(1) CONSIDER A MOTION SETrING A PUBLIC HEARING FOR JULY 31 ON AN ORDINANCE AMENDING CITY CODE 1-5-1 AND 1-9-3 OF THE CODE OF ORDINANCES OF IOWA CITY ESTABLISHING THE BOUNDARIES AND PRECINCTS OF THE CITY COUNCIL DISTRICTS IN IOWA CITY. Comment: The new voting precinct and City Council district boundaries reflecting population changes of the 2000 Census have been drawn up and have been reviewed by the Johnson County Commissioner of Elections. A map with the proposed boundaries and a memorandum will be included in the July 26 Council packet. New precinct boundaries become effective on January 15, 2002. State law requires a public hearing and three readings of the ordinance be done before September 1, 2001. (2) CONSIDER A RESOLUTION FIXING TIME, DATE (JULY 31) AND PLACE FOR HEARINGS ON PROPOSED CIVIL PENALTIES OF $300.00 AGAINST COLLEGE STREET NEWS, DEADWOOD TAVERN, GABE'S, PLAMOR BOWLING INC., AND WAL-MART (STORE NO. 1721). Comment: This Resolution sets the time, date and place for hearings on proposed $300.00 civil penalties, authorized by Iowa Code section 453A.22(2), against College Street News (d/b/a College Street Oasis), 116 East College Street; Deadwood Tavern, 6 South Dubuque Street; Gabe's, 330 East Washington Street, Plamor Bowling Inc., 1555 1st Avenue; and WaI-Mart (Store No. 1721), 1001 Highway I West. STAMPER HOLDINGS, L.L.C., AND THE UNIVERSITY OF IOWA COMMUNITY CREDIT UNION. Comment: Under this agreement the Credit Union will provide the short term financing to TLS that the City agreed to provide in its agreement with TLS dated June 26, 2001 and the City will guarantee the loan. In the event of default by TLS and payment by the City under the guaranty. as under the original agreement the financed infrastructure and improvements serve as collateral. Resolutions. ol-Iq5 (1) CONSIDER A RESOLUTION APPROVING AN AGREEMENT BETWEEN THE CITY OF IOWA CITY AND THE IOWA STATE DEPARTMENT OF ECONOMIC DEVELOPMENT FOR EMERGENCY SHELTER GRANTS PROGRAM FUNDING, AND AUTHORIZING THE MAYOR TO EXECUTE AND THE CITY CLERK TO ATTEST THE SAME. Comment: The Iowa Department of Economic Development has agreed to provide the City of Iowa City $105,630 in funding for supportive services for persons who are homeless. These funds will be used in FY02 by the following local agencies: Domestic Violence Intervention Program ($17,600), Four Oaks a.k.a. Youth Homes ($23,200), Emergency Housing Project ($35,000), Table to Table ($17,600), and Greater Iowa City Housing Fellowship ($7,000). The award also includes $5,230 to reimburse the City for its expenses in administering this grant. This Emergency Shelter Grants Program funding represents a 23% decrease from the FY01 allocation. DI~ I~, (2) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST TO THE RELEASE OF LIEN REGARDING A PROMISSORY NOTE AND A MORTGAGE FOR THE PROPERTY LOCATED AT 421 CRESTVIEW AVENUE, IOWA CITY, IOWA. Comment: The owners of the property located at 421 Crestview Avenue received assistance through the City's Housing Rehabilitation Program totaling $22,000. The financing was in the form of a low interest loan. The loan has been paid off; thus the lien can now be released. c>l-/~7 (3) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST TO THE RELEASE OF LIEN REGARDING A PROMISSORY NOTE FOR THE PROPERTY LOCATED AT 431 NORTH LUCAS STREET, IOWA CITY, IOWA. Comment: The owners of the property located at 431 North Lucas Street received assistance through the City's Housing Rehabilitation Program for the amount of $11,000. The financing was in the form of a ten-year depreciation loan. Comment: This Resolution accepts payment of a $300.00 civil penalty, authorized by Iowa Code section 453A.22(2), from Hemp Cat, 114 ¼ East College Street. Section 453A.22(2) provides that a $300.00 civil penalty will be assessed to a retail cigarette permit holder when and if that permit holder's employee is convicted of or pleads guilty to selling or providing tobacco to a minor. By making this payment and signing the appropriate waiver, Hemp Cat waives its statutory right to have a hearing on whether the civil penalty should be assessed. Staff recommended approval of the amendment in a memorandum dated June 15. The amendment will allow consideration of alternative uses for the Historic Library Building as well as other Historic Landmarks in the CB-10 zone. The applicant requests expedited consideration. Consider an ordinance changing the zoning designation from General Industrial (I-1) to Intensive Commercial (C1-1) for approximately 12.09 acres located on the south side of Highway 1. (REZ01-00002). (Pass and Adopt) ~m Comment: At its eeting by a vote of 5-0 the Planning and Zoning Commission recommended approval of this rezoning subject to a conditional zoning agreement addressing the development's landscaping, building and wall design, signs, vehicular access and the runway protection zone. At its May 17 meeting by a vote of 6-0, the Planning and Zoning Commission recommended approval of revisions to the Draft Conditional Zoning Agreement. (VAC97-00002) (Pass and Adopt) Comment: At its March 2, 2000, meeting, by a vote of 6-0-1, with Gibson abstaining due to a potential conflict of interest, the Planning and Zoning Commission recommended approval of the proposed vacation, subject to the retention of easements that may be needed for public and private utilities, and subject to the disposition of the prope~y concurrent with the final consideration of the ordinance to va~te. Staff recommended approval subject to these conditions in a repo~ dated Mamh 2, 2000. A purchase offer has now been received for this properly. IN EXCHANGE FOR THE CONVEYANCE OF AUDITOR'S PARCEL NO. 2000122 TO CITY BY ACT, INC. Comment: In accord with the Second Amendment to the Agreement between the City and ACT, Inc., the City is deeding its interest in the former Captain Irish Alignment back to ACT in exchange for ACT, Inc., deeding its interest in the property comprising the preferred southerly alignment to the City. This Resolution authorizes the City to convey Auditor's Parcel No. 2000121 to ACT, Inc., in consideration for ACT conveying the property comprising the realignment (Auditor's Parcel No. 2000122) to the City. a.PUBLIC HEARING Action: o I - ~,o ,~, b. CONSIDER A RESOLUTION AUTHORIZING Action: ITEM NO. 6. PLANS, SPECIFICATIONS, FORM OF CONTRACT AND ESTIMATE OF COST FOR THE RECONSTRUCTION OF THE CITY PARK TRAILS, ESTABLISHING AMOUNT OF BID SECURITY TO ACCOMPANY EACH BID, DIRECTING CITY CLERK TO PUBLISH ADVERTISEMENT FOR BIDS, AND FIXING TIME AND PLACE FOR RECEIPT OF BIDS. Comment: This project involves the reconstruction and some rerouting of most of the trail system within City Park. It also includes rebuilding and widening the sidewalk on the north edge of Park Road, between the bridge and the main entrance to the park. A small section of the roadway in lower City Park will be slightly relocated. Approximately 5,500 lineal feet of trail will be reconstructed and/or rerouted; the trail within the park will be 10 feet wide to comply with AASHTO standards and the Park Road sidewalk will be widened to eight feet. Estimated construction cost is $275,000 plus a $20,000 add alternate for the Boys' Baseball service road. Funding for this project comes from a variety of sources including G.O. Bonds, Road Use Tax Funds and miscellaneous transfers. a. PUBLIC HEARING '~1- ,~b .~ b. CONSIDER A RESOLUTION APPROVING Act,on: July 10, 2001 City of Iowa City Page 10 ITEM NO. 7. PLANS, SPECIFICATIONS, FORM OF CONTRACT AND ESTIMATE OF COST FOR THE CONSTRUCTION OF HUNTERS RUN PARK, ESTABLISHING AMOUNT OF BID SECURITY TO ACCOMPANY EACH BID, DIRECTING CITY CLERK TO PUBLISH ADVERTISEMENT FOR BIDS, AND FIXING TIME AND PLACE FOR RECEIPT OF BIDS. Comment: This project will result in the construction of a new 22-acre park in Hunters Run Subdivision, just north of Duck Creek Drive and west of Highway 218. Plans include trails, natural areas, a pond, a park shelter, playground equipment and a substantial amount of landscaping, part of which is to buffer sound from the highway. Four neighborhood meetings were held to gain input from residents. Estimated construction cost is $245,000. The funding source is G.O. Bonds. a.PUBLIC HEARING Action: b.CONSIDER A RESOLUTION APPROVING Action: ITEM NO. 8. CONSIDER AN ORDINANCE AMENDING TITLE 3 ENTITLED "CI~ FINANCES, T~TION & FEES," CHAPTER 4 ENTITLED "SCHEDULE OF FEES, ~TES, CHARGES, BONDS, FINES AND PENALTIES" OF THE CI~ CODE TO INCREASE WATER SERVICE AND FEES IN IOWA CI~, IOWA. (FIRST CONSIDE~TION) Comment: This ordinance increases the charge for meters and meter reading devices by $50. This change in meter charges is necessa~ to recover the cost of providing meters and meter reading devices for new construction and/or a new expanded customer base. CONSIDER AN ORDINANCE AMENDING TITLE 8, CHAPTER 8 OF THE o l-~f '1~ CITY CODE ENTITLED "POLICE CITIZENS REVIEW BOARD" TO DISTINGUISH, IN ACCORDANCE WITH ACTUAL PRACTICE, BETWEEN COMPLAINTS MADE TO THE BOARD AND COMPLAINTS MADE TO THE IOWA CITY POLICE DEPARTMENT, TO ALLOW THE BOARD TO COMMENT ON OFFICER ACTION AND POLICE PRACTICES, PROCEDURES AND WRI'R'EN POLICIES REGARDING AN INCIDENT NOTWITHSTANDING ITS AFFIRMANCE OF THE POLICE CHIEF OR CITY MANAGER'S REPORT IN ACCORDANCE WITH THE REASONABLE BASIS STANDARD OF REVIEW, AND ALLOWING THE BOARD TO REQUEST THAT THE CITY COUNCIL HOLD GENERAL INFORMATIONAL HEARINGS REGARDING POLICE ACTIVITIES. (PASS AND ADOPT) Comment: In accordance with the direction of the City Council, this ordinance amends the PCRB ordinance to distinguish between complaints filed directly with the PCRB and those filed with the Iowa City Police Department to bring the ordinance in line with current practice, to allow the PCRB to comment on officer action and police practices, procedures, and written policies regarding an incident, notwithstanding its afffirmance of the Police Chief or City Manager's report in accordance with the reasonable basis standard of review, and allows the Board to request that the City Council hold general informational hearings regarding police activities. c>l-.~?'7 TAXATION, & FEES," CHAPTER 4 "SCHEDULE OF FEES, RATES, CHARGES, BONDS, FINES AND PENALTIES" OF THE CITY CODE, TO INCREASE WASTEWATER SERVICE CHARGES AND FEES IN IOWA CITY, IOWA. (PASS AND ADOPT) Comment: The proposed ordinance would increase wastewater service charges by 5%. The effective date is for billings on and after August 1, 2001. ITEM NO. 11. CONSIDER A RESOLUTION APPROVlNG AN INVITATION TO IOWA 9c> E, ARTISTS FOR THE IOWA SCULPTOR'S SHOWCASE. Comment: The Public Art Advisory Committee is recommending that Iowa artists be invited to submit proposals for the Iowa Sculptor's Showcase. The sculpture pad for the Showcase is located in the planter on the Dubuque Street leg of City Plaza. The showcase will feature Iowa artists and the sculpture will be changed every June to coincide with the Iowa Arts Festival events. The showcase will allow local artists to promote and sell their artwork. Artist will receive an honorarium of $500 and the project will be funded through the Public Art Program budget. Washington St., is requesting Council approval for a sidewalk caf6 in front of the establishment, which will feature a raised platform and anchored fencing. The application has been reviewed by staff and Design Review. This license application is the first application for an elevated structure or platform on top of the sidewalk and includes the requirement that the structure be removed from December 1 through March 1. ALICE SAHS, AND MARITA MCGURK EICHER, AND SETTING A PUBLIC HEARING ON SAID CONVEYANCE FOR JULY 31, 2001. Comment: On July 10, 2001, the City Council will consider pass and adoption of an ordinance vacating an undeveloped portion of WooIf Avenue from McLean Street South for a distance of 240 feet, subject to City retention of a blanket Sanitary and Storm Sewer Easement over the vacated property. Craig Syrop and Anne Sadler, as owners of adjacent property, have offered the sum of $1,032 for the easterly one-half of the vacated property. M. Alice Sahs, as the owner of adjacent property, has offered the sum of $516 for the southerly one-haif of the westerly one-half of the vacated property. Marira McGurk Eicher, as the owner of adjacent property, has offered the sum of $516 for the northerly one half of the westerly one-half of the vacated property. The amounts offered are consistent with the fair market valuation listed on the assessment rolls for comparable properties. This Resolution declares the City Council's intent to convey the above property to Dr. Syrop, Ms. Sadler, Ms. Sahs, and Ms. Eicher, and sets a public hearing on the proposed conveyance for July 31, 2001. Action: ITEM NO. 15. CONSIDER A RESOLUTION OF INTENT TO CONVEY A SINGLE FAMILY HOME LOCATED AT 1605 DICKENSON LANE AND SE'FI'ING A PUBLIC HEARING FOR JULY 31, 2001. Comment: The Iowa City Housing Authority, under its Affordable Dream Home Program, proposes to sell 1605 Dickenson Lane. The amount of the sale will be $135,000, which is $2,000 less than the appraised value of the home. The funding source, federal HOME funds, limits the purchase price to a maximum of $135,000. The family began receiving Section 8 rental assistance through the Iowa City Housing Authority in June 2000, paying only $110 per month toward rent. The family now pays the full rental amount of $750 per month and has saved $3,000 for the down payment on their new home. The family received a written commitment for a mortgage from a local bank in the amount of $108,000. The City will provide a second mortgage for the remaining $24,000.
