Comment: This resolution sets a public hearing on the FY2002

Comment: In March, JCCOG will be completing Iowa City
Transit's FY2002 Iowa Department of Transportation
Consolidated Transit Funding Application. This application will
contain FY2002 State Transit Assistance formula operating
funds and Federal Transit Administration Section 5307 and/or
5309 operating and capital projects. A public hearing on the
application is required by law, with a notice of the hearing
published in advance. The grant application will be available for
public review prior to the public hearing.

Comment: This agreement provides for an 80% State and 20%
local funding split. The maximum state contribution is $2 million.
This project will reconstruct Mormon Trek Boulevard from Melrose
Avenue north to the Iowa Interstate Railroad viaduct. The
preliminary estimated construction cost is $3,500,000. The local
share of this project will be split between the City and The
University of Iowa. The City share will be paid with Road Use
taxes.

ITEM NO. 6. PLANNING AND ZONING MATTERS.
a. Consider an ordinance changing the use designation from Interim
Development Multi-family Residential (ID-RM) to Community
Commercial (CC-2) for approximately 2 acres of property located west
Comment: At its November 21 ~g, by a vote of 6-0, the Planning
and Zoning Commission recommended approval of the proposed
rezoning, subject to a conditional zoning agreement that would ensure
that any plans for development of the parcel are compatible with future
residential development in this area and for this entranceway to Iowa
City. Staff recommended approval in a report dated November 9,
2000.

b. Consider an ordinance approving a revised sensitive areas
development plan for the Peninsula Neighborhood, an 82.1 acre
residential neighborhood containing up to 410 dwelling units located at
the west end of Foster Road. [REZ00-0022] (Second Consideration)
Comment: At its December 21 meeting, by a vote of 7-0, the Planning
and Zoning Commission recommended approval. Staff recommended
approval in a repod dated December 7.
c. Consider an ordinance amending Section 14-6J-1 the Off-Street
Parking Requirements, to require only one off-street parking space for
small one-bedroom single-family, townhouse, and duplex dwellings.

and Zoning Commission recommended approval. Staff recommended

Comment: At its October 5 meeting, by a vote of 7-0, the Planning and
Zoning Commission recommended the approval of the preliminary and
final plats and manufacture housing site plan of Saddlebrook Addition,
Part 2, subject to approval of legal papers and construction drawings
prior to Council consideration of the final plat. Legal papers are being
reviewed by the City Attorney's Office. Construction plans have been
approved by the Public Works Depadment. Deferred December 19
and January 9.

ITEM NO. 7. PUBLIC DISCUSSION ON PROPOSED ALCOHOL ORDINANCES.
Comment: The proposed ordinances provide for review by the County
Attorney of renewal applications, establish a mechanism for the imposition
of civil penalties, including suspension and revocation in accordance with
state law, make sales to underage persons by employees of licensees a
City offense and prohibit certain drink specials and out-of-sight sales.
Copies of the proposed ordinances as well as the City Attorney's
memorandums to the City Council explaining the same are available in the
City Clerk's Office.
BIDS, AND FIXING TIME AND PLACE FOR RECEIPT OF BIDS.
Comment: This is the re-bidding of the Iowa City Transit Interchange
Facility Phase II. The project involves building a masonry exterior in a
steel frame building with mechanical and electrical installation. The facility
will be located on the North end of the Old Capitol Mall. The estimated
construction cost is $140,000 and will be funded by Transit Division Cash
balances.

ITEM NO. 9. CONSIDER AN ORDINANCE AMENDING CITY CODE TITLE 14,
ENTITLED "UNIFIED DEVELOPMENT CODE," CHAPTER 5, ENTITLED
"BUILDING AND HOUSING," BY ADDING A NEW ARTICLE K
ENTITLED "CONDOMINIUM CONVERSION CODE" TO ESTABLISH
PROCEDURES FOR CONVERSION OF EXISTING STRUCTURES TO
HORIZONTAL PROPERTY REGIMES (CONDOMINIUMS). (FIRST
CONSIDERATION)
Comment: The Iowa legislature passed a law (S.F. 2426) effective
April 25, 2000, that allows an existing building to be converted to a
condominium if the city's building requirements as of the date of
conversion are met. However, S.F. 2426 does not provide any
procedures by which the local building department is to determine if the
requirements are met. This ordinance provides those procedures. If this
ordinance is passed, a resolution will be submitted to establish fees to
offset the costs of performing the inspections.

Comment: The proposed ordinance would regulate the number and
location of parked, or stored vehicles in any single-family or duplex
residential area. This ordinance has been drafted in response to
neighborhood complaints about excessive vehicle storage and parking in
residential areas and its negative impact on the neighborhood. This
ordinance provides standards to protect residential prope~ies from any
negative impacts that may result from excessive outdoor storage of
vehicles.

ITEM NO. 11. CONSIDER AN ORDINANCE TO LIMIT THE AMOUNT A PERSON MAY

ADOPT)
Comment: The City of Iowa City has had a long history of limiting
campaign contributions. In 1976, the City Council decreased the
contribution limit from $125 per person to $50 per person, and it remained
at $50 until 1999. Following the Eighth Circuit's decision in Shrink
Missouri Government PAC v. Adams, 161 F.3d 519 (8th Cir. 1998), the
City Attorney advised the City Council that the $50 limit should be
repealed, and the City Council repealed the limitation. Subsequently, the
United States Supreme Court reversed the Eighth Circuit and determined
that contribution limits need not be subjected to the rigorous evidentiary
scrutiny required by the Eighth Circuit. As a result of the Supreme Court's
decision in Nixon v. Shrink Missouri Government PAC, 120 S. Ct. 897
(2000), the City Council may impose a limit on contributions to candidates
in municipal election if the limit is closely drawn to prevent corruption or
the appearance of corruption and does not prevent candidates from
amassing the resources necessary for effective advocacy. The Supreme
Court stated in Buckley v. Valeo, 424 U.S. I (1976) that large
contributions lead to corruption and the appearance of corruption. In
reviewing the campaign disclosure statements for the 1999 municipal
elections, which were held after the limits were repealed, political
association would have been effective had there been a limit of $100.
Thus, a limit of $100 would survive a challenge under the Supreme
Court's ruling in Nixon.

Comment: Pursuant to State Code the City must adopt a code of
ordinances every five years. This ordinance adopts the City Code, 2001.

ITEM NO. 13. CONSIDER A RESOLUTION AWARDING CONTRACT AND'
J-~ AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO
ATTEST A CONTRACT FOR CONSTRUCTION OF THE SENIOR
CENTER PEDESTRIAN BRIDGE PROJECT.
Comment: The bid opening for this project was held on January 31, 2001,
at 2:00 p.m. The proposed project includes completing an enclosed
elevated pedestrian walkway spanning 43 feet over the alley between the
Senior Center Building and the City parking ramp to the North, Tower
Place and Parking. The extension of existing mechanical, electrical and
fire protection systems is included.

Public Works and Engineering recommend awarding the project to
McComas Lacina Construction. The project will be funded with general
obligation bonds and approximately $120,000 in private Senior Center
Community donations and pledges.

AUTHORIZING THE ALLOCATION OF PUBLIC ART FUNDS, AND
AUTHORIZING NEGOTIATION OF A CONTRACT WITH JUSTINE
ZIMMER, SCULPTOR.
Comment: The Public Art Advisory Committee recommended by a vote of
4-0 at their meeting of December 7, 2000, that $1,700 be allocated from
the public art budget to enable acquisition of the sculpture "Tornado" by
Justine Zimmer and that this sculpture be the first to be displayed on the
pedestrian mall sculpture pad dedicated to the works of Iowa artists.
ITEM NO. 15. CONSIDER A RESOLUTION APPROVING THE PROPERTY TAX
EXEMPTION APPLICATION FOR PROPERTY LOCATED AT 210-212
SOUTH CLINTON STREET, IOWA CITY, IOWA.
Comment: Under the Central Business District Urban Revitalization Plan,
Marc Moen has applied for property tax exemption for the nonresidential
commercial portion of the new construction located at 210-212 South
Clinton Street, which was constructed and completed during calendar year
2000. For a period of three years, the project will receive 100%
exemption from taxation on the actual value added by the improvements.

PROVIDING FOR PUBLICATION OF NOTICE THEREOF.
Comment: This resolution sets a public hearing for 7:00 p.m. on February
20, 2001, to receive public comment regarding the issuance of up to
$15,115,000 Sewer Revenue bonds to allow the City to refund the Series
1996 Sewer Revenue Bonds if there are sufficient savings to do so. The
resolution also authorizes the City Clerk to publish the Notice of Hearing.

Comment: This resolution sets a public hearing for 7:00 p.m. on Februa~
20, 2001, to receive public comment regarding the issuance of up to
$9,825,000 of General Obligation bonds to allow the City to refund the
Series 1996 General Obligation Bonds and Series 1992 Capital Loan
notes if there are sufficient savings to do so. The resolution also
authorizes the City Clerk to publish the Notice of Hearing.

AND PROGRAMS.
Comment: The Parks and Recreation Commission and staff review fees
and charges annually, and increases are considered in order to help
support the Recreation Division's budget. A three-year plan has been
established, with FY02 fee increases being recommended for adoption at
this time, and FY2003 and FY2004 fee increases tentatively identified.
Some of the FY02 increases will actually be implemented in FY01
because the summer season begins in FY01, but continues into FY02.
The Parks and Recreation Commission reviewed and adopted the
proposed increases at their meeting of January 10, 2001.
