WHEREAS, the following firms and persons have made application and paid the mulct tax
required by law for the sale of cigarettes, therefore

granted and the City Clerk is hereby directed to issue a permit to the following named persons

WHEREAS, Paul 's of Iowa City at 424 Highway 1 West in Iowa City,
Iowa, has surrendered cigarette permit No. 01038 , expiring June 30
2002 , and requests a refund on the unused portion, now thereof,
BE IT RESOLVED BY THE CITY COUNCIL OF IOWA CITY, IOWA, that cigarette permit No.

BE IT FURTHER RESOLVED that the Mayor and City Clerk be and they are hereby authorized

RESOLUTION FIXING DATE FOR A MEETING ON THE
PROPOSITION OF THE ISSUANCE OF $10,250,000
SEWER REVENUE BONDS OF IOWA CITY, IOWA AND
PROVIDING FOR PUBLICATION OF NOTICE THEREOF
WHEREAS, the City of Iowa City, Iowa, is in need of funds to carry out the
purpose hereinaf~er described; and, it is deemed necessary and advisable that said City
should issue Sewer Revenue Bonds to the amount of $10,250,000, as authorized by
Section 384.83, of the City Code of Iowa, for the purpose of providing funds to pay costs
thereof; and
WHEREAS, before said bonds may be issued, it is necessary to comply with the
provisions of said Code, and to publish a notice of the proposal to issue such bonds and
of the time and place of the meeting at which it is proposed to take action for the
issuance of the bonds and to receive oral and/or written objections from any resident or
property owner of said City to such action;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF IOWA CITY, IOWA:
Section 1. That this goveming body meet in the Emma J. Harvat Hall, Civic
Center at Iowa City, Iowa, at 7: 00 o'clock y_L.M-, on the 13th day oflqovember ,2001,

for the purpose of taking action on the matter of the issuance of $10,250,000 Sewer
Revenue Bonds of said City, the proceeds of which bonds will be used to provide funds
to pay costs of extending, improving and equipping the sanitary sewer utility of the City.
Section 2. The Clerk is authorized and directed to proceed on behalf of the City
with the sale of said bonds, to select a date for the sale thereof, to cause to be prepared
such notice and sale information as may appear appropriate, to publish and distribute the
same on behalf of the City and otherwise to take all action necessary to permit the sale of
said bonds on a basis favorable to the City and acceptable to this governing body.
Section 3. That the Clerk is hereby directed to cause at least one publication to be
made of a notice of said meeting, in a legal newspaper, printed wholly in the English
language, published at least once weekly, and having general circulation in said City,
said publication to be not less than four dear days nor more than twenty days before the
date of said public meeting on the issuance of said bonds.
Section 4. The notice of the proposed action to issue said bonds shall be in
substantially the following fonn:

PUBLIC NOTICE is hereby given that the City Council of the City of Iowa City,
Iowa, will hold a public hearing on the 13th day of November, 2001, at 7:00 &clock
P..M., in the Emma J. Harvat Hail, Civic Center, in Iowa City, Iowa, at which meeting the
City Council proposes to take additional action for the issuance of $10,250,000 Sewer
Revenue Bonds of said City. Said bonds will not constitute general obligations or be
payable in any manner by taxation, but will be payable from and secured by the net
revenues of the Sanitary Sewer Utility. Said bonds are proposed to be issued for the
purpose of paying costs of extending, improving and equipping the sanitary sewer utility
of the City.
At the above meeting oral or written objections from any resident or property
owner of said City to the above action shall be received. After all objections have been
received and considered, the Council will at said meeting or at any adjoumment thereof,
take additional action forthe issuance of said bonds or will abandon the proposal to issue
said bonds.
This notice is given by order of said governing body as provided by Section 384.83
of the City Code of Iowa.

RESOLUTION ACCEPTING THE WORK FOR THE ROCHESTER AVENUE PCC
PAVEMENT REHABILITATION PROJECT
WHEREAS, the Engineering Division has recommended that the work for construction of the
Rochester Avenue PCC Pavement Rehabilitation Project, as included in a contract between the
City of Iowa City and Cedar Falls Construction Co., Inc. of Cedar Falls, dated December 19, 2000,
be accepted; and
WHEREAS, the performance and payment bond has been filed in the City Clerk's office.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA
CITY, IOWA, THAT said improvements are hereby accepted by the City of Iowa City, Iowa.

I hereby certify that the construction of the Rochester Avenue PCC
Pavement Rehabilitation Project has been completed in substantial
accordance ~vith the plans and specifications prepared by The City
of Iowa City Engineering Department and Anderson-Bogert
Engineers. The final construction cost is $246,716.84.
I recommend that the above referenced improvements be accepted
by the City of Iowa City.

the Neumann Monson Architects of Iowa City, Iowa. The required performance
and payment bond is on file in the City Clerk's office.
The final contract price is $254,536.78
I recommend that the above-referenced improvements be accepted by the City
of Iowa City.

RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK
TO ATTEST A TEMPORARY CONSTRUCTION EASEMENT ON LOT 7,
HIGHLANDER DEVELOPMENT FIRST ADDITION, IOWA CITY, IOWA
WHEREAS, Northgate Park Associates sold Lot 7, Highlander Development First Addition to the
Preucil School of Music for its new facility; and
WHEREAS, a sanitary sewer easement exists on Lot 7 for future installation of the sanitary sewer
line by Northgate; and
WHEREAS, Northgate will be developing property to the east of Lot 7 which will require an
upsizing of the planned sanitary sewer pipe; and
WHEREAS, due to the increased size of the sanitary sewer line, additional area is necessary to
install same; and
WHEREAS, Northgate needs to reserve the ability to install the improvement on Preucil's lot.
WHEREAS, the City Council finds that the execution of the temporary construction easement that
is necessary to facilitate future installation of the public improvements by Northgate is in the public
interest.
NOW, THEREFORE,' BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF IOWA CITY,
IOWA, that:
1. The Mayor and City Clerk are hereby authorized and directed to execute the Temporary
Construction Easement Agreement for Lot 7, Highlander Development First Addition, Iowa
City, Iowa.
2. The Temporary Construction Easement Agreement shall be recorded by the City
Attomey's Office in the Johnson County Recorders Office at Northgate's expense.

AGREEMENTS, TWO PROMISSORY NOTES, TWO MORTGAGES, A FINANCING
STATEMENT (UCC4), AND AN AMENDED PROMISSORY NOTE AND
MORTGAGE FOR THE PROPERTY LOCATED AT 1902 H STREET, IOWA CITY,
IOWA.
WHEREAS, on November 23, 1993, the owners of 1902 H Street executed two Rehabilitation
Agreements, two Promissory Notes, a Financing Statement (UCC4) and one Ten-year Declining
Balance Mortgage ($23,871) and one Conditional Occupancy Mortgage $15,500) for a total
amount of $39,371; and
WHEREAS, on May 15, 1996, the owners executed an amended Promissory Note and an
amended Conditional Occupancy Mortgage for the amount of $14,370.93 for a total amount of
$36,241.93; and
WHEREAS, the balance of the loans was paid off on October 3, 2001; and
WHEREAS, it is the City of Iowa City's responsibility to release this lien.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA
CITY, IOWA that the Mayor is authorized to sign and the City Clerk to attest the attached
Release of Lien for recordation, whereby the City does release the property located at 1902 H
Street, Iowa City, Iowa from the two Rehabilitation Agreements, two Promissory Notes, two
Mortgages and a Financing Statement (UCC4) recorded on May 24, 1994, Book 1753, Page
001 through Page 025; and from the amended Promissory Note and Mortgage recorded on May

RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO
ATTEST TO THE RELEASE OF LIEN REGARDING A REHABILITATION
AGREEMENT AND A STATEMENT OF LIFE LIEN FOR THE PROPERTY
LOCATED AT 328 4TM AVENUE, IOWA CITY, IOWA.
WHEREAS, on October 15, 1990, the property owner of 328 4th Avenue executed a
Rehabilitation Agreement and a Statement of Life Lien through the City's Housing Rehabilitation
Program. The Statement of Life Lien was in the form of a conditional occupancy loan in the
amount of $11,500; and
WHEREAS, on August 5, 1991, the property owner executed an amended Statement of Life
Lien for the amount of $10,993.20; and
WHEREAS, the loan was paid off on October 3, 2001; and
WHEREAS, it is the City of Iowa City's responsibility to release this lien.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA
CITY, IOWA that the Mayor is authorized to sign and the City Clerk to attest the attached
Release of Lien for recordation, whereby the City does release the property located at 328 4th

BACKGROUND INFORMATION:
The property is within Fringe Area A of the Iowa City Johnson County Fringe Area Agreement.
The agreement indicates that this area is within Iowa City's growth limit and may at some point in
the future be annexed into the City. Therefore special consideration must be given to any
development within this portion of Fringe Area A. The agreement requires that any development
within this area meet City urban design standards for infrastructure. The agreement also specifies
that at least fifty percent of the subdivided property must be set aside for open space for
agricultural uses or future development if and when the property is annexed into the City.
Earlier this year an application for a 5-lot subdivision was denied because it did not adhere to the
Fringe Area Agreement. The applicant is now proposing to subdivide the property into two lots.
Lot 1 contains an existing house. Lot A is set aside for future development.

ANALYSIS:
Because no new development lots will be created, the proposed subdivision conforms with the
Fringe Area Agreement. Approval of this subdivision will allow the existing house site to be sold
separately from Outlot A. Outlot A may not be developed unless it is annexed into the city or
infrastructure is installed to meet City design standards.
A note on the bottom right hand corner of the plat states that if Outlot A is used for a single
family residence, Outlot A will have direct vehicular access onto Prairie Du Chien Road. The
Comprehensive Plan discourages access from individual lots onto arterial streets when there
are alternative means of access. In this case the subdivider and owner also own Mulford's First
Subdivision located to the west of this property. An access easement provides for a driveway
from these lots to Linder Road to the south. Staff recommends that if Outlot A is developed for
a single lot, vehicular access be by this existing driveway rather than creating a curb cut onto
Prairie Du Chien Road. This would require an easement to allow Outlot A to have access to the
driveway. In the event that Outlot A is subdivided into multiple lots a new street will be required
and may obtain access from Prairie Du Chien Road. It may not be practical for the existing
driveway to provide access to several additional lots unless it is substantially upgraded; that
issue would be evaluated at the time of any future subdivision. However one additional lot onto
this driveway would be reasonable. Therefore, Staff recommends that the note on the plat be
revised to indicate that if Outlot A is to be developed with one residence, access will be via an
access easement over the current driveway in Mulford's First Subdivision.
STAFF RECOMMENDATION:
Staff recommends approval of the preliminary and final plat of Prairies Edge Subdivision, a 1-lot
residential subdivision with one outlot, located on the west side of Prairie Du Chien Road
subject to an access easement providing vehicular access to Outlot A from Linder Road in the
event that Outlot A is developed for a single residence and staff approval of legal papers prior
to City Council consideration. In absence of such an easement, Staff recommends that the
subdivision be denied.

On December 7, 1999, the City Council approved the final plat of Windsor Ridge, Part 11, a
12.58, 34-1ot subdivision, located west of Arlington Drive. The subdivision includes two new
streets, Buckingham Lane and Cumberland Lane. The applicant now wishes to build
Buckingham Lane, but would prefer to delay the construction of Cumberland Lane. Therefore,
the applicant is proposing to plat Windsor Pad 11A, which would include 16 lots on Buckingham
Lane. Approval of this subdivision will allow construction of Cumberland Lane or the
requirement that funds be put in escrow for its construction. Other than dividing the original
Windsor Ridge, Pad 11, into two pads, there are no other changes proposed in the previously
approved plat.
STAFF RECOMMENDATION
Staff recommends that the final plat of Windsor Ridge, Part 11A, a 5.32, 18-1ot residential
subdivision, be approved subject to approval of legal papers prior to City Council consideration.

PUBLIC HEARING AND RESOLUTION APPROVING PROCEEDING WITH THE
ISSUANCE AND SALE OF NOT TO EXCEED $40,000,000 AGGREGATE PRINCIPAL
AMOUNT OF REVENUE BONDS (ACT, INC. PROJECT) SERIES 2001 OF IOWA CITY,
IOWA.
WHEREAS, Iowa City, Iowa (the "Issuer"), a municipal corporation of the State of Iowa, is
authorized by Chapter 419 of the Iowa Code, as mended (the "Act"), to issue its revenue bonds and
to loan the proceeds from the sale of such revenue bonds to one or more parties to be used to defray
all or a portion of the cost of acquiring, constructing, improving and equipping a "project", as that
term is defined in the Act, including land, buildings and improvements suitable for use as a facility'
for an organization described in Section 501(c)(3) of the Internal Revenue Code which is exempt
from federal income tax under Section 501(a) of the Intemal Revenue Code (a "Tax Exempt
Organization"); and
WHEREAS, the Issuer has been requested by ACT, Inc., an Iowa nonprofit corporation (the
"Borrower"), to authorize and issue an amount not to exceed $40,000,000 of Revenue Bonds (ACT,
Inc. Project) Series 2001 (the "Bonds") pursuant to the provisions of the Act for the purpose of
financing or reimbursing original expenditures incurred to pay all or a portion of the cost of (i)
constructing and equipping additional research-service facilities at the Borrower'g existing complex
at the southeast comer of the 1-80 and Highway 1 interchange in Iowa City, Iowa and related site
development (the "Project") and (ii) paying related costs, including costs of iss~ce of the Bonds;
and
WHEREAS, the proceeds from the sale of the Bonds are to be loaned by the Issuer to the
Borrower pursuant to the provisions of a Loan Agreement (the "Agreement") between the Issuer and
the Borrower; and
WHEREAS, a notice of hearing on the proposal to issue not to exceed $40,000,000 aggregate
principal amount of Revenue Bonds (ACT, Inc. Project) Series 2001, of the Issuer has been
published as required by law; and
WHEREAS, a public hearing has been held at the time and place as specified in said notice
of hearing and any and all objections or other comments relating to such Bonds have been heard and
it is deemed to be in the best interests of the Issuer that said Bonds be issued as proposed; and
NOW, THEREFORE, Be It Resolved by the City Council of the Issuer as follows:
Section 1. That it is hereby determined that it is necessary and advisable that the Issuer
proceed with the issuance of its Revenue Bonds (ACT, Inc. Project) Series 2001 in an amount not
to exceed $40,000,000, as authorized and permitted by the Act, and to loan the proceeds of the sale

of the Bonds to the Borrower all upon terms and conditions mutually satisfactory to the Issuer and
the Borrower.
Section 2. That at the public hearing conducted by this City Council, in accordance with
the provisions of Section 419.9 of the Act and Section 147(f) of the Internal Revenue Code of 1986,
as mended, pursuant to published notice, all persons who appeared were given an opportunity to
express their views for or against the proposal to issue said Bonds.
Section3. Thatitisherebydeterminedthatanyandallobjectionstotheissuanceofsaid
Bonds are hereby overruled and this City Council shall proceed with the necessary proceedings
relating to the issuance of said Bonds upon reasonable advance notice from the Borrower that
satisfactory financing terms have been agreed upon with the proposed purchasers and the required'
documentation has been prepared by Bond Counsel, and approved by all other parties, including the
Issuer.

Sealed proposals will be received by the City
Clerk of the City of Iowa City, Iowa, until 10:30
A.M. on October 4, 2001, and shall be received in
the City Clerk's office no later than said date and
time. Sealed proposals will be opened
immediatelythereafterbytheCityEngineer. Bids
submitted by fax machine shall not be deemed a
'sealed bid' for purposes of this Project.
Proposals will be acted upon by the City Council
at a meeting to be held in the Council Chambers
at 7:00 P.M. on October 8, 2001, or at such later
time and place as may be scheduled.
The Project will involve the following
construction activities:
Furnish and install all labor, materials, and
equipment for the construction of a 468
Sq. Ft. booster pump station and
renovation of existing Jordan well house,
including (2) 1000 gpm horizontal split-
case centrifugal pumps, (1) 1000 gpm
vertical turbine pump, process piping and
valves, roofing, mechanical, electrical,
instrumentation and controls, yard piping,
sitework, fiber optic cable, together with
related subsidiary and incidental work in

All work is to be done in strict compliance with
the plans and specifications prepared by Howard
R. Green Company, 4685 Merle Hay Rd., Ste.
106, Des Moines, IA 50322 which have
heretofore been approved by the City Council,
and are on file for public examination in the Office
of the City Clerk.
Each proposal shall be completed on a form
furnished by the City, and must be accompanied
in a sealed envelope, separate from the one
containing the proposal by a bid bond executed
by a corporation authorized to contract as a
surety in the State of Iowa, in the sum of 10% of
the bid. The bid security shall be made payable
to the TREASURER OF THE CITY OF IOWA
CITY, IOWA, and shall be forfeited to the City of
Iowa City in the event the successful bidder fails
to enter into a contract within ten (10) calendar
days and post bond satisfactory to the City
insuring the faithful performance of the contract
and maintenance of said Project, if required,
pursuant to the provisions of this notice and the
other contract documents. Bid bonds of the

RESOLUTION ESTABLISHING THE
NEIGHBORHOOD HOUSING RELATIONS TASK FORCE
WHEREAS, the Iowa City City Council has identified the need for review of existing
housing nuisance laws and policies to afford peaceful habitation in residential areas of
Iowa City; and
WHEREAS, the Iowa City City Council has determined an ad-hoc, citizen task force is
the most appropriate body to review current laws and policies, to study options and
recommend amendments, as appropriate, to current ordinances to meet the goal of
peaceful habitation.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
IOWA CITY, IOWA:
1. The Neighborhood Housing Relations Task Force is created to fulfill the goal of
improving peaceful habitation in Iowa City residential areas.
2. The Neighborhood Housing Relations Task Force will be comprised of the following
eleven (11) individuals representing the indicated categories: Three Neighborhood
Council: Ann Freerks, Jerry Hansen, Tim Walker; Three Tenant Interests: Mike
Carberry, Nick Klenske, Mike Newman; Three Landlord Interests: Ted Chambers,
Larry Svoboda, Anne Vespa; One member to be named by the Association of
Realtors; and One At-Large Chair: Hillary Sale.
3. Members of the Neighborhood Housing Relations Task Force will serve until the
Iowa City City Council considers the recommendation forwarded by the Task Force,
at which time the Task Force will dissolve.

Re: Neighborhood Housing Relations Task Force
Attached are various items of correspondence concerning the Neighborhood Housing
Relations Task Force. Your decisions at your most recent work sessions included the
following participants on the task force:
1. Three from the Neighborhood Council;
2. Three from tenant interest groups;
3. Three from landlord interest groups;
4. One from the Association of Realtors; and
5. A chair, undecided.
I did check to see if a facilitator could be arranged. While I did not look extensively, it will
likely be difficult to secure a facilitator for a long-term commitment with such short notice.
We suspect many are scheduled into the year. While I believe a facilitator would be
helpful, it appears to be difficult to secure a commitment. It also seems the Council had
some interest in the possibility of the chair serving as a "facilitator," that is guiding the
meeting discussion. If this is decided, we must be aware that the chair position will be one
of guiding the meeting and likely not have active participation. A facilitator was intended to
be able to provide for active participation on all members of the task force.
It would seem Council's decisions include:
1. Appoint members, including the chair;
2. Direct as to whether you wish to pursue the facilitator idea;
3. Some type of schedule of meetings (or your expectations);
4. Identify to the fullest extent practical a specific charge to the task force; and
5. Any type of reporting mechanisms.
This item is scheduled for discussion at your work session of Monday, October 22.

amendments to our City's housing/nuisance ordinances. The City Council, in cooperation with
our community's Neighborhood Association Council, is in the process of formulating such a
committee. The Neighborhood Council directed a proposal to the City Council concerning this
issue, a copy of which is enclosed. In establishing the committee it was suggested that
representatives from the Apa~ment Owners Association would be helpful. Please give this

I am respectfully reqnesting to be considered as a candidate tbr the soon to be created
Nuisance Committee. I have been employed by HACAP in Johnson County for 14 years
now and have served hs the HACAP landlord or property manager for a total of eleven
years. As you know, HACAP o~vns a large amount of rental property in Iowa City,
including an eighteen unit apartment complex on Broadway Street. several units in the
Broadway Condo area, as well as three units in the Hilltop Mobile Home Court on
Waterfront Drive. It is known that HACAP serves low to moderate income families in
our well established Transitional Housing Program. It is also well known that we have
high expectations for our families to succeed. We want the families we serve to leave our
Housing Program with all the tools available to them to continue to be excellent renters in
the Iowa City community. A very large number of our families leave our Housing
Program after one to two years and purchase their own homes in this area.
I have read all the material available concerning the interest in developing a Nuisance
Committee and feel that I would be able to provide much needed knowledge and insight
regarding the areas of concern. I can be reached at my HACAP office on 2007
Waterfront Drive, or by telephone at 337-5765. I am in and out of the office quite often
but a message can always be left for me and hopefully I will be able to return all calls
promptly. l understand that a fairly quick turn around is desired. Thank you in advance

~dergradume student I lived in the U of I doms and later rented on the west
side of town. In 1988 1 m~ried, became a homeowner and s~ed my family.
In 19~5 I stmed graduate school. It was during this s~e ye~ thin I also
divorced which resulted in mY thee children ~d [ moving om of our home
~d once again returning to rental housing. In 1998~ I completed my-gradume
progr~ in Urban ~d Regional Plying with ~ emphasis' of study in
Ho~ing and Community Devdopment. It was in November of this same ye~
that I accepted the position that I continue to hold today of Execmive Director
for the EmergenCy Housing Project.
As indicated, I have had personal experience as bdth tenant ~d homeowner. [
have both academic ~d professional experience thin would be ~elevant to the
overall ch~gel of a.committee focusing on housing and nuis~ce ordinances.
The issues raised with respect to the proposed ordin~ce strike me as veq
serious concerns, ~ot only as a community member but so to as a mother of
