Subject: PARKING CODES
Our daughter, who is a student at U.I., recently was cited for
abandoning her vehicle (in front of the apartment she is renting). In
addition to two tickets, she had to pay $36.00 to get her vehicle
removed from the hook of a tow truck that was just about to drive away
with her car.
As a graduate student, she did NOT receive any listing of the parking
rules of Iowa City. There is NO signage in her neighborhood warning
that if you leave your car unmoved for 72 hours, it will be considered
abandoned.
Here are my complaints:
YOU MUST POST THIS RULE SOMEWHERE
With a transient student population, how are they to know your codes.
Should they look them up on your website as I did. Even after reading
your Title 9 - Chapeter 1, I had NO idea of what unlawfully parked
means. Where I grew up, that would mean the car was parked halfway on
the curb or was parked too far out from the curb. (check
9-1-1:Definitions). You really can't expect students are going to check
your website for this information.
WHEN A PROTEST IS FILED, YOU SHOULD TAKE IT SERIOUSLY.
Your form sent to our daughter would indicate no one listened to her.
WHY SHOULD OUR DAUGHTER BWE EXPECTED TO DRIVE EVERYDAY?
She has chosen to be a good steward and not waste gasoline. She walks
to campus daily. She uses the car to go to church, go to choir
practice, and to go shopping for her larger grocery orders. Why should
she move her car every day or every 72 hours?
IF YOU ARE FRUSTRATED BY LIMITED PARKING, WHY DON'T YOU REQUIRE
LANDLORDS TO MAKE CERTAIN THERE IS ADEQUATE PARKING.
In our daughter's situation, there are three renters and really only one
off-street parking spot. It would seem to us that the ordiance should
require the landlord's to have sufficient parking for the number of
vehicles operated by their renters.
FIANLLY, IF YOU DON'T HAVE THE COURTESY TO RESPOND TO THIS AND TO OUR
DAUGHTER'S PROTEST, WE THINK IT MAY BE NECESSARY TO CONTACT A LAWYER.

I am very much looking forward to your participation in the first Iowa City Youth Summit, Friday,
April 20, 2001 from 2:15 p.m. to 3:15 p.m. in the Council Chambers. There will be approximately
60 sixth graders and 30 UI College of Education students in attendance.
Here is the agenda for the hour long meeting.
Following a brief introduction by me, five of the students will spend two to three minutes each
talking about their topic of concern and how they think children in our community can make a
difference. There will then be approximately 15 to 20 minutes during which any of you who would
like to can respond to the students' ideas. You may have suggestions for their efforts, offer
additional information, and simply affirm their interest and intentions.
We will then repeat the sequence of 5 children speaking and another 15-20 minutes for Council's
response. The issue areas the students will be speaking to are the following: hunger, prejudice,
violence, child labor and abuse, drugs and alcohol abuse, pollution, health issues, teen problems,
and two on environmental issues generally.

I have a suggestion to offer.
When an issue is up for discussion, why not post a web site address
That allows area residents vote??
The current drinking ordinances, for example.
Wouldn't that be a good way to get a feel for what the voters wanted?
It would provide a "bigger picture" than just those who physically attend
council meetings.

To whom it may concern,
i am a concerned parent with my own values. I don't care to be told if I should be pro-choice or pro-life, but I do care about having
the right to drive down the street without my children and I seeing giant, graphic pictures of severed infant heads. I want the laws
changed so that such signs am considered profane and illegal. Something must be done! It is detrimental to children and sensible
adults. Have you ever seen these protesters? 3~ey are from Missionaries for the Pre-born. No child should ever have to see images
of real babies torn to pieces regardless of weather it is legal to have abortions or not.
I would appreciate it if this message gets to the appropriate person so something can be done, Please get back to me.

Dear Council Members-
it has become apparent to me the Council is leaning in favor of initiating a twenty-five cent fee for the Shuttle. As
General Manager for Old Captol Town Center, I would Pike to respecttully ask this Shuttle continue to be free.
While I realize the income is a consideration, the overall impact on the parking issues, real or perceived, will
be compounded by the increased automobile traffic downtown. Parking is already a concern with my customers
and tenants...new and prospective. The statistics have shown if the fee is initiated, those riders will use their own
personal vehicles. I am sure you are all aware of the need to revitalize our retail base. and overcoming our parking
issue is essential to that. Please lend consideration to this request, and I am sure the retail community would
agree. If there is anything I can do to shed further light on this issue. please let me know.

Dear Council members,
I'm writing to express my concern over the fate of the parking lot adjacent to the Public Library. I understand
that it is about to be sold. My family and I use the existing library lot several times per week, and without it we
would be much less inclined to make such frequent visits.
It's impossible to park near the Library on the street for the time that it takes to escort a toddler safely down
the block, go to story hour, check out books and get back without getting a $3 ticket on the one-hour meters. It's
also dangerous and a major hassle to cross streets when trying to juggle books and one child, much less two or
more kids.
If a structure is built on the parking lot site, it's imperative that it provide parking for Library users, preferably
under ground for aesthetic reasons.
A grassy area abutting the ped mall where the parking lot now sits would be a wonderful addition for all!
Imagine having a picnic lunch, art fairs, and even the butterfly exhibit on a green park instead of on the asphalt.
I hope that the building proposed for the site will be required to be in keeping with the original 1800's
architecture of the ped mall. Wouldn't it be nice to make Iowa City back into the attractive, charming
downtown it once was!

small children I have a strong interest in the family-oriented activities and surroundings
that downtown has to offer. 1 am writing in particular about the parking lot adjacent to the
library, which the city is planning to develop. As the last significant piece of downtown
real estate, this space must be developed wisely with an eye to aesthetics, downtown
character, and the needs of the large numbers of families with young children now living
in Iowa City. I strongly urge you to make sure that any development that goes into this
site does not take away from the charm and surroundings of this family friendly.
Additionally, with the loss of Mind Matters Toys and Freshens, both significant draws
to the pedestrian mall for families this comes at an especially difficult time as we are
about to lose the outdoor play structure for over a year due to library construction.
It is important to our family, as it is to many others~ to support downtown locally-owned
businesses to ensure that the heart of Iowa City remains vibrant and charming as well as
to support our fellow citizens as that can only add to the financial health of our town. But
as family4riendly activities and retail leave the Pedestrian Mall, it becomes more and
more inconvenient to do so.
It would be a real boon to the downtown if the city required any proposed development to
include at least one space for a family-oriented organization. It offers the closeness of
small town life yet boasts the sophisticated, one-of-a-kind businesses found in urban
centers: those qualities are threatened when the downtown becomes more service than
retail. I urge you to take time with the decision to develop this parking lot. 1 urge you to
take input from citizens who are concerned about what will happen to this space. Thank
you for considering my comments.

Dear Council Members,
1 am writing you over concern for the future vitality of downtown Iowa City. 1 am concerned about
parking for it to revitalize. Parking is essential and is the reason that malls such as Coral Ridge mall are
so successful. I personsally believe that markedly reducing parking on lowa street is a mistake. Ramps
just are not a substitute for on street parking for the small businesses to survive. I read about a town out
east that removed on street parking for beutification and built a ramp which caused the businesses to
suffer and when they returned the parking it returned to profitability.
At this time, 1 am exceedingly concerned over the possibility of selling the lot at Gilbert end College
streets by the library for a high rise apartment building. It would remove a vital surface lot used by people
to do business in the downtown businesses. Another apartment building would remove this parking and
flood the streets with many more cars, as adequate parking is never provided for those living in the
apartments and visiting there.
The interests of the Iowa City citizens should be taken into aeeoant before this lot is sold as it is our
community that we are concerned about.
1 am enxious to hear your comments regarding this.

I share your concern about this issue and will be working to see that we do
not dismantle the existing bottle and can redemption law. There are forces
working to radically change the existing system. I will oppose these
efforts.
Unfortunately, proposals to expand the existing law are dead for this year.
The proponents of expansion held a rally at the State Capitol this week. It
was artended by Governor Ray, Bratstad and Vilsack. All spoke in favor of
expansion.

Thanks for your comments, Dale. Currently, the bill is stuck in Ways and Means and I don't know if it will get
out of committee so we can even "fix" it on the floor. I do suppod expansion and I do support increasing the
handling fee. I do not suppod dismantling our current system. And most lowarts as well as three Governors
feel the same way! It appears there are only certain legislators, grocers and distributors who object to

As directed by Title 9, Chapter 1, Section 3B of the City Code, this is to advise the City
Council of the following action.
Action:
Pursuant to Section 9-1-3A(10), signage indicating NO PARKING ANY TIME will be
erected on the east side of Union Road between the driveway of the residence at 2008
Union Road and Arizona Avenue.
Comment:
This portion of Union Road is a relatively tight curve on a 25-feet wide street. The Police
Department and Streets Division have requested a No Parking Any Time zone be
established in this area because of visibility problems and maintenance problems due to
parked cars. On-street parking will continue to be allowed on the remainder of one side
of Union Road and the bulb-out portion of Union Road.

I am writin9 to you in advance of tomorrow's Council meetin9 to inform I would like to address the Council regarding the
above-mentioned item as drafted in the Consent Calendar.
Had I known that this item would be voted on before there was Public Discussion, I would have contacted you much
sooner! I was not aware that this issue was included in the Consent Calendar until today when I stopped in to the City
Clerk's Office to pick up an agenda.
Attached for your consideration are the reasons that I am opposed to this issue as drafted (UnionRcodText,rt0. I request
that you review this along with the attached diagrem (UnionRoadDiagram.lxlf) I include this graphic is case you are not
familiar with the situation at Union Road. I will be delivering this correspondence to the City Clerk as well in case you
cannot open the attachments.
It is my understanding that this issue was requested by the Police Department and City Streets Division. While it was
exp~ined to me by Jeff Davison Of Traffic Engineering that issues of safety do not necessarily require resident
involvement, I would hope you would agrea with me that such a major change to our neighborhood should involve the
residents. No one to my knowled0e who lives on Union Road was involved in drafting this issue~ The Traffic Engineer
Department did not send us any survey.
I will be attending the Council meetin9 tomorrow and make myself available for further discussion should you have any
questions regarding my correspondence.
Again, let me urge you to remove this item from the General Consent Calendar and vote separately not to pass this issue
as drafted.

Thank you for allowing me the opportunity to voice my concern regarding the proposed changes to the parking zoning on my street as
described in "Item 4.f(14) a: Designation of a NO PARKING ANY TIME zone on the east side of Union Road between the driveway
at 2008 Union Road and Arizona Avenue." on the Iowa City City Council Agenda for April 17, 2001
While I do not disagree that the curve at my road can be potentially dangerous at times; and I am probably the least affected by this
proposed change since I would still have street parking south of my driveway for visiting guests, I feel it is my civil duty to express
my concern about this issue.
I would like to list some reasons for your consideration before you vote on this matter:
1. Current Situation regarding Accidents
I requested an incident/traffic report from the Police Department's Records Office on Union Road for the last five years, There
appears to be less than a dozen reports involving vehicles in the last five years (mostly illegal parking) and only two actual
"accidents" for this period. The proposal as drafted seems over-restrictive.
2. Neiv, hborhood PreCedance re~ardinR Parking Restrictions
I took the opportunity to make a quick survey of my surrounding neighborhood to see if there was a preeedance that Iowa City
has established with narrow curved roads similar to mine. I was unable to find any instance where reads like mine have similar
parking restrictions. There was only one street that had any restriction and that consisted of a 25-foot length designated as NO
PARKING LOADING ZONE 8am-Spin SCHOOL DAYS. The proposal also alluded to snow-removal problems. This type of
zoning seems conducive to resolving this problend.
3. Creatin~ a Speed Corridor on Union Road
I feel that by eliminating parking on the east side of Union Road will actually increase the potential of vehicle accidents. The
benefit of having cars on the east side is that at least we do not have fast traffic in both directions! Currently worst offendors are
those drivers entering the subdivision from Hwy 6 at speeds in excess of the speed limit. Posting speed limits at the entrance to
Union Road would help alleviate this problem.
4. Changinlt the "feel" of the Neighborhood
Although I do not by any means presume to speak for my neighbors, I feel this proposed change will affect the fabric of the
neighborhood for the worst. lfUnion Road is cleared of all "obstacles," traffic has the potential to intensify and increase the
possibility of accidonts. Union Read would no longer be a "residential street" but merely a "thru-street" with houses on it.
5. Burden on the Residents
If this resolution is passed, there are four neighbors who will not have ANY street parking. It was stated in the letter I received
that parking in the "bulb out" on Union Road would still remain available. The inference was that those without street-parking
enuld use this area. Thore is very limited parking in this cul~e-sac and seems like little consequence to those residents. It also
seems that the residents in the cul-de-sac should have been notified on this matter to allow them to voice their concerns.
6. Lowering Property Values
Recently our house was revalued to a higher amount by the City Assessor. While some might find this an incenveaiencc having to
pay higher taxes, I take it as a compliment. It shows that the hard work and pride I take in improving my home is being noticed. I
believe that this resolution if passed would make my house less desirable by prospective buyers and therefore lowering its value.
I conclude by stating that 1 am not opposed to changes to our current parking zoning--I think any improvement to the neighborhood is
a benefit. I am however much opposed this proposal as drafted. The residents do not seem to be the root of the problem; it is the
drivers who speed though our neighborhood that are causing the potential for accidents.
Please do not pass this issue as drafted. Allow the residents of Union Road to have involvement and a say in how to improve oar
neighborhood! ~:~

Comment:
This block of Willow Street is on a vertical curve with parking permitted on the east side
of the street. Northbound traffic must pull into the oncoming lane in order to get around
parked cars, with visibility restricted because of the hill. This action will eliminate the
necessity of pulling into the oncoming lane of traffic. This action will also increase
visibility for the Lucas Elementary School pedestrian crossing which is located near the
crest of the hill. On street parking will remain on the east side of Willow Street between
Pinecrest Road and Brookside Drive.

At 2:00 p.m. today I called the police from my cell phone to ask them to
have
a vehicle towed that was in my parking spot in the back alley. The
dispatcher told me to hold. After nearly 5 minutes I hung up because the
call had already cost me 60 cents. I parked in front of the store, called
the ICPD from the store and was told someone would call when they were in
the
alley. I was not told how long I would have to wait, so I assumed it would
be the normal 20 minutes or so as I have experienced in the past.
Twice, I moved my car from the front of the store to avoid a parking ticket
(there were no metered spots). Now it is 4:00 p.m. and I have to leave to
show an apartment. The police department just called and said that the
officer is there to tow & ticket the vehicle. I told the dispatcher that I
am ready to leave work now and that I no longer need the space, nor do I
think the person is even still back there because it's been 2 hours since I
called this in.
She proceeded to reprimand me for not calling to cancel the call. When I
told her that I had waited far too long for them to show up and now I have
to
leave for an appointment, she reprimanded me again saying that I disrupted
their busy afternoon.
Beoause of the fact that the police didn't show up, I now have to drive
across town to Hills Bank (at the worst possible time to drive in this
stinking town) with my bank deposit as the downtown bank closes at 4:00 and
I
couldn't leave the store while I was waiting for the officer so I could sign
the complaint.
So, between the cell phone call, the waiting, the moving my car, the
waiting,
and now driving across town for something I usually walk to in 5 minutes, I
ask you --- whose afternoon was interrupted?????

individuals with impaired respiratory function, including asthmatics and those with obstructive airway
disease; and
WHEREAS, according to a study done by RMA in August 2000, 93% of the people in Iowa City and
Coralville believe that second-hand smoke is a health risk, and 74% support restrictions on smoking in
public places; and
WHEREAS, it is in the best interest of the people of the City of lowa City to protect the health of persons
affected by the smoking of others while in indoor areas open to the public, public meetings, food service
establishments, and places of employment by restricting involuntary exposure to environmental tobacco
smoke; and
THEREFORE, the purpose of this ordinance is to preserve and improve the health, comfort, and
enviromment of the people of the City of Iowa City by further limiting exposure to environmental tobacco
smoke.
SECTION I DEFINITIONS:
1. BAR means an establishment or portion of an establishment where one can purchase and consume
alcoholic beverages as defined in the Iowa Code section 123.3, subsection 4, but excluding any
establishment or portion of the establishment having table and seating facilities for serving of meals to
more than fifty people at one time and where, in consideration of payment, meals are served at tables
to the public.
2. PUBLIC MEETING means a gathering in person of the members of a government body, whether an
open or a closed session under chapter 21.
3. SMOKING means the carrying of or control over a lighted cigar, cigarette, pipe or other lighted
smoking equipment.
4. PUBLIC PLACE means any enclosed indoor area used by the general public or serving as a place of
work containing two hundred fifty or more square feet of floor space, including, but not limited to, all
restaurants, all retain stores, lobbies and malls, offices, including waiting rooms, and other commercial
establishments; public conveyances with departures, travel, and destination entirely within this state;
educational facilities; hospitals, clinics, nursing homes, and other health car and medical facilities; and
auditoriums, elevators, theaters, libraries, an museums, concert halls, indoor arenas, and meeting
rooms. "Public Place" does not include a retail store where tobacco or tobacco products are sold, a
private, enclosed office occupied exclusively by smokers even though the office may be visited by
nonsmokem, a room used primarily as the residence of students or other persons at an educational
facility, a sleeping room in a motel or hotel, or each resident's room in a health care facility. The
person in custody or control of the facility shall provide a sufficient number of rooms in which
smoking is not permitted to accommodate all persons who desire such rooms.
5. EMPLOYEE means any person who is employed by any employer in consideration for direct or
indirect monetary wages or profit, any person who volunteers his or her services a non-profit entity.
If any provision, clause, sentence or paragraph of this Ordinance or the application thereof to any person or
circumstances shall be held invalid, such invalidity shall not affect the other provisions of this article which
can be given effect without the invalid provision or application, and to this end the provisions of this article
are declared to be severable.
SECTION 8 EFFECTIVE DATE:
This Ordinance shall be effective thirty (30) days from and atter the date of its adoption.
