CONSIDER A MOTION TO APPROVE DISBURSEMENTS IN THE AMOUNT OF $18,967,933.55 FOR THE PERIOD OF JULY 1 THROUGH JULY 31, 2005, AS RECOMMENDED BY THE FINANCE DIRECTOR SUBJECT TO AUDIT. CONSIDER A RESOLUTION APPROVING THE ACCEPTANCE OF THE DEDICATION OF OUTLOT A, RUPPERT HILLS, AN ADDITION TO THE CiTY OF IOWA CITY, IOWA, FOR PUBLIC PARK PURPOSES. Comment: In connection with the final plat of Ruppert Hills subdivision, it was agreed that the developer RayCal Iowa Ltd. would dedicate the 1.5 acre parcel depicted as Outlot A, located at the corner of Benton Street and Miller Avenue, to the City for public park purposes. The developer has submitted an appropriate warranty deed for this dedication. City Code provides that the City formally accept the dedication of land by resolution. The Parks & Recreation Department recommends that the City accept dedication of the parcel. This resolution authorizes acceptance of a deed to the property. 2. CONSIDER A RESOLUTION APPROVING A CONSENSUAL DUAL AGENCY ADDENDUM TO THE LISTING AGREEMENT FOR COMMERCIAL SPACE AT THE COURT STREET TRANSPORTATION CENTER WITH NAI IOWA REALTY COMMERCIAL. Comment: After considering competitive proposals, the City has awarded the listing agreement for two commercial spaces in the Court Street Transportation Center to NAI Iowa Realty Commercial. A consensual dual agency addendum to the listing agreement is necessary to enable NAI Iowa Realty Commercial to act as agent for both the City and prospective tenants for the two commercial spaces. This resolution approves of the consensual dual agency addendum to the listing agreement and authorizes its execution by the Mayor and City Clerk. 3. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST TO THE RELEASE OF LIENS REGARDING TWO AGREEMENTS, A MORTGAGE AGREEMENT AND AN AMENDMENT TO THE AGREEMENT FOR THE PROPERTY LOCATED AT 2105 BROADWAY STREET AND 2651 ROBERTS ROAD, IOWA CITY, IOWA. Comment: The holder of the promissory note on the property located at 2105 Broadway Street and 2651 Roberts Road received assistance through the City of Iowa City's Community Development Block Grant Funds. Comment: This resolution will establish a 401a money purchase retirement plan with the International City/County Management Association Retirement Corporation (ICMA-RC). This plan is for the new Police Chief Sam Hargadine and is in lieu of the Iowa Police pension plan administered by the State MFPRSI. f) Correspondence. 1. PLANNING AND ZONING MATTERS. a) CONSIDER AN ORDINANCE CONDITIONALLY REZONING APPROXIMATELY 92 ACRES FROM INTERIM DEVELOPMENT RESIDENTIAL (ID-RS) ZONE TO LOW DENSITY SINGLE FAMILY - SENSITIVE AREAS OVERLAY (OSA-5) ZONE FOR PROPERTY LOCATED WEST OF KENNEDY PARKWAY AND EAST OF CAMP CARDINAL ROAD (REZ03-00019) (SECOND CONSIDERATION) Comment: At its July 6 meeting, by a vote of 6-0 (Brooks absent) the Planning and Zoning Commission recommended approval of the proposed rezoning and associated Sensitive Areas Development Plan, subject to necessary easements and an escrow for the extension of a standard 8" sanitary sewer to the south property boundary and a good faith effort for construction traffic to use alternative routes to Kennedy Parkway where possible. Staff recommended approval in a report dated June 16 subject to resolution of deficiencies. Approval will allow the development of Cardinal Ridge, a 93-1ot, residential subdivision. It is anticipated that legal papers and construction drawings will be approved prior to the Council meeting. Staff recommended approval in a report dated July 6, 2005. Action: 0.~-~-~ f) CONSIDER A RESOLUTION APPROVING THE FINAL PLAT OF OLDE TOWNE VILLAGE, IOWA CITY, IOWA (SUB05-00016) (DEFERRED FROM 8/16) Comment: At its July 21 meeting by a vote of 6-0 (Plahutnik absent), the Planning and Zoning Commission recommended approval subject to staff approval of legal papers and construction drawings prior to Council consideration of the final plat. It is anticipated that legal papers and construction drawings will be approved prior to the Council meeting. Approval will allow the development of a 49-1ot, 33.3-acre subdivision with 10 commercial lots and 39 residential lots located south of Rochester Avenue, east of Scott Boulevard, and north of Lower West Branch Road. Action: September 6, 2005 City of Iowa City Page 9 ITEM6. AUTHORIZING CONVEYANCE OF A 5,941 SQUARE FOOT PARCEL OF PROPERTY TO ADJACENT PROPERTY OWNERS JOHN H. ROFFMAN AND JOELLEN S. ROFFMAN. Comment: The City needs to acquire 119 square feet of permanent easement and 613 square feet of temporary easement from John H. Roffman and Joellen S. Roffman for the Mormon Trek Boulevard Extension - Box Culverts Project. The Roffmans have accepted the City's offer to purchase said property interests at the appraised price of $3.00 per square foot, on the condition that the City sell them a 5,941 square foot piece of adjacent City-owned property legally, at the price of $3.00 per square foot, for a total of $17,823.00. This resolution authorizes conveyance of the City-owned parcel to the Roffmans. Zoning map included in Council packet. a) PUBLIC HEARING Action: I'~ r:.) APPROVING PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST OF THE CONSTRUCTION OF A DUPLEX HOME UNDER THE AFFORDABLE DREAM HOME OPPORTUNITIES PROGRAM, ESTABLISHING AMOUNT OF BID SECURITY TO ACCOMPANY EACH BID, DIRECTING THE CITY CLERK TO PUBLISH ADVERTISEMENT FOR BIDS, AND FIXING TIME AND PLACE FOR RECEIPT OF BIDS. Comment: The City of Iowa City, through the Iowa City Housing Authority (ICHA), has created the Affordable Dream Home Opportunities Program (ADHOP) using funds received from the sale of public housing units. Under an agreement with HUD, the ICHA is required to reinvest the proceeds to expand affordable housing opportunities in . Iowa City. Since 1998, 44 home ownership opportunities have been created by the ICHA. The ICHA intends to build in Longfellow Manor Subdivision one universal designed two-family dwelling for sale to families who earn up to 80% of the median income. The estimated construction cost per home is $110,000. a) PUBLIC HEARING Action: \f~., ~¢--z, ,-. ~ ~~ .L¢~ 5bi b) CONSIDER A RESOLUTION Action: September 6, 2005 City of Iowa City Page 10 ITEM 8. CONSIDER AN ORDINANCE AMENDING SECTION 1-9-3B OF THE CODE OF ORDINANCES OF IOWA CITY, AND AMENDING THE BOUNDARIES OF CERTAIN O~-'Z/-I'~ VOTING PRECINCTS IN IOWA CITY TO REFLECT VARIOUS BOUNDARY CHANGES TO THE CORPORATE LIMITS OF IOWA CITY. (SECOND CONSIDERATION) Comment: With the recent severance and annexation of various properties, changes are necessary to the precinct boundaries of Precincts 8, 9, and 13. Although there is an addition to Precinct 7 also, no language change is necessary since the new property will be incorporated in the existing description which refers to the City's corporate boundary. Since most of the land is undeveloped or has only commercial uses, residents will be unaffected by this change, with the exception of one household in Precinct 7. Staff requests expedited consideration. ITEM 9. CONSIDER AN ORDINANCE AMENDING TITLE 9, ENTITLED "MOTOR VEHICLES AND TRAFFIC," CHAPTER 3, ENTITLED "RULES OF THE ROAD," SECTION 6, 4] '7'7 ENTITLED SPEED RESTRICTIONS," SUBSECTION B, ENTITLED "EXCEPTIONS" TO ESTABLISH THE SPEED LIMIT ON COURT STREET EAST OF ITS INTERSECTION WITH LINDEMANN DRIVE. (PASS AND ADOPT) Comment: The current speed limit on Court Street from its intersection with Lindemann Drive east to the City limits is 25 miles per hour. City Staff has conducted an engineering and traffic investigation and recommends that 35 miles per hour is a more reasonable, appropriate and safe speed limit for said portion of Court Street. CONSIDER AN ORDINANCE AMENDING TITLE 3, ENTITLED "CITY FINANCES, TAXATION AND FEES" CHAPTER 4, ENTITLED "SCHEDULE OF FEES, RATES, CHARGES, BONDS, FINE AND PENALTIES," SECTION 8, ENTITLED "PARKING o~ -5/~7 ~ VIOLATIONS," TITLE 9, ENTITLED "MOTOR VEHICLES AND TRAFFIC," CHAPTER 4, ENTITLED "PARKING REGULATIONS," SECTION 10, ENTITLED "PARKING FOR LOADING AND UNI~LOADING" AND SECTION 14, ENTITLED "ENFORCEMENT," AND ADDING NEW SECTION 15 ENTITLED "LIBRARY PARKING" TO INCREASE AVAILABILITY OF PARKING FOR LIBRARY PATRONS, TO ESTABLISH FINES FOR LIBRARY PARKING VIOLATIONS, AND TO PROVIDE FOR INCREASED ENFORCEMENT OF LOADING ZONE VIOLATIONS. (SECOND CONSIDERATION) Comment: This ordinance increases the regulations on loading zone parking and establishes regulations for library parking. Under the current ordinance, a vehicle parked in violation of a loading zone sign cannot be ticketed a second time until two hours have gone by. Staff observes frequent violation of loading zone signs. The proposed amendment will allow a second ticket thirty (30) minutes after the first loading zone violation ticket. The ordinance also designates six of the seven parking spaces (not the handicap space) on Linn Street in front the library as "library parking" to increase the availability of parking for library patrons. The 5-minute space for book drop off will be enforced at all hours, but the other five spots will be limited to library use just during library hours. A vehicle parked in violation of the "library parking" provisions can receive a ticket ten (10) minutes after the first violation. The ordinance further provides that each space have a sign containing certain information that will notify the public of the library parking requirements and that vehicles parked illegally in the book drop off space can be towed. Staff requests expedited consideration. Action: ITEM 1'1. CONSIDER AN ORDINANCE AMENDING TITLE ~ ENTITLED "MOTOR VEHICLES AND TRAFFIC," CHAPTER 3, ENTITLED "RULES OF THE ROAD," SECTION 6, ~- z~l ~ ~ ENTITLED SPEED RESTRICTIONS," SUBSECTION B, ENTITLED "EXCEPTIONS" TO ESTABLISH THE SPEED LIMIT ON SOCCER PARK ROAD FROM ITS INTERSECTION WITH LEHMAN AVENUE TO THE ENTRANCE OF THE SOCCER PARK. (SECOND CONSIDERATION) Comment: The current speed limit on Soccer Park Road is from its intersection with Lehman Avenue to the entrance of the soccer park is 45 miles per hour. City Staff has conducted an engineering and traffic investigation and recommends that 30 miles per hour is a more reasonable, appropriate and safe speed limit for said portion of Soccer Park Road. CONSIDER A RESOLUTION AMENDING THE BUDGETED POSITIONS IN THE HOUSING INSPECTION DIVISION OF THE HOUSING AND INSPECTION - .~ Ca SERVICES DEPARTMENT BY THE REDUCTION OF ONE FULL-TIME HOUSING INSPECTOR POSITION TO A PART-TIME (.5) POSITION AND THE ADDITION OF ONE PART-TIME (.63) HOUSING INSPECTION ASSISTANT POSITION AND AMENDING THE AFSCME PAY PLAN BY THE ADDITION OF THE POSITION OF HOUSING INSPECTION ASSISTANT. Comment: To best respond to the Neighborhood Housing Task Fome's initiatives and the documented increase in rental units, zoning and nuisance complaints and office traffic, the approved full-time housing inspector position which is vacant at this time will be divided into a part-time (.5) housing inspector position and a part-time (.63) housing inspector assistant position. The housing inspector's primary responsibility will be rental housing inspections. The housing inspector assistant's primary responsibility will be responding to nuisance and zoning code complaints, as well as office support, it is anticipated that inspection fees will cover this cost. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO AFl'EST A LEASE AGREEMENT BETVVEEN THE CITY OF IOWA CITY c).~-._.~5_-~ - AND FOUR OAKS FAMILY AND CHILDREN'S SERVICES FOR OPERATION OF A CHILD CARE CENTER AT 1516 SHERIDAN AVENUE. Comment: The property was purchased by a non-profit, Eagles' Flight, Inc D.B.A. Hannah's Blessing Childcare Center, with HUD Community Development Block Grant (CDBG) funds in 2001. Hannah's Blessing Childcare Center no longer provides child care services and the property was deeded to the City of Iowa City for repayment of the CDBG funds. Four Oaks Family and Children's Services, a non-profit, will be leasing the property for one year to provide child care services for Iow-moderate income households at the facility, which continues the intended use for the property. CONSIDER A RESOLUTION AMENDING THE BUDGETED POSI'I~ONS AT THE LIBRARY BY DELETING ONE OFFICE MANAGER--LIBRARY POSITION AND ADDING ONE ADMINISTRATIVE COORDINATOR--LIBRARY POSITION. Comment: The Iowa City Public Library requests a change to it's authorized positions deletin0 a full time Office Manager--Library, and adding a full time Administrative Coordinator. The position will be vacant due to resignation and a review of the job duties show significant change in the last fifteen years, most significantly with the loss of the Assistant Director position in 2003. This position provides the primary personnel and financial records support for the Library, increasingly sophisticated and complex tasks governed by numerous laws, rules and regulations. It is estimated there will be no budget impact in FY06 because the person leaving was at the top of the scale. Potentially, there is a $4,784 increase in wages. Action: ITEM 15. CONSIDER A RESOLUTION APPROVING LOCAL FUNDING FOR LOPAREX INC. RELATED TO ECONOMIC DEVELOPMENT ASSISTANCE AND AUTHORIZING ,~O~ THE CITY MANAGER TO ACT AS CHIEF ADMINISTRATIVE OFFICER AND SUBMIT ALL NECESSARY DOCUMENTATION TO THE IOWA DEPARTMENT OF ECONOMIC DEVELOPMENT AND\OR U.S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT. Comment: On September 6, the City Council Economic Development Committee reviewed the request for $75,000 in local funding for this project and the Community Economic Betterment Account (CEBA) application submitted to the State of Iowa on behalf of the Loparex Inc. for the creation\retention of 15 high quality jobs. D~- :-~q (DEFERRED FROM 8/16) Comment: The City annually reviews basic cable rate information filed with the Federal Communications Commission (FCC) by Mediacom as part of our limited rate regulation authority. We then either approve or challenge the maximum permitted rate calculated by Mediacom. In the most recent filings for the year beginning August 1, 2005, the proposed basic service rate and the maximum permitted rate have been found to be compliant with FCC formulas and with prior agreements between Mediacom and the City. It is recommended that this resolution be adopted. ITEM18. CONSIDER A RESOLUTION RATIFYING THE SETTLEMENT OF PENDING LITIGATION.
