We feel that it is our job to advocate for issues that affect access to the library and convenient parking is the number one access concern for library users. Although the Council was not prepared at this time to formally hold lot 64- 1A for continued use as a surface parking lot, we will continue to advocate for some parking adjacent to the library either as a surface lot, or part of any development- In the meantime we hope to work with you and city staff to implement some of the other options discussed at our meeting. In the next six months we hope to bring you a recommendation for designating parking space in the surface lot and the Dubuque Street ramp for those holding special library parking permits (similar to what has been done in the Chauncey Swan Ramp for the Senior Center). We also would like to see angled parking in the 100 block of Linn Street, This was added recently to the 200 block and also on College Street. Metered parking in front of the Library should be designated at thirty minutes to encourage frequent turnover and availability for short term visits. We expect to further discuss these issues and forward specific recommendations on, or ask for another joint session. In the meantime if you have any questions please let me know. The second occasion is on August 26, 2000 at a ceremony celebrating both the 80th Anniversary of the 19th Amendment and Emma J. Harvat. The festivities begin at 1 lam in front of the old City Hall bell outside of the Civic Center. Our rain location will be inside the Council Chambers. This ceremony will include remarks by Linda Kerber, a professor at the UI who will talk about the historic implications of the sufferage movement and how Emma J. Harvat fit into that historical context. The other part of the ceremony will mark women's achievements in civic and political life, both nationally and locally, decade by decade from 1920 until the present. You are all invited to come to this celebration of 80 years ofwomen's fight to vote. At your last informal meeting you discussed the original request to name the Civic Center after Emma J. Harvat. This is an opportunity for people to come to the Airport and learn about aviation. There will be several static displays, as well as equipment from our Fire and Police Departments. Iowa City Flying Service will be offering airplane rides for a small fee. If the weather is good, we could have as many as 100 aircraft fly in for the breakfast. About 3,000 to 5,000 people usually attend the event. I would like to extend an invitation to you and the Council to come to the fly-in. If you or any of the Council members would like to help with the breakfast, I 'm sure SERTOMA would appreciate an hour or two of your time. Breakfast is served from 7:00 a.m. to 1:00 p.m. It is my understanding that at least you and Mike are veterans in the art of making pancakes. As a reminder, Iowa City will host Fly Iowa 2001 on August 25 and 26, 2001. This is a statewide celebration of aviation. When Iowa City hosted the first Fly Iowa in 1991, 8,000 to 10,000 people artended the event. Planning is well underway and it should be a great weekend. The Airport Commission appreciates the support from the Council in helping to make this one of the best general aviation airports in the state. We, however, are concerned about the safety of our children and the Benton Street traffic. We fear the children will be tempted to cross Benton Street to enter the park before and after school. Being that the traffic on Benton Street is extremely busy and the entrance to the park sits on the hill, we would like the Iowa City City Council to consider measures to make Benton Street a safer street to cross at this location. Some measures could be a foot overhead pass, speed bumps, a walk light, a crossing guard, or to not put in a sidewalk on this side of the street. Thank you for your consideration. Unless directed otherwise by the City Council, this action will occur on or shortly after August 16, 2000. Unless directed otherwise by the City Council, this action will occur on or shortly after August 16, 2000. Action: Pursuant to Section 9-1-3A(14), a parking space for the exclusive use of persons with disabilities will be designated at metered space W237E on the south side of the 200 block of East Washington Street. Comment: This action is being taken following a survey of all on-street handicapped parking spaces in the downtown area. A threshold is established of 60% usage during the period of metered enforcement, typically 8:00 a.m. to 5:00 p.m. Any space which has greater than 60% usage justifies an additional handicapped-only space. In the 200 block of East Washington Street there are two existing on-street handicapped parking spaces; one with 84% usage and one with 54% usage. Based on these figures, a space is being added. The reconstruction to meet specifications of the Americans with Disabilities Act is being done by the existing downtown streetscape contractor. It states: "For violations of the NPDES permit limits after November 1, 1999, including interim limits in this order, the following stipulated penalties shall apply: a. The City will pay penalties of $100 per mg/L per week in excess of the permitted 7-day maximum and $100 per mg/L per month in excess of permitted 30-day average for CBOD and TSS in the final effluent of the treatment plants. b. The City will pay penalties of $1.20 per pound/day in excess of permitted daily maximum, and $1.20 per pound/day per month in excess of permitted 30-day average' for ammonia nitrogen in the final effluent of the treatment plants. Please refer to the attached work sheets for the stipulated penalties that are assessed for effluent violations that occurred at the South plant during the months of November and December 1999, and March and April 2000. No violations were reported for the North plant. The total stipulated penalty for effluent violations due for November and December 1999, and March and April 2000 is $9,594. Washington St. [OV'vt/ Iowa City, IA 52240 Re: Public measure regarding First Avenue extension Dear Members of the Council: I am in the process of reviewing the public measure to be placed on the November 7 General Election ballot regarding the First Avenue extension project. Resolution 00- 183 of the City Council authorized and directed me to place the following question on the ballot: Shall the following public measure be adopted? Yes No The grading and paving for the First Avenue Extension shall be deleted from the Iowa City Capitol Improvements Program. Section 49.44 of the Iowa Code, states in part: "The commissioner may prepare a summary for public measures if the commissioner finds that a summary is needed to clarify the question to the voters." When the First Avenue question was voted upon previously in 1997 1 provided such a summary. While recognizing that Iowa City and Johnson County have some of the most sophisticated and well-educated voters anywhere I remain concerned about the clarity of the language. This is in part due to the nature of the November 7th election together with the fact that the library bond issue will be included on the same ballot and the additional possibility of the inclusion of a county jail bond issue. These factors together with the construction of the First Avenue ballot question language have the potential to increase the possibility that a vote could be cast contrary to the voter's intentions. The nature of the November 7th election pertinent to this subject is that the turnout is very large relative to regular elections of the City of Iowa City. In the 1999 Iowa City General Election 7,842 votes were cast. I estimate that turnout on November 7th for the City of Iowa City alone could well be in excess of 28,000 votes. This would amount to a 250% increase or 20,000 more voters casting ballots who would have the opportunity to vote on all three ballot issues than voted in the last Iowa City General Election. Some of these voters may not have the same level of interest in or knowledge about Iowa City issues as those who regularly vote in City of Iowa City General Elections. This fact adds emphasis to the concern and importance in every election for clarity in ballot language. Yet on the same ballot the voter would vote yes to vote in favor of the library bond issue and no to vote against it. And if the jail bond issue is placed on the ballot the same voter would vote yes to vote for the jail or no to vote against the jail. Put another way, for two of the ballot questions a yes vote would mean yes and a no vote would mean no, but for the First Avenue Extension a yes vote would mean no and a no vote would mean yes. My statutory options for summarizing for clarity would allow me to permit the voter to vote yes when they meant yes regarding the First Avenue Extension and to vote no when they meant no. But at the same time I would have to choose whether to also include the opposite City of Iowa City ballot language on the ballot or, alternatively to post it inside each Iowa City voting booth. So such an action would be pointless. Since I have voiced my concems about the proposed wording of the measure, representatives of the committees on both sides of the issue have contacted me, stating that they have already invested time and money educating citizens about the issue. They are opposed to any changes in the wording of the public measure. However, I do see value in consistency and clarity in ballot language, and believe it is in the best interests of everyone concerned that the question be stated in the clearest possible manner. So I suggest that the council consider changing its proposed ballot language for the First Avenue Extension so that a yes vote would decide in favor and a no vote would decide against. If the council is willing to do this and able to re-certify ballot language by Augx~st 30, 2000 1 would be willing to summarize the language consistently with the other ballot issues and with the common sense understanding that a yes means in favor and a no means against. If the council is not interested in doing this, is unable to do it by August 30tn, or feels constrained by the City Charter, I will not summarize the ballot language. Other than my single objection, it is clear, concise and well written. If these issues cannot be addressed now, I hope consideration will be given to them in the future. County Rezoning Request for Property Located East of Dane Road and West and South of the Lake Ridge Mobile Home Park Dear Sally and Members of the Board: Johnson County has received an application from J.E.B.B., LC, to rezone an approximate 125.43 acre parcel located east of Dane Road and west and south of the Lake Ridge Mobile Home Park from A1, Rural, and RS, Suburban Residential, to RMH, Manufactured Housing Residential. The property lies within Fringe Area C and within the City's adopted growth area. At its July 6, 2000, meeting, the Iowa City Planning and Zoning Commission recommended, by a vote of 6-0, that the City Council forward a letter to the Board of Supervisors recommending denial of the requested rezoning due to its non-compliance with the Fringe Area Agreement, Iowa City's Comprehensive Plan, and the Johnson County Land Use Plan. The Commission further recommended that if the County is inclined to approve the rezoning request, that the Council and Board meet to discuss the relationship of the Fringe Area Agreement to this particular request as well as the future of the agreement itself. The Commission believes that, in pad, the intent of the Fringe Area Agreement is to ensure that urban density growth occurs within the City, built to urban development standards, and with the benefit of City sewer and water and other City services, and that growth in the County occur at densities more appropriate for a rural setting and be directed away from prime agricultural areas and environmentally sensitive areas. The proposed development plan does not appear to comply with the development policies of the Fringe Area Agreement for Area C, and the applicant has not agreed to develop the property in accordance with City development standards. The development of this parcel without annexation may inhibit the City's ability to serve and annex other propedies within its growth area. The development of the subject property without annexation will result in a substantial population being served by a private sewage treatment plant when a modern publicly operated treatment facility is available by 9ravity flow. The proposed rezoning is not consistent with many aspects of Iowa City's Comprehensive Plan or the Johnson County Land Use Plan. The lack of a useable secondary access for residents of the development, the amount of grading that will likely be required to implement the concept plan, and uncertainties regarding storm water management are also of concern. The attached staff report provides more details regarding these issues and the reasons for the Commission's recommendation of denial. Based on the above reasoning, Council agrees with the recommendation of the Planning and Zoning Commission, and there.fore respectfully forwards a comment to the Board that the requested rezoning of approximately 125.43 acres from A1 and RS to RMH is not consistent with the policies of the Fringe Area Agreement, the Iowa City Comprehensive Plan, or the Johnson County Land Use Plan.
