ORDINANCE BY CHANGING THE ZONING
DESIGNATION OF ONE PARCEL OF CITY OF

FAMILY, TO P, PUBLIC.
WHEREAS, the property at 3800 Napoleon Lane,
owned by the City of Iowa City, is currently zoned
Interim Development Residential Multi-Family (ID-
RM); and
WHEREAS, Section 14-61-7B requires that land
owned by a governmental entity shall be zoned P,
Public; and
WHEREAS, the City of Iowa City has initiated the
rezoning of one parcel of property owned by the
City of Iowa City from its current zoning designation
to P, Public; and
WHEREAS, the zoning classification Public, P,
serves as a notice function to those owning or
buying land in proximity to publicly owned land.
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA:
SECTION I. APPROVAL. The parcel described in
Exhibit A is hereby reclassified from its current
zoning designation to P, Public.
SECTION II. REPEALER. All ordinances and
parts of ordinances in conflict with the provisions of
this Ordinance are hereby repealed.
SECTION III. SEVERABILITY. If any section,
provision or part of the Ordinance shall be adjudged
to be invalid or unconstitutional, such adjudication
shall not affect the validity of the Ordinance as a
whole or any section, provision or part thereof not
adjudged invalid or unconstitutional.
SECTION IV. EFFECTIVE DATE. This
Ordinance shall be in effect after its final passage,
approval and publication, as provided by law.

BACKGROUND INFORMATION:
To update the zoning map, the City of Iowa City is initiating the rezoning of a property owned by
the City and located at 3800 Napoleon Lane to bring it into compliance with Section 14-61 of the
zoning ordinance. Section 14-61 states that land acquired by the government of the United States,
the state or a political subdivision thereof, shall retain its existing zoning until such time as the
zoning map is amended to designate such land a public zone.

The City of Iowa City purchased this property with the intention of constructing a new Public
Works facility. This facility will contain a number of buildings and storage areas for administrative
offices, work shops, equipment and material warehousing. There will be one access point to
Gilbert Street as well as two access points to Napoleon Lane.
ANALYSIS:
The parcel is owned by the City of Iowa City. As stated in the intent of the public zone, land owned
or otherwise controlled by the federal government, the state, the county, the city and the Iowa City
Community School District will be designated a public zone. The public zone serves as a
notification for those owning or buying land in proximity to publicly-zoned land, that the land is
currently controlled by a public entity.
3800 Napoleon Lane is zoned Interim Development Residential Multi-Family (IDRM). The property
is currently undeveloped with the exception of three storage buildings. A new Public Works facility
is planned for the site, to be constructed this year.
The proposed development for the site appears to appropriately address its surroundings.
Vegetative screening and building setbacks are provided to help conceal the facility from the
public street as well as adjacent land uses. The project fits the character of the existing Napoleon
Park parking area and will act as a continuation of that public facility, which includes softball fields,
the Parks and Recreation maintenance building, and a sewer pump station.
STAFF RECOMMENDATION:
Staff recommends that REZ00-0017, a request to rezone approximately 20.78 acres of property
from Interim Development Residential Multi-Family, IDRM, to Public, P, for property located at
3800 Napoleon Lane be approved.

ORDINANCE AMENDING THE ZONING CHAPTER BY CHANGING THE ZONING DESIGNATION FOR
APPROXIMATELY 35.15 ACRES LOCATED AT THE NORTH TERMINUS OF KENNEDY PARKWAY BY
APPROVING A SENSITIVE AREAS OVERLAY DEVELOPMENT (OSA-I) PLAN FOR PARTS 8, 9 AND t 0
OF WALNUT RIDGE, IOWA CITY, IOWA.
WHEREAS, the applicant, Southgate Development Co. on behalf of property owners Dorothy J. Kisner &
John W. and Barbara Kennedy, have requested that the City rezone approximately 35.15 acres of property
located at the north terminus of Kennedy Parkway by approving a Sensitive Areas Overlay Development
(OSA) for Parts 8, 9 and 10 of Walnut Ridge, Iowa City, Iowa; and
WHEREAS, the proposed rezoning will allow residential development on the subject property similar in
character to that which exists on adjacent properties; and
WHEREAS, the property contains protected slopes and woodlands that will be protected by a
conservation easement; and
WHEREAS, replacement trees will be planted as approved by the City Forester; and
WHEREAS, the Department of Planning and Community Development and the Planning and Zoning
Commission have reviewed the proposed rezoning and Sensitive Areas Overlay Development (OSA) plan
and recommend approval; and
WHEREAS, it is the intent of the Council that the property remain subject to the terms and conditions of the
Conditional Zoning Agreement approved on January 8, 1991 by Ordinance 91-3485, and recorded in Book
1197, Page 107 of the Johnson County Recorders Office.

E. No provision for public sidewalks adjacent to streets within the subdivision, except Kennedy Parkway.

the proposed right-of-way. This walk shall be continuous from a point on Melrose Avenue to the point
where Kennedy Parkway intersects the west boundary of the subdivision.
SECTION III. ZONING MAP. The Building Inspector is hereby authorized and directed to change the
zoning map of the City of Iowa City, Iowa, to conform to this amendment upon the final passage, approval
and publication of this Ordinance as provided by law.
SECTION IV. CERTIFICATION AND RECORDING. After passage and approval of the Ordinance, the
City Clerk is hereby authorized and directed to certify a copy of this Ordinance for recordation in the Office of
the County Recorder of Johnson County, Iowa, at the Applicant's expense, all as provided by law.
SECTION V. REPEALER. All ordinances and pads of ordinances in conflict with the provisions of this

BACKGROUND INFORMATION:
Development of Walnut Ridge began in 1990 when an Overlay Planned Development
Housing Plan was approved to allow 104 single-family lots on 168 acres. Subsequently
parts 1 to 7 have been final platted and mostly developed. The property was zoned OPDH-1
to allow streets which did not meet City design standards in terms of width and sidewalks.
Given the large lots and low density {less than 1 unit per acre), it was thought that full City
design standards were not necessary. The applicant is now requesting approval of the
preliminary plat for parts 8, 9 and 10. Because the previously approved OPDH plan has
expired and the property contains woodlands, critical and protected slopes, a Sensitive
Areas Overlay (OSA-1) rezoning is required.
ANALYSIS:
Comprehensive Plan: The development of this property for 23 large lots appears to be in
compliance with Comprehensive Plan and compatible with the existing Walnut Ridge
neighborhood.
Sensitive Areas: The northwest portion of the property contains a woodland, critical
slopes and protected slopes. The Sensitive Areas Development plan should be
accompanied by a grading plan to allow staff to assess the affect of the proposed
development on the sensitive areas. The plan should show how grading will be minimized
in areas of steep and critical slopes. It does not appear that any development activity is
proposed in the areas of protected slopes but grading is proposed in areas of critical
slopes (25-40%). The plan should identify the required buffers around the protected
slopes.
The sensitive areas ordinance requires that 70% of a woodland be retained in the Rural
Residential (RR-1) zone, which is the underlying zone for this Planned Development
Overlay. The plan should clearly delineate the woodland areas that will be preserved and
the required 50-foot buffer. The plan should detail the methods that will be used to
protect the trees during construction. This should include fencing along the required
buffer and a pre-construction meeting between the grading contractor and the City's
Development Regulation Specialist.
The plan currently notes that the protected woodlands will be regulated by a homeowner's
association. More specific information regarding how the homeowner's association will
assure the long-term protection of the woodlands is necessary. Because the woodlands
and slopes are located partially on Outlot°O and partially on individual lots, staff
recommends that a conservation easement be established to assure the preservation of
these areas. A conservation easement will need to be approved as part of the legal papers
for the final plat.
The Office of the State Archeologist has indicated that there are several archeological
sites in this general area, but there does not appear to be any identified sites within the
area of Walnut Ridge, Parts 8-10.
Subdivision Design: At the time of approval of the earlier parts of Walnut Ridge concerns
regarding street design and secondary access were resolved. The current plan follows the

concept plans reviewed at that time. With the construction of Part 9, Kennedy Parkway
will be a stub street that will be available to provide access to the property to the west.
When the land to the west is developed secondary street access can be provided to Deer
Creek Road.
Modifications to City street standards where approved for earlier parts of Walnut Ridge.
These modifications should also apply to parts 8-10. These include:
1. Reduction of the right-of-way width of Kennedy Parkway, a collector street, form 66
feet to a minimum of 60 fee.
2. Modification of The City's street standards and specifications for collector streets to
permit a pavement width of 28 fee, back of curb to back of curb, for the undivided
portions of Kennedy Parkway. Where the two lanes of this street are separated by
islands, each of the divided lanes shall be a minimum of 22 feet back of curb to back of
curb.

curb to back of curb.

5. No requirement for public sidewalks adjacent to the streets within the subdivision,
except Kennedy Parkway.
6. Kennedy Parkway shall have a four-foot wide sidewalk, constructed by the developer

Open space: Requirements of neighborhood open fees were satisfied with Parts 6 and 7.
Storm water management: Given the low density of development storm water management
requirements have been waived for Walnut Ridge.
Utilities: The sanitary sewer line located between lots 88 and 89 should be moved to street
right-of-way to allow better access for service and repairs. The sanitary sewer line in
Kennedy Parkway should be extended to the west property line. The tap-on fees for sewer
are 91 ,345.12 per acre. A water main extension fee of 9395 per acre is required.
STAFF RECOMMENDATION:
Staff recommends that Sensitive Areas Overlay and preliminary plan to Walnut Ridge Parts
8,9 and 10 be deferred pending resolution of the following deficiencies and discrepancies.
Upon resolution of these items staff recommends approval of REZO0-O013 and SUB00-
0010 an application from Southgate Development for a rezoning form Planned
Development Housing Overlay (OPDH-1) to Sensitive Areas Overlay (OSA-1) and a
preliminary plat of Walnut Ridge Parts 8-10, a 35.15-acre, 23-1ot residential subdivision
located on Kennedy Parkway subject to a conservation easement for the long-term
protection of the woodlands and protected slopes.
DEFICIENCIES AND DISCREPANCIES:
1. The plan should be accompanied by a woodland protection plan illustrating that 70% of
the woodlands and the required 50-foot buffer be maintained.

2. A grading plan should be submitted.
3. The sanitary sewer line located between lots 88 and 89 should be moved to the street
right-of-way.
4. The sanitary sewer line in Kennedy Parkway should be extended to the west property
line.
5 The outlots should be labeled as common open space.

We have received a revised Sensitive Areas Development Plan for Walnut Ridge, Parts 8-10.
Staff is in the process of reviewing the revised plan and should have a complete evaluation
prior to the Commission's formal meeting.
There are two major items that have yet to be resolved. The City Forester and Development
Regulation Specialist have inspected the site and believe that due to grading that has already
occurred, the root systems of some of the trees within the tree protection and buffer areas have
been damaged. It is likely that these trees will die prematurely. Therefore these trees can not
be counted toward the trees to be retained. We have asked the applicant to have a tree
specialist or qualified landscape architect perform an evaluation and identify the trees that have
been affected by the grading. The City Forester will then review their report. Those trees that
are not likely to survive will be not be included in the tree retention calculations and replacement
trees will need to be planted at a ratio of 1 tree for every 200 square feet of woodland that has
been disturbed.
Staff recommends that a conservation easement be established to assure the long-term
protection of the remaining woodlands and the protected slopes. The applicant has proposed

The applicant has submitted an estimation of the number of trees that received root damage as
a result of the grading on the site (copy attached). Based on these estimates 60 replacement
trees are required. The City Forester has been on vacation and has not been able to revisit the
site. He plans to do so prior to the July 6th meeting and we should have his assessment at that
time.
The applicant proposes that trees planted in previous parts of Walnut Ridge be counted toward
the replacement requirement. The intent of requiring replacement trees is to discourage the
removal of existing woodlands. If previously planted trees were to be counted as replacement
trees then the disincentive to remove trees would be diminished. Therefore the trees planted
prior to the approval of Walnut Ridge, Parts 8-10 may not be counted as replacement trees.
The applicant will need to identity how replacement trees will be planted on this property. If the
City Forester concurs with the applicant's estimates, then 60 trees (less then 3-replacement
trees per lot) will be required.
Staff continues to recommend that a conservation easement be established to assure the long-
term protection of the remaining woodlands and the protected slopes. The applicant has

Woodland Mitigation Calculations
Dear Bob:
The square footage of trees remaining between the 50' buffer limit line/grading limit line and the
tree prese~ation line has been calculated at 48,261 s.f.. This area is a result of the latest design
on the prelimina~ plat and grading plan submitted to the ci~. The intent of the design is to not
remove anymore existing trees during development of these lots. The plus call for the
installation of or~ge safe~ fence the entire length of the 50' buffer limit line / grading line and
substantial silt fence to be placed prior to grading for ~ee protection. Along with a pre-
cons~ction meeting with the Development Regulation Specialist ~d the above mentioned
fencing it is the intent to minimize any fu~her dinage to the existing ~ees. It is safe to assume
that some trees will still be damaged do to the grading occuging in their root zone and eventually
could lead to their death. Assuming that the development occurs as plged ~d fencing is
installed ~d maintained per plans, the damage h~ been estimated at 25% of the 48,261 s.f. or
12,065 s.f. Using a replacement figure of 1 tree / 200 s.f., 60 trees need to be planted to mitigate
for the loss due to this development. To date over 400 trees have been planted by the developer,
in p~s One Seven, a percentage of these trees could be counted tow~ds the required

The City Forester has visited the site and reviewed the material submitted by the applicant. He
accepts the applicant's estimates and concurs that 60 replacement trees should be planted. In
accordance with the Sensitive Areas Ordinance he recommends that trees similar to those
which are located in the existing woodlands be planted in the buffer zone. The recommended
species are: Bur Oak, White Oak (not including Swamp Oak), Red Oak, Hack Berry, Wild Black
Cherry, American Linden (not Little Leaf Linden) and Hickory. Some of the replacement trees
could also be planted in public areas such as the street median.
Staff recommends the approval of REZ00-0013 and SUB00-0010 a rezoning from OPDH-1 to
OSA-I and a preliminary plat of Walnut Ridge Parts 8-10, a 35.15, 23-1ot residential subdivision
located on Kennedy Parkway subject to the final plat including a City Forester approved tree
replacement plan including 60 forest trees to be located within the tree protection buffer and/or
the street medians of parts 8-10, and a conservation easement to assure the long-term
protection of the woodlands and the protected slopes.
