(1) CONSIDER A RESOLUTION SETTING A PUBLIC HEARING FOR FEBRUARY 6 ON PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE CITY OF IOWA CITY TRANSIT INTERCHANGE FACILITY PHASE II PROJECT, DIRECTING CITY CLERK TO PUBLISH NOTICE OF SAID HEARING, AND DIRECTING THE CITY ENGINEER TO PLACE SAID PLANS ON FILE FOR PUBLIC INSPECTION. Comment: This is the re-bidding of the Iowa City Transit Interchange Facility Phase II. The project involves building a masonry exterior in a steel frame building with mechanical and electrical installation. The facility will be located on the North end of the Old Capitol Mall. e. Resolutions. (1) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST THE RELEASE OF LIEN REGARDING A MORTGAGE FOR THE PROPERTY LOCATED AT 717 EAST BLOOMINGTON STREET, IOWA CITY, IOWA. Comment: The owners of the property located at 717 East BLoomington Street received assistance through the City's Rental Rehabilitation Program for the amount of $9,309.83. The financing was in the form of ten-year declining balance loan. The terms of the loan have been satisfied; thus the lien can now be released. Comment: At their December 12, 2000, meeting the Police Citizens Review Board (PCRB) recommended amending the by- laws to establish a regular meeting date for the Board. The Rules Committee met on January 11 and recommended approval of the amendment. f. Correspondence. [UNTIL 8 PM] Public Discussion will be continued, if necessary, prior to "City Council Information" item. ITEM NO. 6. PLANNING AND ZONING MATI'ERS. a. Consider a resolution amending the Comprehensive Plan, South District Plan, to change the land use plan for the area south of Napoleon Park and west of South Gilbert Street from multi-family residential and public open space to public/institutional (approximately 21 acres) and commercial (approximately 2 acres) and to depict the general location of an east-west arterial street, which will connect Gilbert Street to the west side of the Iowa River. ~(3_~x Comment: At its November 21 meeting, by a vote of 6-0, the~an'~ning and Zoning Commission recommended approval of the proposed Comprehensive Plan amendment. Consider an ordinance changing the use designation from Interim Development Multi-family Residential (ID-RM) to Community CommeroiaE (CC-2) for approximately 2 acres of property located west of Gilbert Street and south of Napoleon Lane (REZ00-0021). (First Comment: At its November 21 meeting, by a vote of 6-0, the Planning and Zoning Commission recommended approval of the proposed rezoning, subject to a conditional zoning agreement that would ensure that any plans for development of the parcel are compatible with future residential development in this area and for this entranceway to Iowa City. Consider an ordinance approving a revised sensiti e a eas development plan for the Peninsula Neighborhood, an 82.1 acre residential neighborhood containing up to 410 dwelling units located at the west end of Foster Road. [REZ00-0022] (First Consideration) Comment: At its December 21 meeting, by a vote of 7-0, the Planning and Zoning Commission recommended approval. Consider an ordinance amending Section 14-6J-1 the Off-Street Parking Requirements, to require only one off-street parking space for small one-bedroom single-family, townhouse, and duplex dwellings. (First Consideration) Comment: At its December 21 meeting, by a vote of 7-0, the Planning and Zoning Commission recommended approval. Staff recommended approval in a memorandum dated December 14. Consider an ordinance vacating the northernmost 60 feet of the dead- end alley along the west property line of 405 South Summit Street. (VAC00-0001) (Pass and Adopt) Comment: At its May 4 meeting, by a vote of 5-0, the Planning and Zoning Commission recommended approval of the vacation proposal. Staff recommended approval in a report dated April 6. This item has been postponed since May to give the adjacent property owners time to complete a plat of survey of the area. The adjacent property owners have now provided a plat of survey and legal description of the right-of-way proposed to be vacated. Staff requests indefinite deferral pending resolution of the conveyance of the vacated right of way. f. Consider a letter to the Johnson County Board of Supe~iso~s~ recommending denial of a rezoning of 125.43 acres Io~ted within Fringe Area C east of Dane Road and west and south of the Lakeridge Mobile Home Park from County A1 Rural and RS Suburban Residential to County RMH Manufactured Housing Residential. (CZ0027) Comment: At its June 15 meeting by a vote of 6-0 the Planning and Zoning Commission recommended denial of this rezoning due to its non-compliance with the Fringe Area Agreement, the Iowa City Comprehensive Plan, and the Johnson County Land Use Plan. The Commission also recommended that if the Board ente~ains approval of this rezoning then the Board and City Council should meet to discuss merits of the proposal with relationship to the Fringe Area Agreement and the Future of the agreement. Staff recommended denial in a repo~ dated June 9. Deferred on July 18, August 1, August 15, September 12, September 19, October 3, October 17, November 7, November 21, and December 19. el -/~ g. Consider a resting a final plat of Holl~ood Man~~ a 5.32 acre, 20-lot residential subdivision located west of Sycamore Street, south of Burns Avenue. (SUB00-0024) Comment: At its December 4 meeting, by a vote of 6-0, the Planning and Zoning Commission recommended approval of the proposed final plat, subject to the approval of legal papers and construction drawings. It is anticipated that legal papers and construction drawings wilt be approved prior to Council consideration. Staff recommended approval in a repo~ dated November 16, 2000. CONSIDER A MOTION APPROVING A TENTATIVE AGREEMENT BETWEEN THE CITY OF IOWA CITY AND AFSCME LOCAL 183 FOR A COLLECTIVE BARGAINING AGREEMENT EFFECTIVE JULY 1, 2001, THROUGH JUNE 30, 2003. Comment: This is a two-year agreement which includes a 3.25% across- the-board wage increase in each of the two years covered. It also includes increases in longevity and long-term disability benefits as well as improvements to the dental insurance benefit in the second year. A copy of the tentative agreement is included in Council packet. ITEM NO. 8. CONSIDER AN ORDINANCE AMENDING TITLE 6, CHAP~EI~'I (NUISANCES) OF THE CODE OF ORDINANCES OF THE CITY OF IOWA CITY BY ADDING STANDARDS AND PROCEDURES TO CONTROL THE NUMBER OF VEHICLES PARKED, STORED, PLACE~ OR KEPT OUTSIDE ON PRIVATE PROPERTY. (FIRST CONSIDERATION) Comment: The proposed ordinance would regulate the number and location of parked, or stored vehicles in any single-family or duplex residential area. This ordinance has been drafted in response to neighborhood complaints about excessive vehicle storage and parking in residential areas and its negative impact on the neighborhood. This ordinance provides standards to protect residential properties from any negative impacts that may result from excessive outdoor storage of vehicles. January 16, 2001 City of Iowa City Page 7 ITEM NO. 9. CONSIDER AN ORDINANCE TO LIMIT THE AMOUNT A PERSON MAY CONTRIBUTE TO MUNICIPAL ELECTION CAMPAIGNS. (SECOND CONSIDERATION) Comment: The City of Iowa City has had a long history of limiting campaign contributions. In 1976, the City Council decreased the contribution limit from $125 per person to $50 per person, and it remained at $50 until 1999. Following the Eighth Circuit's decision in Shrink Missouri Government PAC v. Adams, 161 F.3d 519 (8t" Cir. 1998), the City Attorney advised the City Council that the $50 limit should be repealed, and the City Council repealed the limitation. Subsequently, the United States Supreme Court reversed the Eighth Circuit and determined that contribution limits need not be subjected to the rigorous evidentiary scrutiny required by the Eighth Circuit. As a result of the Supreme Court's decision in Nixon v. Shrink Missouri Government PAC, 120 S. Ct. 697 (2000), the City Council may impose a limit on contributions to candidates in municipal election if the limit is dosely drawn to prevent corruption or the appearance of corruption and does not prevent candidates from amassing the resources necessary for effective advocacy. The Supreme Court stated in Buckler v. Valeo, 424 U.S. 1 (1976) that large contributions lead to corruption and the appearance of corruption. In reviewing the campaign disclosure statements for the 1999 municipal elections, which were held after the limits were repeated, political association would have been effective had there been a limit of $100. Thus, a limit of $100 would survive a challenge under the Supreme Court's ruling in Nixon. ITEM NO. 10. CONSIDER AN ORDINANCE TO ADOPT THE CODE OF ORDINANCES OF THE CITY OF IOWA CITY, IOWA, AKA "CITY CODE, 2001." (SECOND CONSIDERATION) Comment: Pursuant to State Code the City must adopt a code of ordinances every five years. This ordinance adopts the City Code, 2001. Services Coordinator RE: Revised Item and Comment for Agenda Item #11 CONSIDER RESOLUTION AWARDING CONTRACT AND AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST A CONTRACT FOR CONSTRUCTION OF THE CITY OF IOWA CITY CABLE TV OFFICES PROJECT. Comment: The bid opening for this project was held on January 16, 2001, at 2:00 p.m. The project involves completing a shelled-in office space at 10 S. Linn Street, in Tower Place Parking Facility. There were 7 bids submitted. Knutson Construction of Iowa City submitted the lowest responsible bid at $256,500.00. The Architect's estimate was $250,000.00. Funding will come from various Cable- related revenues. January 16, 2001 City of Iowa City Page 8 ITEM NO. 12. CONSIDER A RESOLUTION APPROVING EXECUTION OF AN Iz~- AGREEMENT BETWEEN THE CITY OF IOWA CITY AND MCCLURE ENGINEERING COMPANY TO PROVIDE ENGINEERING CONSULTANT AND LAND ACQUISITION SERVICES FOR THE COURT HILL TRUNK SANITARY SEWER PROJECT. Comment: This agreement authorizes McClure Engineering Company to provide engineering consultant and land acquisition services necessary for construction of the Court Hill Trunk Sanitary Sewer Project. This project involves upgrading and repairing the sanitary sewer along Ralston Creek from Court Hill Park to Scott Park.
