Consider a motion setting a public hearing for May 2 on an amendment to Zoning Chapter 14-6D-EG1 regarding the nonconforming provisions in the Neighborhood Conservation Residential Zone (RNC-12). Comment: At its April 6 meeting, by a vote of 7-0, the Planning and Zoning Commission recommended approval of the proposed amendments to allow all uses of buildings which were conforming at the time a property is rezoned to RNC-12 shall continue to be considered conforming uses. Staff recommended approval in a report dated February 3. b. Consider a motion setting a public hearing for May 2 on an ordinance changing the zoning designation from Low Density Single Family Residential (RS-5) and Planned Development Housing Overlay (OPDH-5) to Planned Development Housing Overlay (OPDH-5) and approving a preliminary Planned Development Housing Overlay Plan for Village Green Parts 18-20, a 19.6-acre, lO-Iot, 63-unit residential development with one outlot located south of Village Road and west of Scott Boulevard. (REZO0-0002) Comment: At its April 6 meeting, by a vote of 7-0, the Planning and Zoning Commission recommended approval of the proposed rezoning and preliminary development plan, subject to (1) the City conveying Outlot B (0.35 acres) of Village Green Part 14, to Village Partners, and (2) City receipt of a temporary construction easement agreement to allow off-site grading activity. Staff recommended approval in a report dated March 16. - c. Consider a motion setting a public hearing for May 2 on an ordinance amending the Planned Development Housing Overlay (OPDH-5) Plan, and approving a preliminary Planned Development Housing Overlay Plan for Village Green South Part 5, a Resubdivision of a Portion of Village Green South Part 3A, a 12-lot, 3.33-acre residential development located at Wintergreen Drive west of Scott Boulevard. (REZO0-0009) Comment: At its April 6 meeting, by a vote of 7-0, the Planning and Zoning Commission recommended approval of the proposed rezoning and preliminary development plan, subject to City approval of the vacation and disposition of the north portion of North Jamie Lane. Consider a motion setting a public hearing for May 2 on an ordinance vacating, the northernmost portion of North Jamie Lane, located west of Scott Boulevard. (VAC00-0003) Comment: At its April 6 meeting, by a vote of 7-0, the Planning and Zoning Commission recommended approval of the proposed vacation and release of associated easements, subject to the disposition and conveyance of the right-of- way being approved concurrent with approval of the vacation. Staff recommended approval in a report dated April 6. e. Public hearing on an ordinance amending Title 14, Chapter 5, Building and Housing, Article H, Site Plan Review, by adopting Central Planning District Multi- Family Residential Design Standards and related amendments to Title 14, Chapter 6, Zoning, Article 1, Zoning Title, Purpose and Scope. Comment: At its March 16 meeting, by a vote of 6-0, the Planning and Zoning Commission recommended approval of the proposed amendments which provide for design review and design guidelines for any new apartment buildings in the neighborhoods surrounding the downtown. The Apartment Infill Committee recommended approval of the proposed design standards in a report dated February 18. Staff recommended approval of the proposed design standards and related amendments to the Zoning Chapter in a memorandum dated February 17. Action: f. Public hearing on an ordinance amending Title 14, Chapter 6, Zoning, Article O, Sign Regulations, to allow banner signs in certain commercial zones under some conditions. Comment: At its March 16 meeting, by a vote of 6-0, the Planning and Zoning Commission recommended approval of the proposed amendment. Last fall, an ordinance was referred back to the Planning and Zoning Commission by Council for consideration of provisions to include minimum spacing requirements, and allowing seasonal messages on the signs. These changes have been included in the proposed amendment, and a new public hearing is required. Staff recommended approval in a memorandum dated March 16. Public hearing on an ordinance changing the zoning designation from Low Density Multi-Family Residential (RM-12) to Medium Density Single-Family Residential (RS- 8) for property south of Burlington Street along the 300-600 blocks of Governor Street and a portion of the 800-900 blocks of Bowery Street. (REZOO-0007) Comment: At its April 6 meeting, by a vote of 4-3, Supple, Shannon, and Schintler voting no, the Planning and Zoning Commission recommended approval of rezoning this property to RNC-12. The Commission voted 7-0 to deny the request to rezone this property to RS-8. In a report dated February 3 staff recommended that this property be rezoned to Neighborhood Conservation Residential (RNC-12) rather than RS-8. Correspondence included in Council Action: h. Public hearing on an ordinance changing the zoning designation from Low Density Multi-Family Residential (RM-12) to Neighborhood Conservation Besidential (RNC- 12) for property south of Burlington Street along the 300-600 blocks of Lucas Street and a portion of the 700-800 blocks of Bowery Street. (REZ00-0007) Comment: At its April 6 meeting, by a vote of 4-3, Supple, Shannon, and Schintler voting no, the Planning and Zoning Commission recommended approval of rezoning this property to RNC-12. In a report dated February 3 staff recommended approval i. Amending Title 14, Chapter 6, Zoning, to allow wide-base freestanding signs in some commercial zones under certain conditions. Comment: At its February 17 meeting, by a vote of 7-2, the Planning and Zoning Commission recommended approval of amendments to allow wide-base freestanding signs in some commercial zones. On March 21, Council held a public hearing on this item and referred it back to the Planning and Zoning Commission for consideration of increasing the height of such signs to 26 feet. At its April 6 meeting, by a vote of 2-5 with Chait and Shannon voting in the affirmative, the Planning and Zoning Commission recommended denial of the proposal to allow wide-based signs to be 26 feet in height. Staff recommended against allowing wide-based signs being permitted to be 26 feet in height in a memorandum dated March 30. The Council has before it, the original ordinance amendment and an alternative ordinance changing the height of freestanding sign~ to 26 feet. An ordinance vacating an undeveloped portion of WooIf Avenue from McLean Street south for a distance of 240 feet. (VAC97-0002) Comment: At its March 2 meeting, by a vote of 6-0-1, with Gibson abstaining due to a potential conflict of interest, the Planning and Zoning Commission recommended approval of the proposed vacation, subject to the retention of easements that may be needed for public and private utilities, and subject to the disposition of the property concurrent with the final consideration of the ordinance to vacate. Staff recommended approval subject to these conditions in a report dated March 2. Staff recommends continuation of the public hearing and deferral of consideration to the May 2 Council meeting. (REZ00-O004) (First Consideration) Comment: At its March 2 meeting, by a vote of 7-0, the Planning and Zoning Commission recommended approval of the proposed rezoning to permit construction of a 2E-unit apartment building at Prentiss and Linn. Staff recommended approval in a report dated February 3. I. Consider an ordinance amending Title 14, Chapter 6, Zoning, to allow overnight boarding of animals within small animal clinics in the Commercial Office (CO-1) Zone. (First Consideration) Comment: At its March 2 meeting, by a vote of 7-0, the Planning and Zoning Commission recommended approval of the proposed amendments. Staff recommended approval in a memorandum dated February 25. Act i o .: / sk O- n. Con ordinance conditionally changing the zoning designation from Medium r n Density Single-Family Residential (RS-8) to Low Density Multi-Family Residential (RM-12), for 0.82 acres of property located along the west side of Benton Court, north of Benton Street (Oaknoll). (REZ00-0001) (Second consideration) Comment: At its February 17 meeting, by a vote of 7-0, the Planning and Zoning Commission recommended approval of the proposed rezoning, with conditions for building design review prior to issuance of a building permit. Staff recommended approval in a report dated February 3. o. Consider a resolution authorizing the Mayor to sign and the City Clerk to attest an escrow agreement for Louis Condominiums, Iowa City, Iowa. Comment: The City council has authorized an amendment in the Conditional Zoning Agreement (CZA) covering the above development to allow the driveway between the Louis residence and Foster Road to be re-opened until such time as Bud and Betty Louis cease to occupy the existing residence or occupancy permits are issued for 250 dwelling units on property to the west, whichever occurs first. The amendment to the CZA also included a requirement that the cost of installing the alternative driveway be escrowed with the City prior to the re-opening of the existing driveway. This Escrow Agreement outlines the terms and conditions of the construction of the alternative driveway and releases any lien on the development created by the requirement to construct said driveway and attaches said lien to the escrow. Consider an ordinance amending the Sensitive Areas Overlay (OSA-8) conditional zoning agreement to allow a driveway access onto Foster Road for property located at 500 Foster Road. (REZ99-0016) (Pass and adopt) Comment: At its January 6 meeting, by a vote of 3-4 (with Supple, Ehrhardt, Bovbjerg, and Schintler voting no) the Planning and Zoning Commission recommended denial of an amendment to the OSA-8 Conditional Zoning Agreement. The applicant has requested that the proposed amendment keep the Louis driveway open in perpetuity. Staff recommended denial in a memo dated December 29, 1999. An alternative ordinance has been provided for Council consideration to allow the driveway to remain open only until the Louis' cease to occupy the residence or development to the west warrants its closure and provided an escrow is paid for the alternative driveway. Consideration deferred April 4. Action: ~0- i~ q. Consider a resolution approving a final plat of Windsor Ridge, Part Fifteen, a 40.27-acre, two-lot residential subdivision with two outlots located on the north side of Court Street at its eastern terminus. (SUB00-0004) Comment: At its February 17 meeting, the Planning and Zoning Commission, by a vote of 7-0, recommended approval of the final plat, subject to the approval of construction drawings and legal papers prior to City Council consideration. Construction drawings and legal papers have tentatively been approved. Staff recommended approval in a report dated February 17. Consideration deferred on March 21 and April 4. D~ ~/~ 7 r. Consider a resolution approving an extraterritorial preliminary plat of Woodland Ridge, Part Three, a 22.32-acre, 7-lot residential subdivision with one outlot located at the east terminus of Meadowview Drive. (SUB00-0007) Comment: At its April 6 meeting, by a vote of 7-0, the Planning and Zoning Commission recommended approval of the proposed plat. Staff recommended approval in a report dated April 6. April 18, 2000 City of Iowa City Page 9 ITEM NO. 7. PUBLIC HEARING FOR IOWA CITY'S 2001-2006 CONSOLIDATED PLAN (CITY STEPS). Comment: At their March 9 meeting, the Housing and Community Development Commission (HCDC) recommended to the City Council a budget for the allocation of FY01 Community Development Block Grant (CDBG) and HOME Investment Partnership Program (HOME) funds. The FY01 Annual Action Plan contains these CDBG and HOME budget recommendations, a description of the projects and activities being undertaken, a fair housing plan and other HUD-required documents. A PURCHASE AGREEMENT BETWEEN THE CITY OF IOWA CITY AND GREG AND BETH VAN DUSSELDORP FOR .77 ACRES OF PROPERTY LOCATED ADJACENT TO 4387 KOUNTRY LANE, SE AND TO DISPOSE OF SAID PROPERTY IN ACCORDANCE THEREWITH. Comment: This Resolution approves a purchase agreement for the transfer of a .77 acre parcel of properly located adjacent to 4387 Kountry Lane, SE, Iowa City, Johnson County, Iowa, to Greg and Beth Van Dusseldorp in exchange for the Van Dusseldorps conveying to the City property interests which are neeeded for the South Sycamore Regional Greenspace and Stormwater Project. a. CONSIDER A RESOLUTION APPROVING PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE POLICE DEPARTMENT SECOND FLOOR PROJECT, ESTABLISHING AMOUNT OF BID SECURITY TO ACCOMPANY EACH BID, DIRECTING CITY CLERK TO PUBLISH ADVERTISEMENT FOR BIDS, AND FIXING TIME AND PLACE FOR RECEIPT OF BIDS. Comment: This project involves finishing the interior of the existing 3000 square foot second floor addition above the Police Department for the City of Iowa City. The project is located on the west wing of the Civic Center, located at 410 East Washington Street. The construction includes an elevator and two new stairs to the second floor and will house office spaces for the Police Department. The estimated construction cost is $566,000 and will be funded with General Obligation bonds. a, PUBLIC HEARING Action: "y'~ bD--/5c2 b. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY ~p-/~ CLERK TO ATTEST A CONSULTANT AGREEMENT WITH STANLEY CONSULTANTS, INC. FOR PROPERTY ACQUISITION AND RELOCATION SERVICES FOR THE NEAR SOUTHSIDE TRANSPORTATION CENTER. Comment: Pursuant to the proposed contract, Stanley Consultants, Inc. will provide property acquisition and relocation services for the Near Southside Transportation Center project at a not-to-exceed amount of ~71,000.00. 80% of the cost of these services is reimbursable under the Federal Transit Administration grant. If the contract is not finalized in time for inclusion in Council's packet, it will be distributed at Council's Work Session. April 18, 2000 City of Iowa City Page 11 ITEM NO. 11. CONSIDER A RESOLUTION AWARDING CONTRACT AND AUTHORIZING THE ~o~-i.~tl MAYOR TO SIGN AND THE CITY CLERK TO ATTEST A CONTRACT FOR CONSTRUCTION OF THE TRANSIT METHANE ABATEMENT PROJECT, PHASE 2. Comment: The bid opening for this project was held on April 11, 2000. The following bids were received: IIIowa Enterprises, Inc. Moline, IL $197,035.00 Wolf Construction, Inc. Iowa City, IA 9298,477.00 Engineer's Estimate $ 200,000.00 Public Works and Engineering recommend award of the project IIIowa Enterprises, Inc. of Moline, IL. The project will be funded with 80% federal funds and 20% local funds. Action: ITEM NO. 12. CONSIDER A RESOLUTION AWARDING CONTRACT AND AUTHORIZING THE bo-lz/Z MAYOR TO SIGN AND THE CITY CLERK TO ATTEST A CONTRACT FOR CONSTRUCTION OF THE MORMON TREK BOULEVARD IMPROVEMENTS - ABBEY LANE TO HIGHWAY I PROJECT. Comment: The bid opening for this project was held on April 11, 2000. The following bids were received: Metro Pavers, Inc. Iowa City, IA $2,384,289.40 Peterson Contractors, Inc. Reinbeck, IA $2,430,878.60 Streb Construction Co., Inc. Iowa City, IA $2,459,564.15 Langman Construction, Inc. Rock Island, IL $2,660,386.84 Tschiggfrie Excavating Co. Dubuque, IA $3,065,584.50 Engineer's Estimate $ 2,880,000.00 Public Works and Engineering recommend award of the project to Metro Pavers, Inc. of Iowa City, Iowa. CONSIDER A RESOLUTION APPROVING, AUTHORIZING AND DIRECTING THE Oo- (4-3 MAYOR TO EXECUTE AND THE CITY CLERK TO ATTEST AN AGREEMENT BY AND BETWEEN THE CITY OF IOWA CITY AND PLANGRAPHICS, INC. OF FRANKFORT, KENTUCKY TO PROVIDE SERVICES FOR DEVELOPMENT OF AN IMPLEMENTATION PLAN FOR A GEOGRAPHIC INFORMATION SYSTEM. Comment: This contract is the initial step in the development of a Geographic Information System (GIS) for the City of Iowa City. This contract will provide services to define the applications for our city and design and develop a plan for its implementation. The City's Request for Proposal and the Consultant's Proposal referenced in the agreement are on file in the City Clerk's Office. The cost of these services will be $60,709 and will be funded by GO bonds. ITEM ~O. ~4. CONSIDER ~ RESOEOTIO~ ~OTHORIZI~ THE ~YOR TO Sl~ ~D THE CITY ~0-f4q CLERK TO ATTEST AMENDMENT NUMBER 2 TO THE AGREEMENT DATED FEBRUARY 11, 1997, BETWEEN MMS CONSULTANTS, INC. AND THE CITY OF IOWA CITY TO PROVIDE CONSULTING SERVICES FOR THE SOUTH SYCAMORE REGIONAL STORMWATER PROJECT. Comment: This amendment to the 1997 agreement with MMS Consultants, Inc. for the South Sycamore Regional Stormwater Project provides for the design services of the realignment of the north corridor of the project. It will also provide for the additional acquisition plats and changes to acquisition plats for the realignment. Staff has also requested additional design work be completed for storm sewer along South Sycamore Street and driveway access for Kountry Lane Apartments and the Van Dusseldorp property. The total design costs of this amendment will be $68,000. Action: ~ / ~~t~ ITEM NO. 15. CONSIDER A RESOLUTION AMENDING THE BUDGETED POSITIONS IN THE WATER O0- [ ~5 DIVISION OF THE PUBLIC WORKS DEPARTMENT AND THE AFSCME PAY PLAN. Comment: The Classification Committee has reviewed the position of Senior Treatment Plant Operator - Water as provided bV the AFSCME Collective Bargaining Agreement, and has determined that the duties performed by this position are equivalent to those of positions in Grade 14 of the Pay Plan. Therefore, it is recommended that one full-time position of Senior Treatment Plant Operator - Water be reclassified from AFSCME grade 13 to AFSCME grade 14. Annual cost is approximately $1300. (1) Planning and Zoning Commission - Two vacancies to fill five-year terms ending May 1, 2005. (Terms expire for Ann Bovbjerg and Lea Supple.) (3 males and 2 females currently serve.) (2) Animal Control Advisory Board - One vacancy to fill a three-year term ending April 5, 2003. (Term expires for Shawn Lockhart.) (3 females and 1 male currently serve.)
