DO-/D (1) CONSIDER A RESOLUTION AUTHORIZING THE APPLICATION FOR TRAFFIC SAFETY GRANT FUNDS FROM THE IOWA DEPARTMENT OF TRANSPORTATION FOR THE RECONSTRUCTION OF THE WASHINGTON STREET MEDIAN FROM VAN BUREN STREET TO DODGE STREET. Comment: Washington Street between Van Buren Street and Dodge Street has been identified as a high accident rate location in Iowa City. Modification of the median should prevent many of the collisions. The Engineering Division estimates the project to cost ~60,000 and the Iowa DOT has safety funds for which the project qualifies. January 18, 2000 City of Iowa City Page 3 (2) CONSIDER A RESOLUTION SETTING A PUBLIC HEARING FOR FEBRUARY 1 ON PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE PHASE III IOWA CITY DOWNTOWN STREETSCAPE IMPROVEMENTS, DIRECTING CITY CLERK TO PUBLISH NOTICE OF SAID HEARING, AND DIRECTING THE CITY ENGINEER TO PLACE SAID PLANS ON FILE FOR PUBLIC INSPECTION. Comment: Phase III of the Downtown Streetscape project includes improvements to Clinton Street, Linn Street and Gilbert Street between Burlington and Iowa, College Street between Linn and Gilbert, Washington Street between Capitol and Clinton, and Burlington Street between Capitol and Gilbert. The Downtown Streetscape Plan has been used to guide the final design improvements. (3) CONSIDER A RESOLUTION SETTING A PUBLIC HEARING FOR FEBRUARY 1 c~-/Z- ON PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE IOWA CITY TRANSIT FACILITY METHANE ABATEMENT PROJECT, PHASE 2, DIRECTING CITY CLERK TO PUBLISH NOTICE OF SAID HEARING, AND DIRECTING THE CITY ENGINEER TO PLACE SAID PLANS ON FILE FOR PUBLIC INSPECTION. Comment: This project involves connecting the three horizontal collector pipes installed under the transit building in Phase 1 to gas extraction and treatment system. This project is funded with 80% federal funds and 20% local funds. (4) CONSIDER A RESOLUTION SETTING A PUBLIC HEARING FOR FEBRUARY 15 ON INTENT TO CONTINUE WITH A PUBLIC IMPROVEMENT PROJECT AND TO ACQUIRE PROPERTY RIGHTS FOR THE HIGHWAY 6 CORRIDOR IMPROVEMENTS PROJECT, DIRECTING CITY CLERK TO PUBLISH NOTICE OF SAID HEARING, AND DIRECTING THE CITY ENGINEER TO PLACE DOCUMENTATION ON FILE FOR PUBLIC INSPECTION. Comment: This project will include the installation of a storm sewer system, curbs near intersections, construction of a trial/sidewalk, installation of shoulders and landscaping along Highway 6 between the Iowa River and Sycamore Street. Under the provisions of the House File 476, enacted during the 1999 legislative session, notice of the City's intent to continue with the project and acquire property therefore must be given to all property owners whose properties may be affected. This is the second public' hearing on this project. It is needed because additional potentially affected property owners were identified after the original public hearing. January 18, 2000 City of Iowa City Page 4 (5) CONSIDER A RESOLUTION SETTING A PUBLIC HEARING FOR FEBRUARY 15 ON INTENT TO PROCEED WITH A PUBLIC IMPROVEMENT PROJECT AND TO ACQUIRE PROPERTY RIGHTS FOR THE WESTSIDE TRUNK SEWER PROJECT, PHASE 2, DIRECTING CITY CLERK TO PUBLISH NOTICE OF SAID HEARING, AND DIRECTING THE CITY ENGINEER TO PLACE DOCUMENTATION ON FILE FOR PUBLIC INSPECTION. Comment: This project involves upgrading the sanitary trunk sewer from the Galway Hills to Southwest Estates. Under the provisions of the House File 476, enacted during the 1999 legislative session, notice of the City's intent to proceed with the project and acquire property therefore must be given to all property owners whose properties may be affected. This notice will inform property owners of their opportunity to present their views on the project and proposed acquisition of property rights at the public hearing. (6) CONSIDER A RESOLUTION SETTING A PUBLIC HEARING FOR MARCH 7 FOR THE IOWA CITY HOUSING AUTHORITY'S PROPOSED 5 YEAR PLAN AND ANNUAL PLAN. Comment: The Public Housing Authority is required to adopt a 5 Year Plan and Annual Plan under the Quality Housing and Work Responsibility Act of 1998 ("QHWRA"). The QHWRA also requires that the plans be made available to the public for review not later than 45 days before the public hearing is to take place. The 5 Year Plan and Annual Plan will advise HUD, residents and members of the public of the Iowa City Housing Authority's mission for serving the needs of low income and very low income families, and the Housing Authority's strategy for addressing those needs. January 18, 2000 City of Iowa City Page 5 c>o-/c/ (4) CONSIDER A RESOUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST TO A SUBORDINATION AGREEMENT BETWEEN THE CITY OF IOWA CITY AND HILLS BANK AND TRUST COMPANY, IOWA CITY, IOWA FOR PROPERTY LOCATED AT 723 OAKLAND AVENUE, IOWA CITY, IOWA. Comment: Hills Bank and Trust Company has requested that the City approve a Subordination Agreement for 723 Oakland Avenue. On November 30, 1990, the owners of the property received a Statement of Life Lien and a Rehabilitation Agreement from the City of Iowa City for the amount of 93,085. Hills Bank and Trust Company has refinanced the first mortgage with the property owners for 998,929. The property is appraised at 9113,690 which provides enough equity to cover the City's second lien position. ~)- Z, 0 (5) CONSIDER A RESOLUTION NAMING DEPOSITORIES. Comment: This resolution will increase the maximum depository balance at six institutions. Consider a motion setting a public hearing for February 1 on a resolution to amend the Comprehensive Plan to adopt and incorporate the South Central District Plan for property generally located east of Highway 218, south of Highway 1 and west of the Iowa River. Comment: At its December 2 meeting, by a vote of 6-0, the Planning and Zoning Commission recommended approval of the draft South Central District Plan with certain revisions. In a subsidiary motion, by a vote of 6-0, the Commission recommended that the South Central District Plan include an east/west arterial, with the alignment in the vicinity of Dane Road to be generally between those shown as alternative N-1 and the alternative N-1.1 in the November 15 EarthTech report, subject to finalization of the alignment with consideration of engineering criteria and land acquisition costs as well as social, environmental, and other factors. b. Consider a motion setting a public hearing for February 1 on an ordinance changing the zoning designation from Neighborhood Commercial (CN-1) to Commercial Office (C0-1) for 2.5 acres of property located on the west side of First Avenue at Tudor Drive. (REZ99-0015) Comment: At its January 6 meeting, by a vote of 0-7, the Planning and Zoning Commission recommended denial of the proposed rezoning. The applicant has sent correspondence requesting the proposed rezoning be considered by the City Council. Staff recommended denial in a report dated December 16, 1999. Based on a revised site development concept plan, staff now recommends approval subject to a conditional zoning agreement. Action: ~. fi~?~ y~ '~~~ c. Consider a motion setting a public hearing for February 1 on an ordinance amending the Sensitive Areas Overlay (OSA-8) conditional zoning agreement to allow a driveway access onto Foster Road for property located at 500 Foster Road. (REZ99-O016) Comment: At its January 6 meeting, by a vote of 3-4 (with Supple, Ehrhardt, Bovbjerg, and Schintler voting no) the Planning and Zoning Commission recommended denial of an amendment to the OSA-8 Conditional Zoning Agreement to allow the driveway to remain open only until the Louises cease to occupy the residence and provided an escrow is paid for the alternative driveway. The applicant has requested that the proposed amendment to keep the Louis driveway open in perpetuity be considered by the City Council. Staff recommended denial in a memo dated December 29, 1999. Public hearing on an ordinance changing the zoning designation from Low Density Multi-Family Residential (RM-12) and Medium Density Single Family Residential (RS-8) to Planned Development Housing Overlay (OPDH-12/11.79 acres) and (OPDHo8/1.47 acres) and approving a preliminary Planned Development Housing Overlay Plan for Windsor Ridge, Part 15, a proposed 98-unit residential development located north of Court Street at its eastern terminus. (REZ99-0011) Comment: At its November 18 meeting, by a vote of 7-0, the Planning and Zoning Commission recommended approval of the proposed rezoning and preliminary development plan. Staff recommended approval in a report dated November 4. e. Public hearing on an ordinance changing the zoning designation from Low Density Single-Family Residential (RS-5) to Sensitive Areas Overlay - Low Density Residential (OSA-5) and approving a preliminary Sensitive Areas Development Plan west of Highway 218. (REZ99-0012) ' ~ · Comment: At its November 18 meeting, by a vote of 5-1 with Ehrhardt voting no, the Planning and Zoning Commission recommended approval of the rezoning and preliminary development plan. Public hearing on an ordinance changing the zoning designation from Planned High Density Multi-Family Residential (PRM) to Sensitive Areas Overlay (OSA-PRM) and approving a preliminary Sensitive Areas Development Plan for approximately .28 Comment: The Planning and Zoning Commission will be considering the requested rezoning and preliminary development plan at its December 2 and 16 meetings, and is expected to take action prior to the January 18 Council meeting. In a report dated December 2, staff recommended approval pending staff approval of the development plan and a grading plan that assures the stability of the slope will not be undermined. Consider a resolution approving a final plat of Scott Boulevard East, Part 4, a 7.36- acre, 15-lot residential subdivision with one outlot located at Scott Park Drive and Hummingbird Lane. (SUB99-0027) Comment: At its December 16 meeting, by a vote of 7-0, the Planning and Zoning Commission recommended approval of the proposed subdivision, subject to approval of legal papers prior to Council consideration. Legal papers (have/have not) been approved. Staff recommended approval in a report dated December 16. ITEM NO. 7. PUBLIC DISCUSSION ON THE ADOPTION OF THE 1999 NATIONAL ELECTRICAL CODE. Comment: The 1999 National Electrical Code is an updated version of the most recent electrical code the City of Iowa City has adopted. City staff, along with the Board of Appeals, has reviewed the 1999 National Electrical Code and recommends the adoption of this code with certain amendments. Action: ~ ~~ ITEM NO. 8. THE CITY'S INTENT TO CONTINUE WITH A PUBLIC IMPROVEMENT PROJECT AND ~O- Z~ TO ACQUIRE PROPERTY RIGHTS FOR THE SOUTH SYCAMORE REGIONAL STORMWATER AND GREENSPACE PROJECT. Comment: This project will enhance the drainage corridor south of Mr. Prospect, Part 7 and Lakeside Subdivisions to the Snyder Creek Bottom Wetlands and will provide a regional storm water facility to be used by existing and future subdivisions. Under the provisions of House File 476, enacted during the 1999 legislative session, notice of the City's intent to proceed with the project and acquire property therefore must be given to all property owners whose may be affected. This is the third public hearing on this project. It is needed because the City is contemplating a modification in the northern location of the project where the drainage corridor is being enhanced which may affect additional property owners who were not identified prior to the original public hearing. a. PUBLIC HEARING b. CONSIDER A RESOLUTION DECLARING January 18, 2000 City of Iowa City Page ITEM NO. 9. PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE c>c~-2_~ CONSTRUCTION OF THE IOWA CITY LANDFILL RECYCLING CENTER PROJECT, PHASE 2, ESTABLISHING AMOUNT OF BID SECURITY TO ACCOMPANY EACH BID, DIRECTING CITY CLERK TO PUBLISH ADVERTISEMENT FOR BIDS, AND FIXING TIME AND PLACE FOR RECEIPT OF BIDS. This project consists of upgrading the existing site layout to include more recycling and reclamation drop sites more conveniently situated for customer access. It also includes a new facility building consisting of a scale office, education room, personnel office, a product exchange store and a chemical waste operation room. The engineer's estimate of construction cost is 9542,000 and will be funded by landfill revenues. Staff memorandum included in Council packet. c. PUBLIC HEARING d. CONSIDER A RESOLUTION APPROVING ITEM NO. 10. PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE b~-~-~' CONSTRUCTION OF THE IOWA CITY LANDFILL GAS COLLECTION SYSTEM PROJECT, ESTABLISHING AMOUNT OF BID SECURITY TO ACCOMPANY EACH BID, DIRECTING CITY CLERK TO PUBLISH ADVERTISEMENT FOR BIDS, AND FIXING TIME AND PLACE FOR RECEIPT OF BIDS. Comment: This project consists of installing a gas collection system throughout the entire landfill site to meet current state and federal landfill rules. The system will collect landfill gases from the site for treatment by an enclosed flare before being released to the atmosphere. The engineer's estimate of construction cost is 91,500,000 and will be funded by landfill revenues. a. PUBLIC HEARING b. CONSIDER A RESOLUTION APPROVING January 18, 2000 City of Iowa City Page ITEM NO. 11. CONVEYANCE OF A PORTION OF LOT 1, BLOCK 3, RUNDELL ADDITION, CONSISTING OF APPROXIMATELY 2,995 SQUARE FEET LOCATED AT THE SOUTHEAST CORNER OF GRANT STREET AND COURT STREET, TO ADJACENT PROPERTY OWNERS WILLIAM G. FLANAGAN AND ELIZABETH ROSE. Comment: William G. Flanagan and Elizabeth Rose, as owners of the adjacent property at 406 Grant Street, have offered the sum of 9525 for an approximate 2,995 square foot portion of a City-owned, unbuildable remnant lot known as Lot 1, Block 3 Rundell Addition. Mr. Flanagan and Ms. Rose have made their offer based on an appraisal of the subject property and plan to use the property for the construction of a driveway from their property to Grant Street (see attached letter and appraisal). The amount offered for the property is in the mid-range of the values indicated by the appraisal. (See memo from Sarah Holecek re: methods of fair market valuation and considerations for conveyance of property). This Resolution authorizes the City Council's conveyance of the above property to Mr. Flanagan and Ms. Rose, subject to the purchasers performing a survey to provide an accurate legal description. a.PUBLIC HEARING Action: ITEM NO. 12. CONSIDER A MOTION TO APPROVE A TENTATIVE AGREEMENT BETWEEN THE CITY OF IOWA CITY AND THE POLICE LABOR RELATIONS ORGANIZATION OF IOWA CITY. Comment: City and Police Labor Relations Organization of Iowa City negotiators have reached tentative agreement on a three-year collective bargaining agreement. It provides for a 3¼ % wage increase for each of the three years, benefit adjustments regarding longevity pay and premium pay for field training officers in the first year, and addition of a new 25 year longevity step in the second year, as well as several contract language revisions. A copy of the tentative agreement will be provided to the Council. Staff recommends ratification of this tentative agreement. CONSIDER AN ORDINANCE AMENDING TITLE 14, CHAPTER 3, ENTITLED "CITY UTILITIES" OF THE CITY CODE OF IOWA CITY, IOWA, BY ADOPTING A NEW SECTION 14-3B-5 ENTITLED "PROJECT SPECIFIC TAP-ON FEE FOR THE NORTHWEST SANITARY SEWER PROJECT, PHASE I1." (FIRST CONSIDERATION) Comment: The City Code authorizes the City to adopt and implement, following public hearing, project specific tap on fee ordinances to provide for the equitable apportionment of costs associated with extension of public utilities. The proposed ordinance will adopt a tap-on fee for the cost associated with the construction of the Northwest Sanitary Sewer, Phase II, which is the north fork of the northwest sanitary sewer constructed in 1991, to serve the northerly area of the Clear Creek drainage basin. ITEM NO. 14. CONSIDER AN ORDINANCE AMENDING TITLE 14, CHAPTER 3, ENTITLED "CITY UTILITIES" OF THE CITY CODE OF IOWA CITY, IOWA, BY ADOPTING A NEW SECTION 14-3B-6 ENTITLED "PROJECT SPECIFIC TAP-ON FEE FOR THE SOUTH SYCAMORE SANITARY TRUNK SEWER PROJECT." (FIRST CONSIDERATION) Comment: The City Code authorizes the City to adopt and implement, following public hearing, project specific tap on fee ordinances to provide for the equitable apportionment of costs associated with extension of public utilities. The proposed ordinance will adopt a tap-on fee for the cost associated with the construction of the South Sycamore Sanitary Trunk Sewer to serve the southeast side of Iowa City. ITEM NO. 15. CONSIDER AN ORDINANCE AMENDING TITLE 14, CHAPTER 3, ENTITLED "CITY UTILITIES" OF THE CITY CODE OF IOWA CITY, IOWA, BY ADOPTING A NEW SECTION 14-3B-7 ENTITLED "PROJECT SPECIFIC TAP-ON FEE FOR THE 1996 HIGHLANDER LIFT STATION, FORCE MAIN AND TRUNK SEWER PROJECT." (FIRST CONSIDERATION) Comment: The City Code authorizes the City to adopt and implement, following public hearing, project specific tap-on fee ordinances to provide for the equitable apportionment of costs associated with extension of public utilities. The proposed ordinance will adopt a tap-on fee for the cost associated with the construction of the 1996 Highland Lift Station, Force Main and Trunk Sewer Project to serve the northeast area of Iowa City. CONSIDER AN ORDINANCE AMENDING TITLE 8, ENTITLED "POLICE REGULATIONS," CHAPTER 5, ENTITLED "MISCELLANEOUS OFFENSES," OF THE CITY CODE TO ADD A NEW SECTION PROHIBITING THE USE OF VEHICLES FOR LODGING ON PUBLIC STREETS, RIGHTS-OF-WAY, PARKING LOTS, OR OTHER PUBLIC PROPERTY WITHIN THE CITY OF IOWA CITY. (SECOND CONSIDERATION) Comment: This ordinance is placed on the Council's agenda at Council's direction following the expression of concern by members of the public. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO~SIGN AN~ THE CI~~ ~-~ CLERK ATTEST AN AGREEMENT BETWEEN HOWARD R. GREEN COMPANY OF IOWA CITY, IOWA AND THE CITY OF IOWA CITY FOR CONSULTING SERVICES DURING CONSTRUCTION OF THE NEW WATER TREATMENT PLANT AND WELL HOUSES. Comment: This agreement will provide engineering consulting services during construction of the New Water Treatment Plant and Well Houses. It is desirable to have Howard R. Green Company assist the City in implementing the construction contract in those areas where outside professional engineering support is needed. Specifically, professional engineering support includes review of shop drawings, necessary design modifications, construction site visits to insure project is constructed according to plans, and conducting a final inspection. The cost of this service is ~466,000 and will be funded from water revenues. Public Works recommends approval of this resolution. January 18, 2000 City of Iowa City Page 14 ITEM NO. 19. CONSIDER A RESOLUTION TO PRESCRIBE A PROCEDURE TO WAIVE THE pC>- z-(- APPRAISAL IN CASES INVOLVING THE ACQUISITION OF PROPERTY WITH A LOW FAIR MARKET VALUE FOR PUBLIC IMPROVEMENT PROJECTS THAT MAY ENTAIL CONDEMNATION. Comment: Recent changes to Chapter 6B of the Iowa Code regarding condemnation of private property for public improvement projects provides that an acquiring agency may prescribe a procedure to waive the requirement for an appraisal "in cases involving the acquisition of property with a fair market value." This resolution prescribes such a procedure. Action: ITEM NO. 20. CONSIDER A RESOLUTION AUTHORIZING MAILING AND PUBLICATION OF NOTICE Ol::)- ?_'7 OF INTENT TO COMMENCE PUBLIC IMPROVEMENT PROJECT TO CONSTRUCT THE NEAR SOUTHSIDE TRANSPORTATION CENTER PROJECT AND TO ACQUIRE PROPERTY FOR THE PROJECT; AND SETTING DATE OF THE PUBLIC HEARING FOR MARCH 7. Comment: Under last year's amendments to the Iowa Code a governmental body which proposes to acquire property under power of eminent domain for a public improvement project is required to give notice of its intent to commence the project to all property owners whose properties may be acquired in whole or in part for the project. HAYEK, AND SETTING A PUBLIC HEARING ON SAID CONVEYANCE FOR FEBRUARY 1. Comment: On July 27, 1999, the City Council passed an ordinance vacating a ten- foot wide portion of the Washington Street right-of-way along the west property line of 1033 East Washington Street (Lot 7, Koser Brothers Subdivision) and abutting 1025 East Washington Street. Marjorie B. Hayek, as owner of the adjacent property to the west (1025 E. Washington), has offered the sum of $2,941 for one half of the ten-foot wide by 170' long parcel (approximately 850 square feet), or 93.46 per square foot, which is consistent with the fair market valuation listed on the assessment rolls for comparable properties. This Resolution declares the City Councirs intent to convey the above property to Mrs. Hayek, and sets a public hearing on the proposed conveyance for February 1. Comment: On September 28, 1999, the City Council passed an ordinance vacating approximately 7,720 square feet of the unimproved portion of Virginia Drive located between Lots 2 and 14 of North Hills Subdivision, immediately northeast of the intersection of Virginia Drive and Ridgewood Lane. Philip and Helen Oldis, as owners of the adjacent property (2 Ridgewood Lane), have offered the sum of $500 for the approximately 7,720 square foot parcel. The offer is in-between values obtained through the assessment rolls and sales for comparable properties, and seems consistent with the fact that the property is entirely encumbered by a city easement. This Resolution declares the City Council's intent to convey the above property to Mr. and Mrs. Oldis, and sets a public hearing on the proposed conveyance for February 1. Action: ITEM NO. 23. Comment: The South Wastewater Treatment Plant Improvements Project is scheduled to be amended on February 15, 2000, with construction to begin shortly thereafter. The City desires to have on-site project construction management services provided by City employees. These services can be accomplished with the addition of a Special Projects Manager. CONSIDER A RESOLUTION AMENDING THE BUDGETED POSITIONS IN THE Oh-3>t ACCOUNTING DIVISION OF THE FINANCE DEPARTMENT BY ADDING ONE ASSISTANT CONTROLLER POSITION AND DELETING ONE SENIOR ACCOUNTANT POSITION AND AMENDING THE ADMINISTRATIVE PAY PLAN BY ADDING ONE ASSISTANT CONTROLLER POSITION. Comment: With the promotion of the City Controller to the position of Assistant Finance Director it is recommended that a position of Assistant Controller be created to manage the day to day activities and work assignments of the Accounting Division. The Assistant Controller will assist the Assistant Finance Director/Controller in these activities as well as perform other duties currently performed by a Senior Accountant. A current Senior Accountant position will be eliminated and the duties of the Assistant Controller assigned to that employee. Annual cost is approximately ~ 1,859. .... ITEM NO. 27.
