Notice is hereby given that a public hearing will
be held by the City Council of Iowa City, Iowa, at
7:00 p.m. on the 5th day of March, 2001, in the
Civic Center Council Chambers, 410 E.
Washington Street, Iowa City, Iowa, or if said
meeting is cancelled, at the next meeting of the
City Council thereafter as posted by the City Clerk;
at which hearing the Council will consider:
An ordinance amending the zoning code, section
14-6L-1Q, to allow adult day care in commercial
zones on street less than 28 feet in width.
Copies of the proposed ordinances are on file for
public examination in the office of the City Clerk,
Civic Center, Iowa City, Iowa. Persons wishing to
make their views known for Council consideration
are encouraged to appear at the above-
mentioned time and place.

ORDINANCE NO.
ORDINANCE AMENDING ZONING CODE ARTICLE "L", PROVISIONAL USES, SPECIAL
EXCEPTIONS AND TEMPORARY USES, TO ALLOW ADULT DAYCARE FACILITIES ON STREETS
NARROWER THAN 28 FEET WIDE IN COMMERCIAL ZONES.
WHEREAS, one of the provisions for an adult daycare facility is that they shall have access to an
arterial or collector street with paving wider than 28 feet; and
WHEREAS, this provision was put in place primarily for the location of adult daycare facilities in
residential zones, to ensure the traffic associated with such facilities stays on the arterial and collector
street system; and
WHEREAS, the 28 foot wide street requirement is not necessary for streets within commercial zones;
and
WHEREAS, the interior streets of commercial zones are designed to carry greater volumes of traffic,
often with a width of less than 28 feet.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA:
SECTION I. APPROVAL, City Code Section 14-6L-1Q be amended as follows:
Section 14-6L-1Q: In residential zones adult daycare facilities providing care to six or more adults
shall have access to arterial or collector streets, or to a street with paving wider than 28 feet.
SECTION II. REPEALER. All ordinances and parts of ordinances in conflict with the provision of this
ordinance are hereby repealed.
SECTION Ill. SEVERABILITY. If any section, provision or part of this ordinance shall be adjudged to
be invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole
or any section, provision or part thereof not adjudged invalid or unconstitutional.
SECTION VI. EFFECTIVE DATE. This ordinance shall be in effect after its final passage, approval
and publication, as required by law.

Re: Street Requirements for Adult Daycare Facilities
One of the provisions for an adult daycare facility is that they shall have access to an arterial or
collector street with paving wider than 28 feet. This provision was put in place primarily for the
location of adult daycare facilities in residential areas in order to keep the traffic associated with
such facilities on the arterial and collector street system. Staff has received a request from
Pathways, an adult daycare provider, to amend the zoning code to be permitted on a 25-foot wide
street in the Community Commercial (CC2) zone. Pathways would like to remodel a property for
an adult daycare on Pepperwood Lane, which is a 25-foot wide private street within Pepperwood
Plaza. The attached table describes the zones in which adult daycare facilities are permitted.
The 28-foot wide street requirement does not seem necessary for streets within commercial
zones. While the interior streets of commercial areas might be less than 28 feet wide, their
function is to carry commercial levels of traffic. Staff does not feel there will be any negative
impacts to surrounding neighborhoods or to other commercial land uses if adult daycare facilities
are permitted on streets less than 28 feet wide in commercial zones.
STAFF RECOMMENDATION:
Staff recommends 14-6L-1Q be amended as follows:
In residential zones, adult daycare facilities providing care to six or more adults shall
have access to arterial or collector streets, or to a street with paving wider than 28 feet.

Re: Captain Irish Parkway Extension (Phase II) and
First Avenue Extension Project
The public hearing for the Captain Irish Parkway Extension (Phase II) and First Avenue
Extension Project is on the council agenda of March 5, 2001. The plans and specifications allow
the contractor to begin work as soon as property acquisition is completed around May 1, 2001.
Work is scheduled to be completed by November 15, 2001.
The project includes grading, paving, water main, storm sewer, sidewalk and other
miscellaneous work, all of which will be completed this construction season. After completion of
the work, the paving will be closed off and not opened for use until Captain Irish Parkway
Extension is completed to Rochester Avenue / Scott Boulevard. In other words, First Avenue
Extension will be opened to traffic at the same time as Captain Irish Parkway Extension to
Rochester Avenue / Scott Boulevard is opened to traffic.
If Council approves plans and specs, bids for the Captain Irish Parkway Extension (Phase II)
and First Avenue Extension Project will be opened on March 27, 2001. Schedule for award by
the Council will be shortly thereafter.
