(1) CONSIDER A RESOLUTION AUTHORIZING THE EXECUTION OF FISCAL YEAR 2000 RESIDENT OPPORTUNITIES AND SELF-SUFFICIENCY PROGRAM GRANT AGREEMENT. Comment: Department of Housing and Urban Development has approved the application for a FY 2000 Resident Opportunities and Self Sufficient (ROSS) grant for funding in the amount of $150,000. This Grant was effective January 19, 2001, for a three-year period and is consistent with City Steps. The City of Iowa City Housing Authority in partnership with Goodwill Industries of Southeast Iowa will use grant funds to provide job seeking, placement and training services, as well as case management, childcare and transportation support to services to eligible resident in Iowa City and surrounding Johnson County area. PLANNING AND ZONING MATI'ERS. a. Consider a motion setting a public hearing for March 5 on an ordinance amending the zoning code, section 14-61-1Q, to allow adult day care in commercial zones on streets less than 28 feet in width. Comment: At its February 1 meeting by a vote of 4-0 the Planning and Zoning Commission recommended approval of this amendment. Staff recommended approval in a memorandum dated February 1. ol-5q57 b. Consider an ordinance changing the use designation from Interim Development Multi-family Residential (ID-RM) to Community Commercial (CC-2) for approximately 2 acres of property located west and Adopt) Comment: At its November 2 meeting, by a vote of 6-0, the Planning and Zoning Commission recommended approval of the proposed rezoning, subject to a conditional zoning agreement that would ensure that any plans for development of the parcel are compatible with future residential development in this area and for this entranceway to Iowa City. Consider an ordinance approving a revised sensitive areas development plan for the Peninsula Neighborhood, an 82.1 acre residential neighborhood containing up to 410 dwelling units located at the west end of Foster Road. [REZ00-0022] (Pass and Adopt) Comment: At its December 21 meeting, by a vote of 7-0, the Planning and Zoning Commission recommended approval. Consider a resolution approving the preliminary plat of the Peninsula Neighborhood, an 82.1 acre, 209-1ot subdivision with 15 outlots located at the west end of Foster Road. (SUB00-0026) Comment: See item c. D[-~5~ e. Consider an ordinance amending Section 14-6J-1 Parking Requirements, to require only one off-street parking space for small one-bedroom single-family, townhouse, and duplex dwellings. (Pass and Adopt) Comment: At its December 21 meeting, by a vote of 7-0, the Planning and Zoning Commission recommended approval. Staff recommended approval in a memorandum dated December 14. f. Consider a resolution approving a final plat of Westcott Heights Pa~ Three/, a 78.96 acre, 47-1ot residential subdivision located in JohnsOn County on the west side of Prairie du Chien Road, south of Newpo~ Road. (SUB00-00027) Comment: At its Janua~ 18, 2001 meeting, by a vote of 5-0, the Planning and Zoning Commission recommended approval of the proposed final plat, subject to the approval of legal papers and construction drawings. We anticipate that legal papers and construction drawings will be approved by Februa~ 20. Staff recommended approval in a repo~ dated December 21, 2000. February 20, 2001 City of Iowa City Page 6 g. Consider a letter to the Johnson County Board of Supervisors indicating that the City has no objection to the request submitted by JEBB LC to rezone approximately 1.76 acres located east of Dane Road and west of Lake Ridge Mobile Home Park from County A1, Rural, and County RS, Suburban Residential, to County RMH, Manufactured Housing Residential. Comment: At its February 1 meeting, by a vote of 5-0, The Planning and Zoning Commission recommended that the City Council send a letter indicating no objection to this rezoning despite the fact the further rezoning to RMH of any property of significant size is inconsistent with the Fringe Area Agreement. The Commission recommendation is consistent with the staff recommendation contained in a memorandum dated January 26. Action: ITEM NO. 8. A PUBLIC HEARING TO DISCUSS THE PROPOSED OPERATING BUDGET FOR THE FISCAL YEAR JULY 1, 2001, THROUGH JUNE 30, 2002, THE PROPOSED THREE-YEAR FINANCIAL PLAN, AND ALSO THE MULTI-YEAR CAPITAL IMPROVEMENTS PROGRAM THROUGH FISCAL YEAR 2005. Comment: This hearing is to receive public comment on the FY2002 Proposed Operating Budget, the three-year Financial Plan and multi-year Capital Improvements Program (CIP) through Fiscal Year 2005 on February 20, 2001. PROCEEDINGS TO TAKE ADDITIONAL ACTION FOR THE ISSUANCE OF NOT TO EXCEED $15,115,000 SEWER REVENUE BONDS OF IOWA CITY, IOWA. Comment: This hearing is to receive public comment regarding the issuance of up to $15,115,000 Sewer Revenue bonds to allow the City to refund the Series 1996 Sewer Revenue Bonds if there are sufficient savings to do so. a. PROCEEDINGS TO TAKE ADDITIONAL ACTION FOR THE ISSUANCE OF $9,825,000 GENERAL OBLIGATION BONDS OF IOWA CITY, IOWA. Comment: This hearing is to receive public comment regarding the issuance of up to $9,825,000 of General Obligation bonds to allow the City to refund the Series 1996 General Obligation Bonds and Series 1992 Capital Loan notes if there are sufficient savings to do so. a. Comment: The purchase agreement negotiated by the City's realtor on the City's behalf is a full-price offer of $466,800 for unit 2A in Tower Place & Parking. PUBLIC DISCUSSION ON PROPOSED ALCOHOL ORDINANCES. Comment: The proposed ordinances provide for review by the County Attorney of renewal applications, establish a mechanism for the imposition of civil penalties, including suspension and revocation in accordance with state law, make sales to underage persons by employees of licensees a City offense and prohibit certain drink specials and out-of-sight sales. Copies of the proposed ordinances as well as the City Attorney's memorandums to the City Council explaining the same are available in the City Clerk's Office. Continued from February 6. CONSIDER AN ORDINANCE AMENDING CITY CODE TITLE 14, ENTITLED "UNIFIED DEVELOPMENT CODE," CHAPTER 5, ENTITLED "BUILDING AND HOUSING," BY ADDING A NEW ARTICLE K ENTITLED "CONDOMINIUM CONVERSION CODE" TO ESTABLISH PROCEDURES FOR CONVERSION OF EXISTING STRUCTURES USED FOR HUMAN HABITATION TO HORIZONTAL PROPERTY REGIMES (CONDOMINIUMS). (FIRST CONSIDERATION) Comment: The Iowa legislature passed a law (S.F. 2426) effective April 25, 2000, that allows an existing building to be converted to a condominium if the City's building requirements as of the date of conversion are met. However, S.F. 2426 does not provide any procedures by which the local building department is to determine if the requirements are met. This ordinance provides those procedures and also provides that fees will be adopted by resolution to offset the costs of inspections. This ordinance has been amended since the first reading to clarify that it appeals only to condominiums used for human habitation. Due to the change, tonight's reading will be for the first consideration of the ordinance. ITEM NO. 14. CONSIDER AN ORDINANCE AMENDING TITLE 6, CHAPTER 1 (NUISANCES) OF THE CODE OF ORDINANCES OF THE CITY OF IOWA CITY BY ADDING STANDARDS AND PROCEDURES TO CONTROL THE NUMBER OF VEHICLES PARKED, STORED, PLACED OR KEPT OUTSIDE ON PRIVATE PROPERTY. (PASS AND ADOPT) Comment: The proposed ordinance would regulate the number and location of parked, or stored vehicles in any single-family or duplex residential area. This ordinance has been drafted in response to neighborhood complaints about excessive vehicle storage and parking in residential areas and its negative impact on the neighborhood. This ordinance provides standards to protect residential properties from any negative impacts that may result from excessive outdoor storage of vehicles. Correspondence included in Council packet. Action: n - : / REGULATION OF ABANDONEDNACANT BUILDINGS. Comment: This resolution establishes fees related to the administrative costs of registering, processing, monitoring, and inspecting abandoned/vacant buildings. The proposed fees include a $50 one-time registration fee and an $80 annual inspection fee. February 20, 2001 City of Iowa City Page 9 ITEM NO. 16. CONSIDER CITY OF IOWA CITY LAW ENFORCEMENT NON- o1-~ # DISCRIMINATION RESOLUTION. Comment: Iowa City Police Department was the first in the State to actively initiate a self examination practice within the department. Based on Iowa Clty's lead, a number of Police Departments across the State have initiated such review. In order to support their efforts, Council Member Wilburn is proposing passage of this resolution for two reasons. First, to take a position against racial profiling as a practice in law enforcement efforts; and secondly to encourage other communities to examine practices and support training efforts to eliminate the possibility of racial profiling.
