ITEM NO. 4. PLANNING AND ZONING MATTERS.
a. Consider an ordinance conditionally amending the approved sensitive areas
development plan for Lot 52 of Walden Hills, a 4.89 acre property located on the
west side of Shannon Drive, south of Willow Creek. (REZO0-0005/SUB00-0016)
(First Consideration)
Comment: At its August 3 meeting, by a vote of 6-0, the Planning and Zoning
Commission recommended approval of the proposed amended sensitive areas
development plan, subject to compliance with all applicable provisions of the 1997
conditional zoning agreement that apply to Lot 52 and the retention of evergreen
trees planted along the Highway 218 frontage of the property as required by the
1997 sensitive areas development plan. Staff recommended approval subject to
these conditions in a report dated July 6.
b. Consider an ordinance designating the property located at 13 S. Linn Street as an
Iowa City Historic Landmark. (REZO0-0019) (First Consideration)
Comment: At its August 3 meeting, by a vote of 6-0, the Planning and Zoning
Commission recommended approval of the proposed landmark nomination. The
Historic Preservation Commission recommended approval of the designation by a
vote of 8-0 at its July 13 public hearing on this item. Staff recommended approval
in a memo dated August 3.
o~-~ c. Consider an ordinance rezoning 20.78 acres from Interim Development Multi-
Family (ID-RM) to Public (P) for property located west of Gilbe~ Street south of
Napoleon Lane. (REZO0-0017) (Pass and Adopt)
Comment: At its June 15 Meeting by a vote of 6-0 the Planning and Zoning
Commission recommended approval. Staff recommended approval in a staff report
dated June 15.

Overlay (OPDH-1) to Sensitive Areas Overlay (OSA~I) and approving the
preliminary sensitive areas development plan for Walnut Ridge, Part 8-10, a 22-1ot
residential subdivision located on Kennedy Parkway. (REZO0-O013) (Pass and
Adopt)
Comment: At its July 6 meeting by a vote of 5-0, the Planning and Zoning
Commission recommended approval subject to the final plat application including a
City Forester-approved tree replacement plan and a conservation easement to
assure the long-term protection of the woodlands and protected slopes. Staff
recommended approval subject to the tree replacement plan and conservation
easement.
f. Consider a letter to the Johnson County Board of Supervisors recommending denial
of a rezoning of 125.43 acres located within Fringe Area C east of Dane Road and
west and south of the Lakeridge Mobile Home Park from County A1 Rural and RS
Suburban Residential to County RMH Manufactured HOusing Residential. (CZ0027)
Comment: At its June 15 meeting by a vote of 6-0 the Planning and Zoning
Commission recommended denial of this rezoning due to its non-compliance with
the Fringe Area Agreement, the Iowa City Comprehensive Plan, and the Johnson
County Land Use Plan. The Commission also recommended that if the Board
entertains approval of this rezoning then the Board and City Council should meet to
discuss merits of the proposal with relationship to the Fringe Area Agreement and
the Future of the agreement. Staff recommended denial in a report dated
June 9. Deferred on July 18, August 1, August 15, September 12.

ITEM NO. 5. CONSIDER A MOTION TO ACCEPT THE FORM OF TAX EXEMPTION CERTIFICATE
PERTAINING TO THE $12,000,000 SEWER REVENUE BONDS.
Comment: This certificate is executed and delivered in connection with the issuance
by the City of $12,000,000 Sewer Revenue Bonds. This certificate sets out in detail
a number of facts, promises and obligations which must be met and agreed to by the
City in order to maintain these bonds as tax exempt.
ITEM NO. 6. CONSIDER A MOTION TO ACCEPT THE FORM OF CONTINUING DISCLOSURE
CERTIFICATE PERTAINING TO THE ~12,000,000 SEWER REVENUE BONDS.
Comment: This certificate is executed and delivered in connection with the issuance
by the City of Iowa City of ~12,000,000 Sewer Revenue Bonds. The disclosure
certificate is being executed and delivered for the benefit of the holders and beneficial
owners of the bonds and in order to assist the participating underwriters in complying
with the Securities Exchange Commission (SEC) Rule 15c2-12(b)(5).
ITEM NO. 7. CONSIDER A RESOLUTION AUTHORIZING AND PROVIDING FOR THE ISSUANCE
oo- ~ZD AND SECURING THE PAYMENT OF ~12,000,000 SEWER REVENUE BONDS, SERIES
2000, OF THE CITY OF IOWA CITY, IOWA, UNDER THE PROVISIONS OF THE CITY
CODE OF IOWA, AND PROVIDING FOR A METHOD OF PAYMENT OF SAID BONDS.
Comment: This resolution provides final authorization for issuance of the $12,000,000
Sewer Revenue Bonds.
ITEM NO. 8. CONSIDER A RESOLUTION APPROVING THE 2000-2001 DEER MANAGEMENT PLAN.

on the long-term plan approved by Council in March of 1998. At its August 30,
2000, meeting, by a vote of 9-0, the Deer Management Committee recommended a

ITEM NO. 14. CONSIDER A RESOLUTION REPEALING THE RESOLUTION ESTABLISHING THE IOWA
DO -" -~?-, d~ CITY RIVERFRONT AND NATURAL AREAS COMMISSION.
Comment: In recent years, the responsibilities of the Riverfront and Natural Areas
Commission have been assigned to other commissions or committees in recent years
in addition to experiencing a difficult time with membership. The Commission is
currently down to four members out of ten. The Commission has discussed dissolving
unless the City Council sees a need for the Commission to continue. A letter from the
Commission is attached. Letter of resignation from Lynn Rose included in Council
packet.

Item No. IS Consider a resolution approving the settlement of pending
DC>-- ~Z5 litigation.
Comment: This resolution approves a settlement agreement in connection
with the appeal filed by Sycamore Apartments, Sycamore Farms
and Lake Calvin Properties of awards made by the Compensation
Commission for condemnation of property and temporary
construction easements in connection with the South Sycamore
Regional Greenspace and Drainage Corridor Project. The
agreement addresses a number of matters relating to the owners'
remaining property and access thereto.
