanced which may affect additional property owners who were not
identified prior to the original public hearing.
e. Resolutions.
c~ z~o.~ (1) CONSIDER A RESOLUTION PROVIDING NOTICE THAT AT LEAST NINETY-
FIVE PERCENT (95%) OF THE WORK UNDER THE CONTRACT FOR THE
WILLOW CREEK INTERCEPTOR AND LATERAL SEWERS PROJECT HAS
BEEN COMPLETED AND THAT THE CITY INTENDS TO RELEASE FUNDS
RETAINED PURSUANT TO CHAPTER 573, CODE OF IOWA.
Comment: Kenko, Inc., the general contractor for this project, has requested
that the City release most of the funds which were retained for the project
pursuant to Chapter 573, Code of Iowa. Briefly, Chapter 573 provides that
cities shall retain from the monthly payments to contractors on public
improvement contracts an amount not to exceed five percent (5%) of the
payment due. This five percent (5%) retainage is a fund for the payment of
claims for labor and materials. An amendment to Chapter 573 provides that
cities may release all or part of the retainage thirty days after ninety-five
percent (95%) of the work under the contract is completed if no claims are
filed within that thirty (30) day period. This resolution allows the City to
reduce the amount of the retainage to an amount not less than one percent
(1%). Although the work on this project is complete, the contractor does not
wish the City to accept the project until final dispute resolution is completed.

a. Consider a motion setting a public hearing for January 18 on an ordinance
changing the zoning designation from Low Density Multi-Family Residential (RM-
12) and Medium Density Single Family Residential (RS-8) to Planned Development
Housing Overlay (OPDH-12/11.79 acres) and (OPDH-8/1.47 acres) and approving a
preliminary Planned Development Housing Overlay Plan for Windsor Ridge, Part 15,
a proposed 98-unit residential development located north of Court Street at its
eastern terminus. (REZ99-0011)
Comment: At its November 18 meeting, by a vote of 7-0, the Planning and Zoning
Commission recommended approval of the proposed rezoning and preliminary
development plan. Staff recommended approval in a report dated November 4.
b. Consider a motion setting a public hearing for January 18 on an ordinance
changing the zoning designation from Low Density Single-Family Residential (RS-5)

Comment: At its November 18 meeting, by a vote of 5-1 with Ehrhardt voting no,
the Planning and Zoning Commission recommended approval of the rezoning and
preliminary development plan. Staff recommended approval in a report dated
October 21 and a memorandum dated October 28
c. Consider a motion setting a public hearing for January 18 on an ordinance
changing the zoning designation from Planned High Density Multi-Family
Residential (PRM) to Sensitive Areas Overlay (OSA-PRM) and approving a
preliminary Sensitive Areas Development Plan for approximately .28 acres located
at 522 S. Dubuque Street. (REZ99-O013)
Comment: The Planning and Zoning Commission will be considering the requested
rezoning and preliminary development plan at its December 2 and 16 meetings,
and is expected to take action prior to the January 18 Council meeting. In a repo~
dated December 2, staff recommended approval pending staff approval of the
development plan and a grading plan that assures the stability of the slope will not
be undermined.

Comment: At its July 15 meeting, by a vote of 6-0, the Planning and Zoning
Commission recommended approval of the final plats for Windsor Ridge, Parts Ten
through Fourteen, subject to the approval of legal papers, construction drawings
and a revised sensitive areas site plan prior to Council consideration of the plat,
and subject to provisions regarding the timing of the extension of Arlington Drive
and the construction of sidewalks along Outlot K. All conditions have been
addressed. Deferred on November 9 and 23.

Comment: At its November 18 meeting, by a vote of 7-0, the Planning and Zoning
Commission recommended approval of the final plat subject to the approval of
legal papers prior to Council consideration of the plat. In a report dated November

SECTION 14-3B-5 ENTITLED "PROJECT SPECIFIC TAP-ON FEE FOR THE
NORTHWEST SANITARY SEWER PROJECT, PHASE I1."
Comment: The City Code authorizes the City to adopt and implement, following public
hearing, project specific tap on fee ordinances to provide for the equitable
apportionment of costs associated with extension of public utilities. The proposed
ordinance will adopt a tap-on fee for the cost associated with the construction of the
Northwest Sanitary Sewer, Phase II, which is the north fork of the northwest sanitary
sewer constructed in 1991, to serve the northerly area of the Clear Creek drainage
basin.

PROPERTY RIGHTS FOR THE LONGFELLOW-TWAIN PEDESTRIAN TUNNEL PROJECT.
This project will provide a pedestrian crossing under the Iowa Interstate Railroad that
will link the Longfellow and Twain neighborhoods. This is the second public hearing
on this project. It is needed because additional potentially affected property owners
were identified after the original public hearing.

Comment: This project involves repair and preventive maintenance work to the
Capitol Street and Dubuque Street parking ramps; including the replacement of leaky
expansion joints, control joints and broken precast double-tee weld plates and the
application of a waterproofing membrane and a concrete penetrating sealer. The
project is anticipated to be completed during the months of May-July 2000. The
Engineer's estimate of construction cost is $356,000 and will be funded by parking
revenues.

Comment: This project involves improving the lighting in the Capitol Street parking
ramp by replacing the 20 year old light fixtures with new fixtures that are specifically
designed for parking ramps. The project is anticipated to be completed during the
months of April and May 2000. The Engineer's estimate of construction cost is
$187,000 and will be funded by parking revenues.

ITEM NO. 15. CONVEYENCE OF ONE-HALF OF A TEN FOOT WIDE VACATED PORTION OF THE
WASHINGTON STREET RIGHT-OF-WAY LOCATED BETWEEN 1033 (LOT 7, KOSER
BROTHERS SUBDIVISION) AND 1025 WASHINGTON STREET TO JAMES AND
CHRISTINE WALTERS.
Comment: On July 27, 1999, the City Council passed an ordinance vacating a ten-
foot wide portion of the Washington Street right-of-way along the west property line
of 1033 East Washington Street (Lot 7, Koser Brothers Subdivision) and abutting
1025 East Washington Street. James and Christine Waiters, as owners of the
adjacent property to the east (1033 E. Washington), have offered the sum of $2,312
for one half of the ten-foot wide by 170' long parcel (approximately 850 square feet),
or $2.72 per square foot, which is consistent with the fair market valuation listed on
the assessment rolls for comparable properties.

ITEM NO. 16. CONVEYENCE OF A SINGLE FAMILY HOME LOCATED AT 2660 INDIGO COURT.
Comment: The Iowa City Housing Authority, under its Tenant-to-Ownership Program,
proposes to sell 2660 Indigo Court to the present tenant. The amount of the sale will
be the appraised value of the home, which is 997,000. The family has leased this
single family home from the Iowa City Housing Authority for the past 15 months and
has taken excellent care of the home during this time. The family has received a
written commitment for a mortgage from a local bank in the amount of $57,000 and
has qualified for a 910,000 forgivable grant from the Federal Home Loan Bank. The
City will provide a second mortgage for the remaining 930,000. This sale will provide
the opportunity for a low-income family to obtain ownership of their own home.

Comment: This ordinance is placed on the Council's agenda at Council's direction
following the expression of concern by members of the public.

SECTION 4C THEREIN TO ALLOW THE CITY MANAGER OR DESIGNEE TO INSTALL
OR MODIFY TRAFFIC CONTROL DEVICES FOR TEMPORARY CONDITIONS.
(SECOND CONSIDERATION)
Comment: Periodically traffic conditions change temporarily due to off-site
construction, development, activity, or other factors. Currently modifying traffic
control to meet the temporary conditions requires two actions by the City Council.
This process can take up to 12 weeks in the case of ordinance changes, where the
ordinance needs to be changed and then changed back after the temporary condition
is no longer necessary. To be more responsive to temporary changes, this ordinance
amendment will allow the City Manager or designee to administratively respond to
traffic control changes that are temporary in nature. Written notice will be provided to
the City Council. Staff recommends expedited consideration.

CONSIDERATION)
Comment: Problems have occurred upon enforcement of the 'No Parking" restriction
near transit stops. The distance covered under the code is not defined. Transit officials
have determined that 60 feet is the required space to properly get a transit vehicle in
position to safely load and unload passengers. Staff recommends expedited
consideration.
ITEM NO. 21. CONSIDER A RESOLUTION APPROVING THE DESIGN OF THE EXTERIOR AWNING TO

Comment: The Design Review Committee at its November 30 regular meeting
reviewed the application for a new awning projecting into the City Plaza for the
College Street Billiards Club & Deli at 114-116 E. College Street. The Committee
recommends approval.

Comment: The Design Review Committee at its November 30 regular meeting
reviewed the application for a temporary "book market" sign on the Old Capitol Mall at
the Clinton Street Book Market entrance. The Committee recommends approval of the
temporary sign with the condition that it be removed six months after installation.

Comment: At its special meeting of December 2, the Design Review Committee (by a
vote of 2 to 3) voted that the design of the exterior signage to the Sheraton Hotel be
denied. Committee memorandum included in Council packet.
ITEM NO. 24. CONSIDER A RESOLUTION APPROVING THE EXTERIOR DESIGN AND AWNING TO

Comment: At its special meeting of December 2, the Design Review Committee
viewed preliminary design plans for the exterior of Brothers. A special meeting will be
held December 6 to vote on final approval. Design and awning information will be
distributed to Council at the December 6 Work Session.

SUBMIT SAID PLAN, TECHNICAL CORRECTIONS AND ALL NECESSARY CERTIFICA-
TIONS TO THE U.S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT, AND
DESIGNATING THE CITY MANAGER AS THE AUTHORIZED CHIEF EXECUTIVE
OFFICER FOR THE CONSOLIDATED PLAN.
Comment: On November 18 the Housing and Community Development Commission
(HCDC) reviewed and recommended approval of the 2001-2006 Consolidated Plan
(CITY STEPS). A public hearing was held on November 23 to receive public input.
This document incorporates those public comments and technical corrections as
needed. Once approved, this plan will be sent to the U.S. Department of Housing and
Urban Development.

ITEM NO. 27. CONSIDER A RESOLUTION OF INTENT TO CONVEY A PORTION OF LOT 1, BLOCK 3,

LOCATED AT THE SOUTHEAST CORNER OF GRANT STREET AND COURT STREET,
TO ADJACENT PROPERTY OWNERS WILLIAM G. FLANAGAN AND ELIZABETH
ROSE, AND SETTING A PUBLIC HEARING ON SAID CONVEYANCE FOR
JANUARY 18, 2000.
Comment: William G. Flanagan and Elizabeth Rose, as owners of the adjacent
property at 406 Grant Street, have offered the sum of ~525.00 for an approximate
2,995 square foot portion of a City-owned, unbuildable remnant lot known as Lot 1,
Block 3 Rundell Addition. Mr. Flanagan and Ms. Rose have made their offer based on
an appraisal of the subject property and plan to use the property for the construction
of a driveway from their property to Grant Street (see attached letter and appraisal).
The amount offered for the property is in the mid-range of the values indicated by the
appraisal. This Resolution declares the City Council's intent to convey the above
property to Mr. Flanagan and Ms. Rose, and sets a public hearing on the proposed
conveyance for January 18, 2000.
ITEM NO. 28. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY

DEPARTMENT OF NATURAL RESOURCES AND THE CITY OF IOWA CITY.
Comment: Following receipt of Mississippi River Revival's and Environmental
Advocates' letter and notice regarding National Pollutant Discharge Elimination System
(NPDES) permit compliance issues, City staff has been discussing and negotiating a
Consent Administrative Order with the Iowa Department of Natural Resources which
would address the various permit compliance concerns raised. This resolution
authorizes the execution of the Consent Administrative Order on behalf of Iowa City.

Comment: The ICPL has a complex computer system which is essential to provide
quality public service including information delivery via the World Wide Web and the
Library's computer access. Qualified staff is necessary to maintain computer support
services. To meet this staffing need, a vacant Library Assistant I position is being
reclassified to a Library Web Specialist position. Annual cost for the reclassification is
approximately $1,557. Staff memorandum included in Council packet.
ITEM NO. 30. CONSIDER A RESOLUTION RATIFYING SETTLEMENT OF PENDING LITIGATION.
