(3) CONSIDER A RESOLUTION SETTING A PUBLIC
HEARING FOR GI'PTEMBER 25 ON A RESOLUTION
Comment: This resolution sets a public hearing for October 8, 2001,
to amend the FY2002 budget to carry over budget authority from
FY2001 to FY2002 for capital improvement projects and other
expenses that were either in process in FY2001 and not completed by
FY2001 year end, or budgeted in FY2001 and delayed until FY2002.
The City's policy is to amend the current budget at the beginning of
each fiscal year for the continuation of projects from the prior fiscal
year.

25) AND PLACE FOR HEARING ON PROPOSED CIVIL PENALTY
OF $300.00 AGAINST OUTER LIMITS OF IOWA CITY.
Comment: This Resolution sets the time, date and place for hearings
on a proposed $300.00 civil penalty, authorized by Iowa Code section
453A.22(2), against Outer Limits of Iowa City, 1910 South Gilbert
Street. Iowa Code section 453A.22(2) authorizes a $300.00 civil
penalty against a retail cigarette permit holder whose employee has
been convicted of or pied guilty to selling or providing tobacco to a
solutions.
(1) CONSIDER A RESOLUTION APPROVING THE OFFICIAL
FINANCIAL REPORT FOR CITY STREETS AND PARKING FOR
THE FISCAL YEAR ENDING JUNE 30, 2001.
Comment: The Iowa Department of Transportation requires all
municipalities to submit this report annually on or before September
30.
'/¢j (2) CONSIDER A RESOLUTION AUTHORIZING THE FILING
OF AN APPLICATION WITH THE IOWA
DEPARTMENT OF TRANSPORTATION FOR STATE
TRANSPORTATION ENHANCEMENT FUNDS.
Comment: An application will be filed with the Iowa Department of
Transportation for state Transportation Enhancement funds for
beautification of the Dubuque Street entranceway south of 1-80. This
area is in need of beautification as well as improved drainage. A
concept plan has been prepared by a private engineering firm. The
application will compete for funding with other Transportation
Enhancement applications from around the state. The total project
cost for the Dubuque Street beautification project is $450,000. The
amount covered by the Iowa DOT would be 70%, or $315, 000.

Comment: Each year, the City Council will consider a deer management
plan based on the Long-Term Plan approved by Council in March of 1998.
The Long-Term Plan was affirmed by the Task Force on June 26, 2001
and by the City Council on July 9, 2001. The public discussion is to receive
public input on the Winter 2001-2002 Deer Management Plan.

CERTIFICATION OF THE IOWA CITY HOUSING AUTHORITY FOR
FY2001.
Comment: The Department of Housing and Urban Development
(HUD) requires Housing Authorities to certify fiscal year performance
data as a means of monitoring local activity. HUD will score the Iowa
City Housing Authority (ICHA) based on indicators and will identify
areas of concern or performance based on these indicators.

conditional occupancy loan. The loan has been paid off; thus the lien
can now be released.

Program in the amount of $50,000. The financing was in the form of
a conditional occupancy loan ($25,000) and a ten-year declining
balance loan ($25,000). The loans were paid off on August 15, 2001;
thus the lien can now be released.

CIVIL PENALTY AND WAIVER OF RIGHT TO HEARING

Comment: This Resolution accepts payment of a $300.00 civil
penalty, authorized by Iowa Code section 453A.22(2), from The
Airliner, 22 South Dubuque Street. Section 453A.22(2) provides that
a $300.00 civil penalty will be assessed to a retail cigarette permit
holder when and if that permit holder's employee is convicted of or
pleads guilty to selling or providing tobacco to a minor. By making
this payment and signing the appropriate waiver, The Airliner waives
its statutory right to have a hearing on whether the civil penalty should
be assessed.

AUTHORIZING THE SUBMISSION OF AN APPLICATION FOR
BROWNFIELD REDEVELOPMENT PROGRAM FUNDS TO THE
IOWA DEPARTMENT OF ECONOMIC DEVELOPMENT (IDED) FOR
THE PURPOSE OF FUNDING A BROWNFIELD RECLAMATION
PROJECT AND COMMITMENT BY THE CITY OF IOWA CITY TO
PROVIDE FUNDING TO IMPLEMENT SAID PROJECT.
Comment This resolution will allow the City of Iowa City to proceed
with an application for approximately $500,000 in Brownfield
Redevelopment Program Funds administered by the Iowa
Department of Economic Development.

Zoning Commission recommended approval. Staff recommended
approval in a memorandum dated July 27.

Comment: At its June 21 meeting, by a vote of 7-0, the Planning and
Zoning Commission recommended approval of the proposed rezoning,
subject to approval of a conditional zoning agreement that addresses the
general neighborhood design standards in the Northeast District Plan,
the contribution of funds toward the reconstruction of Lower West Branch
Road, and the dedication of sewer easements. Staff recommended

Comment: At its March 15 meeting by a e Planning and
Zoning Commission reammended approval of this rezoning subject to a
conditional zoning agreement addressing the development's landscaping,
building and wall design, signs, vehicular access and the runway
protection zone. At its May 17 meeting by a vote of 6-0, the Planning
and Zoning Commission recommended approval of revisions to the Draft
Conditional Zoning Agreement. 8taft recommended approval in a repo~
dated March 1. The Conditional Zoning Agreement has been modified to
clarify that the movement of the ac~ss easement is subject to Gi~
approval.

f. Consider a resolution appreving the preliminary and final plat of Saltzman
Subdivision, a 2.8 acre, 3-lot commercial subdivision located east of

Comment: At its August 2 meeting by a vote of 7-0 the Planning and
Zoning Commission recommended approval subject to approval of legal
papers prior to Council Consideration. Legal papers are being reviewed
by the City Attorney's office. Staff recommended approval in a
memorandum dated July 12. Deferred August 21. Applicant requests
deferral to October 8.

2001-2006 CONSOLIDATED PLAN (A.K.A. CITY STEPS).
Comment: A public hearing will be held to provide citizens an opportunity to
request changes or amendments to Iowa City's 2001-2006 Consolidated
Plan (CITY STEPS). The Plan is available for review at the Iowa City Public
Library and the Iowa City Department of Planning & Community
Development. Staff memoranda included in Council packet.
ITEM NO. 7. PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF
COST FOR CONSTRUCTION OF THE WATER FACILITY
IMPROVEMENTS BLOOMINGTON STREET BOOSTER STATION
PROJECT, ESTABLISHING AMOUNT OF BID SECURITY TO
ACCOMPANY EACH BID, DIRECTING CITY CLERK TO PUBLISH
ADVERTISEMENT FOR BIDS, AND FIXING TIME AND PLACE FOR
RECEIPT OF BIDS.
Comment: This project involves construction of a booster (pumping) station
at the Bloomington Street water storage reservoir. The booster station will
maintain flow and pressure in the water distribution system and is a
necessary result of the discontinued use of the Madison Street water
treatment facility. The estimated construction cost is $880,000 and will be
funded with water revenues.

Comment: This project consists of improvements to the sanitary sewer in the
vicinity of the intersection of Johnson and Court Streets. This work is
necessary to separate the sanitary and storm sewer systems. The estimated
construction cost is $160,000 and will be funded with sewer revenues.

RECEIPT OF BIDS.
Comment: This project entails the construction of nearly three miles of trails,
including a number of pedestrian bridges, in Hickory Hill Park. The trails will
be constructed of crushed limestone; will be six feet in width; and will meet
all standards to comply with the Americans with Disabilities Act (ADA). A
great deal of public input was received during the planning process,
particularly from the Friends of Hickory Hill and the Johnson County Coalition
for Persons with Disabilities. Estimated construction cost is $443,000 and
will be funded with General Obligation Bonds.

Comment: This project will involve replacing the cap stones and tuck pointing
the deteriorated grout and caulking around the parapet and repairing the
lintels around the windows in the Senior Center Building before the heating
season of 2001-2002. The estimated construction cost is $59,000 and will
be funded with General Fund and internal loans.

THE ACCOUNTING DIVISION OF THE FINANCE DEPARTMENT AND THE
AFSCME PAY PLAN.
Comment: The Classification Committee has reviewed the position of Senior
Account Clerk - Accounting as provided by the AFSCME Collective
Bargaining Agreement, and has determined that the duties performed by this
position are equivalent to those of positions in Grade 8 of the Pay Plan.
Therefore, it is recommended that one full-time position of Senior Account
Clerk - Accounting be reclassified from AFSCME grade 6 to AFSCME Grade
8. Annual cost is approximately $1,200.
