Comment: This resolution sets a public hearing for 7:00 p.m. on November 13, 2001, to receive public comment regarding the issuance of $10,250,000 of Sewer Revenue Bonds and authorizes the City Clerk to publish the Notice of Hearing. Proceeds from the bonds will pay costs of upgrades to the South and North Wastewater Treatment Plants. (2) CONSIDER A RESOLUTION SE'I'I'ING A PUBLIC HEARING FOR NOVEMBER 13 ON PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE COURT HILL TRUNK SEWER IMPROVEMENTS PROJECT, DIRECTING CITY CLERK TO PUBLISH NOTICE OF SAID HEARING, AND DIRECTING THE CITY ENGINEER TO PLACE SAID PLANS ON FILE FOR PUBLIC INSPECTION. October 23, 2001 City of Iowa City Page 3 (3) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO A'R'EST A TEMPORARY CONSTRUCTiON EASEMENT AGREEMENT ON LOT 7, HIGHLANDER DEVELOPMENT FIRST ADDITION, IOWA CITY, IOWA. Comment: Nodhgate Park Associates sold Lot 7, Highlander Development First Addition to Preucil School of Music for its new facility. A sanitary sewer easement exists on Lot 7 for future installation of the sanitary sewer line by Northgate. Northgate will be developing property to the east of Lot 7 which will require an upsizing of the planned sanitary sewer pipe. Due to the increased size of the sanitary sewer line, additional area is necessary to install same. Further, Northgate needs to reserve the ability to install the improvement on Preucil's lot. This resolution authorizes execution of the temporary construction easement that is necessary to facilitate future installation of the public improvements by Northgate. (4) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST TO THE RELEASE OF LIEN REGARDING TWO REHABILITATION AGREEMENTS, TWO MORTGAGES, TWO PROMISSORY NOTES, A FINANCING STATEMENT (UCC4), AND AN AMENDED PROMISSORY NOTE AND MORTGAGE FOR THE PROPERTY LOCATED AT 1902 H STREET, IOWA CITY, IOWA. Comment: The owners of the property located at 1902 H Street received assistance through the City's Housing Rehabilitation Program totaling $38,241.93. The financing was in the form of a ten- year declining balance loan and a conditional occupancy loan. The balance of the loans has been paid off; thus the lien can now be released. (5) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO A'I'I'EST TO THE RELEASE OF LIEN REGARDING A REHABILITATION AGREEMENT AND STATEMENT OF LIFE LIEN FOR THE PROPERTY LOCATED AT 328 4TM AVENUE, IOWA CITY, IOWA. Comment: The owner of the property located at 328 4th Avenue received assistance through the City's Housing Rehabilitation Program in the amount of $11,500. The financing was in the form of a conditional occupancy loan. The loan was paid off October 3, 2001; thus the lien can now be released. October 23, 2001 City of Iowa City Page 4 o I- 5~jc[ (6) CONSIDER A RESOUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO A'I'I'EST TO A SUBORDINATION AGREEMENT BETWEEN THE CITY OF IOWA CITY AND HAWKEYE STATE BANK, IOWA CITY, IOWA FOR PROPERTY LOCATED AT 416 SOUTH DODGE STREET, IOWA CITY, IOWA. Comment: Hawkeye State Bank, Iowa City, Iowa has requested that the City approve a Subordination Agreement for 416 South Dodge Street. On July 30, 1999, the owners of the property received a loan from the Community Development Block Grant (CDBG) fund and from the HOME Investment Partnership Program for an original total of $125,000. Approximately $33,000 of this loan has been repaid, thus the unpaid obligation to the City is currently about $92,000. Hawkeye State Bank is about to finance a first mortgage to the property owners for the amount of $110,000. The property is appraised for $212,000 which provides enough equity to cover the City's second lien position, which was its original position. o/- 2>h~t:2 (7) CONSIDER A RESOUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO A'R'EST TO A SUBORDINATION AGREEMENT BETWEEN THE CITY OF IOWA CITY AND HAWKEYE STATE BANK, IOWA CITY, IOWA FOR PROPERTY LOCATED AT 716 NORTH DUBUQUE STREET, IOWA CITY, IOWA. Comment: Hawkeye State Bank, Iowa City, Iowa has requested that the City approve a Subordination Agreement for 716 North Dubuque Street. On May 30, 1997, the owners of the property received a loan from the General Fund ($85,000) and from the HOME Investment Partnership Program ($100,000) for an original total of $185,000. Approximately $43,000 of the City's loans have been repaid, thus the unpaid obligation to the City is currently about $142,000. Hawkeye State Bank is about to finance a first mortgage to the property owners for the amount of $300,000. The property is appraised for $455,000 which provides enough equity to cover the City's second lien position, which was its original position. On July 24, 2001, the owners of the property received a loan from the Community Development Block Grant funds for the amount of $300,000. Consider a motion setting a public hearing for November 13 on an ordinance to rezone from Medium Density Single Family (RS-8) to Historic Preservation Overlay (RS-8/OHP) for properties within the Longfellow Neighborhood to establish the Longfellow Historic District. (REZ01-00019) Comment: At its October 4 meeting, by a vote of 5-0-1 (Ehrhardt had abstained), the Planning and Zoning Commission recommended approval of the proposed rezoning. At its August 9, 2001 meeting, the Historic Preservation Commission held a public hearing and by a vote of 7-0, recommended the rezoning. Staff recommended approval in a report dated September 12, 2001. Action: / b. (VAC01-00005) Comment: The proposed vacation would allow the church to expand their parking lot on property that is not needed for the street. At its October 4 meeting, by a vote of 6-0, the Planning and Zoning Commission recommended approval of the vacation. Staff recommended approval in a report dated September 21, 2001. Act,o.: e. Public hearing on an ordinance to rezone approximately 3.07 acres from Medium Density Multifamily, RM-20, to Medium Density Single Family, RS-8, located at 747 W. Benton Street. At its September 20 meeting, by a vote of 6-1 (Shannon voting in the negative), the Planning and Zoning Commission recommended denial of the proposed rezoning. At its September 20 meeting, by a vote of 7-0, the Planning and Zoning Commission recommended approval, subject to no building permits being issued until the extension of First Avenue is open to traffic. Public hearing on a rezoning ordinance to amend the OPDH plan for Village Green Part XVIll to permit nine additional residential units on 4.33 acres of property located west of Scott Boulevard and south of Wellington Drive. (REZ01-00018) Comment: At its October 4 meeting, by a vote of 6-0, the Planning and Zoning Commission recommended approval. Staff recommended approval of the amended OPDH plan in a report dated September 20. i. Public hearing on an ordinance to rezone approximately 14.07 acres of property from Low Density Single Family Residential, RS-5, and Planned Development Overlay - Low Density Single Family Residential, OPDH-5, to OPDH-5, for approximately 14.07 acres of property located south of Village Road and north of Wintergreen Drive. (REZ01-0001.4) Comment: The proposed rezoning would permit c(~n~ of 33 condominium dwellings and 11 single-family houses. At its September 6 meeting, by a vote of 6-0, the Planning and Zoning Commission recommended approval of the proposed rezoning. Staff recommended approval in a report dated August 16. At its September 6 meeting, by a vote of 6-0, the Planning and Zoning Commission recommended approval of the final plat, subject to approval of legal papera and construction plans prior to City Council consideration. (SUB01-00019) Comment: At its October 4 meeting, by a vote of 5-1 (Ehrhardt voted no), the Planning and Zoning Commission recommended approval of the preliminary and final plat, subject to approval of legal papers prior to City Council consideration. PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST OF CONSTRUCTION OF A UNIVERSAL DESIGN SINGLE FAMILY HOME UNDER THE AFFORDABLE DREAM HOME OPPORTUNITIES PROGRAM (1821 B STREET), ESTABLISHING AMOUNT OF BID SECURITY TO ACCOMPANY EACH BID, DIRECTING THE CITY CLERK TO PUBLIC ADVERTISEMENT FOR BIDS, AND FIXING TIME AND PLACE FOR RECEIPT OF BIDS.. Comment: This project involves the construction of a Universal Design Single Family Home under the Housing Authority's Affordable Dream Home Opportunities Program. This home will be a three-bedroom ranch, affordable, and fully accessible and usable by all people, not withstanding their level of ability or disability. The construction of this home will be provide the opportunity for the community to learn about universal design products and building spaces, while demonstrating that a accessibility need not increase costs or result in special, clinical or different looking buildings. Upon completion of the Universal Design Home, it would be the Housing Authority's intention to place it on the 2002 Parade of Homes. The cost of this project is estimated to be $150,000. a. PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR CONSTRUCTION OF THE RECREATION AND CIVIC CENTER HVAC AND PLUMBING REPLACEMENT PROJECT, ESTABLISHING AMOUNT OF BID SECURITY TO ACCOMPANY EACH BID, DIRECTING CITY CLERK TO PUBLISH ADVERTISEMENT FOR BIDS, AND FIXING TIME AND PLACE FOR RECEIPT OF BIDS. Comment: This project will include replacing a number of HVAC [Heating Ventilation Air Conditioning Units] at the Civic Center and Recreation Center and also replacing the Scotch Marine Boilers at the Recreation Center. This is a multi-phased project updating and replacing systems, units and controls and will provide improved energy efficiency. The project will be funded mostly by General Obligation bond proceeds. PROJECT) SERIES 2001 OF IOWA CI~, IOW~ Comment: The City has been requested to issue revenue bonds on behalf of ACT, Inc. for the expansion of its research facili~. a.PUBLIC HEARING Action: ~l - ~ b. CONSIDER A RESOLUTION APPROVING October 23, 2001 City of Iowa City Page 11 ITEM NO. 9. PUBLIC HEARING ON A PROPOSED AMENDMENT TO THE CITY- UNIVERSITY PROJECT I URBAN RENEWAL PLAN AND PLAN AREA IN THE CITY OF IOWA CITY, IA. Comment: The proposed amendments to the City-University Project I Urban Renewal Plan would expand the urban renewal area, allow for the use of tax increment financing, and amend other portions of the Plan to make the Plan more current. At its regular meeting of October 4, 2001, the Planning and Zoning Commission found, by a vote of 6-0, that the Amended City- University Project I (Project No. IA R-14) Urban Renewal Plan conforms with the Iowa City Comprehensive Plan - 1997. Affected taxing entities were invited to a consultation on October 4, 2001, to discuss the proposed amendment to the Plan. No representatives from the affected taxing entities attended the consultation. Action: ITEM NO. 10. CONSIDER AN ORDINANCE AMENDING THE IOWA CITY UNIFIED DEVELOPMENT CODE BY ESTABLISHING A TEMPORARY MORATORIUM ON DEVELOPMENT WITHIN THE AREA ROUGHLY CIRCUMSCRIBED BY MILLER AVENUE, U.S. HIGHWAY 1, HARLOCKE STREET, AND BENTON STREET IN IOWA CITY, IOWA. (FIRST CONSIDERATION) Comment: The City is currently beginning its area study and development of the Southwest District Plan, a district specific component of the Comprehensive Plan. The guidelines and principles set forth in the Comprehensive Plan are used to identify appropriate land uses and guide development within the City. The area circumscribed by Miller Avenue, U.S. Highway 1, Hadocke Street and Benton Street is located within the Southwest District and contains undeveloped properties, established neighborhoods, sensitive areas, high density zoning abutting low density zoning, and possible practical limitations on development due to overburdened infrastructure. This ordinance places a temporary moratorium on development within the above area until September 1, 2002 to allow for the completion of the Southwest District Plan in an effort to establish updated Comprehensive Plan guidelines and make appropriate land-use decisions for this area of the City. ,TEM.o.I,. ~z~L-fi BUDGET. Comment: This resolution amends the FY2002 budget to carry over budget authority from FY2001 to FY2002 for capital improvement projects and other expenses that were either in process in FY2001 and not completed by FY2001 year end, or budgeted in FY2001 and delayed until FY2002. The City's policy is to amend the currant budget at the beginning of each fiscal year for the continuation of projects from the prior fiscal year. CONSIDER A RESOLUTION AWARDING CONTRACT AND AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATrEST A CONTRACT FOR CONSTRUCTION OF THE WATER FACILITY IMPROVEMENTS BLOOMINGTON STREET BOOSTER STATION PROJECT. Comment: The bid opening for this project was held on October 4, 2001, and the following bids were received: Wendler Engineering & Const. South Amana, IA $ 835,568.00 Selzer Werditsch Iowa City, IA $ 848,200.00 Unzeitig Const.
