( 1 ) MOTION SETTING A PUBLIC HEARING ON APRIL 18 FOR THE FY01 ANNUAL ACTION PLAN, THAT IS A PART OF IOWA CITY'S 2001-2006 CONSOLIDATED PLAN (CITY STEPS). Comment: At their March 9 meeting, the Housing and Community Development Commission (HCDC) made a recommendation regarding the allocation of fiscal year 2001 Community Development Block Grant (CDBG) and HOME Investment Partnership Program (HOME) funds. These funds are to be awarded to the projects and activities described within the FY01 Annual Action Plan. o,3-1Z:/ (2) CONSIDER A RESOLUTION SETTING A PUBLIC HEARING FOR APRIL 18, ON PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE IOWA CITY POLICE 2"D FLOOR CONSTRUCTION PROJECT, DIRECTING CITY CLERK TO PUBLISH NOTICE OF SAID HEARING, AND DIRECTING THE CITY ENGINEER TO PLACE SAID PLANS ON FILE FOR PUBLIC INSPECTION. Comment: This project involves finishing the interior of the existing 3000 square foot second floor addition above the Police Department for the City of Iowa City. The project is located on the west wing of the Civic Center, located at 410 East Washington Street. The construction includes an elevator and two new stairs to the second floor and will house office spaces for the Police Department. e. Resolutions. oc>-/Zo (1) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST TO A SUBORDINATION AGREEMENT BETWEEN THE CITY OF IOWA CITY AND UNIVERSITY OF IOWA COMMUNITY CREDIT UNION, IOWA CITY, IOWA FOR PROPERTY LOCATED AT 430 NORTH VAN BUREN STREET, IOWA CITY, IOWA. Comment: University of Iowa Community Credit Union has requested that the City approve a Subordination Agreement for 430 North Van Buren Street. On February 27, 1997 the owner of the property received a Mortgage for $5,463 and on October 21, 1998 another Mortgage for $5,700, from the City of Iowa City for a total amount of $11,163. University of Iowa Community Credit Union has refinanced the first mortgage with the property owner for $60,000. The property is appraised at $164,000 which provides enough equity to cover the City's second lien position. April 4, 2000 City of Iowa City Page 3 -- / Z t (2) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST TO THE RELEASE OF A LIEN REGARDING TWO MORTGAGES FOR THE PROPERTY LOCATED AT 1202 MARCY STREET, IOWA CITY, IOWA. Comment: The owner of the property located at 1202 Marcy Street received assistance through the City's Down Payment Assistance Program for $2,000 on July 12, 1992 and also assistance through the City's Housing Rehabilitation Program for $5,486 on January 14, 1998. The mortgages were in the form of conditional occupancy loans. The mortgages were paid off on March 16, 2000; thus the lien can now be released. /'~-7, (3) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST TO THE RELEASE OF A LIEN REGARDING A MORTGAGE FOR THE PROPERTY LOCATED AT 804 4th AVENUE, IOWA CITY, IOWA. Comment: The owners of the property located at 804 4th Avenue received assistance through the City's Housing Rehabilitation Program for $4,250 on May 14, 1997. The financing was in the form of a payback loan. The balance of the loan (~2,940) was paid off on March 21, 2000; thus the lien can now be released. /?-:S (4) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST TO THE RELEASE OF A LIEN REGARDING TWO PROMISSORY NOTES FOR THE PROPERTY LOCATED AT 617 KEOKUK COURT, IOWA CITY, IOWA. Comment: The owner of the property located at 617 Keokuk Court received assistance through the City's Housing Rehabilitation Program for $3,000 on December 1, 1987 and for ~7,250 on June 8, 1988. Licensing assists in reuniting animals with their owners and serves as identification, proof of rabies vaccine, and ownership. National advertising campaigns such as Tag Day 2000 bring attention to the importance of licensing your animal and increases positive public relations between the animal shelter and local citizens. In an effort to encourage pet owners to register their pets with the Animal Shelter, this resolution authorizes the Animal Shelter to offer a discount on new licenses for animals which are registered at the Iowa City Animal Shelter on April 8, 2000 in connection with National Tag Day (Tag Day 2000). [UNTIL 8 PM] Public Discussion will be continued, if necessary, prior to "City Council Information" item. ITEM NO. 6. PLANNING AND ZONING MATTERS. a. Consider a motion setting a public hearing for April 18 on an ordinance amending Title 14, Chapter 5, Building and Housing, Article H, Site Plan Review, by adopting Central Planning District Multi-Family Residential Design Standards and related amendments to Title 14, Chapter 6, Zoning, Article 1, Zoning Title, Purpose and Scope. Comment: At its March 16 meeting, by a vote of 6-0, the Planning and Zoning Commission recommended approval of the proposed amendments which provide for design review and design guidelines for any new apartment buildings in the neighborhoods surrounding the downtown. The Apartment Infill Committee recommended approval of the proposed design standards in a report dated February 18. Staff recommended approval of the proposed design standards and related amendments to the Zoning Chapter in a memorandum dated February 17. Action: b. Consider a motion setting a public hearing for April 18 on an ordinance amending Title 14, Chapter 6, Zoning, Article Q, Sign Regulations, to allow banner signs in certain commercial zones under some conditions. Comment: At its March 16 meeting, by a vote of 6-0, the Planning and Zoning Commission recommended approval of the proposed amendment. Last fall, an ordinance was referred back to the Planning and Zoning Commission by Council for consideration of provisions to include minimum spacing requirements, and allowing seasonal messages on the signs. These changes have been included in the proposed amendment, and a new public hearing is required. Staff recommended approval in a memorandum dated March 16. Public hearing on an ordinance changing the zoning designation from Planned High Density Mulit-Family Residential (PRM) to Sensitive Areas Overlay (OSA-PRM) for .48 acres located at the northwest corner of Prentiss and Linn Streets. (REZ00- 0004) Comment: At its March 2 meeting, by a vote of 7-0, the Planning and Zoning Commission recommended approval of the proposed rezoning to permit construction of a 25-unit apartment building at Prentiss and Linn. Staff recommended approval in a report dated February 3. Action: ~ ~ d. Public hearing on an ordinance vacating an undeveloped portion of WooIf Avenue from McLean Street south for a distance of 240 feet. (VAC97-0002) Comment: At its March 2 meeting, by a vote of 6-0-1, with Gibson abstaining due to a potential conflict of interest, the Planning and Zoning Commission recommended approval of the proposed vacation, subject to the retention of easements that may be needed for public and private utilities, and subject to the disposition of the property concurrent with the final consideration of the ordinance to vacate. Staff recommended approval subject to these conditions in a report dated March 2. e. Public hearing on an ordinance amending Title 14, Chapter 6, Zoning, to allow masonry wall signs in the General Industial (1-1), Heavy Industrial (1-2), Office Research Park (ORP) and Research Development Park (RDP) Zones. Comment: At its March 2 meeting, by a vote of 7-0, the Planning and Zoning Commission recommended approval of amendments to the Sign Ordinance to permit business identification signs on masonry walls. Staff recommended approval in a memorandum dated February 25. Action: f. Public hearing on an ordinance amending Title 14, Chapter 6, Zoning, to allow overnight boarding of animals within small animal clinics in the Commercial Office (CO-1) Zone. Comment: At its March 2 meeting, by a vote of 7-0, the Planning and Zoning Commission recommended approval of the proposed amendments. Staff recommended approval in a memorandum dated February 25. Action: April 4, 2000 City of Iowa City Page 6 Density Single-Family Residential (RS-8) to Low Density Multi-Family Residential (RM-12), for 0.82 acres of property located along the west side of Benton Court, north of Benton Street (Oaknoll). (REZO0-O001) (First consideration) Comment: At its February 17 meeting, by a vote of 7-0, the Planning and Zoning Commission recommended approval of the proposed rezoning, with conditions for building design review prior to issuance of a building permit. Staff recommended approval in a report dated February 3. Action: i--<'A c,, u escrow agreement for Louis Condominiums, Iowa City, Iowa. Comment: The City council has authorized an amendment in the Conditional Zoning Agreement (CZA) covering the above development to allow the driveway between the Louis residence and Foster Road to be re-opened until such time as Bud and Betty Louis cease to occupy the existing residence or occupancy permits are issued for 250 dwelling units on property to the west, whichever occurs first. The amendment to the CZA also included a requirement that the cost of installing the alternative driveway be escrowed with the City prior to the re-opening of the existing driveway. This Escrow Agreement outlines the terms and conditions of the construction of the alternative driveway and releases any lien on the development created by the requirement to construct said driveway and attaches said lien to the escrow. i. Consider an ordinance amending the Sensitive Areas Overlay (OSA-8) conditional zoning agreement to allow a driveway access onto Foster Road for property located at 500 Foster Road. (REZ99-0016) (Pass and adopt) Comment: At its January 6 meeting, by a vote of 3-4 (with Supple, Ehrhardt, Bovbjerg, and Schintler voting no) the Planning and Zoning Commission recommended denial of an amendment to the 0SA-8 Conditional Zoning Agreement. The applicant has requested that the proposed amendment keep the Louis driveway open in perpetuity. Staff recommended denial in a memo dated December 29, 1999. An alternative ordinance has been provided for Council consideration to allow the driveway to remain open only until the Louis' cease to occupy the residence or development to the west warrants its closure and provided an escrow is paid for the alternative driveway. Consider a resolution approving a final plat of Windsor Ridge, Part Fifteen, a 40.27-acre, two-lot residential subdivision with two outlots located on the north side of Court Street at its eastern terminus. (SUB00-0004) Comment: At its February 17 meeting, the Planning and Zoning Commission, by a vote of 7-0, recommended approval of the final plat, subject to the approval of construction drawings and legal papers prior to City Council consideration. Construction drawings and legal papers have tentatively been approved. Staff recommended approval in a report dated February 17. Consideration deferred on March 21. PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE IOWA CITY LANDFILL SITE PAVING PROJECT, ESTABLISHING AMOUNT OF BID SECURITY TO ACCOMPANY EACH BID, DIRECTING CITY CLERK TO PUBLISH ADVERTISEMENT FOR BIDS, AND FIXING TIME AND PLACE FOR RECEIPT OF BIDS. Comment: This project consists of upgrading and expanding the existing landfill site layout to accommodate more recycling and reclamation drop sites more conveniently provide for customer access. The project includes concrete paving for access to the recycling and reclamation drop sites and customer access areas. The project will be funded by water revenues. Action: ITEM NO. 12. CONSIDER A RESOLUTION AWARDING CONTRACT AND AUTHORIZING THE Do-L_~ MAYOR TO SIGN AND THE CITY CLERK TO ATTEST A CONTRACT FOR CONSTRUCTION OF THE IOWA AVENUE STREETSCAPE PHASE I IMPROVEMENTS PROJECT. Comment: The bid opening for this project was held on March 28, 2000. The following bids were received: All American Concrete West Liberty, IA 91,098,758.10 MBA Concrete Iowa City, IA 91,254,049.75 Engineer's Estimate 91,056,900.00 Public Works and Engineering recommend award of the project to All American Concrete of West Liberty, Iowa. The project will be financed with General Obligation bonds and The University of Iowa is contributing 9400,000 to this phase of the project. CONSIDER A RESOLUTION CERTIFYING UNPAID MOWING AND CLEAN-UP OF oo- i.,~l PROPERTY CHARGES, SNOW REMOVAL CHARGES, SIDEWALK REPAIR CHARGES AND STOP BOX REPAIR CHARGES TO COUNTY FOR COLLECTION IN THE SAME MANNER AS A PROPERTY TAX. Comment: This resolution authorizes the filing of a lien against properties for unpaid mowing and clean-up charges, snow removal charges, sidewalk repair charges and stop box repair charges. On March 20, 2000, letters were mailed to each property owner, exclusive of the property owners for unpaid stop box repair charges, listed in Exhibit A notifying them of the date for the Council's consideration of the resolution. On March 24, 2000 letters were mailed to each property owner for unpaid stop box repair charges listed in Exhibit A notifying them of the date for the Council's consideration of the resolution. After the resolution is moved for adoption, property owners should be permitted to be heard concerning the unpaid charges. Action: (2~/~.~/~ ITEM NO. 14. CONSIDER A RESOLUTION AUTHORIZING MAILING AND PUBLICATION OF N~ 00-/=52- OF INTENT TO COMMENCE PUBLIC IMPROVEMENT PROJECT TO CONSTRUCT THE FOSTER ROAD GRADING AND WATERMAIN PROJECT AND TO ACgUIRE PROPERTY FOR THE PRO~ECT; AND SETTIN8 DATE OF PUBLIC NEARIN8 FOR ~AY 16. Comment: This project includes grading, sanitary sewer, water main and storm sewer construction from Dubuque Street to Prairie Du Chien Road and sets a public hearing on the matter for May 16. ITE~ NO. 1B. CONSIDER A RESOLUTION OF INTENT TO APPROVE A PURCHASE oD-/~ AND TO DISPOSE OF SAID PROPERTY IN ACCORDANCE THEREWITH, AND A PUBLIC HEARING ON SAID ASREE~ENT FOR APRIL 18. Comment: This Resolution will set out the City's intent to approve a purchase agreement concerning property acquisition for the South Sycamore Regional Greenspace and Stormwater Project, and will set a public hearing on said agreement for April 18, if ~he City Council approves of the purchase agreement during the executive session scheduled for Monday, April 3.
