Comment: This resolution sets a public hearing on a proposed rate increase
or changes for water and wastewater fees. The hearing will be held in the
Civic Center Council Chambers at 7:00 p.m., May 16, 2000, to permit public
input to be heard regarding proposed rate increases or changes for water and
wastewater fees. The new rates are scheduled to go into effect for billings
on or after August 1, 2000. The previous rate increase went into effect on
August 1, 1999. Staff memorandum included in Council packet.

a. Consider a motion setting a public hearing for May 16 on an ordinance approving a
preliminary Planned Development Housing Overlay (OPDH-5) Plan for Village Green
South Part 6, an 8.69 acre, 35-1ot residential subdivision with one outlot for
property located at Wintergreen Drive, west of South Jamie Lane. (REZ00-
0010/SUB00-O009)
Comment: At its April 20 meeting, by a vote of 7-0, the Planning and Zoning
Commission recommended approval of the proposed rezoning and preliminary
development plan, subject to a Conditional Zoning Agreement that contains
conditions regrading wetland documentation, trail design, open space landscaping
and dedication, subsurface drainage and basements, grading and erosion control,
and the connection of Wintergreen Drive to Village Road. Staff recommended
approval in a report dated April 6.
b. Consider a motion setting a public hearing for May 16 on an ordinance to rezone
approximately 2.01 acres located north of Washington Street and east of Green

Comment: At its April 6 meeting, by a vote of 7-0, the Planning and Zoning
Commission recommended approval of the proposed amendments to allow all uses
of buildings which were conforming at the time a property is rezoned to RNC-12
shall continue to be considered conforming uses. Staff recommended approval in a
report regarding REZ00-0007 and REZO0o0011 ,dated February 3.

acre, 10~lot, 63-unit residential development with one outlot located south of

Comment: At its April 6 meeting, by a vote of 7-0, the Planning and Zoning
Commission recommended approval of the proposed rezoning and preliminary
development plan, subject to (1) the City conveying Outlot B (0.35 acres) of
Village Green Part 14, to Village Partners, and (2) City receipt of a temporary
construction easement agreement to allow off-site grading activity. Staff
recommended approval in a report dated March 16.

g. Public hearing on an ordinance vacating, the northernmost portion of North Jamie
Lane, located west of Scott Boulevard. (VACO0-O003)
Comment: At its April 6 meeting, by a vote of 7-0, the Planning and Zoning
Commission recommended approval of the proposed vacation and release of
associated easements, subject to the disposition and conveyance of the right-of-
way being approved concurrent with approval of the vacation. Staff recommended
approval in a report dated April 6.
h. An undeveloped portion of WooIf Avenue from McLean Street south for a distance
of 240 feet. (VAC97-0002)
Comment: At its March 2 meeting, by a vote of 6-0-1, with Gibson abstaining due
to a potential conflict of interest, the Planning and Zoning Commission
recommended approval of the proposed vacation, subject to the retention of
easements that may be needed for public and private utilities, and subject to the
disposition of the property concurrent with the final consideration of the ordinance
to vacate. Staff recommended approval subject to these conditions in a report
dated March 2. Staff recommends continuation of the public hearing and deferral
of consideration to the May 2 Council meeting.

i. Title 14, Chapter 5, Building and Housing, Article H, Site Plan Review, by adopting
Central Planning District Multi-Family Residential Design Standards and related
amendments to Title 14, Chapter 6, Zoning, Article A, Zoning Title, Purpose and
Scope.
Comment: At its March 16 meeting, by a vote of 6-0, the Planning and Zoning
Commission recommended approval of the proposed amendments which provide
for design review and design guidelines for any new apartment buildings in the
neighborhoods surrounding the downtown. The Apartment Infill Committee
recommended approval of the proposed design standards in a report dated
February 18. Staff recommended approval of the proposed design standards and
related amendments to the Zoning Chapter in a memorandum dated February 17.

j. Consider an ordinance amending Title 14, Chapter 6, Zoning, Article O, Sign
Regulations, to allow banner signs in certain commercial zones under some
conditions. (First Consideration)
Comment: At its March 16 meeting, by a vote of 6-0, the Planning and Zoning
Commission recommended approval of the proposed amendment. Last fall, an
ordinance was referred back to the Planning and Zoning Commission by Council for
consideration of provisions to include minimum spacing requirements, and allowing
seasonal messages on the signs. These changes have been included in the
proposed amendment. Staff recommended approval in a memorandum dated
March 16.

k. Consider an ordinance changing the zoning designation from Low Density Multi-
Family Residential (RM-12) to Medium Density Single-Family Residential (RS-8) for
property south of Burlington Street along the 300-600 blocks of Governor Street
and a portion of the 800-900 blocks of Bowery Street. (REZO0-O007) (First
Consideration)
Comment: At its April 6 meeting, by a vote of 4-3, Supple, Shannon, and
Schintler voting no, the Planning and Zoning Commission recommended approval
of rezoning this property to RNC-12. The Commission voted 7-0 to deny the
request to rezone this property to RS-8. In a report dated February 3 staff
recommended that this property be rezoned to Neighborhood Conservation
Residential (RNC-12) rather than RS-8. Due to a sufficient protest petition, an extra
majority vote of the Council (6 of 7) is required to approve a rezoning to RS-8. An
extra majority is not required to approve a rez 'n.q to RNC-12. Correspondence

m. Consider an ordinance amending Title 14, Chapter 6, Zoning, to allow wide-base
freestanding signs in some commercial zones under certain conditions. (Second
Consideration)
Comment: At its February 17 meeting, by a vote of 7-2, the Planning and Zoning
Commission recommended approval of amendments to allow wide-base
freestanding signs in some commercial zones. On March 21, Council held a public
hearing on this item and referred it back to the Planning and Zoning Commission
for consideration of increasing the height of such signs to 26 feet. At its April 6
meeting, by a vote of 2-5 with Chair and Shannon voting in the affirmative, the
Planning and Zoning Commission recommended denial of the proposal to allow
wide-based signs to be 26 feet in height. Staff recommended against allowing
wide-based signs being permitted to be 26 feet in height in a memorandum dated
March 30.

n. Consider an ordinance changing the zoning designation from Planned High Density
Multi-Family Residential (PRM) to Sensitive Areas Overlay (OSA-PRM) for .48 acres
located at the northwest corner of Prentiss and Linn Streets. (REZ00-O004)

Comment: At its March 2 meeting, by a vote of 7-0, the Planning and Zoning
Commission recommended approval of the proposed rezoning to permit
construction of a 25-unit apartment building at Prentiss and Linn. Staff
recommended approval in a report dated February 3.
o. Consider an ordinance amending Title 14, Chapter 6, Zoning, to allow masonry
wall signs in the General Industrial (1-1), Heavy Industrial (1-2), Office Research
Park (ORP) and Research Development Park (RDP) Zones. (Second Consideration)
Comment: At its March 2 meeting, by a vote of 7-0, the Planning and Zoning
Commission recommended approval of amendments to the Sign Ordinance to
permit business identification signs on masonry walls. Staff recommended
approval in a memorandum dated February 25.
p. Consider an ordinance amending Title 14, Chapter 6, Zoning, to allow overnight
boarding of animals within small animal clinics in the Commercial Office (C0-1)
Zone. (Second Consideration)
Comment: At its March 2 meeting, by a vote of 7-0, the Planning and Zoning
Commission recommended approval of the proposed amendments. Staff
recommended approval in a memorandum dated February 25.

Comment: At its February 17 meeting, by a vote of 7-0, the Planning and Zoning
Commission recommended approval of the proposed rezoning, with conditions for
building design review prior to issuance of a building permit. Staff recommended
approval in a report dated February 3.

r. Consider a resolution authorizing the Mayor to sign and the City Clerk to attest an
escrow agreement for Louis Condominiums, Iowa City, Iowa.
Comment: The City council has authorized an amendment in the Conditional
Zoning Agreement (CZA) covering the above development to allow the driveway
between the Louis residence and Foster Road to be re-opened until such time as
Bud and Betty Louis cease to occupy the existing residence or occupancy permits
are issued for 250 dwelling units on property to the west, whichever occurs first.
The amendment to the CZA also included a requirement that the cost of installing
the alternative driveway be escrowed with the City prior to the re-opening of the
existing driveway. This Escrow Agreement outlines the terms and conditions of
the construction of the alternative driveway and releases any lien on the
development created by the requirement to construct said driveway and attaches
said lien to the escrow. Consideration deferred April 4 and 18.

s. Consider an ordinance amending the Sensitive Areas Overlay (OSA-8) conditional
zoning agreement to allow a driveway access onto Foster Road for property
located at 500 Foster Road. (REZ99-0016) (Pass and adopt)
Comment: At its January 6 meeting, by a vote of 3-4 (with Supple, Ehrhardt,
Bovbjerg, and Schintler voting no) the Planning and Zoning Commission
recommended denial of an amendment to the OSA-8 Conditional Zoning
Agreement. The applicant has requested that the proposed amendment keep the
Louis driveway open in perpetuity. Staff recommended denial in a memo dated
December 29, 1999. An alternative ordinance has been provided for Council
consideration to allow the driveway to remain open only until the Louis' cease to
occupy the residence or development to the west warrants its closure and
provided an escrow is paid for the alternative driveway. C~psideration deferred
April 4 and 18.
ITEM NO. 6 THE CITY'S INTENT TO PROCEED WITH AND AUTHORIZING THE
ACQUISTION OF PROPERTY RIGHTS FOR THE CAPTAIN IRISH
PARKWAY EXTENSION AND FIRST AVENUE EXTENSION WATER
MAIN INSTALLATION.
Comment: This project includes grading, paving, sidewalks, storm
sewer and related construction of Captain Irish Parkway from the
south entrance of ACT to Rochester Avenue and also the
installation of water mains from Captain Irish Parkway to the north
end of existing First Avenue paving. The grading of the First
Avenue extension has been removed from the proposed project in
light of the City Clerk's Certificate of Sufficiency (accepted on the
Consent Calendar) on the initiative petition to delete the First
Avenue extension from the Capital Improvement Program.

Comment: The bid opening for this project was held on April 25, 2000. The following

ITEM NO. 9. CONSIDER A RESOLUTION ADOPTING IOWA CITY'S FY01 ANNUAL ACTION PLAN,
~o-15~ THAT IS PART OF IOWA CITY'S 2001-2006 CONSOLIDATED PLAN (CITY STEPS),
AND AUTHORIZING THE CITY MANAGER TO SUBMIT SAID PLAN AND ALL
NECESSARY CERTIFICATIONS TO THE U.S. DEPARTMENT OF HOUSING AND
URBAN DEVELOPMENT, AND DESIGNATING THE CITY MANAGER AS THE
AUTHORIZED CHIEF EXECUTIVE OFFICER FOR THE CONSOLIDATED PLAN.
Comment: At their April 24, 2000, meeting, the Iowa City Housing and Community
Development Commission recommended approval of the FY01 Annual Action Plan,
which contains the budget for Community Development Block Grant and HOME
Investment Partnership Program monies. To receive federal fiscal year 2000 funding,
this document must be submitted to the U.S. Department of Housing and Urban
Development (HUD) by May 15, 2000. Council received a draft of the Action Plan in
their March 30 packet. Correspondence included in Council packet.

AGREEMENT NO. 2000-16-088 FOR THE HIGHWAY 6 CORRIDOR IMPROVEMENT
PROJECT STPN-6-7(56)-2J-52.
Comment: This agreement provides for the Iowa DOT sharing in the cost of the storm
sewer to be installed as part of the Highway 6 Corridor Improvements Project. The
Iowa DOT has agreed to contribute approximately $336,300 to the project. This is in
addition to the Surface Transportation Program grant of $994,000 that was previously
approved by Council.
ITEM NO. 12. CONSIDER A RESOLUTION AUTHORIZING AND DIRECTING THE DIRECTOR OF
~-~s<j PUBLIC WORKS TO ACT ON THE CITY'S BEHALF IN SECURING PERMITS FOR
CONSTRUCTION OF PUBLIC IMPROVEMENTS, AND RESCINDING RESOLUTION NO.
98-168.
Comment: Circumstances occur when the City must obtain permits from various
governmental agencies prior to work on public improvements. This resolution
authorizes the Public Works Director to execute permits on the City's behalf and the
Mayor to sign and City Clerk to attest necessary agreements thereunder. This

GREEN SOUTH PART 3A, TO ADJACENT PROPERTY OWNER AND DEVELOPER
GLASGOW-WI[MAM8 REAL ESTATe, AND SETTING A PUBLIC HEARING ON SAID
CONVEYANCE FOR MAY 16,
Comment: Glasgow-Williams Real Estate, as owners and developers of adjacent
property, have requested the vacation and disposition of an approximate 4,229 square
foot parcel of right-of-way located at the "stub" of North Jamie Lane, Village Green
South, Part 3A, for the sum of ~1,285.00. This right-of-way was dedicated to the
City with the platting of Village Green South Part 3A. However, the developer has
reconfigured the area to be platted such that North Jamie Lane will no longer be a
through street, but will end in a cul-de-sac, and the parcel requested for conveyance is
that "stub" portion of the right-of-way that will no longer be necessary for street
purposes. Further, re-acquisition of this parcel by the Developer is necessary for the
proposed platting of Village Green South Part 5 as currently under consideration by
the City Council. This Resolution declares the City Council's intent to convey the
above property to Glasgow-Williams Real Estate, and sets a public hearing on the
proposed conveyance for May 16, 2000.

ITEM NO. 14. CONSIDER A RESOLUTION OF INTENT TO CONVEY OUTLOT B, VILLAGE GREEN
OO- 15'7 PART 14, CONSISTING OF APPROXIMATELY .35 ACRES LOCATED ALONG THE
SOUTHERN BOUNDARY OF VILLAGE ROAD, TO ADJACENT PROPERTY OWNER AND
DEVELOPER VILLAGE PARTNERS, AND SETTING A PUBLIC HEARING ON SAID
CONVEYANCE FOR MAY 16, 2000.
Comment: Village Partners, as owners and developers of adjacent property, have
offered the sum of $ 4,500 for an approximate .35 acre parcel of a City-owned lot
known as Outlot B, Village Green Part 14. Acquisition of this parcel by the Developer
is necessary for the proposed platting of Village Green Parts XVIII - XX as currently
under consideration by the City Council. Outlot B was dedicated to the City with the
platting of Village Green Part 14 with the concept that this parcel would connect to a
larger greenway/park extending to the southern portion of the Village Green/Village
Green South Development. However, redesign of development in the area has
changed the character and location of open space such that retention of this parcel
would result in a small, stand-alone greenspace. This Resolution declares the City
Council's intent to convey the above property to Village Partners, and sets a public
hearing on the proposed conveyance for May 16, 2000.
ITEM NO. 15. CONSIDER A RESOLUTION OF INTENT TO APPROVE A PURCHASE AGREEMENT

AND SETTING A PUBLIC HEARING ON SAID AGREEMENT FOR MAY 16, 2000.
Comment: The City will need to swap a small parcel of land with Super Valu for the
road that will be constructed into the Airport North Commercial Area. This Resolution
sets out the City's intent to approve a purchase agreement concerning this land swap,
and sets a public hearing on said agreement for May 16, 2000.
ITEM NO. 16. CONSIDER A RESOLUTION EXPRESSING A PREFERENCE FOR USE OF THE TERM
- ~ ~ "PEOPLE OF COLOR" RATHER THAN "MINORITIES."
Comment: This resolution has been recommended by the Human Rights Commission
and is consistent with that adopted by the National Black Caucus of Local Elected
Officials.

ITEM NO. 17. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY
o O- I G~ CLERK TO ATTEST AN AGREEMENT BETWEEN THE CITY OF IOWA CITY, IOWA AND
PUBLIC ACCESS TELEVISION, INC. FOR FUNDING, OPERATION, AND MANAGEMENT
OF LOCAL PUBLIC ACCESS FUNCTION.
Comment: This is a 3-year extension of the agreement providing for the operation of
Public Access Channel 2 by PATV, Inc. through December 31, 2002. The City of
Coralville is no longer a party to this agreement as PATV wishes to pursue a separate
agreement with them. The Iowa City Telecommunications Commission and staff
recommend approval of this agreement.

ITEM NO. 18. CONSIDER MOTION GRANTING A 45-DAY EXTENSION TO THE POLICE CITIZENS
REVIEW BOARD FOR THE FILING OF THE REPORT WITH THE CITY COUNCIL ON
COMPLAINT #99-08.
Comment: Ordinance 97-3792 establishes the Police Citizens Review Board and sets
forth reporting mechanisms for complaints. The Ordinance also provides the City
Council to grant extensions of the 45 day reporting requirement for good cause. At
their meeting of April 11, 2000, the Board unanimously requested a 45-day extension
for the reasons stated in the letter included in Council packet.
