CONSIDER A RESOLUTION OF INTENT TO GRANT A oK" ..~Z[.-.~ PERMANENT UTILITY EASEMENT IN THE PENINSULA ' NEIGHBORHOOD AND SETTING A PUBLIC HEARING ON SAID EASEMENT FOR NOVEMBER 15, 2005. Comment: To facilitate the installation of utilities and development within the Peninsula Neighborhood Development Neighborhood Second Addition, Peninsula Development Company LC and MidAmerican Energy Company are requesting that the City grant MidAmerican a utility easement on property currently owned by the City and located to the north of Foster Road, Walker Circle, a private alley and Lot 51 currently located within Peninsula Neighborhood Second Addition. The property subject to the proposed easement is ultimately to be conveyed to Peninsula Development Company LC pursuant to the Peninsula Neighborhood Development Agreement, and the easement is consistent with the proposed development of the land as shown on the approved preliminary plat. This Resolution declares the City Council's intent to grant the requested easement, and sets a public hearing on the proposed easement for November 15, 2005. 2. CONSIDER A RESOLUTION OF INTENT TO CONVEY PORTIONS OF oc~ ~ ~ THE RIGHT-OF-WAY IN AN ALLEY IN BLOCK 13, COUNTY SEAT, A ' ' PORTION OF SOUTH MADISON STREET AND A PORTION OF DES MOINES STREET, TO THE UNIVERSITY OF IOWA, AND SETTING A PUBLIC HEARING ON SAID CONVEYANCE FOR NOVEMBER 15, 2005. Comment: The City Council is considering passage and adoption of an ordinance vacating the above-referenced right-of-way. The University of Iowa, owner of adjacent property, wishes to acquire said right-of-way from the City without compensation. This resolution declares the City Council's intent to convey the above right-of-way property to the University of Iowa, without compensation. This resolution also sets a public hearing on the proposed conveyance for November 15, 2005. Memorandum from the City Manager included in Council packet. e) Resolutions. 1. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN I::).~---- ~"7 AND THE CITY CLERK TO ATTEST A LEASE AGREEMENT WITH S & G MATERIALS FOR RENTAL OF A STORAGE BUILDING LOCATED AT 4213 SAND ROAD IN IOWA CITY FOR PURPOSES OF STORAGE OF CITY EQUIPMENT AND MATERIALS. The Public Works Department wishes to lease a storage building located at 4213 Sand Road in Iowa City for storage of Streets Division equipment and materials. A lease has been negotiated which provides for the lease of said building from November 15, 2005, to March 15, 2005 for rent in the amount of $5,000.00, and further provides for the continuation of said lease term, with the consent of S & G Materials, on a month to month basis for monthly rent of $1,250. This resolution approves of, and authorizes the Mayor and City Clerk to execute, the lease agreement. f) Correspondence. 1. Staff recommended approval in a report dated August 18, 2005. This recommendation is based on the proposal to eliminate the RFBH zone from the zoning code. Staff recommended approval in a report dated August 18, 2005. Approval will allow the continuation of the existing pattern of duplex and zero-lot line development in Whispering Meadows Subdivision. Action: m) CONSIDER AN ORDINANCE VACATING A PORTION OF THE RIGHT-OF- WAY IN AN ALLEY BLOCK 13, COUNTY SEAT, A PORTION OF SOUTH MADISON STREET AND A PORTION OF DES MOINES STREET IN IOWA CITY COMPRISING APPROXIMATELY 1.31 ACRES (VAC05-00007). .(SECOND CONSIDERATION) Comment: At its September 15 meeting, by a vote of 5-0 (Brooks recused, Plahutnik absent), the Planning and Zoning Commission recommended approval of the vacation of a portion of Madison Street, south of Prentiss Street, and Des Moines Street, subject to retention of any necessary utility easements. Staff recommended approval in a report dated September 15, 2005. Approval of this vacation will allow the right-of-way to be acquired by the University of Iowa. Action: n) CONSIDER A RESOLUTION APPROVING THE FINAL PLAT OF VILLAGE GREEN PART XXIII, IOWA CITY, IOWA (SUB05-00024) (DEFERRED FROM 10118) Comment: At its October 6 meeting, by a vote of 7-0, the Planning and Zoning Commission recommended approval subject to approval of legal papers and constructions plans prior to Council consideration. It is anticipated that legal papers and construction drawings will be approved prior to the Council meeting. Staff recommended approval in a report dated October 6, 2005. Approval will allow development of Village Green, Part XXIII, a 38 lot, 19.32-acre residential subdivision on Wintergreen Drive. Applicant has requested indefinite deferral. It is anticipated that legal papers and construction drawings will be approved prior to the Council meeting. Staff recommended approval in a report dated October 6, 2005. Approval will allow development of Village Green, Part XXIV, a 38 lot, 6.36-acre residential subdivision on Sterling Drive. Applicant has requested indefinite deferral. DECIDING THE APPEAL TO CITY COUNCIL OF THE DECISION OF THE HISTORIC PRESERVATION COMMISSION REGARDING THE CERTIFICATE OF APPROPRIATENESS TO ENCLOSE GUTTERS ON THE RESIDENCE LOCATED AT 517 GRANT STREET. Comment: In deciding the appeal, the City Council must consider whether the Historic Preservation Commission has exercised its powers and followed the guidelines established by law and City Code, and whether the Commission's action was patently arbitrary or capricious. After applying this standard of review, the City Council may, in conformity with the provisions of 14-4-C of the City Code (Historic Preservation Regulations) reverse or affirm, wholly or partly, or may modify the decision of the Commission regarding the Certificate of Appropriateness and may make such order, requirement, decision or determination as ought to be made, and to that end shall have the powers of the Historic Preservation Commission. CONSIDER AN ORDINANCE AMENDING TITLE 4, ENTITLED, "ALCOHOLIC BEVERAGES," CHAPTER 5, ENTITLED, "PROHIBITIONS AND RESTRICTIONS," ~-- ~ ~3 .eECTION 4, ENTITLED, "REGULATION OF PERSONS UNDER LEGAL AGE" TO PROVIDE THAT SECOND AND SUBSEQUENT OFFENSE VIOLATIONS MAY BE BASED ON A PRIOR CONVICTION UNDER EITHER THE CITY ORDINANCE OR STATE LAW. (SECOND CONSIDERATION) Comment: On June 21, 2005, Council passed Ordinance No. 05-4162 that, in part, enhanced the penalties for second and subsequent convictions for possession of alcohol under the legal age (PAULA). Because the City ordinance for PAULA essentially mirrors the PAULA provision in state law, the proposed amendment clarifies that the second offense can be based either on a prior PAULA conviction under the City Ordinance or under state law. In other words, the previous PAULA conviction need not be in Johnson County for violation of the City ordinance but could be in Linn County for violation of state law. CONSIDER A RESOLUTION AMENDING THE BUDGETED POSITIONS IN THE HOUSING AUTHORITY DIVISION OF THE HOUSING AND INSPECTION SERVICES ~ DEPARTMENT BY ADDING ONE HALF-TIME HOUSING ASSISTANT POSITION. Comment: The change in this permanent part-time (20 hour) position to permanent full- time (40 hour) position will enable the Iowa City Housing Authority to meet and exceed HUD mandated fraud investigation and subsidy overpayment recovery efforts. Since January 2005, the Iowa City Housing Authority has developed partnerships with all Johnson County law enforcement agencies. While this partnership and newly implemented National Criminal background check procedures has enhanced the Housing Authority's program integrity efforts it has also increased the workload of staff responsible for program compliance activities and the recovery of overpaid subsidy. In addition, our location in City Hall has increased walk-in traffic of clients and other citizens seeking information. Adding this position to assume full-time front desk duties will enhance the ability of other full-time staff to conduct fraud investigations and aggressively pursue collections and other accounts receivable. The increased recovery of overpaid subsidy will mitigate current and potential future Federal budget cuts. This position is 100% Federally funded. If this resolution is approved, the Housing Authority will reduce the amount budgeted for Temporary Wages by $17,500. November 1, 2005 City of Iowa City Page 14 ITEM 10. (DEFERRED FROM 10/18) Comment: The Iowa City Housing Authority received one bid for the construction of a duplex located on Longfellow Place. Staff estimate was $220,000. Todd Hackett Construction Company submitted the bid in the amount of $288,000. (i.e. $144,000 per unit) Staff recommends awarding the bid to Todd Hackett Construction Company. TO KILL DEER BY MEANS OF SHARPSHOOTING IN JANUARY AND FEBRUARY 2006 AS PART OF THE CITY'S LONG-TERM DEER MANAGEMENT PLAN. Comment: The Iowa Natural Resources Council has authorized the City to kill up to 192 antlerless deer this winter between January 11 and February 28. Following this authorization, the City issued a request for proposals (RFP) and received 6 proposals. Comment: The Airport Commission passed a motion at its meeting on October 13, 2005 to recommend that City Council amend the FY06 budget by deleting the full-time airport manager position and adding a part-time (.60) position of airport operations specialist. The Airport Commission has determined that the management duties and responsibilities being shared among a consultant for grant writing and related FAA and Iowa DOT matters, the fixed base operator (Jet Air, Inc.) for daily operations on the field, and a new part- time position for administration, including but not limited to paying bills, responding to telephone calls and correspondence, preparing meeting agenda packets, dealing with tenants/leases, operating the Unicom radio, and assisting Commission with implementing Strategic Plan is an effective and efficient way to provide the full range of management services to the Airport at the present time.
