Harvat Hall, 410 E. Washington Street, Iowa City, Iowa, or if said meeting is cancelled, at the next meeting of the City Council thereafter as posted by the City Clerk; at which hearing the Council will consider: an ordinance allowing roof canopy signs in the Central Business District zones. Copies of the proposed ordinances are on file for public examination in the office of the City Clerk, Civic Center, Iowa City, Iowa. AN ORDINANCE AMENDING TITLE 14, CHAPTER 6, ENTITLED "ZONING," ARTICLE O, ENTITLED "SIGN REGULATIONS," TO PERMIT CANOPY ROOF SIGNS AS A PERMITrED SIGN IN THE CB-2, CENTRAL BUSINESS SUPPORT, CB-5, CENTRAL BUSINESS SUPPORT ZONE AND THE CB-10, CENTRAL BUSINESS DISTRICT ZONE. WHEREAS, signs located on canopy roofs are considered to be roof signs and are therefore prohibited in all zone so that the quality of the skyline may be preserved; and WHEREAS, canopy signs are allowed in the CB-2, Central Business Service, CB-5, Central Business Support Zone, and the CB-10, Central Business District Zone provided the sign is attached to the face or underside of the canopy; and WHEREAS, canopy roof signs of the appropriate size and scale for Central Business storefront properties and the pedestrian-oriented environment are appropriate in the CB-2 Central Business Service Zone, CB-5, Central Business Support Zone, and the CB-10, Central Business District Zone; and WHEREAS, canopy roof signs wilJ not adversely effect the quality of the skyline. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY, IOWA: SECTION I. AMENDEMENT Chapter 6, entitled "Zoning," Article O, entitled "Sign Regulations," Section 5 entitled "Signs Permitted by Zone; Regulations:", Subsection E, entitled "CB-2 Zone" is hereby amended to include the following additional paragraphs and subparts: 14-60-5F. Chapter 6, entitled "Zoning,: Article B, entitled "Zoning Definitions" is hereby amended to include the following additional paragraphs: 14-6B-2: Definitions STOREFRONT: The ground level frontage of a building in which there is located a single business directly behind the frontage. The length of the storefront is measured from the outside edge of the exterior walls of the building, or if there are multiple businesses located in a single building, from the centerline of the wall that separates the business from another business, public area, or other area not occupied by the business. SECTION II. REPEALER. All ordinances and pads of ordinances in conflict with the provisions of this Ordinance are hereby repealed. SECTION III. SEVERABILITY. If any section, provision or part of the Ordinance shall be adjudged to be invalid or unconstitutional, such adjudication shall not affect the validity of the Ordinance as a whole or any section, provision or part thereof not adjudged or unconstitutional. SECTION IV. EFFECTIVE DATE. This Ordinance shall be in effect after its final passage, approval and publication, as provided by law. Passed and approved this day of ,20__ Mayor Attest: City Clerk pcd\shelly\canopyorddoc City of Iowa City MEMORANDUM TO: Planning and Zoning Commission FROM: Shelley McCafferty, Associate Planner DATE: July 27, 2001 RE: Canopy Roof Signs Recently Mondo's was given a temporary use permit for a 35 sq.ft. sign to be installed at the top of the canopy at 210 S. Clinton Street. While the location of the sign appears to be reasonable (which is why the temporary use permit was issued). This type of sign is not permitted under the current City Code. Canopy signs, by Iowa City's definition, are only permitted to be incorporated into the face or underside of a canopy, and are only permitted to be a maximum of 12 sq. ft. in size in the downtown zones. Roof signs, which are signs affixed to and extending above a roof or roof-like structure, are not permitted. Roof signs are prohibited in many communities due to their potential to have a negative impact on scenic views and to interrupt the skyline. In addition to the Mondo's sign, staff has heard from at least two other businesses that are interested in being able to install signs affixed to the top of a canopy. The issues staff has identified with these types of signs are related to the size and scale of the sign in relation to the scale of the building wall and to the character of downtown. Staff has drafted the attached amendment to the sign ordinance to allow canopy roof signs in the Central Business (CB-10), Central Business Support (CB-5) and Central Business Service (CB-2) zones. The intent for downtown is for it to be a pedestrian-oriented shopping, entertainment and commercial district. As such, signage should be designed for the pedestrian scale. It is the design of storefronts in downtown that contributes most significantly to the pedestrian scale. Therefore, the amendment to the signage ordinance for Canopy Roof Signs, uses the length of the individual storefront to determine the appropriate dimensions for a Canopy Roof Sign. In addition, a definition of "Storefront" has been added to the ordinance. The definition clarifies how the length of the storefront is to be determined. Staff believes that the proposed amendment will provide downtown businesses with an alternative method of locating signs while at the same time respecting the pedestrian scale of the downtown environment. CITY STEPS) At the September 11 City Council meeting you will be holding a public hearing to receive input regarding proposed changes or amendments to Iowa City's 2001-2006 Consolidated Plan (a.k.a. C~I'Y STEPS). Proposals for amendments to C~FY STEPS may be related to any aspect of the plan including the allocation of funds for broad activities (i.e. housing, economic development, public facilities and public services), overall goals of the plan or the priority levels identified in the plan. Following this public hearing the proposed amendments will be forwarded to the Housing and Community Development Commission (HCDC) for their consideration and recommendation. CITY STEPS). One of the amendments to the Plan that the Council is asked to consider is increasing the percentage of federal funds designated for economic development activities from 5% to 9%. On July 31,2001, the City Council adopted Resolution Number 01-240 which established a Community Development Block Grant (CDBG) Economic Development Fund. The resolution states that begirming with FY03 CDBG funding, the CDBG Economic Development Fund will annually be funded by the Council setting aside a percentage of federal funds received. The resolution did not specifically state what that percentage would be. At its June 28, 2001, meeting, the Council Economic Development Committee recommended, by a vote of 3-0, that the Council annually set-aside 9% of federal funds for economic development projects. The Committee requests that the Council use this 9% of federal funds received to fund the CDBG Economic Development Fund.
