(1) CONSIDER A MOTION SETI'ING A PUBLIC HEARING FOR APRIL 17, 2001, REGARDING THE PROPOSED COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) AND HOME INVESTMENT PARTNERSHIP PROGRAM (HOME) BUDGETS FOR THE FY02 ANNUAL ACTION PLAN, THAT IS A SUB-PART OF IOWA CITY'S 2001-2006 CONSOLIDATED PLAN (CITY STEPS). Comment: At their March 22, 2001, meeting the Housing and Community Development Commission made recommendations to the City Council for FY02 CDBG and HOME funding. A public hearing on the proposed CDBG\HOME allocations will be held on April 17, 2001. OI- '7.S (2) CONSIDER A RESOLUTION SETTING A PUBLIC HEARING FOR APRIL 17, 2001, ON PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE TRANSIT PARKING LOT RESURFACE PROJECT, DIRECTING CITY CLERK TO PUBLISH NOTICE OF SAID HEARING, AND DIRECTING THE CITY ENGINEER TO PLACE SAID PLANS ON FILE FOR PUBLIC INSPECTION. Comment: This project will resurface the Transit Maintenance Facility parking lot. It will include asphalt paving and concrete sidewalk replacement. of- '71o (3) CONSIDER A RESOLUTION SETTING A PUBLIC HEARING FOR MAY 15, 2001, FOR THE IOWA CITY HOUSING AUTHORITY'S UPDATED ANNUAL PLAN. Comment: The Public Housing Authority is required to update the Annual Plan under the Quality Housing and Work Responsibility Act of 1998 ("QHWRA"). The Annual Plan will advise HUD, residents and members of the public of the Iowa City Housing Authority's mission for serving the needs of low income and very low income families, and the Housing Authority's strategy for addressing those needs. The QHWRA requires that the plans be made available to the public for review not later than 45 days before the public hearing is to take place. Notice to public was published on Friday, March 30. e. Resolutions. /-71 (1) CONSIDER A RESOLUTION ACCEPTING THE WORK FOR THE RIVER STREET/WOOLF AVENUE RECONSTRUCTION PROJECT. Comment: See Engineer's Report. April 3, 2001 City of Iowa City Page 3 (2) CONSIDER A RESOLUTION ACCEPTING WORK FOR THE SANITARY SEWER PUBLIC IMPROVEMENTS FOR PHASE 1 ON LOT 2 OF SADDLEBROOK ADDITION, PART 1, AND DECLARING PUBLIC IMPROVEMENTS OPEN FOR USE. Comment: See Engineers Report. (3) CONSIDER A RESOLUTION CHANGING THE NAME OF CAPTAIN IRISH PARKWAY TO SCOTI' BOULEVARD. Comment: The realignment of Captain Irish Parkway to intersection directly across from Scott Boulevard at Rochester Avenue makes it appropriate for the name "Scott Boulevard" to be carried along the new alignment to North Dodge Street. This will facilitate understanding of the street system in northeast Iowa City and increase clarity for emergency service providers. f. Correspondence. PLANNING AND ZONING MATTERS. a. Consider a motion setting a public hearing for April 17 on an ordinance changing the zoning designation from General Industrial (I-1) to Intensive Commercial (Cl-1) for approximately 12.09 acres located on the south side of Highway 1. (REZ01-0002). Comment: At its March 15 meeting by a vote of 5-0 the Planning and Zoning Commission recommended approval of this rezoning subject to a conditional zoning agreement addressing the development's landscaping, building and wall design, signs, vehicular access and the runway protection zone. Staff recommended approval in a report dated March 1. Action: b. Consider a motion setting a public hearing for April 17 on a resolution amending the Comprehensive Plan to include the North District Plan. Comment: At its March 15 meeting by a vote of 5-0 the Planning and Zoning Commission recommended that the Comprehensive Plan be amended to include the North District Plan. c. Public hearing on an ordinance amending the zoning code Article (D), definitions, and Article (L) provisional uses, special exceptions and temporary uses, to allow accessory apartments in accessory buildings. Comment: At its March 1 meeting by a vote of 5-0 the Planning and Zoning Commission recommended approval of this amendment provided that an accessory apartment in an accessory building is no larger than 500 square feet and contains no more than one bedroom. Staff recommended approval in a memorandum dated August 1, 1998. d. Consider an ordinance changing the zoning designation by establishing a Conservation Overlay Zone for properties generally located south of Burlington Street along Governor and Lucas Streets. (First Consideration) Comment: At its March 1 meeting by a vote of 4-1 the Planning and Zoning Commission recommended approval of the proposed Conservation Overlay Zone. The Historic Preservation Commission has recommended approval of the proposed overlay zone. Staff recommended approval in a memo dated February 9. April 3, 2001 City of Iowa City Page 5 e. Consider an ordinance changing the zoning designation from High Density Multi-family Residential, RM-44, to Sensitive Areas Overlay, OSA-44, for approximately 4.01 acres of property to allow 39 dwellings in three buildings located on the east side of Harlocke Street. (First Consideration) Comment: At its February 12 meeting, by a vote of 3-2 (Ehrhardt, Hanson voting no), the Planning and Zoning Commission recommended approval of the proposed rezoning. Consider an ordinance amending the zoning code, sec ion 14-61-1 ~ to allow adult day care in commercial zones on streets less than 2 feet in width. (Second Consideration) Comment: At its Februa~ 1 meeting by a vote of 4-0 the Planning and Zoning Commission recommended approval of this amendment. CONSIDER AN ORDINANCE AMENDING TITLE 1, ENTITLED "ADMINISTRATION," CHAPTER 4, ENTITLED "GENERAL PENALTY," SECTION I(B) TO INCREASE THE M~IMUM CRIMINAL PENALTY FOR SIMPLE MISDEMEANORS TO $500 AS AUTHORIZED BY STATE CODE. (FIRST CONSIDE~TION) Comment: In accordance with State law this ordinance increases the maximum penalty for unscheduled simple misdemeanom to $500.00. CONSIDER AN ORDINANCE AMENDING THE CITY CODE OF THE CITY OF IOWA CITY, IOWA, BY ENACTING NEW SECTIONS NUMBERED 4-2-3, ENTITLED "LOCAL REVIEW OF APPLICATION/INVESTIGATION OF APPLICANT"; SECTION 4-2-4, ENTITLED "NOTICE AND HEARING"; AND SECTION 4-2-5, ENTITLED "CIVIL PENALTIES"; REVISING SECTION 4-5-4 ENTITLED "REGULATION OF PERSONS UNDER LEGAL AGE"; ENACTING A NEW SECTION 4-5-6 ENTITLED "SALES TO INTOXICATED PERSONS"; AND ENACTING A NEW SECTION 4-5-7 ENTITLED "LIMITATIONS ON SALES," ALL OF WHICH PROVIDE FOR THE REGULATION OF ALCOHOL SALES. (FIRST CONSIDERATION) Comment: A public hearing was held on February 6 and continued to February 20 on the proposed ordinance. Changes in the ordinance were made by staff at the request of the Council after the close of the hearings. This ordinance implements administrative penalties in accordance with State Code and prohibits out-of-sight sales and drink specials. Action: "' ITEM NO. 9. CONSIDER AN O~RI~INANCE AMENDING ~4, "UNIFIED _¥}b,~ DEVELOPMENT CODE"", CHAPTER 3, "CITY UTILITIES"" SECTION 14- 3A-6, ENTITLED ""BILLING AND COLLECTION PROCEDURES; DELINQUENT ACCOUNTS" OF THE CITY CODE TO REVISE THE PROCEDURE FOR CERTIFICATION TO THE COUNTY TREASURER OF LIENS FOR UNPAID WATER, WASTEWATER AND/OR REFUSE AND RECYCLING SERVICES. (PASS AND ADOPT) Comment: The proposed amendment to the City's utility code would simplify and expedite the collection of unpaid delinquencies on utility accounts by removing the resolution to City Council, removing the public hearing requirement, and establishing the collection processes as stipulated in State Code 384.84. This change also promotes City fiscal responsibility by facilitating timely collections. Past practice was to complete this collection process annually. Owners and landlords of residential rental properties have requested that the City process these collections more frequently as their means of collection from any tenant at that late date is limited. With the approval of this amendment the City's lien collection for unpaid delinquent utility services will be scheduled on a quarterly basis and thereby processed more effectively. CONSIDER AN ORDINANCE AMENDING TITLE 6, CHAPTER 1 ~l-..~q~ (NUISANCES) OF THE CODE OF ORDINANCES OF THE CITY OF IOWA CITY BY ADDING STANDARDS AND PROCEDURES TO CONTROL THE NUMBER OF VEHICLES PARKED, STORED, PLACED OR KEPT OUTSIDE ON PRIVATE PROPERTY. (PASS AND ADOPT) Comment: The proposed ordinance would regulate the number and location of parked, or stored vehicles in any single-family or duplex residential area. This ordinance has been drafted in response to neighborhood complaints about excessive vehicle storage and parking in residential areas and its negative impact on the neighborhood. This ordinance provides standards to protect residential properties from any negative impacts that may result from excessive outdoor storage of vehicles. With respect to violations of this ordinance on or before May 1, 2001, no action to abate shall be taken until May 1, 2002. Staff memorandum included in Council packet. Action: ITEM NO. 11. CONSIDER A RESOLUTION ESTABLISHING A DEER TASK FORCE. ~ o~- ~b Comment: The Deer Management Committee has been in existence since 1997; however, the City Council has never formalized the structure. The City Attorney's Office recommends the structure be formalized and a task force be created. At their March 20, 2001, meeting, members of the Deer Management Committee unanimously agreed to recommend formation of a Deer Task Force. This Resolution establishes a Deer Task Force which contains a sunset clause on March 15, 2004. At that time, the direction of the Task Force will be evaluated. The proposed Resolution implements all of the Committee's recommendations. Staff memorandum and Committee minutes included in Council packet. AUTHORIZING THE MAYOR TO SIGN AND THE CI~ CLERK TO ~ A~EST A CONTACT FOR CONSTRUCTION OF THE CAPT~N IRISH PARLAY EXTENSION (PHASE II) AND FIRST AVENUE EXTENSION PROJECT. Comment: The bid opening on this project has been postponed until April 6, 2001. A recommendation for award will be made at Council's April 17, 2001, meeting. CONSIDER A RESOLUTION AWARDING CONTRACT AND __ ~_ ~'/ AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO A'I'I'EST A CONTRACT FOR CONSTRUCTION OF THE 2001 ASPHALT RESURFACING PROJECT. Comment: The bid opening for this project was held on March 27, 2001 at 10:30 a.m. The following bids were received: L.L. Pelling Company, Inc. North Liberty, IA $832,763.33 Cedar Valley Asphalt Cedar Rapids, IA $836,595.53 Engineer's Estimate $931,610.00 Public Works and Engineering recommend award of the contract to L.L. Pelling Company in the amount of $832,763.33. The project will be funded with Road Use taxes and IDOT will contribute $54,580 for work on Dodge Street (Highway 1 ). Action: ~/2~/~,, w,//~ ITEM NO. 14. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN ol- ~3. AND THE CITY CLERK TO ATTEST AN IOWA DEPARTMENT OF TRANSPORTATION FUNDING AGREEMENT FOR THE FOURTH AVENUE BRIDGE RECONSTRUCTION PROJECT IBRC-3715-619)- - 8E-52. Comment: This agreement provides eligible project costs to be reimbursed with Federal funds to a maximum amount of $135,000. The funding comes from the Federal-Aid Innovative Bridge Research and Construction Program and has been approved to cover costs involved with preliminary engineering, construction and evaluation. The roadway deck of the new bridge will be constructed with an innovative material, possibly carbon or glass fibers. ITEM NO. 15. CONSIDER A RESOLUTION APPROVlNG AN AGREEMENT BE'I'~NEEN c,I- ~']THE CITY OF IOWA CITY AND MCCLURE ENGINEERING COMPANY CONSULTING ENGINEERS TO PROVIDE ENGINEERING CONSULTANT SERVICES FOR THE IOWA CITY COURT HILL TRUNK SANITARY SEWER PROJECT. Comment: This agreement authorizes McClure Engineering Company to provide engineering consultant services necessary for design of the Court Hill Trunk Sanitary Sewer Project. This project involves upgrading and repairing the sanitary sewer along Ralston Creek from Court Hill Park to Scott Park. The cost of these consultant services is $87,500 and will be funded with wastewater revenues. April 3, 2001 City of Iowa City Page 9 ITEM NO. 16. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN c~l- ~z4 AND THE CITY CLERK TO ATTEST A SANITARY SEWER EASEMENT AGREEMENT FOR LOT 2, SADDLEBROOK ADDITION, PART 1, IOWA CITY, IOWA. Comment: Pursuant to the Code of Ordinances of the City of Iowa City, Iowa, the Subdivider submitted a subdivision plat for the area known as Saddlebrook Addition, Part 1, Iowa City, Iowa, and under said plan, infrastructure was installed to service the structures within the development. During the installation of said infrastructure, it was determined that an additional sanitary sewer easement is required. City staff has approved the location of the proposed sanitary sewer easement as well as the association easement agreement. ITEM NO. 17. PUBLIC DISCUSSION [IF NECESSARY] (ITEMS NOT ON THE AGENDA).
