(1) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST THE RELEASE OF LIENS REGARDING TWO REHABILITATION AGREEMENTS AND TWO STATEMENTS OF LIFE LIENS AND A MORTGAGE FOR THE PROPERTY LOCATED AT 527 CLARK STREET, IOWA CITY, IOWA. Comment: The owners of the property located at 527 Clark Street received assistance through the City's Housing Rehab Program for the amount of ~8,245. The financing was in the form of two conditional occupancy loans and one no interest loan. The loans were paid off on August 28, 2000; thus the liens can now be released. (2) CONSIDER A RESOLUTION ACCEPTING THE WORK FOR THE SANITARY SEWER, STORM SEWER, WATER MAIN, AND PAVING PUBLIC IMPROVEMENTS FOR WINDSOR RIDGE - PART TEN (WITH THE EXCEPTION OF THE PUBLIC IMPROVEMENTS WHICH SERVE LOTS 189-196), AND DECLARING PUBLIC IMPROVEMENTS OPEN FOR PUBLIC ACCESS AND USE. Comment: The Iowa Department of Transportation requires all municipalities to submit this report annually on or before September 30. Report available for review on the City Clerk's Office. f. Setting Public Hearings. oo - ,:5 t ?_ (1) CONSIDER A RESOLUTION SETTING A PUBLIC HEARING FOR OCTOBER 3 ON AMENDING THE FY2001 OPERATING BUDGET. Comment: This resolution sets a public hearing for October 3, 2000, to amend the FY2001 budget to carry over budget authority from FY2000 to FY2001 for capital improvement projects and other expenses that were either in process in FY2000 and not completed by FY2000 year end, or budgeted in FY2000 and delayed until FY2001. The City's policy is to amend the current budget at the beginning of each fiscal year for the continuation of projects from the prior fiscal year. g. Correspondence. PLANNING AND ZONING MATTERS. a. Consider a motion setting a public hearing for October 3 on an ordinance changing the zoning designation from Low Density Multi-Family Residential (RM-12) and Neighborhood Conservation Residential (RNC-20) to Medium Density Single-Family Residential (RS-8) for four (4) properties on the south side of the 900 block of Iowa Avenue, seventeen (17) properties on the 900 and 1000 blocks of Washington Street, ten (10) properties on the 100 and 200 blocks of South Summit Street, four (4) properties on the east side of the 10 and 1 O0 blocks of Governor Street, three (3) properties on the west side of the 1000 block of Street. Comment: At its August 17 meeting, by a vote of 1-5 with Hanson voting yes, the Planning and Zoning Commission recommended denial of rezoning the entire area to RS-8. The Commission voted 5-1, with Ehrhardt voting no, to recommend rezoning the 11 properties north of Washington Street and west of Muscatine Avenue from RM-12 to RS-8, and to rezone the remainder of the rezoning area from RNC-20 and RM-12 to Neighborhood Conservation Residential, RNC-12. The Commission's recommendation is consistent with staff's recommendation in a report dated August 3. Correspondence included in Council packet. September 12, 2000 City of Iowa City Page 5 b. Consider a motion setting a public hearing for October 3 on an ordinance amending the non-conforming use provisions of the Neighborhood Conservation Residential, RNC-12 zone, to make it clear any existing conforming multi-family use would continue to be conforming under the RNC-12 zone. Comment: At its August 17 meeting, by a vote of 6-0, the Planning and Zoning Commission recommended approval of the proposed amendment. Staff recommended approval in a memo dated August 17. Action: c. Public hearing on an ordinance conditionally 8mending the approved sensitive areas development plan for Lot 52 of Walden Hills, 8 4.8g acre property located on the west side of Shannon Drive, south of Willow Creek. Comment: At its August 3 meeting, by a vote of 6-0, the Planning and Zoning Commission recommended approval of the proposed 8mended sensitive areas development plan, subject to compliance with 811 applicable provisions of the 1997 conditional zoning agreement that apply to Lot 52 and the retention of evergreen trees planted 8long the Highway 218 frontage of the property as required by the 1997 sensitive areas developmen~ plan. Linn Street as an Iowa City Historic Landmark. Comment: At its August 3 meeting, by a vote of 6-0, the Planning and Zoning Commission recommended approval of the proposed landmark nomination. The Historic Preservation Commission recommended approval of the designation by a vote of 8-0 at its July 13 public hearing on this item. Staff recommended approval in a memo dated August 3. Action: e. Consider an ordinance rezoning 20.78 acres from Interim Development Multi- Family (ID-RM) to Public (P) for property located west of Gilber. t Street south of Napoleon Lane. (REZO0-0017) (Second consideration) Comment: At its June 15 Meeting by a vote of 6-0 the Planning and Zoning Commission recommended approval. Staff recommended approval in a staff report dated June 15. September 12, 2000 City of Iowa City Page 6 f. Consider an ordinance rezoning 35.15 acres from Planned Development Housing Overlay (OPDH-1) to Sensitive Areas Overlay (OSA-1) and approving the preliminary sensitive areas development plan for Walnut Ridge, Part 8-10, a 23-1ot residential subdivision located on Kennedy Parkway. (REZOO-OO13/SUBO0-O010) (Second consideration) Comment: At its July 6 meeting by a vote of 5-0, the Planning and Zoning Commission recommended approval subject to the final plat application including a CitV Forester-approved tree replacement plan and a conservation easement to assure the long-term protection of the woodlands and protected slopes. Staff recommended approval subject to the tree replacement plan and conservation easement. C)O - 39 L/LI g. Consider an ordinance to conditionally rezone 30.32 acres from County Suburban Residential (RS) to Low Density Single-Family Residential (RS-5) and 39.05 acres from County Suburban Residential (RS) to Interim Development Residential (ID-RS) for property located at the southwest corner of Lower West Branch Road and Taft Comment: At its May 18 meeting, by a e nd Zoning Commission recommended approval of the proposed rezoning, subject to the eventual development of the property being consistent with the policies in the Northeast District Plan, and the retention of a stone railroad bridge for public access use. Staff recommended approval in a report dated May 4. h. Consider a letter to the Johnson County Board of Supervisors recommending denial of a rezoning of 125.43 acres located within Fringe Area C east of Dane Road and west and south of the Lakeridge Mobile Home Park from County A1 Rural and RS Suburban Residential to County RMH Manufactured Housing Residential. (CZ0027) Comment: At its June 15 meeting by a vote of 6-0 the Planning and Zoning Commission recommended denial of this rezoning due to its non-compliance with the Fringe Area Agreement, the Iowa City Comprehensive Plan, and the Johnson County Land Use Plan. The Commission also recommended that if the Board entertains approval of this rezoning then the Board and City Council should meet to discuss merits of the proposal with relationship to the Fringe Area Agreement and the Future of the agreement. Consider a resolution authorizing the Mayor to sign and the City Clerk to attest an agreement between Johnson County, Iowa and Iowa City, Iowa, amending the Fringe Area Policy Agreement between Johnson County and Iowa City. Comment: At its August 17 meeting, by a vote of 6-0, the Planning and Zoning Commission recommended approval of the amendments to Fringe Area Policy Agreement Between Johnson County and Iowa City as drafted by the Fringe Area Committee. approval of a conditional use permit for a sand mining and extraction operation for property located in unincorporated Johnson County south of Izaac Walton League Road, west of the Iowa River. (~ ~ ) Comment: At its August 6 meeting, by a vote of 6-0, the Planning and Zoning Commission recommended approval of the proposed conditional use permit, subject to the County requiring the implementation of the restoration plan submitted with the application. Staff recommended approval in a memo dated August 4. ITEM NO. 6. THE AMENDED FY01 ANNUAL ACTION PLAN, THAT IS A SUB-PART OF IOWA CITY'S 2001-2006 CONSOLIDATED PLAN (CITY STEPS), AUTHORIZING THE CITY MANAGER TO SUBMIT SAID PLAN AND ALL NECESSARY CERTIFICATIONS TO THE U.S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT, AND DESIGNATING THE CITY MANAGER AS THE AUTHORIZED CHIEF EXECUTIVE OFFICER FOR THE CONSOLIDATED PLAN. Comment: At their July 20, 2000, meeting, the Iowa City Housing and Community Development Commission recommended approval of the Amended FY01 Annual Action Plan. This amendment provides ~25,550 to the Greater Iowa City Housing Fellowship for the acquisition of a lot to be used for an affordable homeownership project in conjunction with the Iowa City Community School District and the Homebuilders Association. The US Department of Housing and Urban Development requires a public hearing and approval of an amended Annual Action Plan by the City Council. In addition to the proposed project, the budget amendment includes the addition of supplemental FY00 program income. a. PUBLIC HEARING Action: ~D ~ 9~~ o~- ~1H b. CONSIDER A RESOLUTION ADOPTING September 12, 2000 City of Iowa City Page 8 ITEM NO. 7. PUBLIC DISCUSSION ON A RESOLUTION APPROVING THE 2000-2001 DEER MANAGEMENT PLAN. Comment: Each year, the City Council will consider a deer management plan based on the long-term plan approved by Council in March of 1998. At its August 30, 2000, meeting, by a vote of 9-0, the Deer Management Committee recommended a plan for 2000-2001 that is consistent with the long-term plan. The public discussion is to receive public comment on the 2000-2001 Deer Management Plan. Correspondence and staff memorandum included in Council packet. Detailed plan included in Council packets only. ITEM NO. 8. PUBLIC HEARING ON A RESOLUTION APPROVING AND OF AN AGREEMENT FOR PRIVATE REDEVELOPMENT BY AND BETWEEN THE CITY OF IOWA CITY AND MGD L.C. Comment: This agreement outlines the details regarding the provision of TIF property tax rebates for the Sycamore Mall project. Correspondence included in Council packet. Action: ITEM NO. 9. CONSIDER AN ORDINANCE PROVIDING THAT GENERAL PROPERTY TA LEVIED AND COLLECTED EACH YEAR ON ALL PROPERTY LOCATED WITHIN THE SYCAMORE AND FIRST AVENUE URBAN RENEWAL PROJECT AREA, IN THE CITY OF IOWA CITY, COUNTY OF JOHNSON, STATE OF IOWA, BY AND FOR THE BENEFIT OF THE STATE OF IOWA, CITY OF IOWA CITY, COUNTY OF JOHNSON, IOWA CITY COMMUNITY SCHOOL DISTRICT AND OTHER TAXING DISTRICTS, BE PAID TO A SPECIAL FUND FOR PAYMENT OF PRINCIPAL AND INTEREST ON LOANS, MONIES ADVANCED TO AND INDEBTEDNESS, INCLUDING BONDS ISSUED OR TO BE ISSUED, INCURRED BY SAID CITY IN CONNECTION WITH SAID URBAN RENEWAL REDEVELOPMENT PROJECT. (SECOND CONSIDERATION) Comment: The adoption of the Sycamore and First Avenue Tax Increment Financing District Ordinance establishes the mechanism by which incremental property tax revenue will be made available to the City for the purposes of financing public infrastructure improvements and providing financial assistance to qualifying businesses. Comment: Bids were received at 11:00 am on September 12, 2000 for the sale of $12,000,000 Sewer Revenue Bonds. This resolution ratifies and confirms the actions of the City Clerk and Finance Director in the determination of the most favorable bid. A completed resolution will be presented to the City Council at the formal meeting the evening on September 12, 2000. ITEM NO. 11. CONSIDER A RESOLUTION AWARDING CONTRACT AND AUTHORIZING THE o0-~i~ MAYOR TO SIGN AND THE CITY CLERK TO ATTEST A CONTRACT FOR 'CONSTRUCTION OF THE 2000 PAVEMENT MARKING PROJECT. Comment: The bid opening for this project was held on September 6, 2000. The following bids were received: All Iowa Contracting Waterloo, IA ~33,976.90 (HPS-5) All Iowa Contracting Waterloo, IA ~36,758.28 (Epoxy) Dennis Parking Lot Maintenance Des Moines, IA ~39,925.50 (LPM-1200) Engineer's Estimate ~50,000.00 Public Works and Engineering recommend award of the project to All Iowa Contracting of Waterloo, Iowa in the amount of ~33,976.90.
