Resolutions. ol- I,~5 (1) CONSIDER A RESOLUTION ACCEPTING THE WORK FOR THE IOWA AVENUE STREETSCAPE PROJECT, PHASE I. Comment: See Engineer's Report. ol-/~7 (2) CONSIDER A RESOLUTION ACCEPTING THE DEDICATION OF OUTLOTS A AND B TO THE CITY OF IOWA CITY AS PLATTED IN THE SCOTT SIX INDUSTRIAL PARK, IOWA CITY, IOWA AND DECLARING IT OPEN FOR PUBLIC USE. Comment: The Subdivider's agreement for the Scott Six Industrial Park contemplated the dedication of Outlots A and B to the City of Iowa City for public use upon completion of construction of the Storm Water Management Plan and compliance with the Plan for three years. As these requirements have now been met, the Public Works Department now recommends acceptance of the dedication as being public interest. This Resolution accepts the dedication of the descdbed portions of Outlots A and B and declares it open for public use. Comment: The owner of the property located at 951 Dover Street received assistance through the City's Downpayment Assistance Program for the amount of $3,000. The financing was in the form of a conditional occupancy loan. The loan was paid off; thus the lien can now be released. ol-/?,q (4) RESOLUTION AUTHORIZINGTHE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST TO THE RELEASE OF LIEN REGARDING TWO MORTGAGES FOR THE PROPERTY LOCATED AT 801 SECOND AVENUE, IOWA CITY, IOWA. Comment: The owner of the property located at 801 Second Avenue received assistance through the City's Housing Rehabilitation Program totaling $19,359. The financing was in the form of a conditional occupancy loan ($16,455) and a ten-year declining balance loan ($2,904). Comment: On May 1 the City Council approved local HOME funding for the Village Green Commons project. This project will consist of 34 units of housing for large families. This resolution of support will assist Metro Plains Development L.L.C. in their application to the State of Iowa for Low Income Housing Tax Credits. ITEM NO. 3d(7) A RESOLUTION SUPPORTING THE DEVELOPMENT OF AFFORDABLE HOUSING IN IOWA CITY AND AUTHORIZING THE MAYOR TO SIGN A LETTER OF SUPPORT IN ORDER TO FULFILL THE THRESHOLD REQUIREMENTS OF THE LOW INCOME HOUSING TAX CREDIT APPLICATION. Comment: Burns & Burns LC has requested that the City Council adopt a resolution of support for the Foxboro Ridge Limited Partnership project which will consist of 30 units of housing for the eldedy and persons with disabilities. This resolution of support will assist them in their application to the State of Iowa for Low Income Housing Tax Credits. ITEM NO. 3d(8) A RESOLUTION SUPPORTING THE DEVELOPMENT OF AFFORDABLE HOUSING IN IOWA CITY AND AUTHORIZING THE MAYOR TO SIGN A LETTER OF SUPPORT IN ORDER TO FULFILL THE THRESHOLD REQUIREMENTS OF THE LOW INCOME HOUSING TAX CREDIT APPLICATION. Comment: Burns & Burns LC has requested that the City Council adopt a resolution of support for the Emerson Point Limited Partnership project which will consist of 30 units of housing for the elderly and persons with disabilities. May 15, 2001 Agenda additions Page 2 ITEM NO. 3d(9) CONSIDER A RESOLUTION SETTING A PUBLIC /-~"t' HEARING FOR JUNE 12 ON PLANS, SPECIFICATIONS, FORM OF CONTRACT AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE IOWA CITY KICKERS SOCCER PARK PARKING LOT RESURFACING PROJECT, DIRECTING CITY CLERK TO PUBLISH NOTICE OF SAID HEARING, AND DIRECTING THE PARKS AND RECREATION DIRECTOR TO PLACE SAID PLANS ON FILE FOR PUBLIC INSPECTION. Comment: This project entails the installation of a 4-inch asphalt lift on the existing chip-seal surface on all three parking lots at the Iowa City Kickers Soccer Park. It also includes striping, and one of the parking lots may be expanded slightly. This project is needed primarily to provide a more organized parking pattern which will reduce parking problems; it will also minimize the dust which can be a problem during time~; of heavy use. The funding source for this project is General Obligation Bonds. Consider a motion setting a pubic hearing for June 12 on an ordinance changing the zoning code by amending the Planned Development Housing Overlay, OPDH-8, plan for Arbor Hill a an 8.2 acre 17-unit residential development located north of Washington Street on Arbor Hill Circle. Comment: At its May 3 meeting, by a vote of 7-0, the Planning and Zoning Commission recommended approval. Staff recommended approval in an April 19 staff report. Action: b. Consider a motion setting a pubic hearing for June 12 on an ordinance vacating Hemingway Lane west of Russell Drive. Comment: At its April 19, 2001 meeting, by a vote of 6-0, the Planning and Zoning Commission recommended approval of the proposed mzoning. Staff recommended approval in a memo dated April 12, 2001. (Pass and Adopt) Comment: At its March 1 meeting by a vote of 5-0 the Planning and Zoning Commission recommended approval of this amendment provided that an accessory apartment in an accessory building is no larger than 500 square feet and contains no more than one bedroom. PUBLIC HEARING ON AN ORDINANCE A~NDING TITLE a "Cl~ FINANCES, T~TION, ~ FE~8," CHAPTER ~ "SCHE~U~ OF FEES, ~T~S, CHARGES, BONDS, FINE8 AND PENALTIES" OF THE COD~, TO INCR~8~ WASTEWATER 8~RVICE CHARGE8 AND IN IOWA Cl~, IOWA. Comment: This public hearing will permit input regarding proposed rate increases or changes for wastewaler fees. The new rates are scheduled to go into effect for billings on or after August 1, 2001. The previous rate increase went into effect on August 1, 2000. Action: ~2 _~~ May 15, 2001 City of Iowa C~ty Page 7 ITEM NO. 7. THE IOWA CITY HOUSING AUTHORITY'S UPDATED ANNUAL PLAN. Comment: The Public Housing Authority is required to update the Annual Ran under the Quality Housing and Work Responsibility Act of 1998 CQHWRA"). The Annual Plan provides details about the agency's immediate operations, program participants, programs and services, and the agency's strategy for handling operational concerns, residents' concerns and needs, programs and services for the upcoming fiscal year. As required by the QHWRA, the plan has been available to the public for review 45 days prior to this public hearing; a notice was published March 30, 2001. A memo was mailed to 45 local service agencies and the Housing Authority's Resident Advisory Board inviting them to an informational meeting that was to be held on April 26, 2001. There were no attendees at the meeting; however, copies of the plan were mailed upon request. No comments have been received. Copies of the plan will have also been forwarded to the Housing & Community Development Committee prior to the public hearing. a. PUBLIC HEARING b. CONSIDER A RESOLUTION APPROVING ITEM NO. 8. CONSIDER A RESOLUTION AUTHORIZING ACQUISITION OF A ~ SINGLE-FAMILY LOT LEGALLY DESCRIBED AS LOT 6, BLOCK 39, EAST IOWA CI~, UNDER THE AFFORDABLE DREAM HOME OPPORTUNITIES PROG~M. Comment: The Iowa Ci~ Housing AuthoriW (ICHA), under its Affordable Dream Home Oppo~unities Program (ADHOP) and in pa~nership with Mercy Hospital, Mike and Judy Cilek, Coldwell Banker Real Estate Professionals, and others in the communi~, proposes to construct a universally-designed, affordable single-family home. The universal design in housing is both accessible and barrier-free to people of all ages, sizes and abilities without looking unusual or clini~l. This resolution authorizes purchase of a lot in East Iowa CiW from Mike and Judy Cilek. The lot price has been redu~d by the seller to make it affordable and to suppo~ the construction of a univemally-designed home. Staff memorandum included in Council packet. CONSIDER AN ORDINANCE AMENDING THE CITY CODE OF THE CITY OF IOWA CITY, IOWA, BY ENACTING NEW SECTIONS NUMBERED 4-2-3, ENTITLED "LOCAL REVIEW OF APPLICATION/INVESTIGATION OF APPLICANT"; SECTION 4-2-4, ENTITLED "NOTICE AND HEARING"; AND SECTION 4-2-5, ENTITLED "CIVIL PENALTIES"; REVISING SECTION 4-5-4 ENTITLED "REGULATION OF PERSONS UNDER LEGAL AGE"; ENACTING A NEW SECTION 4-5-6 ENTI'TLED "SALES TO INTOXICATED PERSONS"; AND ENACTING A NEW SECTION 4-5-7 ENTITLED "LIMITATIONS ON SALES," ALL OF WHICH PROVIDE FOR THE REGULATION OF ALCOHOL SALES. (SECOND CONSIDERATION) Comment: A public hearing was held on February 6 and continued to February 20 on the proposed ordinance. Changes in the ordinance were made by staff at the request of the Council after the close of the hearings. This ordinance implements administrative penalties in accordance with State Code and prohibits out-of-sight sales and drink specials. Staff has sent a letter to current license holders offering them an opportunity to provide input concerning interpretation or enforcement of provisions . regarding drink specials (Section 4-5-7, A and B). After discussion with license holders and input of Council, a revised ordinance was prepared and given first consideration on May 1. Correspondence included in council Act,on: L/ ITEM NO. 10. CONSIDER A RESOLUTION AMENDING THE FY2001 OPERATI~I~'~<f / 5 ~ BUDGET. Comment: State legislation mandates municipalities amend their annual budgets by May 31, Detailed information on amendments have been available for public inspection since April 20, 2001. CONSIDER A RESOLUTION AWARDING CONTRACT AND AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO A'I'I'EST A CONTRACT FOR CONSTRUCTION OF THE TRANSIT PARKING LOT RESURFACE PROJECT. Comment: The bid opening for this project was held on May 8, 2001 at 10:30 a.m., and the following bids were received: L.L. Pelling Company, Inc. North Liberty, IA $85,412.00 Cedar Valley Asphalt Cedar Rapids, IA $91,025.60 Engineer's Estimate $101,000.00 Public Works and Engineering recommend award of the project to L.L. Pelling Company of North Liberty, Iowa in the amount of $85,412.00. The Federal Transit Administration will fund 80% of the project. The remaining 20% will come from the Transit Division funds. ITEM NO. 12. CONSIDER A RESOLUTION APPROVING THE TERMS ON WHICH THE CITY WILL PURCHASE LOT 49, PARK WEST SUBDIVISION IN IOWA CITY, AND AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO A'R'EST DOCUMENTATION OF THE SAME. Comment: Adjacent property owners have expressed concerns over use of their property as access and exit for the Willow Creek Trail. The Parks and Recreation Commission considers it in the public interest to acquire property to serve as a designated access and exit point for the trail. Park West Subdivision, Inc., owner of Lot 49, Park West Subdivision, adjacent to the trail, has accepted an offer from the City to purchase the property for $25,000. The offer is contingent upon City Council approval on or before May 31, 2001. This resolution approves the terms on which the City will purchase the property. CONVEYANCE OF THE PROPERTY KNOWN AS PENINSULA NEIGHBORHOOD, FIRST ADDITION, IN IOWA CITY, IOWA, TO TERRY L. STAMPER HOLDINGS, L.L.C. Comment: Pursuant to the Peninsula Neighborhood Development Agreement between the City of Iowa City and Terry L. Stamper Holdings, L.L.C. ("Stamper") approved by Resolution No. 00-231 of the City Council dated June 29, 2000, and amendments thereto ("Agreement"), Stamper has agreed to develop a tract of land known as the Peninsula Neighborhood. The City Council will consider and intends to approve the final plat of the Peninsula Neighborhood, First Addition, at its meeting scheduled for May 15, 2001. Pursuant to said Agreement, Stamper has agreed to purchase the Peninsula Neighborhood, First Addition, for a price equal to a per-unit base price of $3,171.00 multiplied by the total number of final site-plan approved units. This Resolution authorizes the City Council's conveyance of the above property to Stamper. OL PUBLIC HEARING ~1' CONSIDER A RESOLUTION AUTHORIZING ITEM NO. 14. CONSIDER A RESOLUTION APPROVING CABLEVISION VII, INC.'S REQUESTED RATE INCREASE AND ESTABLISHING MAXIMUM PERMITTED RATES FOR BASIC CABLE SERVICE. Comment: This resolution approves the subscriber rate for basic cable services effective June 1, 2001. It furlher establishes a maximum permitted rate for basic cable service as calculated by the City. Action: May 15, 2001 City of Iowa City Page 11 ITEM NO. 15. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO ol./~Z, SIGN AND THE CITY CLERK TO ATTEST THE FY2002 AGREEMENT BETWEEN THE CITY OF IOWA CITY AND THE CITY OF UNIVERSITY HEIGHTS FOR THE PROVISION OF TRANSIT SERVICE WITHIN THE CORPORATE LIMITS OF UNIVERSITY HEIGHTS. Comment: This resolution approves the FY2002 agreement for provision of fixed route transit service within the corporate limits of University Heights. The total cost of the FY2002 contract is $26,192.04. The method of calculating the City of University Heights cost that was used in FY2001 was continued for the FY2002 agreement. This method uses the percentage of Iowa City Transit's total operating costs based on University Heights population as a percentage of the total population of Iowa City and University Heights. This method was used successfully for many years to calculate the University Heights contract amount. Due to the decrease in the City of University Heights population between 1990 and 2000, the actual contract amount decreased for FY2002 from $27,411 to $26,192.04. Act,on: ITEM NO. 16. CONSIDER A RESOLUTION APPROVING DISTRIBUTION OF THE l,t2, ""PROGRAM FOR IMPROVING NEIGHBORHOODS"" (PIN) GRANT FUNDS. Comment: The City Council allocated $25,000 for Fiscal Year 2002 for the purpose of funding grants to neighborhood associations so that they could make improvements in their neighborhood. The Neighborhood Council has solicited, selected, and recommends that funding of eleven applications from neighborhood associations and seeks the City Council's review and approval of this recomme datio?. M orandum included in Council packet. ITEM NO. 17. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO A'R'EST AN AMENDED CHAPTER 28E AGREEMENT BETWEEN THE CITY OF CORALVILLE AND THE CITY OF IOWA CITY REGARDING RECONSTRUCTION OF FIRST AVENUE FROM THE CLEAR CREEK BRIDGE TO IMMEDIATELY SOUTH OF THE IOWA INTERSTATE RAILROAD VIADUCT. Comment: This amended 28E agreement revises the earlier 28E agreement between Iowa City and Coralville to increase Iowa City's contribution to Phase I of the project (the railroad viaduct) by $233,000.
