RECONSTRUCTION OF THE CITY PARK TRAILS, DIRECTING
CITY CLERK TO PUBLISH NOTICE OF SAID HEARING, AND

Comment: This project involves the reconstruction and some
rerouting of most of the trail system within City Park. It also includes
rebuilding and widening the sidewalk on the nodh edge of Park
Road, between the bridge and the main entrance to the park. A
small section of the roadway in lower City Park will be slightly
relocated. Approximately 5,500 lineal feet of trail will be
reconstructed and/or rerouted; the trail within the park will be 10 feet
wide to comply with AASHTO standards, and the Park Road
sidewalk will be widened to eight feet, with a curb cut to correspond
with the one on the south side of the street.

Comment: This project will result in the construction of a new 22-
acre park in the Hunters Run Subdivision, just north of Duck Creek
Drive and west of Highway 218. Plans include trails, natural areas, a
pond, a park shelter, playground equipment and a substantial
amount of landscaping, part of which is to buffer sound from the
highway. Four neighborhood meetings were held to gain input from
residents.

AND AMERICAN RESIDENTIAL FUNDING, MT. VERNON,
IOWA FOR PROPERTY LOCATED AT 424
NORTH VAN BUREN STREET, IOWA CITY, IOWA.
Comment: American Residential Funding, Mt. Vernon, Iowa has
requested that the City approve a Subordination Agreement for 424
North Van Buren Street. On August 21, 2000 and on February 13,
2001, the owners of the property received loans from the City's
Housing Rehabilitation Program for a total of $9,588.99. American
Residential Funding is about to finance a new mortgage to the
property owners for the amount of $118,000. The property is assessed
at $145,000 which provides enough equity to cover the City's second
lien position, which was its original position.

Comment: The owners of the property located at 1726 Dover Street
received assistance through the City's Housing Rehabilitation
Program totaling $1,700. The financing was in the form of a
conditional low interest loan. The loan has been paid off; thus the
lien can now be released.

FROM A & J MINIMART, 2153 ACT CIRCLE, PURSUANT
TO IOWA CODE SECTION 453A.22(2) (2001).
Comment: This Resolution accepts payment of a $300 civil penalty,
authorized by Iowa Code section 453A.22(2), from A & J Minimart,
2153 ACT Circle. Section 453A.22(2) provides that a $300.00 civil
penalty will be assessed to a retail cigarette permit holder when and
if that permit holder's employee is convicted of or pleads guilty to
selling or providing tobacco to a minor. By making this payment and
signing the appropriate waiver, A & J Minimart waives its statutory
right to have a hearing on whether the civil penalty should be
assessed.

Comment: This ordinance increases the charge for meters and meter
reading devices by $50. This change in meter charges is necessa~ to
recover the cost of providing meters and meter reading devices for new
construction and/or a new expanded customer base.

GROUND FLOOR OF HISTORIC LANDMARK BUILDINGS
BY SPECIAL EXCEPTION.
Comment: At its June 21 meeting by a vote of 2-5, the
Planning and Zoning Commission recommended that the
amendment not be approved. Staff recommended approval
of the amendment in a memorandum dated June 15. The
amendment will allow consideration of alternative uses for
the Historic Library Building as well as other Historic
Landmarks in the CB-10 zone.

BIDS, AND FIXING TIME AND PLACE FOR RECEIPT OF BIDS.
Comment: This project entails the construction of a concrete skate park,
approximately 11,000 square feet in size, to be located in Terrell Mill Park.
Estimated construction cost is $312,000. The funding source is General
Obligation Bonds.

ITEM NO. 8. CONVEYANCE OF THE PORTION OF HEMINGWAY LANE LOCATED
WEST OF RUSSELL DRIVE TO STEVE KOHLI CONSTRUCTION, L.C.
Comment: When Southpointe Addition Part 7 (a resubdivision of a portion of
Southpointe Parts 2 and 3) was designed, a portion of right-of-way previously
dedicated to the City was to be utilized for stormwater management
purposes and would no longer be used as a street. However, due to
oversight, the former dedicated right-of-way was not formally vacated,
although the replatted Southpointe Addition Part 7 was approved in 2000.
This action will address any title objections raised as a result of the replatted
right-of-way. Further, as the replatting of the subdivision results in fewer lots,
a better stormwater management design, and more open space on this
property, it is recommended that the property be conveyed to the developer
without compensation to the City. This Resolution authorizes the City
Council's conveyance of the above property to Steve Kohli Construction, L.C.

Comment: in accordance with the direction of the City Council, this
ordinance amends the PCRB ordinance to distinguish between complaints
filed directly with the PCRB and those filed with the Iowa City Police
Department to bring the ordinance in line with current practice, to allow the
PCRB to review police practices, procedures, and written policies only at the
direction of the City Council, City Manager, or Police Chief and to maintain
the current reasonable basis standard of review but allow the Board to
comment if it has concern notwithstanding that the conduct did not rise to the

ITEM NO. 10. CONSIDER AN ORDINANCE AMENDING TITLE "3,~'Z'CITY FINANCES,
TAXATION AND FEES," CHAPTER 4, "SCHEDULE OF FEES, RATES,
79 CHARGES, BONDS, FINES AND PENALTIES" OF THE CITY CODE, TO
INCREASE PARKING FEES IN IOWA CITY, IOWA. (SECOND
CONSIDERATION)
Comment: This ordinance increases the parking fees in the Capitol and
Dubuque Street Parking Ramps and the Linn Street parking lot to $.60 per
hour. It also establishes a fee of $.60 per hour for the Tower Place parking
facility. In addition, the hourly rate in the Chauncey Swan Parking Ramp will
be increased from $.40 per hour to $.50 per hour. All monthly parking
permits will be increased by $5 per month. These increases are proposed to
meet the new debt service required by the construction of Tower Place.
Staff requests expedited consideration to allow new rates effective for July 1
annual renewals.

CHARGES, BONDS, FINES AND PENALTIES" OF THE CITY CODE, TO
INCREASE WASTEWATER SERVICE CHARGES AND FEES IN IOWA
CITY, IOWA. (SECOND CONSIDERATION)
Comment: The proposed ordinance would increase wastewater service
charges by 5%. The effective date is for billings on and after August 1, 2001.
ITEM NO. 12. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND
CITY CLERK TO A'I'I'EST AN AGREEMENT WITH MIDAMERICAN
SERVICES FOR THE FINANCING OF GREEN LED TRAFFIC SIGNAL
EQUIPMENT.
Comment: MidAmerican Services will make available $150,835 to the City of
Iowa City for the purchase of 544 12" green LED traffic signal lamps; 40 8"
green LED traffic signal lamps; 169 green arrow LED traffic signal lamps;
and 292 12" 'Don't Walk' pedestrian signal LED lamps. The LED equipment
will be installed by City crews this summer. The total annual energy savings
from installation of this equipment is estimated to be $40,880. The City's
annual payment for equipment over a 5-year period will be $35,500.
ITEM NO. 13. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND
THE CITY CLERK TO ATTEST THE PENINSULA NEIGHBORHOOD FIRST
ADDITION SHORT-TERM FINANCING AGREEMENT BETWEEN THE CITY
OF IOWA CITY AND TERRY L. STAMPER HOLDINGS, L.L.C.
Comment: The recent Elks' litigation concerning the Peninsula property
created a cloud on the title to the property, thereby preventing the developer,
Terry L. Stamper Holdings, L.L.C. ['I'LS], from presenting clear title to the
property as security for financing infrastructure within the Peninsula
Neighborhood Development. This short-term financing agreement between
the City and TLS will allow the developer to take full advantage of this
construction season for the installation of public improvements while seeking
financing based on the newly cleared title. Per the terms of this agreement,
the developer shall not take title to the First Addition until such time as
permanent financing is secured and all sums expended by the City are repaid.
This Resolution authorizes the Mayor to sign and the City Clerk to attest the
Peninsula Neighborhood First Addition Short-Term Financing Agreement to
facilitate the installation of public improvements during this construction

the Committee recommends to approve the application.

Comment: This is a ~o-year agreement which includes a 3.25% across-the-
board wage increase in each of the ~o years covered. It also includes
increases in longevity compensation and long-term disability benefits as well
as improvements to the dental insurance benefit in the second year. A copy
of the agreement is included in Council's packet.

AGREEMENT BE~EEN THE CI~ OF IOWA CI~ AND ACT INC.,
(FORMERLY THE AMERICAN COLLEGE TESTING PROG~M, INC.)
CONCERNING ACT INC.'S MASTER DEVELOPMENT PLAN AND STREET
IMPROVEMENTS BY THE CI~ OF IOWA CI~.
Comment: ACT and City previously entered into an "Agreement be~een the
City of Iowa City and American College Testing (ACT) concerning ACT's
Master Development Plan" dated December 15, 1992, as well as a
Supplement and First Amendment thereto finally dated April 1, 1998. These
agreements addressed issues concerning the extension of Scott Boulevard
(F~ Captain Irish Parkway) through ACT prope~y, and per the original
Agreement and First Supplement, ACT conveyed to the City the real estate
necessa~ for the extension of Scott Boulevard (F~ Captain Irish Parkway)
through ACT prope~y. Since that time, the City and ACT have agreed to a
preferred southerly alignment for Scott Boulevard (F~ Captain Irish
Parkway) and have negotiated an agreement outlining the obligations of both
ACT and City for the conveyance of prope~y and easements necessa~
under the new alignment in exchange for the return of unnecessa~ prope~y
to ACT. This Resolution authorizes the Mayor to sign and the City Clerk to
attest the Second Amendment to the original agreement be~een ACT, Inc.
as necessa~ to construct the preferred southerly alignment.

ITEM NO. 21. CONSIDER A RESOLUTION OF INTENT TO CONVEY AUDITOR'S
PARCEL NO. 2000121 TO ACT, INC. IN EXCHANGE FOR THE
CONVEYANCE OF AUDITOR'S PARCEL NO. 2000122 TO CITY BY ACT,
INC., AND SETTING A PUBLIC HEARING FOR JULY 10, 2001.
Comment: See above item. In accord with the Second Amendment to the
Agreement between the City and ACT, Inc, the City is deeding its interest in
the former Captain Irish Alignment back to ACT in exchange for ACT, Inc.
deeding its interest in the property comprising the preferred southerly
alignment to the City. This Resolution declares the City Council's intent to
convey Auditor's Parcel No. 2000122 to ACT, Inc. in consideration of ACT
conveying the property comprising the realignment (Auditor's Parcel No.
2000121) to the City, and sets a public hearing on the proposed conveyance
for July 10, 2001.
