Comment: State legislation mandates municipalities amend their annual budgets by May 31. This resolution sets the public hearing for amendments on May 1, 2001. Comment: This project involves the installation of 24" water main, street grading, sanitary sewer upgrade and storm sewer culvert work on Foster Road extended from Dubuque Street to Prairie du Chien. Comment: This resolution sets a public hearing for 7:00 pm on May 1, 2001, to receive public comment regarding the issuance of $9,825,000 General Obligation bonds and authorizes the City Clerk to publish the notice of hearing. Proceeds from the bonds will pay for the construction, reconstruction, and repairing of street improvements and water works, water mains and extensions; the construction, reconstruction, extension and improving of facilities useful for the collection, treatment and disposal of sewage and industrial waste in a sanitary manner, for the collection and disposal of surface waters and streams and drainage improvements; the rehabilitation, improvements and equipping of existing city parks; the reconstruction, extension and improvement of the Municipal Airport; the improvement of real estate for cemeteries and the construction and reconstruction of other cemetery facilities; the equipping of the fire, police, sanitation, street and civil defense departments; and acquiring and developing a geographic computer data base system for automated mapping and facilities management. ~/~ ~q (4) CONSIDER A RESOLUTION FIXING DATE OF MAY 1 FOR A MEETING ON THE PROPOSITION OF THE ISSUANCE OF NOT TO EXCEED $670,000 OF GENERAL OBLIGATION BONDS (FOR A GENERAL CORPORATE PURPOSE) AND PROVIDING FOR PUBLICATION OF NOTICE THEREOF. Comment: This resolution sets a public hearing for 7:00 pm on May 1, 2001, to receive public comment regarding the issuance of $670,000 General Obligation bonds and authorizes the City Clerk to publish the notice of hearing. Proceeds from the bonds will pay for improvements to the baseball field complex in Mercer Park; the construction of a skateboard facility for a city park; the construction of a downtown transit interchange facility and equipment for city buildings. Comment: This resolution sets a public hearing for 7:00 pm on May 1, 2001, to receive public comment regarding the issuance of $700,000 General Obligation bonds and authorizes the City Clerk to publish the notice of hearing. Proceeds from the bonds will pay for the acquisition and construction of a transit intermodal facility. Resolutions. (1) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST THE RELEASE OF LIEN REGARDING A RENTAL REHABILITATION LIEN FOR THE PROPERTY LOCATED AT 435 - 437 SUMMIT STREET, IOWA CITY, IOWA. Comment: The owners of the property located at 435 - 437 Summit Street received assistance through the City's Rental Rehabilitation Program for the amount of $17,000. The financing was in the form of ten-year declining balance loan. The terms of the loan have been satisfied; thus the lien can now be released. (2) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO A'I'I'EST TO A SUBORDINATION AGREEMENT BETWEEN THE CITY OF IOWA CITY AND IOWA STATE BANK AND TRUST CO., IOWA CITY, IOWA FOR PROPERTY LOCATED AT 109 SOUTH JOHNSON STREET, IOWA CITY, IOWA. Comment: Iowa State Bank and Trust Co., Iowa City, Iowa has requested that the City approve a Subordination Agreement for 109 South Johnson Street. On July 23, 1993, and on November 8, 1994, the owner of the property received loans from the City's Housing Rehabilitation Program for a total of $6,311. Iowa State Bank and Trust Co. is about to finance a new mortgage to the property owner for the amount of $130,000. The property is assessed at $211,000 which provides enough equity to cover the City's second lien position, which was its original position. Consider a motion setting a public hearing for May 1 on an ordinance amending the Sensitive Areas Overlay Plan for Walnut Ridge Parts 9- 10, a 20.67 acre, 13-1ot residential subdivision located on Kennedy Parkway. (REZ01-0003) Comment: At its April 5 meeting, by a vote of 6-1 (Erhardt voting no), the Planing and Zoning Commission recommended approval of the proposed Sensitive Areas Overlay Plan. Staff recommended denial in a report dated March 15, 2001. Action: b. Public hearing on an ordinance changing the zoning designation from General Industrial (I-1) to Intensive Commercial (C1-1) for approximately 12.09 acres located on the south side of Highway 1. (REZ01-0002). Comment: At its M eti vote of 5-0 the Planning and Zoning Commission recommended approval of this rezoning subject to a conditional zoning agreement addressing the development's landscaping, building and wall design, signs, vehicular access and the runway protection zone. Staff recommended approval in a report c. (First Consideration) Comment: At its February 12 meeting, by a vote of 3-2 (Ehrhardt, Hanson voting no), the Planning and Zoning Commission recommended approval of the proposed rezoning. Public H"~a;ing on a resolution amending the Comprehensive Plan to include the North District Plan. Comment: At its March 15 meeting by a vote of 5-0 the Planning and Zoning Commission recommended that the Comprehensive Plan be amended to include the North District Plan. e. Consider an ordinance amending the zoning code Article (D), definitions, and Article (L) provisional uses, special exceptions and temporary uses, to allow accessory apartments in accessory buildings. (First Consideration) Comment: At its March 1 meeting by a vote of 5-0 the Planning and Zoning Commission recommended approval of this amendment provided that an accessory apartment in an accessory building is no larger than 500 square feet and contains no more than one bedroom. Staff recommended approval in a memorandum dated August 1, 1998. f. Consider an ordinance changing the zoning designation by establishing a Conservation Overlay Zone for properties generally located south of Burlington Street along Governor and Lucas Streets. (Second Consideration) Comment: At its March I meeting by a vote of 4-1 the Planning and Zoning Commission recommended approval of the proposed Conservation Overlay Zone. The Historic Preservation Commission has recommended approval of the proposed overlay zone. Staff recommended approval in a memo dated February 9. Action: ol- ~/~ g. PUBLIC HEARING REGARDING THE FY02 ANNUAL ACTION PLAN, THAT IS A SUB-PART OF IOWA CITY'S 2001-2006 CONSOLIDATED PLAN (CITY STEPS), AUTHORIZING THE CITY MANAGER TO SUBMIT SAID PLAN AND ALL NECESSARY CERTIFICATIONS TO THE U.S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT, AND DESIGNATING THE CITY MANAGER AS THE AUTHORIZED CHIEF EXECUTIVE OFFICER FOR THE CONSOLIDATED PLAN. Comment: At their March 22, 2001, meeting, the Housing and Community Development Commission made recommendations for the allocation of FY02 Community Development Block Grant and HOME Investment Partnership program funds. These budget recommendations are contained within Section III (page 6) of the FY02 Annual Action Plan. The U.S. Department of Housing and Urban Development requires a public hearing and approval of the FY02 Annual Action Plan by the City Council. Approval of the FY02 Annual Action Plan is scheduled for May 1, 2001. ITEM NO. 8. PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE TRANSIT PARKING LOT RESURFACE PROJECT, ESTABLISHING AMOUNT OF BID SECURITY TO ACCOMPANY EACH BID, DIRECTING CITY CLERK TO PUBLISH ADVERTISEMENT FOR BIDS, AND FIXING TIME AND PLACE FOR RECEIPT OF BIDS. Comment: This project will resurface the Transit Maintenance Facility parking lot. It will include asphalt paving and concrete sidewalk replacement. The Federal Transit Administration will fund 60% of the project. The remaining 20% will come from the Transit Division funds. The engineer's construction estimate is $101,000. a. CONSIDER AN ORDINANCE AMENDING TITLE 1, ENTITLED "ADMINISTRATION," CHAPTER 4, ENTITLED "GENERAL PENALTY," SECTION I(B) TO INCREASE THE MAXIMUM CRIMINAL PENALTY FOR SIMPLE MISDEMEANORS TO $500 AS AUTHORIZED BY STATE CODE. (SECOND CONSIDERATION) Comment: In accordance with State law this ordinance increases the maximum penalty for unscheduled simple misdemeanors to $500.00. ~dence Inut~d~d in Cuunsil pac.-ket. CONSIDER AN ORDINANCE AMENDING THE CI~ CODE OF THE CI~ OF IOWA CI~, IOWA, BY ENACTING NEW SECTIONS NUMBERED 4-2-3, ENTITLED "LOCAL REVIEW OF APPLICATION/INVESTIGATION OF APPLICANT"; SECTION 4-24, ENTITLED "NOTICE AND HEARING"; AND SECTION 4-2-5, ENTITLED "CIVIL PENALTIES"; REVISING SECTION 4-5-4 ENTITLED "REGULATION OF PERSONS UNDER LEGAL AGE"; ENACTING A NEW SECTION 4-5-6 ENTITLED "SALES TO INTOXICATED PERSONS"; AND ENACTING A NEW SECTION 4-5-7 ENTITLED "LIMITATIONS ON SALES," ALL OF WHICH PROVIDE FOR THE REGULATION OF ALCOHOL SALES. (SECOND CONSIDE~TION) Comment: A public hearing was held on Februa~ 6 and continued to Februa~ 20 on the proposed ordinance. Changes in the ordinance were made by staff at the request of the Council after the close of the hearings. This ordinance implements administrative penalties in accordance with State Code and prohibits out-of-sight sales and drink specials. Staff has sent a letter to currant li~nse holders offering them an oppodunity to provide input concerning interpretation or enforcement of provisions regarding drink specials (Sealion 4-6-7, A and B). CONSIDER A RESOLUTION APPROVING, AUTHORIZING AND ~ DIRECTING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST AN AGREEMENT BY AND BETWEEN THE CITY OF IOWA CITY AND HOWARD R. GREEN COMPANY TO PROVIDE ENGINEERING CONSULTANT SERVICES FOR THE MORMON TREK IMPROVEMENT - MELROSE AVENUE TO THE IOWA INTERSTATE RAILROAD BRIDGE PROJECT, STP-U-3715(615)--70-52. Comment: This agreement authorizes Howard R. Green Company to provide construction administration, construction observation and construction survey services related to the Mormon Trek Improvement Project. The total cost of the services is $275,500 and will be funded by General Obligation bonds and Road Use taxes. ITEM NO. 12. Comment: Iowa City Coffee Company, Java House, currently has authorization to operate a sidewalk caf~ on the public right-of-way in front of 211 1/2 E. Washington Street. In addition to the sidewalk caf~, Java House has requested permission to place anchored fencing around the sidewalk caf~. City Staff has reviewed the application, location, and specifications for the proposed sidewalk care and found these to be in compliance with the sidewalk caf~ ordinance. CONSIDER A RESOLUTION AUTHORIZING AGREEMENT BETWEEN -/o~ THE CITY OF IOWA CITY AND THE IOWA CITY ASSOCIATION OF PROFESSIONAL FIREFIGHTERS, IAFF, AFL-CIO, LOCAL #610, TO BE EFFECTIVE JULY 1, 2001, THROUGH JUNE 30, 2003. Comment: This is a two-year agreement which provides for a 3.25% wage increase in each of the two years. There are increases in the amounts paid in lieu of overtime for holidays worked and for EMT-B certification of $50.00 each in each year of the agreement, and other language revisions as well.
