Comment: The proposed amendments 1) change the permitted location of
sidewalk cafes in City Plaza; 2) changes dimensional requirements and other
, requirements for all sidewalk cafes; and 3) makes the definition of
restaurants as it pertains to sidewalk cares and outdoor service areas
consistent with the Zoning Codes definition of restaurant.

Comment: This project involves the construction of a new 5,200 square foot
Public works Complex Administration Building and the associated site work
located on the southwest corner of Napoleon Lane and South Gilbert Street.
The new administration building will house the administration offices of
Streets, Traffic Engineering and Solid Waste Division.

Comment: This project involves constructing new water main and hanging it
from the Dodge Street Bridge and abandoning the existing water main under
the railroad tracks. Main breaks along this section of main are thought to be
caused by the age of the pipe and vibration from the railroad above and claim
damage has been incurred by the City from main breaks in this area.

Comment: This project involves improvements along Iowa Avenue from
Gilbert Street west to Linn Street including pavement removal and
replacement, landscaping, water main and sanitary sewer construction. This
project also includes replacement of the Beer Creek Storm Sewer from Iowa
Avenue north along Gilbert Street to Jefferson Street.
(5) CONSIDER A RESOLUTION SETTING A PUBLIC HEARING FOR MARCH 7 ON
PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST
FOR THE CONSTRUCTION OF THE BENTON STREET TURN LANE AND NED
ASHTON MEMORIAL PARK PROJECT, DIRECTING CITY CLERK TO PUBLISH

Comment: The Benton Street Turn Lane and Ned Ashton Memorial Park
Project will add a right turn lane on the north side of Benton Street at its
intersection with Riverside Drive for the west bound traffic. This project will
also construct the Ned Ashton Memorial Park on the north side of Benton
Street west of the Iowa River. This will complete the Iowa River Corridor
Trail in this area.
(6) CONSIDER A RESOLUTION SETTING A PUBLIC HEARING FOR
FEBRUARY 29 TO DISCUSS THE PROPOSED OPERATING BUDGET FOR THE
FISCAL YEAR JULY 1, 2000 THROUGH JUNE 30, 2001, THE PROPOSED
THREE-YEAR FINANCIAL PLAN, AND ALSO THE MULTI-YEAR CAPITAL
IMPROVEMENTS PROGRAM THROUGH FISCAL YEAR 2004.
Comment: This resolution sets a public hearing on the FY2001 Proposed
Operating Budget, the three-year Financial Plan and multi-year Capital
Improvements Program (CIP) through Fiscal Year 2004 on February 29,
2000. Detailed information on the budget will be available for public
inspection on February 18, 2000.

o~- -~ (1) CONSIDER A RESOLUTION APPROVING AND AUTHORIZING EXECUTION OF
AN AGREEMENT WITH MERCY HOSPITAL FOR TEMPORARY USE OF
PUBLIC RIGHT-OF-WAY ON JOHNSON STREET IN IOWA CITY, IOWA.
Comment: This agreement authorizes Mercy Hospital to temporarily close the
sidewalk on the west side of Johnson Street between Bloomington and
Market Streets and the north side of Market Street between Johnson and
Van Buren Streets. The agreement also authorizes a permanent easement
which will allow Mercy Hospital to install sidewalk and street lighting on the
west side of Johnson Street between Bloomington and Marker Streets and on
the north side of Market Street between Johnson and Van Buren Streets;
install a canopy over the walkway into the new Mercy entrance which will
extend approximately two feet into the west side of the Johnson Street right-
of-way; and construct a drop lane on the west side of Johnson Street
centered on the new entrance to Mercy Hospital. Engineering recommends
approval of the agreement.

LOCATED AT 28-28~ NORTH GOVERNOR STREET, IOWA CITY, IOWA.
Comment: The owners of the property located at 28-28¼ North Governor
Street received assistance through the City's Rental Rehabilitation Program
for ~12,O00 on July 12, 1989. The financing was in the form of a ten-year
depreciation loan. The terms of the loan have been satisfied; thus the lien can
now be released.

Comment: The owner of the property located at 919 East Washington Street
received assistance through the City's Housing Rehabilitation Program for
~7,384 on November 8, 1996. The financing was in the form of a conditional
occupancy loan. The owner passed away on December 3, 1999, and the loan
was paid off; thus the lien can now be released.

THE REVISED VOUCHER PAYMENT STANDARDS FOR THE
IOWA CITY HOUSING AUTHORITY VOUCHER PROGRAM.
comment: The Iowa City Housing Authority is requesting to revise the Voucher
Payment Standards in compliance with HUD regulations for use in its Voucher
program. The Voucher Payment Standards for each size of dwelling unit
must not exceed 110% of the current Fair Market Rent (FMR) or be less than
90% of the FMR. The Iowa City Housing Authority proposes to set the
Voucher Payment Standards to the 110% of the FMRs. Voucher Payment
Standards are used in the calculation for the amount of Housing Assistance
Payment (HAP) paid to landlords on behalf of the tenant. The increase in the
Voucher Payment Standard will be paid by HUD through the Annual
Contributions Contract (ACC). Increasing the Voucher Payment Standard will
allow clients the opportunity to rent units that would otherwise be
unobtainable due to the HUD imposed rent restrictions and the higher cost of
renting in Johnson County. This increase will open doors to otherwise cost
prohibitive homes.

ITEM NO. 6. PLANNING AND ZONING MATTERS.
a. Public hearing on a resolution to amend the Comprehensive Plan to adopt and
incorporate the South Central District Plan for property generally located east of
Highway 218, south of Highway 1 and west of the Iowa River.
Comment: At its December 2 meeting, by a vote of 6-0, the Planning and Zoning
Commission recommended approval of the draft South Central District Plan with
certain revisions. In a subsidiary motion, by a vote of 6-0, the Commission
recommended that the South Central District Plan include an east/west arterial,
with the alignment in the vicinity of Dane Road to be generally between those
shown as alternative N-1 and the alternative N-1.1 in the November 15 EarthTech
report, subject to finalization of the alignment with consideration of engineering
criteria and land acquisition costs as well as social, environmental, and other
factors. Public hearing continued from February 1. Staff memoranda included in
Council packet.

Comment: At its November 18 meeting, by a vote of 5-1 with Ehrhardt voting no,
the Planning and Zoning Commission recommended approval of the rezoning and
preliminary development plan. Staff recommended approval in a report dated
October 21 and a memorandum dated October 28.
c. Consider an ordinance changing the zoning designation from Neighborhood
Commercial (CN-1) to Commercial Office (CO-1) for 2.5 acres of property located
on the west side of First Avenue at Tudor Drive. (REZ99-0015) (First

Comment: At its January 6 meeting, by a vote of 0-7, the Planning and Zoning
Commission recommended denial of the proposed rezoning. The applicant has
sent correspondence requesting the proposed rezoning be considered by the City
Council. Staff recommended denial in a report dated December 16, 1999. Based
on a revised site development concept plan, staff now recommends approval
subject to a conditional zoning agreement. The Council is requested to vote on first
consideration prior to the joint meeting with the Planning and Zoning Commission

Comment: This agreement provides for a 80% State 20% local City funding split.
This project provides for the installation of a pedestrian tunnel under the Iowa
Interstate Railroad west of Pine Street. The preliminary estimated construction cost is
$250,000. The local share of this project will be funded with Road Use Taxes.

Comment: This project will include the installation of a storm sewer system, curbs
near intersections, construction of a trail/sidewalk, installation of shoulders and
landscaping along Highway 6 between the Iowa River and Sycamore Street. This is
the second public hearing on this project. It is needed because additional affected
property owners were identified after the original public hearing.

PROPERTY OWNERS WILLIAM G. FLANAGAN AND ELIZABETH ROSE.
Comment: William G. Flanagan and Elizabeth Rose, as owners of the adjacent property
at 406 Grant Street, have offered the sum of ~525 for an approximate 2,995 square
foot portion of a City-owned, unbuildable remnant lot known as Lot 1, Block 3 Rundell
Addition. Mr. Flanagan and Ms. Rose have made their offer based on an appraisal of
the subject property and plan to use the property for the construction of a driveway
from their property to Grant Street (see attached letter and appraisal). The amount
offered for the property is in the mid-range of the values indicated by the appraisal.
This Resolution authorizes the City Council's conveyance of the above property to Mr.
Flanagan and Ms. Rose, subject to the purchasers performing a survey to provide an
accurate legal description.

LOCATED BETWEEN LOTS 2 AND 14 OF NORTH HILLS SUBDIVISION IMMEDIATELY
NORTHEAST OF THE INTERSECTION OF VIRGINIA DRIVE AND RIDGEWOOD LANE
TO ADJACENT PROPERTY OWNERS PHILIP AND HELEN OLDIS.
Comment: Philip and Helen Oldis, as owners of the adjacent property at 2 Ridgewood
Lane, have offered the sum of $500.00 for an approximate 7,720 square foot parcel
of the unimproved, vacated portion of the Virginia Drive right-of-way located between
Lots 2 and 14 of North Hills Subdivision immediately northeast of the intersection of
Virginia Drive and Ridgewood Lane. Mr. and Mrs. Oldis have made an offer which is
mid-way between values obtained through the assessment rolls and sales for
comparable properties and the offer is consistent with the fact that the subject
property is entirely encumbered by a city easement. This Resolution authorizes the
City Council's conveyance of the above property to Philip and Helen Oldis.

PROPERTY OWNER MARJORIE B. HAYEK.
Comment: Marjorie B. Hayek, as owner of the adjacent property at 1025 East
Washington Street, has offered the sum of $2,941 for one-half of a ten-foot wide
vacated portion of the Washington Street right-of-way located between 1033 (Lot 7,
Koser Brothers Subdivision) and 1025 Washington Street. Mrs. Hayek has made an
offer based on the fair market valuation listed on the assessment rolls for comparable
properties. This Resolution authorizes the City Council's conveyance of the above
property to Marjorie B. Hayek.

ITEM NO. 13. CONVEYANCE OF 1512 DICKINSON LANE.
Comment: 1512 Dickinson Lane is currently a vacant lot owned by the Iowa City
Housing Authority. The Housing Authority intends to convey the lot to Moore
Construction Co. for $17,000 which is the amount the Housing Authority recently
paid for the lot. Moore Construction plans to construct an affordable, resource-
efficient, environmentally-friendly ("green built") single-family home on the lot which
would be purchased by the Housing Authority under the Affordable Dream Home
Opportunities Program for sale to a family who earns up to 80% of the median
income.

Comment: The Iowa City Housing Authority has negotiated a contract with Pat Moore
Construction Company, dba Moore Construction Company, for the construction and
purchase of an affordable, resource-efficient, environmentally-friendly ("green built")
single family home at 1512 Dickinson Lane in the amount of ~147,000. (This amounts
to ~130,000 for construction of the home and ~17,000 for the lot. Moore
Construction Company will pay the City ~ 17,000 for this lot prior to execution of this
contract.) The home would be purchased under the Affordable Dream Home
Opportunities Program for sale to a family who earns up to 80% of the median
income.
ITEM NO. 15. CONSIDER AN ORDINANCE ADOPTING THE 1999 NATIONAL ELECTRICAL CODE
WITH CERTAIN LOCAL AMENDMENTS. (SECOND CONSIDERATION)
Comment: The 1999 National Electrical Code is an updated version of the most recent
electrical code the City of Iowa City has adopted. City staff and the Board of Appeals
recommend adoption of this code with the local amendments. Public discussion of
this code was held on January 18. In order to enact the Code as soon as possible,
staff recommends expedited consideration.

RIGHTS," CHAPTER 1, ENTITLED "GENERAL PROVISIONS," SECTION 1, ENTITLED
"DEFINITIONS," REGARDING THE DEFINITION OF SEXUAL ORIENTATION. (SECOND
CONSIDERATION)
Comment: Upon the recommendation of the Iowa City Human Rights Commission, this
ordinance amends Section 2-1-1 of the City Code to provide an updated definition of
sexual orientation. The current definition defines sexual orientation based on age and
behavior. The Commission believes a change is necessary because people of all ages
may identify with a specific sexual orientation. The recommended definition is the
same as that included in Cedar Rapids' Civil Rights Ordinance.

Comment: The City Code authorizes the City to adopt and implement, following public
hearing, project specific tap on fee ordinances to provide for the equitable
apportionment of costs associated with extension of public utilities. The proposed
ordinance will adopt a tap-on fee for the cost associated with the construction of the
Northwest Sanitary Sewer, Phase II, which is the north fork of the northwest sanitary
sewer constructed in 1991, to serve the northerly area of the Clear Creek drainage
basin.
ITEM NO. 18. CONSIDER AN ORDINANCE AMENDING TITLE 14, CHAPTER 3, ENTITLED "CITY

SECTION 14-3B-6 ENTITLED "PROJECT SPECIFIC TAP-ON FEE FOR THE SOUTH
SYCAMORE SANITARY TRUNK SEWER PROJECT." (PASS AND ADOPT)
Comment: The City Code authorizes the City to adopt and implement, following public
hearing, project specific tap on fee ordinances to provide for the equitable
apportionment of costs associated with extension of public utilities. The proposed
ordinance will adopt a tap-on fee for the cost associated with the construction of the
South Sycamore Sanitary Trunk Sewer to serve the southeast side of Iowa City.

Comment: The City Code authorizes the City to adopt and implement, following public
hearing, project specific tap-on fee ordinances to provide for the equitable
apportionment of costs associated with extension of public utilities. The proposed
ordinance will adopt a tap-on fee for the cost associated with the construction of the
1996 Highland Lift Station, Force Main and Trunk Sewer Project to serve the
northeast area of Iowa City.

Comment: The City Code authorizes the City to adopt and implement, following public
hearing, project specific tap-on fee ordinances to provide for the equitable
apportionment of costs associated with extension of public utilities. The proposed
ordinance will adopt a tap-on fee for the cost associated with the construction of the
Scott Boulevard trunk sewer to serve the southeasterly area of Iowa City.
ITEM NO. 21. CONSIDER A RESOLUTION ESTABLISHING A REVISED SCHEDULE OF FEES AND
c>~- lo"~- CHARGES FOR PARKS AND RECREATION SERVICES AND PROGRAMS.
Comment: The Parks and Recreation Commission and staff review fees and charges
annually, and increases are considered in order to help support the Recreation
Division's budget. A three-year plan has been established, with FY01 fee increases
being recommended for adoption at this time, and FY2002 and 2003 fee increases
tentatively identified. Some of the FY01 increases will actually be implemented in
FY00 because the summer season begins in FY00, but continues into FY01. The
Parks and Recreation Commission reviewed and adopted the proposed increases at
their meeting of January 12, 2000. Deferred on February 1.

Comment: The bid opening for this project was held on February 8, 2000 and the

Because the bids for the above project came in higher than expected, Public Works
recommends rejecting the bids and re-bidding the project in March. In an effort to
stay within the targeted $550,000 project budget, Public Works will re-evaluate the
project components to find possible areas to reduce costs.
This project consists of upgrading the existing site layout to include more recycling
and reclamation drop sites more conveniently situated for customer access. It also
includes a new facility building consisting of a scale office, education room, personnel
office, a product exchange store and a chemical waste operation room.

WASTEWATER TREATMENT AND COLLECTION FACILITY IMPROVEMENTS.
Comment: This agreement will provide engineering consulting services during
construction of Contract 3 - South Plant Improvements. It is desirable to have Stanley
Consultants assist the City in implementing the construction contract in those areas
where outside professional engineering support is needed. Specifically, professional
engineering support includes review of shop drawings, necessary design
modifications, construction site visits to insure project is constructed according to
plans, and conducting a final inspection. The cost of this service is $465,000 and will
be funded from wastewater revenues. Public Works recommends approval of this
resolution.

Comment: This project involves upgrading and repairing the sanitary sewer from Lucas
St. to Van Buren St. between Burlington and Bowery Streets. Under the provisions of
the House File 476, enacted during the 1999 legislative session, notice of the City's
intent to proceed with the project and acquire property therefore must be given to all
property owners whose properties may be affected. This notice will inform property
owners of their opportunity to present their views on the project and proposed
acquisition of property rights at the public hearing.

February 21 through March 21, after which full public access will be restored. Due to
the late submittal of this request, Council will not receive copies of the agreement
until their February 14 Work Session. This agreement authorizes the closure.
