Notice is hereby given that a public hearing will be held by the City Council of Iowa
City, Iowa, at 7:00 p.m. on the 21st day of November, 2000, in the Civic Center Council
Chambers, 410 E. Washington Street, Iowa City, Iowa, at which hearing the Council will
consider:
1. An ordinance vacating the northernmost 60 feet of the dead end alley along the west
property line of 405 South Summit Street.
Copies of the proposed ordinances are on file for public examination in the office of the
City Clerk, Civic Center, Iowa City, Iowa. Persons wishing to make their views known for
Council consideration are encouraged to appear at the above-mentioned time and place.

ORDINANCE NO.
AN ORDINANCE VACATING THE NORTHERNMOST 60 FEET OF THE DEAD-END ALLEY
ALONG THE WEST PROPERTY LINE OF 405 SOUTH SUMMIT STREET.
WHEREAS, the northernmost 60 feet of the alley between South Governor Street and South
Summit Street, adjacent to the west property line of 405 South Summit Street, is not used for
pedestrian or vehicular traffic circulation; and
WHEREAS, there are no utilities in the right-of-way proposed to be vacated; and
WHEREAS, the area proposed to be vacated does not provide access to any drives or
driveways, is partially unpaved, and is not being used by the general public.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF IOWA
CITY, IOWA:
SECTION I. VACATION. Subject to the disposition and conveyance of the right-of-way being
approved concurrent with approval of the vacation, the City of Iowa City hereby vacates the right-
of-way legally described as follows:
THE SOUTH 60 FEET OF THE NORTH 80 FEET OF THE PLATTED ALLEY IN BLOCK 2,
BERRYHILL'S SECOND ADDITION, IOWA CITY, IOWA, ACCORDING TO THE PLAT
THEREOF, RECORDED IN DEED BOOK 28 AT PAGE 293 IN THE RECORDS OF THE
JOHNSON COUNTY RECORDER, CONTAINING 1,200 SQUARE FEET AND SUBJECT TO
EASEMENTS AND RESTRICTIONS OF RECORD.
SECTION II. REPEALER. All ordinances and parts of ordinances in conflict with the provi-
sions of this Ordinance are hereby repealed.
SECTION Ill. SEVERABILITY. If any section, provision or part of the Ordinance shall be
adiudged to be invalid or unconstitutional, such adjudication shall not affect the validity of the
Ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconsti-
tutional.
SECTION IV. EFFECTIVE DATE. This Ordinance shall be in effect after its final passage,
approval and publication, as provided by law.

Alley west of 405 S. Summit Street
GENERAL INFORMATION:

Purpose: To allow adjacent property owner(s) to acquire alley
right-of-way and incorporate it into private property.
Location: Northernmost portion of alley between 405 S.
Summit Street and 338 S. Governor Street
Size: 1,600 square feet
Existing Land Use and Zoning: The property to the east of the alley (405 S. Summit
Street) is zoned Medium Density Single Family
Residential (RS-5) and is in a designated historic
district. The property to the west of the alley (338 S.
Governor) is zoned Low Density Multi-Family
residential (RM-12).
Surrounding Land Use and Zoning: North: Residential; RS-5 and RM-12
South: Residential; RS-5 and RM-12
East: Residential; RS-5
West: Residential; RM-12
Comprehensive Plan: The Comprehensive Plan designates the area to the
east of the alley as Residential 2-8 units/acre, and
the area to the west of the alley as Residential 8-16
units/acre

BACKGROUND INFORMATION:
Sue Travis has applied for the vacation of an 80-foot long by 20-foot wide section of alley adjacent
to the rear of her property at 405 S. Summit Street. This section of alley is the northernmost
portion of alley between S. Governor Street and S. Summit Street; the alley dead-ends behind
Ms. Travis's property at 405 S. Summit Street. The northern portion of the alley right-of-way is
unpaved and has an unkempt appearance with shrubs and debris collecting in it. The southern
portion of the alley is paved and is used as for parking by residents of the apartment buildings at
338 and 404 S. Governor. The applicant has requested the City vacate the alley so she can
acquire the area abutting her property, allowing the back yard to be extended, and allowing for
more control of the area for landscaping, etc.
ANALYSIS:
In general release of a street or alley right-of-way should not be recommended when it would
result in 1 ) detrimental vehicular or pedestrian cimulation, 2) interference with the rights of access
to private property, or 3) if it would inhibit the access of fire or emergency vehicles, or utility
service vehicles.
The area proposed for vacation does not appear to be used by the general public. The northern
portion is not paved, and contains shrubs and other vegetation. The southern portion is being
used as a parking area by residents of the apartments at 338 and 404 S. Governor Street. In the
past, it has even been striped for parking. According to the property owner of 338 S. Governor
Street, who acquired the property in the eady 1990's, the alley area has been used as a parking
area since before they acquired the property. City staff is not aware of any complaints regarding
parking in this area. Parking within alleys is not permitted by city code, however, in this case staff
did not realize there was parking in the alley right-of-way until the vacation request was
investigated. There appears to be adequate room for this parking to be moved into the remainder
of the parking lot without losing any parking spaces.
A private drive between the apartment buildings at 338 and 404 S. Governor connects S.
Governor Street to the alley, and allows for someone using the alley to enter or exit the alley
either at the north end of this block of South Governor Street. There are two accesses to the alley
at the south end of this block. There are numerous garages and parking spaces off the alley for
households on S. Governor Street and S. Summit Street. The property owner of 338 South
Governor Street would like to maintain access to the alley from the private drive serving her
property.
Staff feels it is reasonable to vacate the northern 60 feet of the alley, but not the entire 80 feet as
is being proposed. The south 20 feet of the alley adjacent to the property at 405 S. Summit Street
connects the alley right-of-way to the private drive between 338 and 404 S. Governor Street.
While this private drive is not part of the public right-of-way, it is used for general traffic circulation
by residents whose properties abut the alley. If the property at 338 S. Governor ever redevelops,
having alley access will be an important part of the parking and access design of the property.
The northern 60 feet of the alley does not provide access to any drives or driveways, is partially
unpaved, and is partially being used as a parking area for residents of 338 and 404 S. Governor
Street. There does not appear to be a public benefit to keeping the northern 60 feet of this alley
as public right-of-way.
Staff has notified the utility companies of the proposed vacation. Any necessary utility easements
will be reserved. There are no public utilities in this portion of the alley.
Disposition and conveyance: Staff recommends that final approval of the ordinance vacating
the alley by the Council be held until agreements have been reached with the adjacent property
owners regarding the purchase of the property from the City. The vacation ordinance and
approval of the conveyance of the right-of-way to adjacent property owners would be done
concurrently, at the same City Council meeting. This way, the City will avoid a situation where a
property has been vacated, but is not conveyed to adjacent property owners.

In this case, both adjacent property owners (owners of 405 S. Summit Street and 338 S. Governor
Street) have expressed interest in acquiring the vacated right-of-way. As has been our past
practice, staff recommends that if both adjacent property owners are interested in acquiring
vacated right-of-way, each should have the option of acquiring half of the area. In this case, each
property owner would be conveyed 10 feet of the 20-foot wide right-of-way, along it's 60-foot
length.
STAFF RECOMMENDATION:
Staff recommends the City vacate the northern 60 feet of the 20-foot wide alley right-of-way
abutting the west property line of the property at 405 S. Summit Street, subject to the retention
of any necessary utility easements, and subject to conveyance of the right-of-way being
approved concurrently with the approval the ordinance vacating the alley.
