Resolutions. ~ I - ~ (1) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST THE RELEASE OF A LIEN REGARDING A MORTGAGE FOR THE PROPERTY LOCATED AT 920 SOUTH DODGE STREET, IOWA CITY, IOWA. Comment: The owner of the property located at 920 South Dodge Street received assistance through the City's Downpayment Assistance Program for the amount of $3,000. The financing was in the form of a loan. The loan was paid off on December 22, 2000; thus the lien can now be released. (2) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO ~ I - ,~' SIGN AND THE CITY CLERK TO ATTEST THE RELEASE OF LIEN REGARDING A MORTGAGE FOR THE PROPERTY LOCATED AT 326 NORTH JOHNSON STREET, IOWA CITY, IOWA. Comment: The owners of the property located at 326 North Johnson Street received assistance through the City's Rental Rehabilitation Program for the amount of $36,759.75. The financing was in the form of ten-year payback loan. The loan has been paid off; thus the lien can now be released. Comment: Branton Bank has requested that the City approve a Subordination Agreement for 1562 Dickenson Lane. On February 12, 1998, the owner (Greater Iowa City Housing Fellowship) of the property received a loan from the HOME Investment Partnership Fund and a Mortgage for a total of $61,400 on three properties. Brenton Bank is about to finance a new mortgage to the property owner for the amount of $77,200. The property is assessed at $101,000 which provides enough equity to cover the City's second lien position, which was its original position. e. Correspondence. January 9, 2001 City of Iowa City Page 4 ITEM NO. 5. PLANNING AND ZONING MA'FI'ERS. a. Public hearing on a resolution amending the Comprehensive Plan, South District Plan, to change the land use plan for the area south of Napoleon Park and west of South Gilbert Street from multi-family residential and public open space to public/institutional (approximately 21 acres) and commercial (approximately 2 acres) and to depict the general location of an east-west arterial street, which will connect Gilbert Street to the west side of the Iowa River. ~;~,,:,~_~,,~ p Comment: At its November 21 meeting, by a vote of 6-0, the~ng and Zoning Commission recommended approval of the proposed Comprehensive Plan amendment. Staff recommended approval in a report dated November 9, 2000. b. Public hearing on an ordinance changing the use designation from Interim Development Multi-family Residential (ID-RM) to Community Commercial (CC-2) for approximately 2 acres of property located west of Gilbert Street and south of Napoleon Lane (REZ00-0021). ~/~.~ Comment: At its November 21 meeting, by a vote of 6-0, the Pl:ni~ng and Zoning Commission recommended approval of the proposed rezoning, subject to a conditional zoning agreement that would ensure that any plans for development of the parcel are compatible with future residential development in this area and for this entranceway to Iowa City. Staff recommended approval in a report dated November 9, 2000. c. Public hearing on an ordinance approving a revised sensitive areas development plan for the Peninsula Neighborhood, an 82.1 acre residential neighborhood containing up to 410 dwelling units located at the west end of Foster Road. [REZ00-0022] Comment: At its December 21 meeting, by a vote of 7-0, the Planning and Zoning Commission recommended approval. Staff recommended approval, subject to correction of technical deficiencies on the plat, in a report dated December 7. January 9, 2001 City of Iowa City Page 5 c~ d. Public hearing on an ordinance amending Section 14-6J-1 the Off- Street Parking Requirements, to require only one off-street parking space for small one-bedroom single-family, townhouse, and duplex dwellings. Comment: At its December 21 meeting, by a vote of 7-0, the Planning and Zoning Commission recommended approval. Staff recommended approval in a memorandum dated December 14. e. Consider an ordinance vacating the northernmost 60 feet of the dead- end alley along the west property line of 405 South Summit Street. (VAC00-0001) (Second Consideration) Comment: At its May 4 meeting, by a vote of 5-0, the Planning and Zoning Commission recommended approval of the vacation proposal. Staff recommended approval in a report dated April 6. This item has been postponed since May to give the adjacent property owners time to complete a plat of survey of the area. The adjacent property owners have now provided a plat of survey and legal description of the right-of-way proposed to be vacated. f. Consider a resolution approving the preliminary plat and manufacture housing site plan of Saddlebrook addition, Part 2, a 201.2 acre, 6-lot residential subdivision and 290-unit manufactured housing site plan located at the southern terminus of Heinz Road. (SUB00-00015) Comment: At its October 5 meeting, by a vote of 7-0, the Planning and Zoning Commission recommended the approval of the preliminary and final plats and manufacture housing site plan of Saddlebrook Addition, Pad 2, subject to approval of legal papers and construction drawings prior to Council consideration of the final plat. Legal papers are being reviewed by the City Attorney's Office. Construction plans have been approved by the Public Works Department. Deferred December 19. g. Consider a resolution approving the final plat and manufactured housing site plan of Saddlebrook Addition, Part 2, a 77.65 acre, 5-lot subdivision located on Heinz Road. PUBLIC HEARING ON AN ORDINANCE AMENDING TITLE 6, CHAPTER 1 (NUISANCES) OF THE CODE OF ORDINANCES OF THE CITY OF IOWA CITY BY ADDING STANDARDS AND PROCEDURES TO CONTROL THE NUMBER OF VEHICLES PARKED, STORED, PLACED OR KEPT OUTSIDE ON PRIVATE PROPERTY. Comment: The proposed ordinance would regulate the number and location of parked, or stored vehicles in any single-family or duplex residential area. This ordinance has been drafted in response to neighborhood complaints about excessive vehicle storage and parking in residential areas and its negative impact on the neighborhood. This ordinance provides standards to protect residential properties from any negative impacts that may result from excessive outdoor storage of vehicles. Action: , co ITEM NO. 7. THE CITY'S INTENT TO PROCEED WITH AND AUTHORIZING 'I~HE ACQUISITION OF PROPERTY RIGHTS FOR THE FIRST AVENUE EXTENSION PROJECT. Comment: This project includes grading, paving, sidewalks, storm sewer, water main and related construction of First Avenue from the existing paving north of Rochester Avenue to Captain Irish Parkway. A PURCHASE AGREEMENT BE'i'VVEEN THE CITY OF IOWA CITY AND DONNA AND VIC ZENDER FOR CONDOMINIUM UNIT 1-G IN TOWER PLACE AND PARKING AND THE DISPOSITION OF SAID PROPERTY IN ACCORDANCE THEREWITH. Comment: The Zenders have made a full-price offer for Unit 1-G in Tower Place and Parking ($313,024). Unit 1-G is the unit on the corner of Linn and Iowa. The purchase agreement was included in Council's December 19 packet. a. PUBLIC HEARING ~/" ~ b. CONSIDER A RESOLUTION APPROVING ITEM NO. 9. PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE SENIOR CENTER PEDESTRIAN BRIDGE PROJECT, ESTABLISHING AMOUNT OF BID SECURITY TO ACCOMPANY EACH BID, DIRECTING CITY CLERK TO PUBLISH ADVERTISEMENT FOR BIDS, AND FIXING TIME AND PLACE FOR RECEIPT OF BIDS. Comment: This project will construct a skywalk that will connect the third floor of Tower Place and Parking with the third level of the Senior Center and will allow direct enclosed access from the parking facility to the Senior Center. The estimated construction cost is $268,000 and will be funded with general obligation bonds and approximately $120,000 in private donations and pledges. a. PUBLIC HEARING _ O/- ~ b. CONSIDER AN ORDINANCE TO LIMIT THE AMOUNT A PERSON MAY CONTRIBUTE TO MUNICIPAL ELECTION CAMPAIGNS. (FIRST CONSIDERATION). Comment: The City of Iowa City has had a long history of limiting campaign contributions. In 1976, the City Council decreased the contribution limit from $125 per person to $50 per person, and it remained at $50 until 1999. Following the Eighth Circuit's decision in Shrink Missouri Government PAC v. Adams, 161 F.3d 519 (8th Cir. 1998), the City Attorney advised the City Council that the $50 limit should be repealed, and the City Council repealed the limitation. Subsequently, the United States Supreme Court reversed the Eighth Circuit and determined that contribution limits need not be subjected to the rigorous evidentiary scrutiny required by the Eighth Circuit. As a result of the Supreme Court's decision in Nixon v. Shrink Missouri Government PAC, 120 S. Ct. 897 (2000), the City Council may impose a limit on contributions to candidates in municipal election if the limit is closely drawn to prevent corruption or the appearance of corruption and does not prevent candidates from amassing the resources necessary for effective advocacy. The Supreme Court stated in Bucklev v. Valeo, 424 U.S. 1 (1976) that large contributions lead to corruption and the appearance of corruption. In reviewing the campaign disclosure statements for the 1999 municipal elections, which were held after the limits were repealed, political association would have been effective had there been a limit of $100. Thus, a limit of $100 would survive a challenge under the Supreme Court's ruling in Nixon. ITEM NO. 11. CONSIDER AN ORDINANCE TO ADOPT THE CODE OF ORDINANCES OF THE CITY OF IOWA CITY, IOWA, AKA "CITY CODE, 2001 ." (FIRST CONSIDERATION) Comment: Pursuant to State Code the City must adopt a code of ordinances every five years. This ordinance adopts the City Code, 2001. ITEM NO. 13. ANNOUNCEMENT OF VACANCIES. a.
