ITEM 7. APPROVING AN AMENDMENT TO A PURCHASE AGREEMENT BETWEEN THE
CITY OF IOWA CITY AND WAL-MART REAL ESTATE BUSINESS TRUST FOR
APPROXIMATELY 21.76 ACRES OF PROPERTY LYING WITHIN LOTS 10
THROUGH 17 OF NORTH AIRPORT DEVELOPMENT SUBDIVISION AND LOTS 2,
THROUGH 4 OF THE NORTH AIRPORT DEVELOPMENT SUBDIVISION - PART
TWO.
Comment: The City has entered into a purchase agreement for the sale of
approximately 21.76 acres of property lying within Lots 10 through 17 of North Airport
Development Subdivision and Lots 2 through 4 of the North Airport Development
Subdivision - Part Two to Wal-Mart Real Estate Business Trust. Said purchase
agreement provides for closing to occur upon completion of contingencies set forth
therein, no later than two hundred seventy (270) days after the February 9, 2005
effective date thereof, unless a later date is mutually agreed to in writing by the City and
Wal-Mart. Extension of the closing date provided for in the purchase agreement is
necessary for completion of the contingencies, and Wal-Mart has requested that
purchase agreement be amended such that the closing shall take place not later than
January 31, 2006. This resolution approves of the amendment and authorizes its
execution by the Mayor and City Clerk. Staff memo included in Council packet.

ITEM 8. APPROVING PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE
OF COST FOR THE CONSTRUCTION OF THE PARKING FIBER PROJECT,
ESTABLISHING AMOUNT OF BID SECURITY TO ACCOMPANY EACH BID,
DIRECTING CITY CLERK TO PUBLISH ADVERTISEMENT FOR BIDS, AND FIXING
TIME AND PLACE FOR RECEIPT OF BIDS.
Comment: This project is to install fiber optic and copper cable between Iowa City
Parking to unify data networking and telephony services to parking facilities. This
project will establish data networking for parking facilities, and end recurring monthly
charges for phone circuits. The estimated construction is $84,000 and will be funded
with General Fund Contingency and Parking Reserves.

BEVERAGES," CHAPTER 5, ENTITLED, "PROHIBITIONS AND RESTRICTIONS,"
SECTION 4, ENTITLED, "REGULATION OF PERSONS UNDER LEGAL AGE" TO
PROVIDE THAT SECOND AND SUBSEQUENT OFFENSE VIOLATIONS MAY BE
BASED ON A PRIOR CONVICTION UNDER EITHER THE CITY ORDINANCE OR
STATE LAW. (FIRST CONSIDERATION)
Comment: On June 21, 2005, Council passed Ordinance No. 05-4162 that, in part,
enhanced the penalties for second and subsequent convictions for possession of
alcohol under the legal age (PAULA). Because the City ordinance for PAULA
essentially mirrors the PAULA provision in state law, the proposed amendment clarifies
that the second offense can be based either on a prior PAULA conviction under the
City Ordinance or under state law. In other words, the previous PAULA conviction
need not be in Johnson County for violation of the City ordinance but could be in Linn
County for violation of state law.

ITEM 10. CONSIDER A RESOLUTION SUPPORTING THE DEVELOPMENT OF
AFFORDABLE HOUSING IN THE CITY OF IOWA CITY AND AUTHORIZING THE
MAYOR TO SIGN A LETTER OF SUPPORT TO FULFILL THE THRESHOLD
OC-~--' ~t'D ., REQUIREMENTS OF THE LOW-INCOME HOUSING TAX CREDIT APPLICATION.
Comment: The Johnson County Permanent Supportive Housing Limited Partnership is
applying to the Iowa Finance Authority for financial assistance in the form of Low-
Income Housing Tax Credits for the construction of 18 affordable housing units for
persons with a disability to be known as Melrose Ridge. Priority will be given on a
waiting list for persons with chronic mental illness. The 18 units will be constructed
next to Chatham Oaks on land leased from the County. The Johnson County
Permanent Supportive Housing Limited Partnership has asked the City Council for a
resolution of support to assist them in meeting the scoring criteria for the Low-Income
Housing Tax Credit program. Correspondence included in Council packet.
ITEM 11. CONSIDER A RESOLUTION AWARDING CONTRACT AND AUTHORIZING THE
MAYOR TO SIGN AND THE CITY CLERK TO ATTEST A CONTRACT WITH TODD
HACKETT CONSTRUCTION COMPANY FOR THE CONSTRUCTION OF A DUPLEX
HOME UNDER THE AFFORDABLE DREAM HOME OPPORTUNITIES PROGRAM.
Comment: The Iowa City Housing Authority received one bid for the construction of a
duplex located on Longfellow Place. Staff estimate was $220,000. Todd Hackett
Construction Company submitted the bid in the amount of $288,000. (i.e. $144,000 per
unit) Staff recommends awarding the bid to Todd Hackett Construction Company.

CALL TO ARTISTS FOR THE
WETHERBY FRIENDS AND NEIGHBORS NEIGHBORHOOD ART PROJECT.

Oomment: At their October 8, 2005 meeting, the Public Art Advisory Oommittee
approved a Call to Artist for the Wetherby Friends and Neighbors Neighborhood Art
project which includes the installation of a "Wethervane' on the top of the Wetherby
Park shelter depicting the historical heritage of the neighborhood and a metal railing for
the shelter that will represent the cultural diversity of the neighborhood. City Oouncil
review and approval is required prior to the distribution of the Calls to Artists. The
Committee recommends that $1§,000 from public art funds be made available for this
project.

ITEM 13. CONSIDER A RESOLUTION APPROVING AN AGREEMENT BETWEEN THE CITY
OF IOWA CITY AND JOHNSON COUNTY DOGPAC FOR CONSTRUCTION OF
t)~.~ ~o% IMPROVEMENTS FOR A DOG PARK WITHIN THE PENINSULA PARKLAND.
Comment: Johnson County DogPAC has requested permission to contract with private
entities for the construction of infrastructure and improvements for a dog park within 10
to 12 acres of land located within the Peninsula Parkland owned by the City. This
resolution authorizes execution of an agreement pursuant to which the City would allow
such construction and DogPAC would agree to obtain prior approval of said contracts by
the Director of Public Works and/or the Director of Parks and Recreation, and hold
harmless, indemnify and provide appropriate insurance to the City for claims related to
the construction work.

ITEM 14. CONSIDER A RESOLUTION APPROVING THE PARKS AND RECREATION
DEPARTMENT'S MEMORIAL DONATION POLICY.
Comment: The need for a policy addressing the donation of memorials arose in
connection with the Bronze Angel statue approved by the Parks & Recreation
Department for placement in City Park. The proposed policy provides that typical park
amenities will be approved by the Director and other memorials (e.g., sculptures,
plaques, pieces of art) will be approved by the Parks & Recreation Commission subject
to review by the City Council within 60 days.
