SIGN A LETTER OF SUPPORT IN ORDER TO FULFILL THE THRESHOLD
REQUIREMENTS OF THE LOW INCOME HOUSING TAX CREDIT
APPLICATION.
Comment: In order to meet the threshold requirements set forth by the Iowa
Finance Authority for Low Income Housing Tax Credits, Lexington Place
Limited Partnership (formally Iowa City IHA II Limited Partnership) is
requesting a resolution and a letter of support from the City of Iowa City.

AND THE CITY CLERK TO ATTEST THE RELEASE OF A LIEN
REGARDING A MORTGAGE FOR THE PROPERTY LOCATED
AT 38 WEST SIDE DRIVE, IOWA CITY, IOWA.
Comment: The owners of the property located at 38 West Side Drive
received assistance through the City's Downpayment Assistance Program for
the amount of $1,723. The financing was in the form of a conditional
occupancy loan. The loan was paid off on June 14, 2000; thus the lien can
now be released.

' AND THE CITY CLERK TO ATTEST TO A SUBORDINATION
AGREEMENT BETWEEN THE CITY OF IOWA CITY AND IOWA STATE
BANK AND TRUST COMPANY, IOWA CITY, IOWA FOR PROPERTY
LOCATED AT 1209 HIGHLAND AVENUE, IOWA CITY, IOWA.
Comment: Iowa State Bank and Trust Company has requested that the City
approve a Subordination Agreement for 1209 Highland Avenue. On March
17, 1995, the owners of the property received a Mortgage for $25,000 and
another Mortgage for 93,800 from the City of Iowa City for a total amount of
928,800. Iowa State Bank and Trust Company has refinanced the first and
second mortgage with the property owner for 932,000. The property is
appraised at 971,500 which provides enough equity to cover the City's
second lien position.

THE OAKLAND CEMETERY PHASE ONE EXPANSION PROJECT.
Comment: On August 24, 1999, a contract was entered into with Peterson
Contractors of Reinbeck, Iowa for expanding Oakland Cemetery to the east,
including extended roadways and a columbarium. The total contract amount,
including change orders, is $430,053.08. All work covered by the contract
has been completed, all required paper work has been submitted and all
invoices have been paid other than the retainage.

PARK DEVELOPMENT AND TY'N CAE STORMWATER PROJECT.
Comment: On April 20, 1999 a contract was entered into with Peterson
Contractors of Reinbeck, Iowa for the development of the 14-acre Kiwanis
Park and modifications to the Ty'n Cae stormwater management basin. The
total contract amount, including change orders, is $345,136.95. All work
covered by the contract has been completed, all required paper work has
been submitted and all invoices have been paid other than the retainage.

Comment: This resolution sets a public hearing for 7:00 p.m. on August 1,
2000, to receive public comment regarding the issuance of $13,000,000 of
Water Revenue Bonds and authorizes the City Clerk to publish the Notice of
Hearing. Proceeds from the bonds will pay for costs associated with the new
Water Treatment Plant.

Comment: At its May 18 meeting, by a vote of 5-0, the Planning and Zoning
Commission recommended approval of the proposed annexation. Staff

Comment: At its May 18 meeting, by a vote of 5-0, the Planning and Zoning

Comment: At its July 6 Meeting by a vote of 5-0 the Planning and Zoning
commission recommended approval of this rezoning unless the Board determines
that strict adherence to the "infill" policies of the Johnson County Land Use Plan is
essential to the successful implementation of the Plan. In a memorandum dated
June 20 staff recommend approval.

p. Consider a letter to the Johnson County Board of Supervisors recommending denial
of a rezoning of 125.43 acres located within Fringe Area C east of Dane Road and
west and south of the Lakeridge Mobile Home Park from County A1 Rural and RS
Suburban Residential to County RMH Manufactured Housing Residential. (CZ0027)
Comment: At its June 15 meeting by a vote of 6-0 the Planning and Zoning
Commission recommended denial of this rezoning due to its non-compliance with
the Fringe Area Agreement, the Iowa City Comprehensive Plan, and the Johnson
County Land Use Plan. The Commission also recommended that if the Board
entertains approval of this rezoning then the Board and City Council should meet to
discuss merits of the proposal with relationship to the Fringe Area Agreement and
the Future of the agreement. Staff recommended denial in a report dated
June 9.

ITEM NO. 7. PUBLIC HEARING ON PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND
ESTIMATE OF COST FOR THE CONSTRUCTION OF THE 2000 CONCRETE
PAVEMENT REHABILITATION PROJECT, ESTABLISHING AMOUNT OF BID SECURITY
TO ACCOMPANY EACH BID, DIRECTING CITY CLERK TO PUBLISH ADVERTISEMENT
FOR BIDS, AND FIXING TIME AND PLACE FOR RECEIPT OF BIDS.
Comment: A notice was not published and the public hearing is not to be held at this
time. Instead, it is recommended that this project be bid in February 2001 for
construction during the summer of 2001. A new public hearing would be set at that
time. The schedule staff is proposing would allow the contractor a wider time frame to
complete the construction, and will also allow for construction while Regina High
School is not in session.

MEMBERSHIP, TERMS, DUTIES, POWERS, AND AUTHORITY OF SAID COMMISSION.
Comment: At their May 15 Work Session, Council approved the formation of a Solid
Waste Advisory Commission. A resolution establishing the Solid Waste Advisory
Commission is attached.

ITEM NO. 9. CONSIDER A RESOLUTION DETERMINING THE NECESSITY AND SETTING DATES OF
o~_ZH¢{ ..... A CONSULTATION (JULY 24) AND A PUBLIC HEARING (AUGUST 15) ON A
PROPOSED SYCAMORE AND FIRST AVENUE URBAN RENEWAL PLAN FOR A
PROPOSED URBAN RENEWAL AREA IN THE CITY OF IOWA CITY, IOWA.
Comment: The proposed resolution states that the Council has reasonable cause to
believe that the proposed urban renewal area satisfies the eligibility criteria for
designation as an urban renewal area under Iowa law. The resolution sets the public
hearing on the proposed plan for August 15.
ITEM NO. 10. CONSIDER A RESOLUTION OF INTENT TO APPROVE A PURCHASE AGREEMENT
WITH FAMILY VIDEO FOR CONDOMINIUM UNIT 1-D IN TOWER PLACE AND
PARKING AND TO DISPOSE OF SAID PROPERTY IN ACCORDANCE THEREOF, AND
SETTING A PUBLIC HEARING FOR AUGUST 1, 2000.
Comment: A purchase agreement for Unit ID has been negotiated with Family Video.
Due to changes in the square footage of the unit additional negotiation is required.
The purchase agreement will be filed with the Clerk prior to publication of the notice
of public hearing and provided to Council prior to its August 1 meeting.
ITEM NO. 11. CONSIDER A RESOLUTION AUTHORIZING AND APPROVING $2;25,000 IN
co-2-SO AFFORDABLE HOUSING FUNDING POOL FUNDS ($175,000 IN CITY GENERAL
FUNDS AND $50,000 IN HOME FUNDS) FOR A PROJECT TO PROVIDE HOUSING
FOR LOW AND MODERATE INCOME FAMILIES.
Comment: On June 15, 2000, the Housing and Community Development Commission
(HCDC) by a vote of 5-0 recommended that ~225,000 in Affordable Housing Funding
Pool (AHFP) funds be allocated to this project. A memorandum is included in
Council's Packet. Correspondence included in Council packet.

ITEM NO. 13. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY

PATHNET TO USE A PORTION OF CITY STREETS RIGHTS-OF-WAY FOR THE
INSTALLATION, OPERATION AND MAINTENANCE OF A FIBER OPTIC NETWORK.
Comment: This agreement will allow Pathnet to install, operate, and maintain a fiber
optic cable system within City of Iowa City rights-of-way.
ITEM NO, 14. CONSIDER A RESOLUTION TEMPORARILY CLOSING A PORTION OF MADISON
- ?, S-~ STREET RIGHT-OF-WAY AND AUTHORIZING THE EXECUTION OF AN AGREEMENT
FOR TEMPORARY USE OF PUBLIC RIGHT-OF-WAY BETWEEN THE CITY OF IOWA
CITY AND THE UNIVERSITY OF IOWA.
Comment: The University of Iowa desires to repair a steam vault on the southeast
corner of Washington Street and Madison Street in the Madison Street right of way.
The temporary use of the City right of way along Madison Street is necessary during
construction to secure the construction site against pedestrian and vehicular traffic,
and to provide adequate space for construction. Two lanes of traffic, one northbound
and one southbound, will be maintained at all times. The effective date for this work
in the agreement is ending no later than September 1, 2000.
ITEM NO. 15. CONSIDER A RESOLUTION APPROVING AND AUTHORIZING EXECUTION OF AN
C>C> -- 7_5~ AGREEMENT WITH THE STATE OF IOWA FOR TEMPORARY USE OF PUBLIC RIGHT-
OF-WAY FOR A PORTION OF IOWA AVENUE IN IOWA CITY, IOWA.
Comment: The State of Iowa desires to reconstruct the entrance to their building at
402 Iowa Avenue. This resolution will allow the utilization of the area between the
building and the curb along Iowa Avenue and will not affect vehicular traffic. The
agreement shall be in effect until no later than September 17, 2000. Public Works
and Engineering recommend approval of the agreement.

ITEM NO. 16. CONSIDER A RESOLUTION AUTHORIZING AND DIRECTING THE DIRECTOR OF

TEMPORARY USE OF PUBLIC RIGHT-OF-WAY.
Comment: This resolution will authorize the Director of Public Works to review and
execute, as deemed appropriate, temporary use of public right-of-way agreements.
The applicable agreements cover such things as temporary use of right-of-way for
construction, placement of dumpsters, retaining walls, and ADA accessible ramps.
Use of right-of-way for the placement of public utilities and sidewalk caf~ utilization
are not covered under this resolution and will continue to be presented to Council for
approval.

Comment: This agreement allows Mercy Hospital to place an electrical duct bank
within the public right-of-way in the 200 block of Johnson Street to provide electrical
power to the addition currently under construction. Public Works and Engineering
recommend approval of the agreement.

Comment: The City of Iowa City must acquire right-of-way, fee title and temporary
construction easements to construct the Mormon Trek Improvements Project. This
resolution authorizes City staff to negotiate and the Mayor to sign these documents,
including authorization of condemnation if necessary. Every effort will be made to
negotiate acceptable agreements without resorting to condemnation. Prior to
proceeding with condemnation, staff will notify Council.

Comment: The Design Review Committee met on May 11, 2000, and reviewed the
application for the canopy for the Whiteway 2000 Apartment Building. With a

RE-ROOF PHASE II PROJECT.
Comment: This project involves the removal and replacement of roofing, insulation
and fascia over the Police Department, a portion of the Fire Department, the lobby and
the entire east wing (other than the Council Chambers) totaling 13,085 square feet.
The other sections of the roof were replaced in 1997. Bids for this project were
opened on July 6, 2000 with the following results:

AND THE AFSCME PAY PLAN.
Comment: The Classification Committee has reviewed the position of Housing
Program Assistant as provided by the AFSCME Collective Bargaining Agreement, and
has determined that the duties performed by this position are equivalent to those of
positions in grade 9 of the Pay Plan. Therefore, it is recommended that 6 full-time
positions of Housing Program Assistant - Housing Authority be reclassified from
AFSCME grade 7 to AFSCME grade 9. Annual cost is approximately 911,400.
ITEM NO. 22. CONSIDER A RESOLUTION AMENDING THE BUDGETED POSITIONS IN THE

COORDINATOR POSITION.
Comment: Because of market conditions, it has been difficult to fill the position of City
Architect/Engergy Coordinator. This resolution eliminates the position of City
Architect/Engergy Coordinator and replaces it with an Architectural Services
Coordinator, which does not require professional registration. This is considered a
temporary change that will be reversed at such time as favorable candidates may be
available.

ITEM NO. 23. CONSIDER A RESOLUTION RATIFYING SETTLEMENT OF PENDING LITIGATION.
Comment: This Resolution will confirm and ratify a proposed settlement agreement
involving pending litigation in the Gase of City of Iowa City v. Winebrenner Ford, Inc.
Pending formal City Council approval, the case has been settled for $120,000.00.
Pursuant to the proposed settlement agreement, the City Attorney's Office is holding
Winebrenner Ford's check to the City in the amount of $173,504, which is the
amount of the original condemnation award over the settlement amount.
