CONSIDER A RESOLUTION OF INTENT TO AMEND A PURCHASE AGREEMENT BETWEEN THE CITY OF IOWA CITY AND WAL-MART REAL ESTATE BUSINESS TRUST FOR APPROXIMATELY 21.76 ACRES OF PROPERTY LYING WITHIN LOTS 10 THROUGH 17 OF NORTH AIRPORT DEVELOPMENT SUBDIVISION AND LOTS 2, THROUGH 4 OF THE NORTH AIRPORT DEVELOPMENT SUBDIVISION - PART TWO, AND SETTING A PUBLIC HEARING FOR OCTOBER 18, 2005 Comment: The City has entered into a purchase agreement for the sale of approximately 21.76 acres of property lying within Lots 10 through 17 of North Airport Development Subdivision and Lots 2 through 4 of the North Airport Development Subdivision - Part Two to Wal-Mart Real Estate Business Trust. Said purchase agreement provides for closing to occur upon completion of contingencies set forth therein, no later than two hundred seventy (270) days after the February 9, 2005 effective date thereof, unless a later date is mutually agreed to in writing by the City and Wal-Mad. Extension of the closing date provided for in the purchase agreement is necessary for completion of the contingencies, and Wal- Mart has requested that purchase agreement be amended such that the closing shall take place not later than January 31,2006. oE~--' ~)l~, 2. CONSIDER A RESOLUTION SETTING A PUBLIC HEARING ON OCTOBER 18, 2005 ON PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE PARKING FIBER INTERCONNECT PROJECT, DIRECTING CITY CLERK TO PUBLISH NOTICE OF SAID HEARING, AND DIRECTING THE CITY ENGINEER TO PLACE SAID PLANS ON FILE FOR PUBLIC INSPECTION. Comment: This project is to install fiber optic and copper cable between Iowa City Parking to unify data networking and telephony services to parking facilities. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO EXECUTE AND THE CITY CLERK TO ATTEST TO A SUBORDINATION AGREEMENT BETWEEN THE CITY OF IOWA CITY AND UNIVERSITY OF IOWA COMMUNITY CREDIT UNION, IOWA CITY, IOWA FOR PROPERTY LOCATED AT 62 REGAL LANE, IOWA CITY, IOWA. Comment: University of Iowa Community Credit Union., Iowa City, Iowa has requested that the City approve a Subordination Agreement for 62 Regal Lane. On June 12, 1996, the owners of the property received a loan from the City of Iowa City's Housing Rehabilitation Program. Comment: The owners of the property located at 1756 Dover Street received assistance through the City of Iowa City's Housing Rehabilitation Program. (VAC05-00007) Comment: At its September 15 meeting, by a vote of 5-0 (Brooks recused, Plahutnik absent), the Planning and Zoning Commission recommended approval of the vacation of a portion of Madison Street, south of Prentiss Street, and Des Moines Street, subject to retention of any necessary utility easements. Staff recommended approval in a report dated September 15, 2005. Approval of this vacation will allow the right-of-way to be acquired by the University of Iowa. APPROVING THE VOLUNTARY ANNEXATION OF APPROXIMATELY 51.9 ACRES LOCATED ON AMERICAN LEGION ROAD (ANN05-00002) Comment: At its September 1 meeting, by a vote of 7-0, the Planning and Zoning Commission recommended approval of this annexation. Staff recommended approval in a Staff report dated September 1. The annexation and rezoning of this property will allow the Fairview Golf Course to be developed with single-family homes. 1. CONSIDER A RESOLUTION ~ October 4, 2005 City of Iowa City Page 10 k) CONDITIONALLY REZONING APPROXIMATELY 51.9 ACRES FROM JOHNSON COUNTY RESIDENTIAL (R) TO LOW DENSITY SINGLE-FAMILY RESIDENTIAL (RS-5) SUBJECT TO CONDITIONS, FOR THE PROPERTY LOCATED ON AMERICAN LEGION ROAD (REZ05-00018) Comment: At its September 1 meeting, by a vote of 7-0, the Planning and Zoning Commission recommended approval subject to a Conditional Zoning Agreement specifying the developer's responsibility for contributing to the cost of the improvement of American Legion Road. Staff recommended approval with conditions in a Staff report dated September 1. 1. PUBLIC HEARING 2. CONSIDER AN ORDINANCE (FIRST CONSIDERATION) Action: ~ / I) CONSIDER A RESOLUTION APPROVING THE FINAL PLAT OF CARDINAL RIDGE PART ONE, IOWA CITY, IOWA. (SUB05-00018) Comment: At its September 15 meeting, by a vote of 6-0 (Plahutnik absent), the Planning and Zoning Commission recommended approval, subject to staff approval of legal papers and construction plans prior to Council consideration. It is anticipated that legal papers and construction drawings will be approved prior to the October 4, Council meeting. Staff recommended approval in a report dated September 15, 2005. Approval will allow the development of Cardinal Ridge Part One, a 50-lot, 35.32-acre residential subdivision located on Kennedy Parkway October 4, 2005 City of Iowa City Page 11 ITEM 7. CONSIDER AN ORDINANCE AMENDING TITLE 3, ENTITLED "CITY FINANCES, z~! [ ~r TAXATION AND FEES" CHAPTER 4, ENTITLED "SCHEDULE OF FEES, RATES, CHARGES, BONDS, FINE AND PENALTIES," SECTION 9, ENTITLED "VIOLATION OF VARIOUS CODE SECTIONS," TO MAKE THE FINE FOR LITTERING THE SAME AS THE FINE UNDER THE STATE CODE. (SECOND CONSIDERATION) Comment: Currently, the fine for littering is $10. State law regulates littering on a street or highway and sets the fine at $35. The City cannot have a fine that is less than the State. The City can either make the fine for littering on a street or highway $35 and keep the fine at $10 for littering everywhere else or increase the fine for littering to $35 regardless of where it occurs. CONSIDER A RESOLUTION AUTHORIZING THE INSTALLATION OF SPEED ~.~'" -~E> HUMPS IN THE ALLEY BETWEEN 7TM AVENUE AND BRADLEY STREET. Comment: The residents of the alley between 7th Avenue and Bradley Street have successfully gone through the City of Iowa City approved traffic calming program. This resulted in a survey of the neighborhood yielding a 86% majority in favor of speed humps. Action: ITEM 9. CONSIDER A RESOLUTION APPROVING THE THIRD AMENDMENT TO THE o5---..~ PENINSULA NEIGHBORHOOD DEVELOPMENT AGREEMENT BETWEEN THE CITY OF IOWA CITY AND PENINSULA DEVELOPMENT COMPANY, L.L.C. Comment: Pursuant to the Peninsula Neighborhood Development Agreement between the City and Peninsula Development Company LLC (PDC), as amended, the City has approved a preliminary plat for the entire Peninsula Neighborhood, consisting of 82.1 acres. Said preliminary plat contains an Outlot N consisting of approximately 35.6 acres as depicted thereon. It is the oral agreement of the City and PDC that Outlot N will be retained by the City as public open space and parkland. The development agreement between the City and PDC should be amended to reflect this agreement. PDC has executed the appropriate amended drafted and proposed by the City Attorney's Office. This resolution authorizes execution of the amendment by the Mayor and City Clerk. Action: / October 4, 2005 City of Iowa City Page 12 ITEM 10. CONSIDER A RESOLUTION DESIGNATING 143.52 ACRES OF THE PENINSULA PROPERTY AS PUBLIC PARKLAND. Comment: In 1995 the City purchased approximately 190 acres of property on the Peninsula, for development and public parkland. Approximately 143.52 acres of City- owned property on the Peninsula lies outside the portion of the property to be developed, and is to serve as parkland. This resolution formally designates said 143.52 acres of property as public parkland. Action: /~.~w.4.¢,,.,h/~¢ ~ ITEM11. CONSIDER A RESOLUTION RESCINDING RESOLUTION NO. 98-87 AND ~,9o~ APPROVING A REVISED LONG-TERM DEER MANAGEMENT PLAN. Comment: In 1998, Council approved a Long-Term Deer Management Plan. The Deer Task Force recommends that Council adopt a revised plan that includes decreasing the deer population limit from thirty-five (35) to twenty-five (25) per square mile and to remove trap and kill as a deer management option.
