Setting Public Hearings. ol- H,~ (1) CONSIDER A RESOLUTION SETTING A PUBLIC HEARING FOR MARCH 20 ON PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE MORMON TREK BOULEVARD IMPROVEMENT - MELROSE AVENUE TO THE IOWA INTERSTATE RAILROAD BRIDGE PROJECT STP-U- 3715(618)--70-52, DIRECTING CITY CLERK TO PUBLISH NOTICE OF SAID HEARING, AND DIRECTING THE CITY ENGINEER TO PLACE SAID PLANS ON FILE FOR PUBLIC INSPECTION. Comment: This project will widen Mormon Trek Boulevard to four lanes from south of Melrose Avenue to the Iowa Interstate Railroad bridge. It will include the installation of storm sewer, sanitary force sewer force main, sidewalks and water main. Comment: This project will enhance the drainage corridor south of Mt. Prospect, Part 7 and Lakeside Subdivisions to the Snyder Creek Bottom Wetlands. (1) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO A'FI'EST TO A SUBORDINATION AGREEMENT BETWEEN THE CITY OF IOWA CITY AND THE UNIVERSITY OF IOWA COMMUNITY CREDIT UNION, IOWA CITY, IOWA FOR PROPERTY LOCATED AT 62 REGAL LANE, IOWA CITY, IOWA. Comment: The University of Iowa Community Credit Union, Iowa City, Iowa has requested that the City approve a Subordination Agreement for 62 Regal Lane. On June 12, 1996, the owners of the property received a loan from the City's Housing Rehabilitation Program for a total of $22,152. The University of Iowa Community Credit Union is about to finance a new mortgage to the property owners for the amount of $66,200. The property is assessed at $100,000 which provides enough equity to cover the City's second lien position, which was its original position. (2) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST THE RELEASE OF LIEN REGARDING A REHABILITATION AGREEMENT AND A RENTAL REHABILITATION LIEN FOR THE PROPERTY LOCATED AT 529 BROWN STREET, IOWA CITY, IOWA. Comment: The owners of the property located at 529 Brown Street received assistance through the City's Rental Rehabilitation Program for the amount of $9,917.87. The financing was in the form of ten-year declining balance loan. The terms of the loan have been satisfied; thus the lien can now be released. (3) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO A'FI'EST THE RELEASE OF LIEN REGARDING A RENTAL REHABILITATION LIEN FOR THE PROPERTY LOCATED AT 824 EAST COLLEGE STREET, IOWA CITY, IOWA. Comment: The owners of the property located at 824 East College Street received assistance through the City's Rental Rehabilitation Program for the amount of $7,984.57. The financing was in the form of ten-year declining balance loan. The terms of the loan have been satisfied; thus the lien can now be released. Comment: Firstar Bank, Iowa City, Iowa has requested that the City approve a Subordination Agreement for 428 Fifth Avenue. On May 6, 1996 and on October 31, 1996 the owners of the property received a loan from the City's Housing Rehabilitation Program for a total of $25,176. Firstar Bank is about to finance a new mortgage to the property owners for the amount of $64,000. Consider a motion setting a public hearing for March 20 on an ordinance changing the zoning designation by establishing a Conservation Overlay Zone for properties generally located south of Burlington Street along Governor and Lucas Streets. Comment: It is anticipated the Planning and Zoning Commission will vote on the proposed Conservation Overlay Zone at their March 1 meeting. The Historic Preservation Commission has recommended approval of the proposed overlay zone. Staff recommended approval in a memo dated February 9. b. Consider a motion setting a public hearing for March 20 on an ordinance changing the zoning designation from High Density Multi- family Residential, RM-44, to Sensitive Areas Overlay, OSA-44, for approximately 4.01 acres of property to allow 39 dwellings in three buildings located on the east side of Harlocke Street. Comment: At its February 12 meeting, by a vote of 3-2 (Ehrhardt, Hanson voting no), the Planning and Zoning Commission recommended approval of the proposed rezoning. Staff recommended approval in a report dated February 1. Action: c. Public hearing on an ordinance amending the zoning code, section 14- 61-1Q, to allow adult day care in commercial zones on streets less than 28 feet in width. Comment: At its February 1 meeting by a vote of 4-0 the Planning and Zoning Commission recommended approval of this amendment. Staff recommended approval in a memorandum dated February 1. Consider a resolution approving a final plat of Westcott Heights Part Three-A, a 78.96 acre, 47-1ot residential subdivision located in Johnson County on the west side of Prairie du Chien Road, south of Newport Road. (SUB00-00027) Comment: At its January 18, 2001 meeting, by a vote of 5-0, the Planning and Zoning Commission recommended approval of the proposed final plat, subject to the approval of legal papers and construction drawings. We anticipate that legal papers and construction drawings will be approved by March 5. Staff recommended approval in a report dated December 21, 2000. Deferred on February 20. ITEM NO. 7. PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE FOSTER ROAD AND MORMON TREK BOULEVARD LANDSCAPING PROJECT, ESTABLISHING AMOUNT OF BID SECURITY TO ACCOMPANY EACH BID, DIRECTING CITY CLERK TO PUBLISH ADVERTISEMENT FOR BIDS, AND FIXING TIME AND PLACE FOR RECEIPT OF BIDS. Comment: This project includes landscaping along Foster Road from No Name Road to the Elks' Driveway and along the west side of Mormon Trek Boulevard from Westside Drive to Plaen View Drive. The Engineer's Estimate for this project is $60,000. This project will be funded with General Obligation bonds. a. PUBLIC HEARING ol - 'i~q b. CONSIDER A RESOLUTION APPROVING March 5, 2001 City of Iowa City Page 7 ITEM NO. 8. PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE CAPTAIN IRISH PARKVVAY EXTENSION (PHASE II) AND FIRST AVENUE EXTENSION PROJECT, ESTABLISHING AMOUNT OF BID SECURITY TO ACCOMPANY EACH BID, DIRECTING CITY CLERK TO PUBLISH ADVERTISEMENT FOR BIDS, AND FIXING TIME AND PLACE FOR RECEIPT OF BIDS. Comment: This project involves construction of Captain Irish Parkway from the south entrance to ACT to the east ACT property line and First Avenue from its north terminus to Captain Irish Parkway including grading, paving, sidewalk, water main and storm sewer construction. The estimate construction cost is $2,500,000 and will be financed with Road Use taxes and General Obligation bonds. The estimated City cost of installing the underground electric cable along the proiect corridor is $72,000. MidAmerican Energy Company will install overhead electric along Captain Irish Parkway from the existing overhead at N. Dubuque Road to the intersection of Captain Irish and First Avenue and underground for the remainder of Captain Irish Parkway and First Avenue. a. PUBLIC HEARING ~ ~ ol ~ 5D b. CONSIDER A RESOLUTION APPROVING Action: ITEM NO. 9. PLANS, SPECIFICATIONS, FORM OF CONTACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE 2001 ASPHALT RESURFACING PROJECT, ESTABLISHING AMOUNT OF BID SECURI~ TO ACCOMPANY EACH BID, DIRECTING CI~ CLERK TO PUBLISH ADVERTISEMENT FOR BIDS, AND FIXING TIME AND P~CE FOR RECEIPT OF BIDS. Comment: This biennial project involves the asphalt resu~acing and chip sealing of various streets throughout Iowa City. The estimated cost of the project is $931,610 of which $54,580 will be funded by the IDOT for the work on Dodge Street (Highway 1) and the remainder by Road Use taxes. a. CONSIDER AN ORDINANCE AMENDING TITLE 14, CHAPTER 3 (CITY UTILITIES) OF THE CODE OF ORDINANCES OF THE CITY OF IOWA CITY BY AMENDING PARAGRAPH 6B-1, REMOVING THE RESOLUTION AND PUBLIC HEARING REQUIREMENTS FOR CERTIFICATION OF UNPAID DELINQUENT UTILITY CHARGES TO THE COUNTY TREASURER FOR COLLECTION IN THE S d simplify and expedite the collection of unpaid delinquencies on utility accounts by removing the resolution to City Council, removing the public hearing requirement, and establishing the collection processes as stipulated in State Code 384.84. This change also promotes City fiscal responsibility by facilitating timely collections. Past practice was to complete this collection process annually. Owners and landlords of residential rental properties have requested that the City process these collections more frequently as their means of collection from any tenant at that late date is limited. With the approval of this amendment the City's lien collection for unpaid delinquent utility services will be scheduled on a quarterly basis and thereby processed more effectively. ./-,_. ITEM NO. 11. CONSIDER AN ORDINANCE AMENDING CITY CODE TITLE 14, ENTITLED "UNIFIED DEVELOPMENT CODE," CHAPTER 5, ENTITLED "BUILDING AND HOUSING," BY ADDING A NEW ARTICLE K ENTITLED "CONDOMINIUM CONVERSION CODE" TO ESTABLISH PROCEDURES FOR CONVERSION OF EXISTING STRUCTURES USED FOR HUMAN HABITATION TO HORIZONTAL PROPERTY REGIMES (CONDOMINIUMS). (SECOND CONSIDERATION) Comment: The Iowa legislature passed a law (S.F. 2426) effective April 25, 2000 that allows an existing building to be converted to a condominium if the city's building requirements as of the date of conversion are met. However, S.F. 2426 does not provide any procedures by which the local building department is to determine if the requirements are met. This ordinance provides those procedures and also provides that fees will be adopted by resolution to offset the costs of inspections. This ordinance applies only to condominiums used for human habitation. Two applications to convert existing structures have on the agenda is a proposed resolution to establish fees, which are needed if this ordinance passes. March 5, 2001 City of Iowa City Page 9 ITEM NO. 12. ~(M CONSIDER A RESO N ADOPTING FEES FOR CONVERSION OF EXISTING ST RES FOR HUMAN HABITATION TO HORIZONTAL PR INIUMS). Comment: On April 25, 2001, the Iowa legislature passed a law (S.F. 2426) that allows an existing building used for human habitation to be converted to a condominium if the City's building requirements are met. A proposed ordinance, which is on this agenda for expedited consideration, provides procedures by which the building official will determine if the requirements are met. The proposed ordinance provides that fees should be adopted to offset the costs of performing the inspections. It will take considerable staff time to conduct the inspections. Actio,: ITEM NO. 13. CONSIDER AN ORDINANCE AMENDING TITLE 6, CHAPTER 1 (NUISANCES) OF THE CODE OF ORDINANCES OF THE CITY OF IOWA CITY BY ADDING STANDARDS AND PROCEDURES TO CONTROL THE NUMBER OF VEHICLES PARKED, STORED, PLACED OR KEPT OUTSIDE ON PRIVATE PROPERTY. (PASS AND ADOPT) Comment: The proposed ordinance would regulate the number and location of parked, or stored vehicles in any single-family or duplex residential area. This ordinance has been drafted in response to neighborhood complaints about excessive vehicle storage and parking in residential areas and its negative impact on the neighborhood. This ordinance provides standards to protect residential properties from any negative impacts that may result from excessive outdoor storage of vehicles. Deferred on February 20. ITEM NO. 14. CONSIDER A RESOLUTION APPROVING AN AGREEMENT BE~EEN e/. _~ THE CI~ OF IOWA CI~ AND THE NATIONAL SCULPTURES GUILD WITH AND THROUGH ITS ARTIST FOR THE WEST PAD OF THE DOWNTOWN PEDESTRIAN MALL AND AUTHORIZING THE MAYOR TO EXECUTE AND THE CI~ CLERK TO A~EST THE SAME. Comment: At its October 12 meeting, the Public Art Advisory Committee recommended by a 5-0 vote to select Jazz, a work of Gary Alsum for the west pad of the downtown pedestrian mall. The City Council affirmed this selection of artists and sculptures for the sculpture pads at their October 17 meeting by adopting Resolution 00-352. (Comment reads the same.) March 5, 2001 City of Iowa City Page 10 ITEM NO. 15. CONSIDER A RESOLUTION ADOPTING THE ANNUAL BUDGET FOR _c>~ THE FISCAL YEAR ENDING JUNE 30, 2002. Comment: A public hearing was held on February 20, 2001, to receive public input on the fiscal year (FY) 2002 Operating Budget. State law requires that the City adopt only a one-year budget. Council now proceeds to adopt the annual budget for the fiscal year ending June 30, 2002 (FY2002) so that it may be certified to the Johnson County Auditor by March 15, 2001, in the format required by the State. Correspondence included in Council packet. ITEM NO. 16. CONSIDER A RESOLUTION APPROVING THE FINANCIAL PLAN FOR r~1-55 THE CITY OF IOWA CITY, IOWA, FOR FISCAL YEARS 2002 THROUGH 2004 AND THE MULTI-YEAR CAPITAL IMPROVEMENTS PROGRAM THROUGH FISCAL YEAR CAPITAL IMPROVEMENTS PROGRAM THROUGH FISCAL YEAR 2005. Comment: A public hearing was held on February 20, 2001, to receive public input on the FY2002 through FY2004 three-year Fiscal Plan and the multi-year Capital Improvements Program through Fiscal Year 2005. Council now proceeds to adopt the three-year Financial Plan and multi- year Capital Improvements Program. NO Action: · 17. CONSIDER~~LUTION AUTHORIZI'GI~HE MAYOR TO THE UNION BUS DEPOT PROPERTY, 404 EAST COLLEGE STREET, PURSUANT TO WHICH GREYHOUND LINES, INC. WILL RENEW ITS LEASE FOR A TERM OF THREE YEARS. Comment: The current lease with Greyhound Lines, Inc. expires February 28, 2001. This addendum to the lease extends the lease for an additional three years, and provides that Greyhound Lines, Inc. may terminate the lease during this three-year period in the event Greyhound Lines, Inc. relocates its bus operations to the Transportation Center. TO PROVIDE ENGINEERING CONSULTANT SERVICES FOR THE HIGHWAY 6 CORRIDOR IMPROVEMENTS PROJECT, STP-U-3715(615)- -70-52. Comment: This agreement authorizes Shive-Hattery, Inc. to provide construction administration, construction observation, and construction survey services related to the Highway 6 Corridor Improvements project. The total cost of the services is $146,000 and will be funded by Road Use taxes and General Obligation bond proceeds. Based on the bid received, funding for this project will be provided by STP funds in the amount of $994,312, Iowa Department of Transportation contribution in the amount of $306,000 and the remaining balance will be funded by the City with Road Use taxes and General Obligation bond proceeds. CONSIDER A RESOLUTION APPROVING, AUTHORIZING AND ~D DIRECTING THE MAYOR TO EXECUTE AND THE CITY CLERK TO A'R'EST AND AGREEMENT BY AND BETWEEN THE CITY OF IOWA CITY AND NNW, INC. OF IOWA CITY TO PROVIDE ENGINEERING CONSULTANT SERVICES FOR THE DESIGN OF THE RECONSTRUCTION OF THE IOWA RIVER DAM AND PEDESTRIAN BRIDGE. Comment: This agreement is with NNW, Inc. for design of the reconstruction of the Iowa River Dam and Pedestrian Bridge. This project includes renovation of the Iowa River dam to ensure the permanence of the water pool formed by the dam, to provide a pedestrian bridge atop the dam, pedestrian approach walks at the east and west end of the dam, and improvements to Coralville's boat ramp to the Iowa River. This project is scheduled for construction in the fall of 2001 through 2002. CONSIDER A MOTION TO APPROVE A TENTATIVE AGREEMENT BETWEEN THE IOWA CITY ASSOCIATION OF PROFESSIONAL FIREFIGHTERS AND THE CITY OF IOWA CITY. Comment: This tentative agreement is for a two-year collective bargaining agreement effective July 1, 2001, through June 30, 2003. It provides for a 3.25% wage increase in each of the two years and increases the amounts paid in lieu of overtime for holidays worked and for EMT-B certification by $50 each in each year of the agreement.
