Comment: The owners of the property located at 531 Center Street received assistance through the City's Housing Rehabilitation Program for the amount of $8,050. The financing was in the form of a conditional occupancy loan ($3,220) and a five-year declining balance loan ($4,830). The loans have been paid off; thus, the lien can now be released. f. PLANNING AND ZONING MATTERS. a. Consider a motion setting a public hearing for April 3 on an ordinance amending the zoning code, section 14-6-B2 and 14-6L-1A, to permit accessory apartments in an accessory building. Comment: At its March 1 meeting by a vote of 5-0 the Planning and Zoning Commission recommended approval of this amendment provided that an accessory apartment in an accessory building is no larger than 500 square feet and contains no more than one bedroom. Staff recommended approval in a memorandum dated August 1, 1998. Action: b. Public hearing on an ordinance changing the zoning designation by establishing a Conservation Overlay Zone for properties generally located south of Burlington Street along Governor and Lucas Streets. Comment: At its March 1 meeting by a vote of 4-1 the Planning and Zoning Commission recommended approval of the proposed Conservation Overlay Zone. The Historic Preservation Commission has recommended approval of the proposed overlay zone. Staff recommended approval in a memo dated February 9. Public hearing on an ordinance changing the zoning designation from High Density Multi-family Residential, RM-44, to Sensitive Areas Overlay, OSA-44, for approximately 4.01 acres of property to allow 39 dwellings in three buildings located on the east side of Harlocke Street. Comment: At its February 12 meeting, by a vote of 3-2 (Ehrhardt, Hanson voting no), the Planning and Zoning Commission recommended approval of the proposed rezoning. Staff recommended approval in a report dated February 1. Correspondence included in Council packet. d. Consider an ordinance amending the zoning code, section 1~4-61-1~,'4) to allow adult day care in commercial zones on streets less than 28 feet in width. (First Consideration) Comment: At its February 1 meeting by a vote of 4-0 the Planning and Zoning Commission recommended approval of this amendment. Staff recommended approval in a memorandum dated February 1. C>/- C. 5 e. Consider a resolution approving the extra-territorial final plat of Prairie View Estates Part 4, a 30.86 acre, 21-lot residential subdivision with two outlots located east of Prairie du Chien Road in Johnson County. Comment: At its February 12 meeting, by a vote of 5-0, the Planning and Zoning Commission recommended approval of the final plat of Prairie View Estates Part 4, subject to approval of legal papers and construction plans prior to Council approval. THE FILING OF AN APPLICATION WITH THE IOWA DEPARTMENT OF TRANSPORTATION FOR FY2002 IOWA DOT STATE TRANSIT ASSISTANCE AND FEDERAL TRANSIT ADMINISTRATION FUNDING. Comment: JCCOG will be filing an application on behalf of Iowa City Transit with Iowa DOT for State Transit Assistance [STA] and Federal Transit Administration [FTA] funding for FY2002. Iowa City Transit will be receiving approximately $332,621 in Iowa DOT STA formula funds and is applying for $9,906,697 in FTA capital funding and approximately $359,540 of operating funds. The attached memorandum lists the capital proiects that will be applied for in FY2002 by Iowa City Transit. a. PUBLIC HEARING Action: ~ ~ bh~ b. PLANS, SPECIFICATIONS, AND ESTIMATE ~~THE CONSTRUCTION OF THE MORMON TREK BOULEVARD IMPROVEMENTS - MELROSE AVENUE TO THE IOWA INTERSTATE ~ILROAD BRIDGE IMPROVEMENTS PROJECT, STP-U-3715(618)-- 70-52, AND DIRECTING CI~ CLERK TO PUBLISH ADVERTISEMENT FOR BIDS. Comment: This project will widen Mormon Trek Boulevard to four lanes from south of Melrose Avenue to the Iowa Interstate Railroad Bridge and will include the installation of storm sewer, sanita~ force sewer main, sidewalks and water main. This is a joint project with The University of Iowa. This project will be funded by $2,000,000 in STP funds and the University of Iowa will contribute $732,500. The remaining amount will be financed by the City with General Obligation bonds and Road Use tax proceeds. The engineer's estimate is $3,465,000. a.PUBLIC HEARING Action: b. CONSIDER A RESOLUTION APPROVING March 20, 2001 City of Iowa City Page 6 ITEM NO. 8. CONSIDER A RESOLUTION APPROVING PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE SOUTH SYCAMORE REGIONAL GREENSPACE AND STORMWATER PROJECT, ESTABLISHING AMOUNT OF BID SECURITY TO ACCOMPANY EACH BID, DIRECTING CITY CLERK TO PUBLISH ADVERTISEMENT FOR BIDS, AND FIXING TIME AND PLACE FOR RECEIPT OF BIDS. Comment: This project will enhance the drainage corridor south of Mt. Prospect, Part 7 and Lakeside Subdivisions to the Snyder Creek Bottom Wetlands. This will provide a regional storm water facility to be used by existing and future subdivisions. This project will be funded by General Obligation bonds and Road Use tax proceeds. The engineer's estimate is $1,500,000. a. PUBLIC HEARING ~, ~, b. CONSIDER A RESOLUTION APPROVING ITEM NO. 9. AN ORDINANCE AMENDING TITLE 14, "UNIFIED DEVELOPMENT CODE", CHAPTER 3, "CITY UTILITIES" SECTION 14-3A-6, ENTITLED "BILLING AND COLLECTION PROCEDURES; DELINQUENT ACCOUNTS" OF THE CITY CODE TO REVISE THE PROCEDURE FOR CERTIFICATION TO THE COUNTY TREASURER OF LIENS FOR UNPAID WATER, WASTEWATER AND/OR REFUSE AND RECYCLING SERVICES. (SECOND CONSIDERATION) Comment: The proposed amendment to the City's utility code would simplify and expedite the collection of unpaid delinquencies on utility accounts by removing the resolution to City Council removing the public hearing requirement, and establishing the collection processes as stipulated in State Code 384.84. This change also promotes City fiscal responsibility by facilitating timely collections. Past practice was to complete this collection process annually. Owners and landlords of residential rental properties have requested that the City process these collections more frequently as their means of collection from any tenant at that late date is limited. With the approval of this amendment the City's lien collection for unpaid delinquent utility services will be scheduled on a quarterly basis and thereby processed more effectively. / March 20, 2001 City of Iowa City Page 7 ITEM NO. 10. CONSIDER AN ORDINANCE AMENDING TITLE 6, CHAPTER 1 (NUISANCES) OF THE CODE OF ORDINANCES OF THE CITY OF IOWA CITY BY ADDING STANDARDS AND PROCEDURES TO CONTROL THE NUMBER OF VEHICLES PARKED, STORED, PLACED OR KEPT OUTSIDE ON PRIVATE PROPERTY. (SECOND CONSIDERATION) Comment: The proposed ordinance would regulate the number and location of parked, or stored vehicles in any single-family or duplex residential area. This ordinance has been drafted in response to neighborhood complaints about excessive vehicle storage and parking in residential areas and its negative impact on the neighborhood. This ordinance provides standards to protect residential properties from any negative impacts that may result from excessive outdoor storage of vehicles. With respect to violations of this ordinance on or before May 1, 2001, no action to abate shall be taken until May 1, 2002. Revised ordinance is included in Council packet. Action: ITEM NO. 11. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN 7 AND THE CITY CLERK TO ATTEST AN AGREEMENT BETWEEN THE CITY OF IOWA CITY AND THE IOWA DEPARTMENT OF TRANSPORTATION FOR THE INSTALLATION OF VIDEO TRAFFIC SIGNAL DETECTION EQUIPMENT ON U.S. HIGHWAY 6 BETWEEN GILBERT STREET AND FAIRMEADOWS BOULEVARD. Comment: This resolution approves the contract between the Iowa Depadment of Transportation and the City of Iowa City for a grant under the Urban State Traffic Engineering Program (U-STEP), for the installation of video traffic signal detection equipment at seven intersections on U.S. Highway 6 between Gilbed Street and Fairmeadows Boulevard. The grant provides 55% of the estimated $161,403 total project cost from Iowa DOT funds. The remaining 45% of the funding will be provided by the City of Iowa City through a combination of Road Use Tax and in-kind labor, equipment, and materials. The video traffic signal detection equipment will be installed by City crews during summer 2001. ITEM NO. 12. CONSIDER A RESOLUTION AUTHORIZING AND DIRECTING THE SOLICITATION OF OFFERS TO PURCHASE URBAN RENEWAL PARCEL 64-1A FOR A PRIVATE REDEVELOPMENT PROJECTS. Comment: The resolution authorizes and directs the City Manager to solicit offers to purchase Parcel 64-1a for a private development project. CONSIDER A RESOLUTION APPROVING AN AGREEMENT BETWEEN of -/~,ci THE CITY OF IOWA CITY AND JUSTINE ZIMMER, SCULPTOR, FOR A SCULPTURE TO BE PLACED ON THE ROTATING SCULPTURE PROGRAM PAD IN THE DOWNTOWN PEDESTRIAN MALL AND AUTHORIZING THE MAYOR TO EXECUTE AND CITY CLERK TO ATTEST THE SAME. Comment: This resolution authorizes a contract with Justine Zimmer for the sculpture "Tornado" to be placed on the planter pad in the Pedestrian Marl. The City's cost for this sculpture is $1,700. The sculpture will become part of the City's public art collection and will be placed at various locations in Iowa City over time. The sculpture will remain on the pedestrian mall for at least one year. Act,on: ITEM NO. 14. Action: ITEM NO. 15. CONSIDER A RESOLUTION APPROVlNG, AUTHORIZING AND DIRECTING THE MAYOR TO EXECUTE AND THE CITY CLERK TO A"I'I"EST AN AGREEMENT BY AND BETWEEN THE CITY OF IOWA CITY AND THE DUNBAR/JONES PARTNERSHIP OF DES MOINES TO PROVIDE ENGINEERING CONSULTANT SERVICES FOR THE HICKORY HILL PARK TRAIL IMPROVEMENT. Comment: These services are necessary to complete the design, engineering, bidding and construction phases of this project, which entails the construction of approximately 15,600 linear feet of nature trails, six feet in width and accessible to persons with disabilities. The final concept design was arrived at through a series of public meetings with a great deal of involvement from the Johnson County Coalition of Persons with Disabilities and the Friends of Hickory Hill. The trails will be constructed of a crushed and compacted limestone surface, and will include six bridges of various sizes as well as signage and benches. Three wetland areas will also be incorporated into the design. The negotiated fee is $66,461 and will be funded with G.O. Bonds. Action: ITEM #14. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN "1 ,~ AND THE CITY CLERK TO ATTEST AN ADDENDUM TO A LEASE FOR BUSINESS PROPERTY WITH THE JOHNSON COUNTY AGRICULTURAL ASSOCIATION FOR RENTAL OF THE JOHNSON COUNTY 4-H BUILDING IN IOWA CITY, IOWA FOR PURPOSES OF STORAGE OF CITY EQUIPMENT. Comment: The current lease with the Johnson County Agricultural Association for the lease of the Johnson County 4-H Building expires June 30, 2001. This addendure to the lease provides for up to three additional ten-month renewal terms. ITEM NO. 17. CONSIDER A RESOLUTION AMENDING THE BUDGETED POSITIONS ~-~ IN THE BUILDING INSPECTION DIVISION OF THE HOUSING AND INSPECTION SERVICES DEPARTMENT AND THE AFSCME PAY P~N. Comment: The Classification Committee has reviewed the position of Building Inspector as provided by the AFSCME Collective Bargaining Agreement, and has determined that the duties pe~ormed by this position are equivalent to those of positions in grade 12 of the Pay Plan. Therefore, it is recommended that six full-time positions of Building Inspector be reclassified from AFSCME grade 11 to AFSCME grade 12. Annual cost is approximately $6,000. ITEM NO. 18. CONSIDER A RESOLUTION ADOPTING AMENDED BY~WS FOR 7~ THE IOWA CI~ TELECOMMUNICATIONS COMMISSION. Comment: The Iowa Ci~ Telecommunications Commission wishes to amend its bylaws to better reflect the current role and function of the Commission in light of recent changes in federal and state laws and in the Federal Communications Commission rules and regulations governing cable ~ and telecommunications issues.
