Setting Public Hearings. c,I-/0 I~ (1) CONSIDER A RESOLUTION SETTING A PUBLIC HEARING FOR MAY 15 ON AN ORDINANCE AMENDING TITLE 3 ENTITLED "CITY FINANCES, TAXATION, & FEES," CHAPTER 4 ENTITLED "SCHEDULE OF FEES, RATES, CHARGES, BONDS, FINES AND PENALTIES" OF THE CITY CODE TO INCREASE OR CHANGE THE RATES FOR FEES AND CHARGES FOR WASTEWATER SERVICE CHARGES. Comment: This resolution sets a public hearing on a proposed rate increase or changes for wastewater fees. The hearing will be held in the Civic Center Council Chambers at 7:00 p.m. May 15, 2001, to permit public input to be heard regarding proposed rate increases or changes for wastewater fees. The new rates are scheduled to go into effect for billings on or after August 1, 2001. The previous rate increase went into effect on August 1,2000. Resolutions. ,:>/- I o '7 (1) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO A'I'I'EST THE RELEASE OF A LIEN REGARDING A SECOND MORTGAGE, A PROMISSORY NOTE, AND A RESALE AGREEMENT FOR THE PROPERTY LOCATED AT 451 RUNDELL STREET, IOWA CITY, IOWA. Comment: In 1992, the previous owners of the property located at 451 Rundell Street received assistance through the City's Affordable Housing Program for the amount of $8,000. The financing was in the form of a loan. The property owners declared bankruptcy and the property was returned to the City. The City sold the property to another family below 80% median income; thus the lien can be released. May 1, 2001 City of Iowa City Page 3 ol-/o~' (2) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO A'I'FEST THE RELEASE OF A LIEN REGARDING A SECOND MORTGAGE AND APPROVAL OF THE SALE OF THE PROPERTY PURSUANT TO THE RESALE AGREEMENT FOR THE PROPERTY LOCATED AT 451 RUNDELL STREET, IOWA CITY, IOWA. Comment: In 1995, the current owners of the property located at 451 Rundell Street received assistance through the City's Affordable Housing Program for the amount of $30,000. The financing was in the form of a loan. The loan was paid off on April 20, 2001; thus the lien can now be released. 91-/ocl (3) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST THE RELEASE OF LIEN R.EGARDING TWO AMENDED MORTGAGES FOR THE PROPERTY LOCATED AT 531 CENTER STREET, IOWA CITY, IOWA. Comment: The owners of the property located at 531 Center Street received assistance through the City's Housing Rehabilitation Program totaling $10,464. The financing was in the form of a conditional occupancy loan ($4,464) and a five-year declining balance loan ($6,000). The balance of the amended loans has been forgiven; thus the lien can now be released. ~, lo//D (4) CONSIDER A RESOLUTION NAMING DEPOSITORIES. Comment: This resolution will include the following changes: 1) Brenton Bank was previously listed on the Resolution Naming Depositories with a depository limit of $50 million. Brenton Bank has become Wells Fargo Bank Iowa N.A., and therefore Brenton Bank is no longer on the depository listing; and 2) increase the maximum depository balance at Commercial Federal Bank. We are recommending an increase in the depository limit at Commercial Federal Bank from $35 million to $50 million. Additional investments at this institution would be cellateralized by the state sinking fund. (5) CONSIDER A RESOLUTION ACCEPTING THE WORK FOR THE IOWA CITY LANDFILL GAS COLLECTION SYSTEM. (REZ01-0003) Comment: At its April 5 meeting, by a vote of 6-1 (Erhardt voting no), the Planing and Zoning Commission recommended approval of the proposed Sensitive Areas Overlay Plan. An ordinance rezoning 24 acres from P, Public to SAO-5 Sensitive Area Overlay and amending the preliminary SAO plan of the Peninsula Neighborhood, an 82.1 acre development located at the west end of Foster Road. Comment: At its April 19 meeting, by a vote of 6-0, the Planning and Zoning Commission recommended approval of the rezoning and amended development plan. Consider an ordinance amending the zoning code Article (D), definitions, and Article (L) provisional uses, special exceptions and temporary uses, to allow accessory apartments in accessory buildings. (Second Consideration) Comment: At its March 1 meeting by a vote of 5-0 the Planning and Zoning Commission recommended approval of this amendment provided that an accessory apartment in an accessory building is no larger than 500 square feet and contains no more than one bedroom. Consider an ordinance changing the zoning designation by establishing a Conservation Overlay Zone for properties generally located south of Burlington Street along Governor and Lucas Streets. (Pass and Adopt) Comment: At its March 1 meeting by a vote of 4-1 the Planning and Zoning Commission recommended approval of the proposed Conservation Overlay Zone. The Historic Preservation Commission has recommended approval of the proposed overlay zone. Staff recommended approval in a memorandum dated February 9. Action: h. Comment: State legislation mandates municipalities amend their annual budgets by May 31. Detailed information on amendments have been available for public inspection since April 20, 2001. ITEM NO. 8. THE ISSUANCE OF $9,825,000 GENERAL OBLIGATION BONDS (FOR AN ESSENTIAL CORPORATE PURPOSE) OF IOWA CITY, IOWA. Comment: This public hearing is to receive public comment regarding the issuance of $9,825,000 General Obligation bonds and authorizes the City Clerk to publish the notice of hearing. Proceeds from the bonds will pay for the construction, reconstruction, and repairing of street improvements and water works, water mains and extensions; the construction, reconstruction, extension and improving of facilities useful for the collection, treatment and disposal of sewage and industrial waste in a sanitary manner, for the collection and disposal of surface waters and streams and drainage improvements; the rehabilitation, improvements and equipping of existing city parks; the reconstruction, extension and improvement of the Municipal Airport; the improvement of real estate for cemeteries and the construction and reconstruction of other cemetery facilities; the equipping of the fire, police, sanitation, street and civil defense departments; and acquiring and developing a geographic computer data base system for automated mapping and facilities management. a. Proceeds from the bonds will pay for the development, construction, improvement and equipping of a new city park; Civic Center HVAC replacement and the acquisition of art for public buildings. a. PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE FOSTER ROAD GRADING AND WATER MAIN PROJECT, ESTABLISHING AMOUNT OF BID SECURITY TO ACCOMPANY EACH BID, DIRECTING CITY CLERK TO PUBLISH ADVERTISEMENT FOR BIDS, AND FIXING TIME AND PLACE FOR RECEIPT OF BIDS. Comment: This project involves the installation of 24" water main, street grading, sanitary sewer upgrade and storm sewer culvert work on Foster Road extended from Dubuque Street to Prairie du Chien. PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE LONGFELLOW / TWAIN PEDESTRIAN TUNNEL PROJECT, ESTABLISHING AMOUNT OF BID SECURITY TO ACCOMPANY EACH BID, DIRECTING CITY CLERK TO PUBLISH ADVERTISEMENT FOR BIDS, AND FIXING TIME AND PLACE FOR RECEIPT OF BIDS. Comment: This project will construct a pedestrian tunnel under the Iowa Interstate Railroad near the Kirkwood Avenue and Lower Muscatine Avenue intersection. This project will link the Longfellow and Mark Twain neighborhoods with a pedestrian trail. The estimated construction cost is $250,000 of which $196,000 will provided by a Federal Transportation Enhancement Program grant. The remaining will be funded by Road Use taxes. a. CONSIDER AN ORDINANCE AMENDING TITLE 1, ENTITLED o1.' ;Sq b5 "ADMINISTRATION," CHAPTER 4, ENTITLED "GENERAL PENALTY," SECTION I(B) TO INCREASE THE MAXIMUM CRIMINAL PENALTY FOR SIMPLE MISDEMEANORS TO $500 AS AUTHORIZED BY STATE CODE. (PASS AND ADOPT) Comment: In accordance with State law this ordinance increases the maximum penalty for unscheduled simple misdemeanors to $500.00. Act.on: ~;~_./~.~ ITEM NO. 16. CONSIDER AN ORDINANCE AMENDING THE CITY CODE OF THE CITY OF IOWA CITY, IOWA, BY ENACTING NEW SECTIONS NUMBERED 4-2-3, ENTITLED "LOCAL REVIEW OF APPLICATION/INVESTIGATION OF APPLICANT"; SECTION 4-2-4, ENTITLED "NOTICE AND HEARING"; AND SECTION 4-2-5, ENTITLED "CIVIL PENALTIES"; REVISING SECTION 4-5-4 ENTITLED "REGULATION OF PERSONS UNDER LEGAL AGE"; ENACTING A NEW SECTION 4-5-6 ENTITLED "SALES TO INTOXICATED PERSONS"; AND ENACTING A NEW SECTION 4-5-7 ENTITLED "LIMITATIONS ON SALES," ALL OF WHICH PROVIDE FOR THE REGULATION OF ALCOHOL SALES. (SECOND CONSIDERATION) Comment: A public hearing was held on February 6 and continued to February 20 on the proposed ordinance. Changes in the ordinance were made by staff at the request of the Council after the close of the hearings. This ordinance implements administrative penalties in accordance with State Code and prohibits out-of-sight sales and drink specials. CONSIDER A RESOLUTION APPROVING, AUTHORIZING AND DIRECTING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST AN AGREEMENT BY AND BETWEEN THE CITY OF IOWA CITY AND MMS CONSULTANTS, INC. TO PROVIDE ENGINEERING CONSULTANT SERVICES FOR THE SOUTH SYCAMORE REGIONAL GREENSPACE AND STORM WATER PROJECT. Comment: This agreement authorizes MMS Consultants, Inc. to provide construction administration, construction observation and construction survey services related to the South Sycamore Regional Greenspace and Storm Water Project. The total cost of the services is $136,900 and will be funded by General Obligation bonds. Action: ITEM NO. 18. CONSIDER A RESOLUTION ADOPTING IOWA CITY'S FY02 ANNUAL oP/Z-7- ACTION PLAN, THAT IS PART OF IOWA CITY'S 2001-2006 CONSOLIDATED PLAN (CITY STEPS), AND AUTHORIZING THE CITY MANAGER TO SUBMIT SAID PLAN AND ALL NECESSARY CERTIFICATIONS TO THE U.S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT, AND DESIGNATING THE CITY MANAGER AS THE AUTHORIZED CHIEF EXECUTIVE OFFICER FOR THE CONSOLIDATED PLAN. Comment: At their March 22, 2001, meeting, the Iowa City Housing and Community Development Commission recommended a FY02 budget for Community Development Block Grant and HOME Investment Partnership Program monies. To receive federal fiscal year 2001 funding, this document must be submitted to the U.S. Department of Housing and Urban Development (HUD) by May 15, 2001.
