I parked on the second floor of the parking ramp, one space into the No Parking 6-10 A.M. zone. As I was attending a workshop at the Undquist Center Education Building, I tried to find a spot that would be near the Burlington Street stairwells. I did not take any of the lower floors or near the doors of the Old Capital Mall. As I was coming in at 8:30 and leaving at 11:00 a.m., I didn't feel I was depriving any merchant or shopper a prime space for parking. I feel you are overzealously patrolling this area. Is this a way to encourage your downtown participation? The Mall has so few stores at this time that I don't believe the enforcement procedures need to be so rigidly observed. To add insult to this ticket, I still was charged $1.50 to exit the ramp. I am a proponent of downtown Iowa City. I have lived in Iowa City for ;71 years. Recently I spoke as a minority opinion against the moving of the First Christian Church from Iowa Avenue to the suburbs of Coralville. That took a lot of courage to stand before my congregation of 2 t years to say we needed to stay in downtown Iowa City and be a presence in the city. No other member of the Church spoke for this position. I shop at Prairie Lights and regularly recommend it to people as the place to shop rather than heading to Barnes & Noble in Coralville. I believe in downtown Iowa City. I wish more people could believe also. Let's get a more realistic look at what our parking enforcement procedures are. Rauer 100 Cardiff Circle Iowa City, IA 52246 Dear Ms. Rauer: Thank you for taking the time to write regarding the parking ticket you received in the Capitol Street parking garage. The City's parking enforcement officers are instructed to enforce parking regulations fairly and uniformly for all. I am sure you can appreciate the importance of this enforcement policy. The "No Parking 6am-10am' restriction that was imposed in the Capitol Street parking garage was done so at the request of merchants and property owners. This was done several years ago in order to encourage that longer term parkers would seek the upper floors and that the lower levels, important to businesses and merchants within the Old Capitol Town Center, would have these spaces available early at the opening of their business. Their experience had been that the first few floors would fill up early and I suspect a good many of them are University staff and students. The idea of this regulation was developed in our working with the Old Capitol Town Center. If you have any other ideas that might be helpful to the folks at the Old Capitol Town Center, I believe you can discuss these matters directly with them through their mall manager, Lisa Rowe. We are attempting to provide not only fair enforcement of our parking regulations but also do our best to accommodate the interests of those seeking to use the Old Capitol Town Center. There appears to be some interest in the possibility of a dog park project. I do not think there is interest in having it located in Hickory Hill Park. I advised the Council of our earlier discussions concerning the south area basin off of Scott as a possible location. Council Members are also aware that while we can require users of the park to clean up after their animals we will certainly find many who will abuse the use of this public space. We need to determine costs and other features that could make a dog park acceptable as well as successful. Some information from other communities would be helpful. Feel free to refer this matter back to the Parks and Recreation Commission so they may discuss the matter further. Just wanted to let you know. 0 3 -0 9 -0 0 I IP8 Snyder Creek Wetlands Study TO: Steve Atkins ~~. ~.C DATE: RE: Snyder Creek Watershed Forum Last night was the Snyder Creek Watershed Forum at the Moose Lodge. We had attendance at over twice what we expected -- there were more than 50 people in attendance, not including our project team and the cable TV staff. The audience was mostly rural, though there were nine people from Iowa City. Here's a summary of the evening: Mary Somerville talked about the components of a healthy watershed, and how a watershed can be managed so that the use of the land is measured against its capacity for sustainable production. She talked about why it was important to pursue development activities in ways that protect water and soil, maintain habitat, and preserve the indigenous resources of the area, and how you can design conservation/restoration projects using the boundaries of a watershed. Lon Drake presented an overview of the Snyder Creek Wetlands Study research. He showed how the study area was historically a wetland, and much of it is still within the 100-year floodplain. He showed slides illustrating how farming activity in the lowlands is adversely affected by flooding, and wetland vegetation is reclaiming urban and rural acres where farming no longer occurs. He explained that data on soils, water, vegetation and animals is being gathered through summer 2001. The Soil and Water Conservation District had four staff persons presenting information. Wendell Jones, District Conservationist, stressed how cooperation is critical when the watershed approach is used to improve water quality. The people living and working within the watershed, and the various government agencies within the watershed, have to work together. Lori Schnoor gave an outline of the funding available for restoring habitat, buffering streambanks, and building wetlands. Amy Bouska talked about her role educating Johnson Co. residents about preventing erosion during urban and rural land-disturbing activity. And Carol Hunt talked about her Local Food Sources project, and how local production of food for local consumption can decrease our reliance on food transported from thousands of miles away, and encourages the wise use of natural resources. A cooperative project by Johnson County Soil and Water Conservation District, Environmental Protection Agency, Natural Resources Conservation Service, Lon Drake, MMS Consultants, and the City of Iowa City. The Panel discussion was not the strongest part of the evening. We lost about 20 people after we took a break (Carol provided food prepared with ingredients from within the Watershed - apple cake, chicken sandwiches, vegetarian pizza, apple cider). Those who stuck around didn't ask more than three questions so Mary Somerville asked the Panel questions I'd prepared in advance. Topics discussed with the Panel included restoration of small and large wetlands, agricultural and urban causes of increased stormwater runoff, partnerships between landowners and Corps of Engineers for restoration projects, and properties of hydric soils. The evening's presentations will be broadcast on Cable TV Channel 4, though the dates of broadcast haven't been scheduled. There was some concern expressed that the presence of cameras and spotlights was intimidating. That could be true; people were asking questions of the Wetland Study researchers and SWCD staff before the program began and during the break, but they were very quiet while the cameras were rolling. The Moose Lodge worked well for this event. There was plenty of room for the a/v equipment, the food, the visual displays, and comfortable seating. We had some great displays: a 3D model of the Clear Creek watershed, a map of creeks in Johnson County with their names and history behind the names, photos of backyard habitat and soil conservation farming practices, soil borings from the field testing, and brochures about conservation/restoration programs. We'll be doing another one nearer the conclusion of the study, when we're able to draw some conclusions and make some recommendations based on the data. The data will be used to assess various ways of improving water quality and controlling flooding, to determine whether wetlands in this area have the potential for restoration or re-creation, and if wetlands in the area can be linked into an integrated water management system. We'll be looking at multiple uses of wetlands, including treatment of stormwater runoff, storage of floodwater, wildlife habitat, and recharge of local water tables, plus education and recreation opportunities. Dilkes, City Attorney Re: Settlement of Blue Cross Litigation The Blue Cross litigation has been settled on the terms we previously discussed with you in executive session, the settlement having been approved by the Blue Cross Board of Directors as well as the Settlement Committee comprised of Plaintiffs' representatives. The settlement amount for all plaintiffs is $14 million plus an agreement by Blue Cross to reimburse all out of pocket costs not to exceed $125,000. The amount of damages claimed by all Plaintiffs was approximately $19.5 million with the City's claim amounting to approximately $564,000 without interest and over $800,000 with interest. In essence, the settlement amount represents approximately 100 cents on the dollar without interest for all damages being claimed, except a return of administrative fees, which are not a part of this settlement. Additional calculations regarding costs as well as documentation of the settlement are yet to be completed. It appears, however, that the gross amount of the City of Iowa City's share will be approximately $550,000 from which contingent attorneys' fees will be deducted. As you will recall, our attorney fee agreement provides for one-third of the recovery to be paid in attorney's fees, resulting in a net amount to the City of approximately $366,667.00.
