RESOLUTION TO ISSUE DANCING PERMIT
BE IT RESOLVED BY THE CITY COUNCIL OF IOWA CITY, IOWA, that a Dancing Permit as
provided by law is hereby granted to the following named person and at the following
described locations upon his filing an application, having endorsed thereon the certificates of
the proper city officials as to having complied with all regulations and ordinances, and
having a valid beer, liquor, or wine license/permit, to wit:

RESOLUTION SETTING PUBLIC HEARING ON
AI~IENDING THE FY2002 OPERATING BUDGET.
BE IT RESOLVED BY THE CITY COUNCIL OF IOWA CITY, IOWA, that a public hearing will
be held in the Civic Center at 7:00 p.m., October 8, 2001, or if said meeting is cancelled, at
the next meeting of the City Council thereafter as posted by the City Clerk, to permit any
citizen to be heard for or against the proposed amendment to the FY2002 Operating Budget.
The City Clerk is hereby directed to give notice of public hearing and time and place thereof
by publication in the Iowa City Press-Citizen, a newspaper of general circulation in Iowa
City, not less than ten (10) days and not more than twenty (20) days before the time set for
such hearing.

RESOLUTION NO. 01-277
RESOLUTION FIXING TIME, DATE AND PLACE FOR HEARING ON PROPOSED
CIVIL PENALTY OF $300.00 AGAINST OUTER LIMITS OF IOWA CITY
WHEREAS, an employee of Outer Limits of Iowa City, 1910 South Gilbert Street, Iowa City,
Iowa 52240, a business operating with a retail cigarette vending machine on its premises, was
convicted/pied guilty in Johnson County District Court, of violating Iowa Code § 453A.2(l); and
WHEREAS, pursuant to Iowa Code § 453A.22(2), an establishment with a retail cigarette
rending machine on its premises is subject to a civil penalty of $300.00 as a result of its
employee being convicted of or pleading guilty to a violation of Iowa Code § 453A.2(1 ), after a
hearing and proper notice; and
WHEREAS, the City of Iowa City City Council is advised and does believe that a hearing should
be fixed for the 25th day of September, 2001, at 7:00 p.m. in Hatvat Hall, City of Iowa City Civic
Center, 410 East Washington Street, Iowa City, Iowa 52240 for the purpose of considering
whether a civil penalty in the amount of $300.00 should be assessed against Outer Limits of Iowa
City, pursuant to Iowa Code § 453A.22(2).
NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF IOWA CITY CITY COUNCIL
that the City Council conduct a hearing on the 25th day of September, 2001, at 7:00 p.m. in
Harvat Hall, City of Iowa City Civic Center, 410 East Washington Street, Iowa City, Iowa 52240
for the purpose of considering whether a civil penalty in the amount of $300.00 should be
assessed against Outer Limits of Iowa City, pursuant to Iowa Code § 453A.22(2).
BE IT FURTHER RESOLVED, that the City Clerk is hereby directed to provide Outer Limits of
Iowa City with no less than l0 days' notice of the hearing by mailing a copy of this Resolution to
the permit holder' s place of business as it appears on the application.

2000, through June 30, 2001, as required by the Code of Iowa, Chapter 312, Section 14.
This report, when combined with those submitted from other cities in Iowa, will provide the
Iowa Department of Transportation and the Federal Highway Administration with a
documented record of street receipts and expenditures in Iowa cities.

RESOLUTION NO. 01-279
RESOLUTION AUTHORIZING THE FILING OF AN APPLICATION WITH THE
IOWA DEPARTMENT OF TRANSPORTATION FOR STATE TRANSPORTATION
ENHANCEMENT FUNDS.
WHEREAS, the Dubuque Street entranceway south of Interstate 80 is in need of beautification;
and
WHEREAS, said entranceway serves as the primary entrance into Iowa City as well as the
University of Iowa; and
WHEREAS, state Transportation Enhancement funds would allow for this entranceway to be
reconstructed and landscaped as well as provide improved drainage and plantings to help
mitigate water runoff.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA
CITY, IOWA, THAT:
1. Staff is authorized to submit an application to the Iowa Department of Transportation for
state Transportation Enhancement funds.
2. Staff is authorized to file any additional documentation that is required by the Iowa
Department of Transportation.
3. The City agrees to maintain the improvements for a minimum of 20 years if funding is
approved.

BOULEVARD IMPROVEMENTS - ABBEY LANE TO HIGHWAY 1 PROJECT
WHEREAS, the Engineering Division has recommended that the work for construction of
the Mormon Trek Boulevard Improvements - Abbey Lane to Highway 1 Project, as
included in a contract between the City of Iowa City and Metro Pavers, Inc. of Iowa City,
Iowa, dated April 27, 2000, be accepted; and
WHEREAS, the performance and payment bond has been filed in the City Clerk's office.

RESOLUTION APPROVING THE PUBLIC HOUSING ASSESSMENT SYSTEM
MANAGEMENT OPERATIONS CERTIFICATION OF THE IOWA CITY HOUSING
AUTHORITY FOR FY01.
WHEREAS, the Public Housing Assessment System (PHAS) implements 42 U.S.C. §1437d(j)
and evaluates the performance of public housing agencies (PHAs) in major areas of management
operations; and
WHEREAS, the Department of Housing and Urban Development requires formal approval of a
written cedi~cation showing compliance with federal regulations; and
WHEREAS, said written cedi~cation is on file in the office of the Housing Administrator; and
WHEREAS, it is in the best interest of the City of Iowa City to continue participation in the Public
Housing Program.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA
CITY, IOWA, in its capacity as the City of Iowa City Housing Authority that the PHAS Certification
be approved.

WHEREAS, on February 25, 2000, the owners of 2011 Union Road executed a
conditional occupancy loan for the amount of $1,560; and
WHEREAS, the loan was paid off on August 17, 2001; and
WHEREAS, it is the City of Iowa City's responsibility to release this lien.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
IOWA CITY, IOWA that the Mayor is authorized to sign and the City Clerk to attest the
attached Release of Lien for recordation, whereby the City does release the property

WHEREAS, on June 7, 2001, Stacey Marie Hermsen was convicted/pied guilty in
Johnson County District Court, Case No. 107006 of violating Iowa Code § 453A.2(1 );
and
WHEREAS, at the time of the violation underlying the above conviction/plea, Hermsen
was an employee of the establishment operating under the retail cigarette permit issued to
The Airliner, 22 South Dubuque Street, Iowa City, Iowa 52240; and
WHEREAS, pursuant to Iowa Code § 453A.22(2), an establishment which holds a retail
cigarette permit is subject to a civil penalty of $300.00 as a result of its employee being
convicted of or pleading guilty to a violation of Iowa Code § 453A.2(1 ), after a hearing
and proper notice; and
WHEREAS, on August 17, 2001, The Airliner waived its fight to the hearing required by
Iowa Code § 453A.22(2) and accepted responsibility for its employee's violation of Iowa
Code § 453A.2(1), by paying a $300.00 civil penalty to the City Clerk of the City of Iowa
City; and
WHEREAS, the violation underlying the above civil penalty is the first such violation.

WHEREAS, the violation underlying the above civil penalty is the first such violation.

RESOLUTION ACCEPTiNG PAYMENT OF $300.00 CIVIL PENALTY AND
WAIVER OF RIGHT TO HEARING FROM PAUL'S OF IOWA CITY D/B/A
PAUL' S DISCOUNT
WHEREAS, on May 24, 2001, Brent Russell Branmayer was convicted/pied guilty in
Johnson County District Court, Case No. STIC107009 of violating Iowa Code §
453A.2(1); and
WHEREAS, at the time of the violation underlying the above conviction/plea, Ronan was
an employee of the establishment operating under the retail cigarette permit issued to
Paul's of Iowa City, 424 Highway 1 West, Iowa City, Iowa 52240; and
WHEREAS, pursuant to Iowa Code § 453A.22(2), an establishment which holds a retail
cigarette permit is subject to a civil penalty of $300.00 as a result of its employee being
convicted of or pleading guilty to a violation of Iowa Code § 453A.2(1), after a hearing
and proper notice; and
WHEREAS, on August 9, 2001, Paul's of Iowa City waived its right to the hearing
required by Iowa Code § 453A.22(2) and accepted responsibility for its employee's
violation of Iowa Code § 453A.2(1 ), by paying a $300.00 civil penalty to the City Clerk
of the City of Iowa City; and
WHEREAS, the violation underlying the above civil penalty is the first such violation.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF IOWA CITY CITY
COUNCIL that the City Council should accept the waiver of tight to heating and
payment of $300.00 civil penalty on behalf of Paul's of Iowa City.
BE IT FURTHER RESOLVED, that the City Clerk will forward a copy of this
Resolution to the Johnson County Attomey's Office, which will then provide a copy of
the same to the retail cigarette permit holder via regular mail sent to the permit holder' s
place of business as it appears on the application for a retail cigarette permit.

WHEREAS, the City Council of Iowa City believes that it is in the public interest to improve the
condition of brownfield sites; and
WHEREAS, the City Council recognizes that there exists a brownfield located at 1200 S.
Riverside Drive; and
WHEREAS, the City Council of Iowa City wishes to utilize $500,000 in funding from the Iowa
Department of Economic Development to assist the City with the reclamation of the brownfield;
and
WHEREAS, the City of Iowa City is committed to using up to $500,000 in local funding for said
project.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA
CITY, IOWA, THAT:
1. The Mayor of Iowa City be authorized to submit an application to the Iowa Department of
Economic Development for $500,000 for the purpose of funding a Brownfield
Redevelopment Program project.

3. The Mayor and City Clerk of the City of Iowa City, Iowa, am hereby authorized and directed,
upon approval by the City Attorney, to execute all legal documents relating to said
subdivision, and to certify a copy of this resolution, which shall be affixed to the final plat after
passage and approval by law. The City Clerk shall record the legal documents and the plat at
the office of the County Recorder of Johnson County, Iowa at the expense of the

RIVERSIDE FESTIVAL STAGE
SEATING PROJECT
IOWA CITY, IOWA
Sealed proposals will be received by the City
Clerk of the City of Iowa City, Iowa, until 10:00
a.m. on the 11th day of September, 2001, and
shall be received in the City Clerk's office no later
than said date and time. Sealed proposals will be
opened immediately thereafter by the City
Engineer. Bids submitted by fax machine shall
not be deemed a "sealed bid" for purposes of this
Project. Proposals will be acted upon by the City
Council at a meeting to be held in the Council
Chambers at 7 p.m. on the 11th day of
September, 2001, or at such later time and place
as may be scheduled.
The Project will involve the following:
Project consists of concrete paving, storm water
drainage, and aisle lighting for fixed seating
installed under separate contract at an outdoor
amphitheater.
All work is to be done in strict compliance with
the plans and specifications prepared by
Neumann Monson, P.C., 111 E. College Street,
Iowa City, Iowa, 52240, which have heretofore
been approved by the City Council, and are on file
for public examination in the Office of the City
Clerk.
Each bid shall be made on the Bid Form
prepared for this purpose and is included in the
Project Manual. Each Bid shall be accompanied
by a Bid Security attached in a separate envelope.
The Bid Security will be a Bid Bond executed by a
corporation authorized to contract as a surety in
the State of Iowa, in the sum of 10% of the bid.
The bid security shall be made payable to the
TREASURER OF THE CITY OF IOWA CITY,
IOWA, and shell be forfeited to the City of Iowa
City in the event the successful bidder fails to
enter into a contract within ten (10) calendar days
and post bond satisfactory to the City ensuring the
faithful performance of the contract and mainte-
nance of said Project, if required, pursuant to the
provisions of this notice and the other contract
documents. Bid bonds of the lowest two or more
bidders may be retained for a period of not to
exceed thidy (30) calendar days until a contract is
awarded, or until rejection is made. Other bid
bonds will be returned after the canvass and
tabulation of bids is completed and repoded to the
City Council.
The successful bidder will be required to furnish

a bond in an amount equal to one hundred
percent (100%) of the contract price, said bond to
be issued by a responsible surety approved by the
City Council, and shall guarantee the prompt
payment of all materials and labor, and also
protect and save harmless the City from all claims
and damages of any kind caused directly or
indirectly by the operation of the contract, and
shall also guarantee the maintenance of the
improvement for a period of one (1) year from and
after its completion and formal acceptance by the
City.
The following limitations shall apply to this
Project:

after the bid date.
Completion Dates:
Entire Project: November 15, 2001
Liquidated Damages: None.

by bona fide bidders.
A $50.00 refundable deposit and a $5.00 non-
refundable handling charge is required for each
set of plans and specifications provided to bidders
or other interested persons. The deposit and fee
shall be in the form of two separate checks, made
payable to Neumann Monson, P.C. The $50.00
check will be refundable upon return of said plans
and specifications in good and useable condition
within ten days after bids are received.
Prospective bidders are advised that the City of
Iowa City desires to employ minority contractors
and subcontractors on City projects.
By vidue of statutory authority, preference will be
given to products and provisions grown and coal
produced within the State of Iowa, and to Iowa
domestic labor, to the extent lawfully required
under Iowa Statutes. The Iowa Reciprocal
Preference Act applies to the contract with respect
to bidders who are not Iowa residents.
The City reserves the right to reject any or all
proposals, and also reserves the right to waive
technicalities and irregularities.

RESOLUTION NO. 01-299
RESOLUTION AMENDING THE BUDGETED POSITIONS IN THE ACCOUNTING
DIVISION OF THE FINANCE DEPARTMENT AND THE AFSCME PAY PLAN
WHEREAS, Resolution No. 01-54 adopted by the City Council on March 5, 2001, authorized
permanent positions in the Accounting Division for FY02; and
WHEREAS, Resolution No. 01-189, adopted by the City Council on June 26, 2001 established a
classification/compensation plan for AFSCME employees; and
WHEREAS, the AFSCME Classification Review Committee has reviewed the changes in the
position of Senior Account Clerk - Accounting and determined that this position performs duties
equivalent to those of positions in a higher grade; and
WHEREAS, the AFSCME Classification Review Committee has recommended that the
budgeted positions in the Accounting Division of the Finance Department be amended by
reclassifying the position of Senior Account Clerk - Accounting, from grade 6 to grade 8.
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA
CITY, IOWA THAT:
1. The budgeted positions in the Accounting Division of the Finance Department be
amended by reclassifying the position of Senior Account Clerk - Accounting from
grade 6 to grade 8.
2. The AFSCME pay plan be amended by moving the position of Senior Account Clerk
- Accounting from grade 6 to grade 8.
