ORDINANCE NO. 00-3950
ORDINANCE AMENDING CITY CODE TITLE 2,
ENTITLED "HUMAN RIGHTS," CHAPTER 3, EN-
TITLED "DISCRIMINATORY PRACTICES," SECTION
2-3-2, ENTITLED "PUBLIC ACCOMMODATION;
EXCEPTIONS" TO EXEMPT DISCOUNTS FOR
SERVICES OR ACCOMMODATIONS BASED UPON
AGE FROM THE PROHIBITION ON
DISCRIMINATION IN PUBLIC ACCOMMODATIONS.
WHEREAS, the Iowa City Human Rights Ordinance
includes age as a protected category in the area of
Public Accommodation; and
WHEREAS, discounts based on age are possibly a
violation of the Ordinance.
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY COUNCIL OF THE CITY OF IOWA CITY, IOWA:
SECTION 1. AMENDMENT. Title 2, entitled
"Human Rights," Chapter 3, entitled "Discriminatory
Practices," Section 2-3-2, entitled Public
Accommodations; Exceptions: is hereby amended as
follows:
1. Title 2, Chapter 3, Section 2-3-2 is hereby
amended by deleting Section A and substituting in lieu
thereof the following:
A. It shall be unlawful for any person to deny any
other person the full and equal enjoyment of the
goods, services, facilities, privileges, advantages of
any place of public accommodation because of age,
color, creed, disability, gender identity, marital status,
national origin, race, religion, sex or sexual orientation.
This section shall not apply to discounts for services or
accommodations based upon age.
SECTION 11. REPEALER. All ordinances. and
parts of ordinances in conflict with the provisions of
this Ordinance are hereby repealed.
SECTION III. SEVERABILITY. If any section,
provision or part of the Ordinance shall be adjudged to
be invalid or unconstitutional, such adjudication shall
not affect the validity of the Ordinance as a whole or
any section, provision or part thereof not adjudged
invalid or unconstitutional.
SECTION IV. EFFECTIVE DATE. This
Ordinance shall be in effect after its final passage,
approval and publication, as provided by law.
