RESOLUTION TO ISSUE CIGARETTE PERMITS
WHEREAS, the following firms and persons have made application and paid the mulct tax
required by law for the sale of cigarettes,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA
CITY, IOWA, THAT: the applications be granted and the City Clerk is hereby directed to issue a

RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK
TO ATTEST TO THE RELEASE OF LIEN REGARDING A MORTGAGE FOR
THE PROPERTY LOCATED AT 613 RONALDS STREET, IOWA CITY, IOWA.
WHEREAS, on October 6, 2000, the owner executed an Mortgage with the City of Iowa
City; and
WHEREAS, the terms of the loan have been satisfied; and
WHEREAS, it is the City of Iowa City's responsibility to release this lien.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
IOWA CITY, IOWA that the Mayor is authorized to sign and the City Clerk to attest the
attached Release of Lien for recordation, whereby the City does release the property
located at 613 Ronalds Street, Iowa City, Iowa from a Mortgage, recorded October 17,
2000, Book 3012, Page 62 through Page 68 of the Johnson County Recorder's Office.

RESOLUTION ACCEPTING THE WORK FOR THE
2005 TRAFFIC SIGNALIZATION PROJECT
WHEREAS, the Engineering Division has recommended that the work for construction of the
2005 Traffic Signalization Project, as included in a contract between the City of Iowa City and
Advanced Electrical Services, Inc. of Iowa City, dated July 21,2005, be accepted; and
WHEREAS, the Engineer's Report and the performance and payment bond has been filed in the
City Clerk's office; and
WHEREAS, the final contract price is $412,091.12.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA
CITY, IOWA, THAT said improvements are hereby accepted by the City of Iowa City, Iowa.

RESOLUTION NO. 05_-334
RESOLUTION ESTABLISHING A YOUTH ADVISORY COMMISSION FOR
THE CITY OF IOWA CITY, IOWA.
WHEREAS, the City Council of the City of Iowa City, Iowa deems it to be in the public interest
that the City Council establish a Youth Advisory Commission for the City of Iowa City, Iowa to
serve as an advisory body to the City Council.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA
CITY, IOWA, as follows:
1. A Youth Advisory Commission is hereby established for the City of Iowa City.
2. The mission of the Youth Advisory Commission is to promote understanding and
awareness of Iowa City among Iowa City youth, allow a select group of youth to help
make decisions concerning them and their peers, enable youth members to utilize and
expand on their leadership abilities, to serve as a mechanism for communication
between youth and adults in Iowa City and create a bridge whereon youth and adults
can develop partnerships.
3. The Youth Advisory Commission shall consist of seven (7) members appointed by the
City Council. All members of the Commission shall be residents of Iowa City. Four (4)
members shall be ages 15 to 17 on the date of appointment. Three (3) members shall
be ages 18 to 21 on the date of appointment. Said age requirements may be waived by
the Council due to a lack of applicants. All members shall serve without compensation,
except for reimbursable expenses.
4. The City Council shall appoint members to the Commission for staggered terms. All
appointments shall be for two (2) year terms, except for the initial appointments which
shall be as follows:
a. Two (2) persons appointed to the age 15-17 seats for two (2) year terms.
b. Two (2) persons appointed to the age 18-21 seats for two (2) year terms.
c. Two (2) persons appointed to the age 15-17 seats for one (1) year terms.
d. One (1) person appointed to the age 18-21 seats for a one (1) year term.
5. The Council shall choose one (1) council member to serve as the Council liaison to the
Youth Advisory Commission and one (1) council member to serve as an alternate
liaison. Said liaison shall interview persons applying to serve on the Commission and
make a recommendation to Council. Said liaison shall attend the Commission's
meetings.

6. The City Clerk of the City of Iowa City, Iowa shall be authorized to take whatever
administrative action is necessary to provide staff assistance and information necessary
to aid the Commission in the performance of its duties.
7. The Commission shall adopt a set of By-Laws to be approved by the City Council which
the Commission deems necessary and advisable for conducting the business of the
Commission, subject to the ordinances of the City of Iowa City, and in accordance with
the Iowa Open Meetings law.

upon approval by the City Attorney, to execute all legal documents relating to said
subdivision, and to certify a copy of this resolution, which shall be affixed to the final plat after

BACKGROUND INFORMATION:
The applicant, Southgate Development Co., is requesting approval of the final plat of Cardinal
Ridge - Parts Two and Three. A separate application has been submitted for the final plat of
Cardinal Ridge - Part One. On July 6, the Commission recommended approval of a rezoning,
Sensitive Area Development Plan and preliminary plat for Cardinal Ridge. The City Council is
scheduled to vote on the final reading of the rezoning ordinance and the preliminary plat at their
September 20th meeting.
ANALYSIS:
The final plats as submitted are in general conformance with the pending preliminary plat.
Construction plans and legal papers are being reviewed by the City Engineering Division and
City Attorney's office. They must be approved by staff prior to Council consideration of the final
plat.
As noted in the staff report for Cardinal Ridge - Part One, the Parks and Recreation Commission
may wish to require dedication of open space in Outlot C for the purpose of an east west trail.
Depending on the Parks and Recreation Commission's decision, the open space will need to be
identified on the plat or the legal papers will need to address payment of fees in lieu of open
space.
STAFF RECOMMENDATION:
Staff recommends that SUB05-00022, the final plat of Cardinal Ridge - Part Two, a 29.56-acre,
23-1ot residential subdivision and Cardinal Ridge - Part Three, a 27.89-acre, 19-1ot residential
subdivision located west of Kennedy Parkway, be approved subject to staff approval of legal
papers and construction drawings prior to City Council consideration.

BACKGROUND INFORMATION:
The applicant, Arlington Development Inc., is requesting approval of the final plat of Windsor
Ridge - Part Twenty One. The preliminary plat was approved in September 2004. The
applicant recently constructed an extension of Court Street to provide access to this property.
This subdivision will allow the development of two multi-family lots on Huntington Drive.

ANALYSIS:
The final plat as submitted is in general conformance with the approved preliminary plat.
Construction plans and legal papers are being reviewed by the City Engineering Division and
City Attorney's Office. They must be approved by staff prior to Council consideration of the final
plat.
The Neighborhood Open Space Ordinance requires that a development of this size dedicate .6
acres of open space or pay fees equivalent to the value of .6 acres of land. Although there is
no land with Windsor Ridge Part 21 that is appropriate for neighborhood open space, the
Northeast District Plan indicates the possibility of a trail just to the west and north of this
subdivision. Rather than requiring the dedication of land or payment of fees at this time, the
Parks and Recreation Commission is considering the transfer of the open space requirements
to the adjacent land under the ownership of the applicant. This will allow for the dedication of a
larger tract of open space at the time the adjacent land develops. The issue of transfer of open
space requirements to the adjacent property should be addressed in the legal papers.
A provision for the payment for the construction of future sidewalks on Taft Avenue should also
be contained in the legal papers.
STAFF RECOMMENDATION:
Staff recommends that SUB05-00006, the final plat of Windsor Ridge - Part Twenty One, a
10.66-acre, 2-lot residential subdivision located north of Court Street west of Taft Avenue, be
approved subject to staff approval of legal papers and construction drawings prior to City
Council consideration.

BACKGROUND INFORMATION:
The applicant, Third Street Partners, is requesting approval of the final plat of Village Green
Part XXIII, a 19.32-acre, 38-1ot subdivision. A separate application has been submitted for the
final plat of Village Green Part XXIV. A rezoning and preliminary plat and preliminary OPDH
plan for this property were approved by the City Council earlier this year.
ANALYSIS:
The final plat as submitted is in general conformance with the approved preliminary plat and
OPDH plan. Construction plans and legal papers are being reviewed by the City Engineering
Division and City Attorney's office. They must be approved by staff prior to Council
consideration of the final plat.

The preliminary OPDH plan included a landscaping buffer adjacent to the rail road right-of-way,
landscaping for the Outlots, landscaping for the zero-lot line dwellings and a private alley. The
responsibility for long term maintenance of these features by a home owner's association or
property owners should be addressed in the legal papers.
Payment of neighborhood open space fees, water main extension fees and sanitary sewer tap
on fees should also be addressed in the legal papers.
STAFF RECOMMENDATION:
Staff recommends that SUB05-00024, the final plat of Village Green Part XXlII, a 19.32- acre,
38-1ot residential subdivision located south of Wintergreen Drive, be approved subject to staff
approval of legal papers and construction drawings prior to City Council consideration.

RESOLUTION APPROVING OF AN AMENDMENT TO A PURCHASE
AGREEMENT BETWEEN THE CITY OF IOWA CITY AND WAL-IVIART REAL
ESTATE BUSINESS TRUST FOR APPROXIMATELY 21,76 ACRES OF
PROPERTY LYING WITHIN LOTS 10 THROUGH 17 OF NORTH AIRPORT
DEVELOPMENT SUBDIVISION AND LOTS 2, THROUGH 4 OF THE NORTH
AIRPORT DEVELOPMENT SUBDIVISION - PART TWO.
WHEREAS, The North Airport Development Subdivision and North Airport Development Part Two
Subdivision include commercial lots which have been marketed for sale to the general public; and
WHEREAS, City has entered into a purchase agreement for the sale of approximately 21.76 acres of
property lying within Lots 10 through 17 of North Airport Development Subdivision and Lots 2 through 4 of
the North Airport Development Subdivision - Part Two to Wal-Mart Real Estate Business Trust; and
WHEREAS, said purchase agreement provides for closing to occur upon completion of
contingencies set forth therein, no later than two hundred seventy (270) days after the February
9, 2005 effective date thereof, unless a later date is mutually agreed to in writing by the City and
Wal-Mart; and
WHEREAS, extension of the closing date provided for in the purchase agreement is necessary for
completion of the contingencies, and Wal-Mart has requested that purchase agreement be
amended such that the closing shall take place not later than January 31, 2006, in accordance
with the FIRST AMENDMENT TO PURCHASE AGREEMENT attached hereto.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA
CITY, IOWA, THAT:
1. The City Council hereby approves in form and substance, and the Mayor and City Clerk
are hereby authorized to execute, the attached FIRST AMENDMENT TO PURCHASE

THE CITY OF IOWA CITY, IOWA ("Seller")
WAL-MART REAL ESTATE BUSINESS TRUST, a Delaware statutory trust ("Buyer")
WHEREAS, Seller and Price Properties ("Price") entered into a Purchase Agreement (the
"Purchase Agreement") dated effective February 9, 2005, covering approximately 21.76 acres of
property out of North Airport Development Subdivision and North Airport Development
Subdivision Part Two, a Resubdivision of Lots 1-4 of North Airport Development Subdivision,
located in the City of Iowa City, Johnson County, Iowa, as described and/or depicted on Exhibit
A attached to the Purchase Agreement and incorporated herein by this reference for all purposes;
and
WHEREAS, the rights, title and interests of Price under the Purchase Agreement were
assigned to Buyer pursuant to that certain Assignment of Purchase Agreement dated April 6,
2005; and
WHEREAS, Seller and Buyer have agreed to amend the Purchase Agreement as
hereinafter set forth;
NOW THEREFORE, for and in consideration of the mutual covenants of the parties as
set forth in the Purchase Agreement and herein, and other good and valuable considerations, the
receipt and sufficiency of which are hereby acknowledged by each of the parties, it is agreed by
Seller and Buyer as follows:
1. Interpretationl Definitions. This First Amendment to Purchase Agreement (the
"First Amendment") shall be construed with and as a part of the Purchase
Agreement. In the event of any conflict between the terms of this First
Amendment and the terms of the Purchase Agreement, the terms of this First
Amendment shall be deemed to supersede and control. All defined terms used in
this First Amendment shall have the respective definitions proVided for such
defined terms in the Purchase Agreement unless herein otherwise expressly
provided.
2. Closing Date. Section 16(a) of the Purchase Agreement is hereby amended to
provide that the Closing of the transaction provided for in the Purchase
Agreement shall take place at a place and time mutually agreed upon by the
parties, but not later than January 31, 2006, unless mutually agreed to in writing
by Seller and Buyer.

3. Counterparts. This First Amendment may be executed in multiple counterparts,
each of which shall be deemed to be an original, but all of which, together, shall
constitute but one and the same instrument. Execution of this First Amendment
by Seller and Buyer may be evidenced by the facsimile or electronic transmission
(e-mail) exchange of separately executed counterparts.
4. Affirmation. Except as herein amended, the Purchase Agreement is hereby
ratified and affirmed in its entirety by the parties.

A RESOLUTION SUPPORTING THE DEVELOPMENT OF AFFORDABLE HOUSING
IN THE CITY OF IOWA CITY AND AUTHORIZING THE MAYOR TO SIGN A LETTER
OF SUPPORT TO FULFILL THE THRESHOLD REQUIREMENTS OF THE LOW
INCOME HOUSING TAX CREDIT APPLICATION.
WHEREAS, the City of Iowa City, Iowa has been informed by Johnson County Permanent Supportive
Housing Limited Partnership that a Low°Income Housing Tax Credit Application will be filed with the Iowa
Finance Authority for the development of affordable rental housing to be located on Melrose Avenue,
Iowa City, Iowa with the legal description as follows:
A portion of the northeast one-quarter of the northeast one-quarter of Section 13, Township 79
north, Range 7 west of the 5th Principal Meridian, City of Iowa City, Johnson County, Iowa, more
particularly described as follows:

WHEREAS, the Johnson County Permanent Supportive Housing Limited Partnership has asked for and
been awarded local assistance through City HOME funds;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Iowa City, Iowa that we support
and approve the development of the aforesaid housing in our community, subject to city ordinances and
the building permit process. This resolution is effective until December 31, 2007. In the event that any of
the characteristics mentioned above should change prior to issuance of a building permit, this resolution
is null and void.

Project Summary
Project Description
Melrose Ridge addresses the need for permanent supportive housing identified by the City of
Iowa City (in CITY STEPS 2006-2010), Johnson County (in the MH/DD 2003 Needs
Assessment) and the State (in the Governor's Housing Task Force Report and the Governor's
2004 initiative to add 1,000 units to the housing stock for persons with disabilities).
Melrose Ridge will consist of two buildings, each with eight one-bedroom dwelling units and one
two-bedroom unit for a total of 18 units. Each apartment will have a full kitchen and bathroom.
All apartments will open into a common area at the center of the building, which will include a
multipurpose area, a computer learning center, laundry facilities, a community kitchen, a TV
lounge, and a management/supportive service office.
All of the units will be rented to households with incomes at or below 50% of the area median
income. In addition, 11 of the 18 units will be rented to households with incomes at or below
40% of the area median income. Section 8 rental assistance will be accepted and priority will
be given to persons with chronic and persistent mental illness. All 18 units will be accessible.
Chatham Oaks, Inc., the General Partner of the Johnson County Permanent Supportive
Housing Limited Partnership, will be the landlord of the project. They will offer 24 hour crisis
assistance, transportation coordination, and direct services. All services will be optional and
tailored to meet the individual tenant's needs. Tenants are welcome to secure supportive
services from other providers as well. The National Alliance for the Mentally III of Johnson
County is the Limited Partner of the Johnson County Permanent Supportive Housing Limited
Partnership.
Burns & Burns, L.C. is acting as a consultant to the Limited Partnership to help secure the
funding and develop the property. They will also initially help manage Melrose Ridge and train
Chatham Oaks, Inc. on management specifics.
Melrose Ridge will be located on the southwest corner of the intersection of Melrose Avenue
and Highway 218 on land that will be leased from Johnson County. The site is directly east of
Chatham Oaks.
Project Funding
Melrose Ridge was awarded HOME funds from the City of Iowa City in FY06. The next step to
secure the funding needed for this project is to apply for State HOME funds and Low Income
Housing Tax Credits (LIHTC). This joint application is due in November 2005. A resolution of
support from the City of Iowa City is an element of the LIHTC application scoring process and
will increase the chance that Melrose Ridge is awarded funding from the State.

CONSTRUCTION OF A DUPLEX HOME LOCATED ON LOT 12, LONGFELLOW MANOR SUBDIVISION,
UNDER THE AFFORDABLE DREAM HOME OPPORTUNITIES PROGRAM
Sealed proposals will be received by the City Clerk of the City of Iowa City, Iowa, until 1:30 P.M. on the 6th
day of October, 2005, or at a later date and/or time as determined by the Director of Housing and Inspection
Services or designee, with notice of said later date and/or time to be published as required by law. Sealed
proposals will be opened immediately thereafter by the Director of Housing and Inspection Services or
designee. Bids submitted by fax machine shall not be deemed a "sealed bid" for purposes of this Project.
Proposals will be acted upon by the City Council at a meeting to be held in the Emma J. Harvat Hall at 7:00
P.M. on the 18th day of October, 2005, or at such later time and place as may be scheduled.
The Project will involve the following:
Construction of a single-family home and all necessary site work on Lot 12, Longfellow Manor
Subdivision, Iowa City, Iowa
All work is to be done in strict compliance with the plans and specifications which have heretofore been
approved by the City Council, and are on file for public examination in the Office of the City Clerk.
Each proposal shall be completed on a form furnished by the City and must be accompanied in a sealed
envelope, separate from the one containing the proposal, by a bid bond executed by a corporation
authorized to contract as a surety in the State of Iowa, in the sum of 5% of the bid. The bid security shall be
made payable to the TREASURER OF THE CITY OF IOWA CITY, IOWA, and shall be forfeited to the City of
Iowa City in the event the successful bidder fails to enter into a contract within ten (10) calendar days and
post bond satisfactory to the City ensuring the faithful performance of the contract and maintenance of said
Project, if required, pursuant to the provisions of this notice and the other contract documents. Bid bonds of
the lowest two or more bidders may be retained for a period of not to exceed fifteen (15) calendar days until a
contract is awarded, or until rejection is made. Other bid bonds will be returned after the canvass and tabula-
tion of bids is completed and reported to the City Council.
The successful bidder will be required to furnish a bond in an amount equal to one hundred percent (100%)
of the contract price, said bond to be issued by a responsible surety approved by the City Council, and shall
guarantee the prompt payment of all materials and labor, and also protect and save harmless the City from
all claims and damages of any kind caused directly or indirectly by the operation of the contract, and shall
also guarantee the maintenance of the improvement for a period of one (1) year from and after its completion
and formal acceptance by the City.
The following limitations shall apply to this Project:
Completion Date: May 15, 2006
Liquidated Damages: $100 per day
The plans, specifications and proposed contract documents may be examined at the office of the City Clerk.
Copies of said plans and specifications and form of proposal blanks may be secured at the Office of the
Director of Housing and Inspection Services, Iowa City, Iowa, by bona fide bidders.
Prospective bidders are advised that the City of Iowa City desires to employ minority contractors and
subcontractors on City projects.
Bidders shall list on the Form of Proposal the names of persons, firms, companies or other parties with
whom the bidder intends to subcontract. This list shall include the type of work and approximate subcontract
amount(s).
The Contractor awarded the contract shall submit a list on the Form of Agreement of the proposed
subcontractors, together with quantities, unit prices and extended dollar amounts. If no minority business
enterprises (MBE) are utilized, the Contractor shall furnish documentation of all reasonable, good faith efforts
to recruit MBE's.
A listing of minority contractors can be obtained from the Iowa Department of Economic Development at
(515) 242-4721.
By virtue of statutory authority, preference will be given to products and provisions grown and coal produced
within the State of Iowa, and to Iowa domestic labor, to the extent lawfully required under Iowa Statutes. The
Iowa Reciprocal Preference Act applies to the contract with respect to bidders who are not Iowa residents.
The City reserves the right to reject any or all proposals, and also reserves the right to waive technicalities
and irregularities.

SIGN AND THE CITY CLERK TO ATTEST A CONTRACT WITH TODD
HACKETT CONSTRUCTION COMPANY FOR THE CONSTRUCTION OF A
DUPLEX HOME UNDER THE AFFORDABLE DREAM HOME OPPORTUNITIES
PROGRAM.
WHEREAS, the City Council of the City of Iowa City functions as the Iowa City Housing Authority;
and
WHEREAS, on September 14, 1993, City Council considered and passed Resolution No. 93-255,
approving a Section 5(h) Implementing Agreement with HUD for the conversion of public housing
to private ownership, also known as the Tenant-to-Ownership program; and
WHEREAS, under this agreement the proceeds for such sales must be used to expand affordable
housing opportunities in Iowa City; and
WHEREAS, the Iowa City Housing Authority has negotiated a contract with Todd Hackett
Construction Company, for the construction of a duplex structure located on Longfellow Place in
the amount of $288,000; and
WHEREAS, the duplex homes would be sold under the Affordable Dream Home Opportunities
Program to two families who earn up to 80% of the median income; and
WHEREAS, the duplex homes would benefit the citizens of Iowa City by expanding affordable
home ownership opportunities.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA
CITY, IOWA, THAT:
Under the direction of the City Attorney, the Mayor and the City Clerk are hereby authorized to
sign and attest a contract between the City of Iowa City and Todd Hackett Construction Company
for the construction and acquisition of a duplex dwelling located in Longfellow Manor Subdivision.

RESOLUTION APPROVING THE CALL TO ARTISTS FOR THE WETHERBY
FRIENDS AND NEIGHBORS NEIGHBORHOOD ART PROJECT
WHEREAS, the Iowa City Public Art Program Acquisition Procedures provide for City Council
consideration of each "Call to Artists" and project budget; and
WHEREAS, the Public Art Advisory Committee has determined that the art in the
neighborhoods is one of the primary focuses of the Public Art Program for the next several
years; and
WHEREAS, the Public Art Advisory Committee, approved the Call to Artists presented for the
Wetherby Neighborhood Art project at their October 6 meeting.

CALL TO ARTISTS
The Wetherby Friends and Neighbors Neighborhood Association has presented a
proposal to the Iowa City Public Art Advisory Committee and has been approved to
participate in the ]~owa City Neighborhood Art Project. The Neighborhood
Association is pleased to invite artists from ]:owa City and its surrounding
communities to submit proposals and portfolio materials to be considered for the
design, construction and installation of the following:
-design, construction and installation of a "Wethervane" that will be
installed on top of the Wetherby Park shelter. The roof includes a cupola
and the weathervane must be designed to be structurally compatible with
both the roof and cupola.
-design, construction and installation of o metal roiling and post system that
will be installed in the Wetherby Park Shelter. The previous railing was
repeatedly vandalized and subsequently completely removed.
Wetherby Park is a 24.3 acre park located on the south side of Iowa City at the
end of Taylor Drive. The park has been renovated with new playground equipment,
trail system, basketball court and landscaping. The original shelter was reoriented
and rehabilitated with new rest rooms, railings and roof/cupola. The railing system
could not withstand heavy and sometimes abusive use and was removed.
Project Goals:
· To define the character of the Wetherby neighborhood in the design of both
the "Wethervane" and shelter railing.
· To provide the residents of the Wetherby neighborhood the opportunity to
participate in the selection of themes, designs, and artists for the weathervane
and railing.
· To create an aesthetic feature to the neighborhood, unifying its diverse
population.
The Wetherby neighborhood has determined a number of themes for the
weathervone and roiling, although other ideas will be considered:
· The "Wethervone" should reflect the heritage of the neighborhood. ]:saac
Augustus Wetherby, the nome sake of the pork, was considered to be
City's First Photographer'. He lived in ]:owo City during the t860-70's and is
buried in Oakland Cemetery. The Wetherby neighborhood also lies on what was
primarily agricultural land and that should be reflected os part of the heritage
of the neighborhood.
· The Wetherby Shelter roiling should reflect the current culture of the
neighborhood; one that is diverse in age, race, and background. The roiling must
be industrial strength. Other supporting posts of the shelter may be
incorporated into the design by pointing or replacing with comparable supporting
capabilities. Some may be removed if not structural. Any and oll structural
changes must be reviewed and approved by Terry Trueblood, Pork and
Recreation Director or his designee.
· There is approximately $12,000.00 -15,000.00 available for completion of these
two project including all design, materials, fabrication, installation and
coordination costs.
Project Time Line
· Deadline for submissions by interested artists - November 18, 2005
· Presentation by artist to the Wetherby F&N Neighborhood Association -
Wednesday, November 30, 2005 - 7:00 PM.
· 5election of Artist by neighborhood association - no later than December

· Determine final details of design, budget and timeframe and present to
Public Art Advisory Committee and the City Council - February, 2006

Selection Process:
The concept for this process has been initially reviewed by the ]:owo City Public Art
Advisory Committee and approved. Proposals received from artists will be reviewed
by the Wetherby F&N Neighborhood Association in November, 2005 and a
recommendation mode to the Public Art Advisory Committee and City Council for
final approval per the above schedule. The artist may be requested to attend one
or oll of these meetings.
Eligibilily:
A professional artist living in Iowa who has experience in working with the proposed
materials and has the design experience to create lively, attractive and inviting
artwork.
Artist must document their ability and interest in working with the neighborhood
residents to further define the subject matter and design of the weathervane and
railing if necessary.
Artist must document ability to work closely with City staff to see the project
completed to the installation.

RESOLUTION APPROVING AN AGREEMENT BETWEEN THE CITY OF IOWA
CITY AND JOHNSON COUNTY DOGPAC FOR CONSTRUCTION OF
IMPROVEMENTS FOR A DOG PARK WITHIN THE PENINSULA PARKLAND.
WHEREAS, the City and Johnson County DogPAC, a private non-profit corporation which
advocates for the development of dog parks and other dog activities in and around Iowa City,
wish to cooperatively develop and maintain an off-leash dog park within 10 to 12 acres of land
located within the Peninsula Parkland owned by the City;
WHEREAS, Johnson County DogPAC has requested permission to contract with private entities
for the construction of infrastructure and improvements for said dog park, on the basis of an
agreement pursuant to which the City would allow such construction and DogPAC would agree to
obtain prior approval of said contracts by the Director of Public Works and/or the Director of Parks
and Recreation, and hold harmless, indemnify and provide appropriate insurance to the City for
claims related to the construction work; and
WHEREAS the City Council finds it is in the public interest to enter into said agreement for the
development of the dog park, in a form approved by the City Attorney's Office, Director of Public
Works and Director of Parks and Recreation.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF IOWA CITY,
IOWA, that:
The Mayor and City Clerk are hereby authorized and directed to execute an agreement
approved by the City Attorney's Office, Director of Public Works and Director of Parks and
Recreation, pursuant to which the City would allow DogPAC to contract with private entites
for the construction of infrastructure and improvements for the dog park, and DogPAC
would agree to obtain prior approval of said contracts by the Director of Public Works
and/or the Director of Parks and Recreation, and hold harmless, indemnify and provide
appropriate insurance to the City for claims related to the construction work.

MEMORIAL DONATION POLICY.
WHEREAS, from time to time the City of Iowa City's Department of Parks & Recreation receives
requests to make memorial donations;
WHEREAS, the City desires to adopt a policy regarding memorial donations that is consistent with
the mission of the Parks & Recreation Department to provide the community with high quality and
cost efficient parks, facilities and recreational and cultural opportunities, and to maintain, enhance
and promote those programs and facilities; and
WHEREAS, the attached Memorial Donation Policy is consistent with said mission.

MEMORIAL DONATION POLICY
Memorial donations that are consistent with this policy and the mission of the Parks and Recreation
Department and Commission to provide the community with high quality and cost efficient parks,
facilities and recreational and cultural opportunities and to maintain, enhance and promote those programs
and facilities may be accepted as set forth herein.
PURPOSES AND CONTENT:
1. Memorials should further at least one of the following purposes:
a. 'Fo honor / recognize deceased loved ones, outstanding citizens or community
organizations.
b. rI'o enhance the aesthetics of the park / area in which the memorial is located.
c. To serve a functional purpose for the park / area in which the memorial is located.
d. To contribute to the environment of the area immediately surrounding the memorial.
2. To be eligible for acceptance memorials shall not:
a. Proselytize a particular point of view or contain political viewpoints or material;
b. Advertise or be a commercial promotion;
c. Contain violent, defamatory, or sexually explicit language or pictures;
d. Make a solicitation for fundraising or charitable contributions;
e. Have the purpose or primary effect of advancing or inhibiting religion or cause
entanglement between the City and religion; or
f. Directly or indirectly indicate that the participation of persons is unwelcome,
objectionable or not solicited because of age, color, creed, disability, gender identity,
marital status, national origin, race, religion, sex or sexual orientation.
AESTHETICS AND LOCATION
In reaching a determination as to whether or not a donated item will be accepted, consideration shall be
given to design, color, size of the item, proposed location and whether or not it is tasteful and pleasing to
the eye. It must be considered an enhancement, not a distraction, to the aesthetics of the area.
Plaques, signs or engraving may be requested by the donor but are subject to approval at the time that
such donation is approved.
PROCESS
Memorial donations are initiated by completing an application form designed for this purpose and
available at the Department of Parks and Recreation.
Decisions on memorial items considered to be typical park amenities (e.g. benches, picnic tables, park
shelters, trees, drinking fountains, playground equipment, trash receptacles and flag poles) shall be made
by the Director of Parks and Recreation.
Decisions on memorials no__!t considered to be typical park amenities (e.g. sculptures, plaques, pieces of
art) shall be referred to the Parks and Recreation Commission with a staff recommendation. A decision
by the Parks and Recreation Commission may be reviewed by the City Council within 60 days of
notification of the Commission's decision. Notification to the City Council shall be effective upon the
Council's formal receipt and filing of the Commission's minutes containing a decision approving the
memorial and referencing the Council's 60-day period to review the donation. The memorial shall not be
installed until the City Council approves the memorial, the City Council waives its right to review the
memorial or the 60-day period expires, whichever occurs first.
INSTALLATION
The method of installation must be approved by the Director of the Parks and Recreation Department.
REMOVAL OR RELOCATION
The City reserves the right to remove or relocate the memorial. In the event of removal, the donating
party will be notified and given the opportunity to take possession of the memorial. In the event of
relocation, the City will notify the donating party of the proposed relocation and attempt to determine a
mutually agreeable location. However, the final decision on relocation will rest with the City.
Notification to the donating party will be by regular mail at the address listed on the Memorial
Application and shall be effective upon mailing. Notice will be given 10 days prior to removal or
relocation unless immediate removal or relocation is required due to safety concerns.
MAINTENANCE
The City shall perform routine maintenance but assumes no responsibility for replacing or repairing
donated items which are damaged or stolen.
PUBLIC ART
Public art proposed to be placed in parks shall be routed through the Public Art Advisory Committee in
accordance with adopted procedures, but shall also be submitted to the Parks and Recreation Commission
for review/endorsement.
