Comment: This project involves upgrading and repairing the

to fund the site-specific design for the public improvement, make
the final selection of the route or site selection for the public

Comment: This project includes full and partial depth patching,

east from this point to Scott Boulevard. This work will extend the
life of the pavement.

Comment: The City of Iowa City, through the Iowa City Housing
Authority, has created the Affordable Dream Home Opportunities
Program (ADHOP) using funds received from the sale of public
housing units. The City is required to reinvest such proceeds to
expand affordable housing opportunities in Iowa City. The
Housing Authority intends to build a single-family home under
this program on a lot located on Dickenson Lane in Iowa City.
Families who earn up to 80% of median income may qualify to
purchase the home after it is completed.

ITEM NO. 6. PLANNING AND ZONING MATTERS.
a. Consider a motion setting a public hearing for November 21 on an
ordinance vacating the northernmost 60 feet of the dead-end alley
along the west property line of 405 South Summit Street. (VAC00-
0001 )
Comment: At its May 4 meeting, by a vote of 5-0, the Planning and
Zoning Commission recommended approval of the vacation proposal.
Staff recommended approval in a report dated April 6. This item has
been postponed since May to give the adjacent property owners time
to complete a plat of survey of the area. The adjacent property
owners have now provided a plat of survey and legal description of the
right-of-way proposed to be vacated.

b. Consider an ordinance amending an approved OPDH-12 plan to allow
a 40-unit assisted living building on 2.87 acres located on the

Comment: At its September 21 meeting, on a vote of 7-0, the
Planning and Zoning Commission recommended approval of the
revised OPDH-12 plan. Staff recommended approval in a report dated
September 7.

c. Consider an ordinance amending the zoning chapter by changing the
zoning designation from low-density multi-family residential (RM-12) and
neighborhood conservation residential (RNC-20) to medium -density
single-family residential (RS-8) and neighborhood conservation
residential (RNC-12) for four properties on the south side of the 900
block of Iowa Avenue, 17 properties on the 900 and 100 blocks of
Washington Street, 10 properties on the 100 and 200 blocks of south
Summit Street, four properties on the east side of the 10 and 100 blocks
of Governor Street, three properties on the west side of the 1000 block
of Muscatine Avenue, and five properties on the 900 and 1000 blocks of
College Street. (Second Consideration)
Comment: At its August 17 meeting, by a vote of 1-5 with Hanson
voting yes, the Planning and Zoning Commission recommended denial
of rezoning the entire area to RS-8. The Commission voted 5-1, with
Ehrhardt voting no, to recommend rezoning the 11 properties north of
Washington Street and west of Muscatine Avenue from RM-12 to RS-
8, and to rezone the remainder of the rezoning area from RNC-20 and
RM-12 to Neighborhood Conservation Residential, RNC-12. The
Commission's recommendation is consistent with staff's
recommendation in a report dated August 3.

d. Consider an ordinance amending the non-conforming use provisions
of the Neighborhood Conservation Residential, RNC-12 zone, to make
it clear any existing conforming multi-family use would continue to be
conforming under the RNC-12 zone. (Second Consideration)
Comment: At its August 17 meeting, by a vote of 6-0, the Planning and
Zoning Commission recommended approval of the proposed
amendment. Staff recommended approval in a memorandum dated
August 17.

recommending denial of a rezoning of 125.43 acres located within
Fringe Area C east of Dane Road and west and south of the Lakeridge
Mobile Home Park from County A1 Rural and RS Suburban
Residential to County RMH Manufactured Housing Residential.

Comment: At its June 15 meeting by a vote of 6-0 the Planning and
Zoning Commission recommended denial of this rezoning due to its
non-compliance with the Fringe Area Agreement, the Iowa City
Comprehensive Plan, and the Johnson County Land Use Plan. The
Commission also recommended that if the Board' entertains approval
of this rezoning then the Board and City Council should meet to
discuss merits of the proposal with relationship to the Fringe Area
Agreement and the Future of the agreement. Staff recommended
denial in a report dated June 9. Deferred on July 18, August 1, August
15, September 12, September 19, October 3, and October 17.

a 14.48 acre, 9-lot residential subdivision located on Kennedy

Comment: At its September 7 meeting, by a vote of 6-0, the Planning
and Zoning Commission recommended approval of the proposed plat
of Walnut Ridge Parts 8, 9, and 10, subject to the approval of legal
papers and construction drawings prior to Council approval. Staff
recommended approval in a report dated September 7. The applicant
has requested the final plat of Walnut Ridge Part 8 be considered for
approval, while Walnut Ridge Parts 9 and 10 be deferred.

COST FOR THE CONSTRUCTION OF THE WASHINGTON STREET
TRANSIT INTERCHANGE PROJECT, PHASE 2.
Comment: This building is being constructed to provide a downtown
information and pass sales area to better serve transit riders, a passenger
waiting area, and restrooms and a break area for transit drivers. It will be
approximately 600 square feet in size. The Engineer's estimate is
$120,000. This project is funded by the Transit Division cash balance.

ITEM NO. 8. CONSIDER AN ORDINANCE AMENDING TITLE 6, CHAPTER 1
(NUISANCES), OF THE CODE OF ORDINANCES OF THE CITY OF
IOWA CITY BY ADDING STANDARDS AND PROCEDURES FOR
REGISTRATION AND REGULATION OF ABANDONED/VACANT
BUILDINGS. (FIRST CONSIDERATION)
Comment: The proposed amendment to the City's Nuisance Code would
require property owners of buildings unoccupied for longer than 180
continuous calendar days to register their buildings with the City. The
purpose is to identify abandoned\vacant buildings so Police, Fire and
Housing Inspection services can ensure these buildings are secure,
maintained, safe, and don't become a danger to the public. The proposed
amendment also requires annual Housing Code inspections of the interior
and exterior of the premises, compliance with the Housing Code as well
as other City requirements, disclosure of all pertinent ownership
information, designation of an agent to act on behalf of an out-of-town
property owner to accept legal processes, payment of an annual fee
reasonably related to the administrative costs of the City, and submittal of
a plan or timetable to be approved by the City to bring the building into
compliance with applicable City Codes.

"DISCRIMINATORY PRACTICES," SECTION 2-3-2, ENTITLED PUBLIC
ACCOMMODATION; EXCEPTIONS" TO EXEMPT DISCOUNTS FOR
SERVICES OR ACCOMMODATIONS BASED UPON AGE FROM THE
PROHIBITION ON DISCRIMINATION IN PUBLIC ACCOMMODATIONS
(PASS AND ADOPT)
Comment: Upon the recommendation of the Iowa City Human Rights
Commission, this ordinance amends the Public Accommodation Section
of the City Code, §2-3-2A, to include a statement that this section does
not apply to discounts for services or accommodations based on age.
The Commission believes a change is necessary because discounts
based on age e.g. senior citizen discounts, can possibly be considered a
violation of the law as it currently stands. The recommended change is
included in the Cedar Rapids' Civil Rights Ordinance.

ITEM NO. 10. CONSIDER A RESOLUTION APPROVING THE PROPERTY TAX
~'~-.~'7-~ EXEMPTION APPLICATION FOR PROPERTY LOCATED AT 332 S.
LINN STREET, IOWA CITY, IOWA.
Gomment: Under the Near Southside Commercial Urban Revitalization
Plan, Gene L.C. has applied for property tax exemption for the
nonresidential commercial portion of the new construction located at 332
S. Linn Street, which was constructed during calendar year 2000. For a
period of ten years, the project will receive a declining percentage
exemption from taxation on the actual value added by the improvements.

ITEM NO. 11. CONSIDER A RESOLUTION TO ADOPT AMENDED BY-LAWS FOR
THE PUBLIC ART ADVISORY COMMITTEE.
Comment: At their September 27, 2000, meeting, the Public Art Advisory
Committee recommended by a vote of 5-1 (Nagle) to adopt amended by-
laws increasing the number of members of the committee to nine, with at
least three of the Council appointees being from the art or design
professions. At their October 23 meeting, the Rules Committee voted
denial of the recommendation.

ITEM NO. 12. CONSIDER A RESOLUTION AMENDING THE BUDGETED POSITIONS

DEPARTMENT AND THE AFSCME PAY PLAN BY DELETING THE
POSITION OF CENTRAL SERVICES CLERK.
Comment: It has been determined that it is more cost efficient to eliminate
the City's centralized office supply function and enable staff to purchase
office supplies directly from an on-line vendor, thereby reducing costs of
administration and storage of inventory. Current print shop equipment is in
need of replacement and an in-house study has determined that it would
be more cost effective to outsource the City's printing needs.

ITEM NO. 13. CONSIDER A RESO~~G THE BUDGETED POSITIONS~z~

AND THE AFSCME AND ADMINISTRATIVE PAY PLANS BY DELETING
THE POSITION OF SENIOR MAINTENANCE WORKER - LANDFILL
AND ADDING THE POSITION OF ASSISTANT SUPERINTENDENT -
LANDFILL.
Comment: The Landfill operation does not have an administrative
supervisor on site during most business hours. The Sr. Maintenance
Worker position has been relied upon to make "on the spot" decisions
regarding personnel issues, customer service complaint issues, and other
financial issues when needed. The growing costs, technical complexity,
and competitive markets of solid waste disposal/recycling at the Landfill
require more attention from an administrative level. The City will be better
served by having an administrative position, Assistant Landfill
Superintendent, available to concentrate on planning, personnel, cost
control, purchasing, and customer service for the landfill operation
specifically. The Superintendent of Wastewater/Landfill will continue to
work with the new position to ensure an efficient operation. Approximate
cost resulting from this change is $4,500.

IN THE LIBRARY AND THE AFSCME AND ADMINISTRATIVE PAY
PLANS BY DELETING THE POSITION OF MAINTENANCE WORKER III
- LIBRARY AND ADDING THE POSITION OF LIBRARY BUILDING
MANAGER.
Comment: In FY00 the Library added 2.25 full time equivalent employees
(three positions) to take over general building cleaning done for many
years by contract cleaning services. This move was made to assure
acceptable quality performance, which had not been the case for some
time with the contract service. The three people hired are managed and
supervised by the Library's Maintenance Worker III. This change reflects
increased job responsibilities. Approximate cost resulting from this
change is $3,400.

~D-~"7~ FAMILY HOME LOCATED AT 1905 GLEASON AVENUE TO THE
TENANT AND SETTING A PUBLIC HEARING FOR NOVEMBER 21,
2000.
Comment: The Iowa City Housing Authority, under its Tenant-to-
Ownership Program, proposes to sell 1905 Gleason Avenue to the
present tenant. The amount of the sale will be the appraised value of the
home, which is $93,000.00. The family has leased this single family home
from the Iowa City Housing Authority since November of 1999 and has
taken excellent care of the home during this time. The family received a
written commitment for a mortgage from a local bank in the amount of
$60,000.00 and have received a forgivable mortgage from the Federal
Home Loan Bank in the amount of $10,000.00. The City will provide a
second mortgage for the remaining $23,000.00. This sale will provide the
opportunity for a low-income family to obtain ownership of their own home.

ITEM NO. 16. CONSIDER A RESOLUTION AUTHORIZING THE ACQUISTION OF
PROPERTY INTERESTS NECESSARY FOR CONSTRUCTION OF THE
PRAIRIE DU CHIEN ROAD TO DODGE STREET WATER MAIN
PROJECT.
Comment: The City of Iowa City must acquire permanent water main
easements and temporary construction easements to construct the Prairie
Du Chien to Dodge Street Water Main Project. This resolution authorizes
City staff to negotiate and the Mayor to sign these documents, including
authorization of condemnation if necessary. Every effort will be made to
negotiate acceptable agreements without resorting to condemnation.
Prior to proceeding with condemnation, staff will notify Council.
ITEM NO. 17. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN
co- 3~,c, AND THE CITY CLERK TO ATTEST AN AGREEMENT BETWEEN THE
CITY OF IOWA CITY AN THE CITY OF CORALVILLE, IOWA TO USE A
PORTION OF PUBLIC LAND AND RIGHTS-OF-WAY FOR THE
INSTALLATION, OPERATION AND MAINTENANCE OF A
WASTEWATER EFFLUENT FORCE MAIN.
Comment: This agreement will allow the City of Coralville to install and
maintain a wastewater effluent force main within City of Iowa City property
and public-right-way. The area affected is Brookland Park, Greenwood
Drive and Myrtle Avenue. The effluent line route begins at Coralville's
wastewater treatment plant and extends to the Iowa River along a route
that generally follows the Iowa Interstate Railroad. Public Works and
Engineering recommend approval of the agreement with Coralville.

ENGINEERING CONSULTANT SERVICES FOR THE IOWA CITY
SANITARY LANDFILL.
Comment: This agreement authorizes Howard R. Green Company to
provide engineering services necessary for groundwater and surface
monitoring and annual water quality reports in accordance with State and
Federal regulations for a period of three years. The total cost of
engineering consultant services is $172,800. Funding will be provided by
landfill revenues.

Comment: This agreement authorizes Howard R. Green Company to
provide engineering services necessary for operation and monitoring of
the landfill gas collection system and to prepare reports in accordance
with State and Federal regulations for a period of three years. The total
cost of engineering consultant services is $147,950. Funding will be
provided by landfill revenues.
ITEM NO. 20. CONSIDER A RESOLUTION AWARDING CONTRACT AND

CONCESSION AND RESTROOM FACILITY.
Comment: Bids for this project were opened November 1, 2000 at 2:00
pm. The following bids were received:

Apex Construction, Iowa City $197,500
Muller Construction, Iowa City $215, 115
Reising Development Corp., Mt. Vernon $270,000
Consultant's Estimate $200,000
The Parks and Recreation Director recommends awarding the bid to
Moore Construction Company for the low bid of $175,900.

ITEM NO. 21. CONSIDER A RESOLUTION AUTHORIZING JOINT AGREEMENT
oo- 3~,~ BE'rWEEN THE IOWA CITY LIBRARY BOARD OF TRUSTEES AND
THE CITY COUNCIL OF THE CITY OF IOWA CITY TO COORDINATE
NEGOTIATING PROCEDURES FOR PURPOSES OF COLLECTIVE
BARGAINING.
Comment: The City is entering into labor contract negotiations with
AFSCME Local 183 for a new collective bargaining agreement to be
effective July 1, 2001. In the past, City negotiators have traditionally acted '
on behalf of the Library Board of Trustees whose employees constitute a
bargaining unit separate from other general employees of the City. This
arrangement has been in place since the inception of statutory bargaining
in 1975 and has worked satisfactorily. The Library Board is proposing that
it be continued in the current negotiations. Staff recommends adoption of
the resolution.
ITEM NO. 22. CONSIDER A RESOLUTION SUPPORTING THE EXPANSION OF THE
ao- ~,~3, , IOWA BEVERAGE CONTAINER DEPOSIT LAW.
Comment: This resolution formalizes the City Council's support for
proposed changes in the Iowa Beverage Container Deposit Law. Council
agreed at a prior work session that this item should be placed on your
agenda.
