PLANNING & ZONING ITEMS
PCD Director Franklin presented the following items:
A. Motion setting a public hearing for November 13 on an ordinance to rezone from Medium
Density Single Family (RS-8) to Historic Preservation Overlay (RS-8/OHP) for properties
within the Longfellow Neighborhood to establish the Longfellow Historic District. (REZ01-
00019)
B. Motion setting a public hearing for November 13 on an ordinance to rezone from Medium
Density Single Family (RS-8) to Conservation District Overly (RS-8/OCD) for propedies
within the Longfellow Neighborhood to establish the Clark Street Conservation District.

C. Motion setting a public headng for November 13 on an ordinance to rezone from Medium
Density Single Family (RS-8) to Conservation District Overly (RS-8/OCD) for properties
within the Longfellow Neighborhood to establish the Dearborn Street Conservation District.

In response to Council Member Kanner, material will be distributed in the information packet of
October 25 to allow Council time to review.
D. Motion setting a public hearing for November 13 on an ordinance to vacate 11,800 square
feet of undeveloped Kirkwood Avenue right-of-way located south of the Church of Christ
parking lot at 1320 Kirkwood Avenue. (VAC01-00005)
In response to Council Member Kanner, information regarding the conveyance and offering
price could be distributed prior to the November 12 work session.
E. Public hearing on an ordinance to rezone approximately 3.07 acres from Medium Density
Multifamily, RM-20, to Medium Density Single Family, RS-8, located at 747 W. Benton
Street. (REZ01-00013)

F. Public hearing on an ordinance to rezone approximately 6.15 acres from Intensive
Commercial, C1-1, to Community Commercial, CC-2, located at Commerce Drive and Liberty
Drive. (REZ01-00015)
In response to Mayor Lehman, staff will provide a list of all permitted uses in the C1-1 and CC-2
zones prior to action by Council in November. Council Member Vanderhoef also requested that
the CN-1 uses also be provided.
G. Public hearing on an ordinance to rezone approximately 24.12 acres from Interim
Development Single-Family, ID-RS, to Sensitive Areas Overlay Low Density Single-Family,
SAO-5, located east of Hickory Trail. (REZ01-00012)
H. Public hearing on a rezoning ordinance to amend the OPDH plan for Village Green Part
XVIII to permit nine additional residential units on 4.33 acres of property located west of
Scott Boulevard and south of Wellington Drive. (REZ01-00018)
I. Public hearing on an ordinance to rezone approximately 14.07 acres of property from Low
Density Single Family Residential, RS-5, and Planned Development Overlay - Low Density
Single Family Residential, OPDH-5, to OPDH-5, for approximately 14.07 acres of property
located south of Village Road and north of Wintergreen Drive. (REZ01-00014)
J. Ordinance amending the Zoning Code, Article O, Sign Regulations, to permit canopy roof
signs. (Pass and Adopt)
K. Resolution approving the final plat of a Resubdivision of Lot 236, Washington Park Addition,
Part 11 (Arbor Hill), an 8.02 acre, 2-1ot residential subdivision located north of Washington
Street, east of Green Mountain Drive. (SUB01-00017)
L. Resolution approving the preliminary and final plat of Prairie Edge Subdivision, a 6.33 acre
one-lot residential subdivision located west of Prairie du Chien Road. (SUB01-00019)
P&Z Member Jerry Hansen present for discussion.
M. Resolution approving the final plat of Windsor Ridge, Part 11A, a 5.32 acre 16-1or residential
subdivision located at Arlington Drive. (SUB01-00021 )
AGENDA ITEMS
1. (Agenda item #10 - Ordinance amending Unified Development Cede...moratorium...Miller
Avenue, U.S. Highway 1, Harlocke Street and Benton Street) After discussion, Council
agreed to defer consideration to November 13 to allow notification to all property owners.

response to Council Member Kanner, PCD Director Franklin explained that both agreements
were for traditional housing projects, and the owners were changing banks with the City in
the same second mortgage position as it currently holds.
COUNCIL APPOINTMENTS

Housing & Community Development Commission (1) - readvertise, no applications received
WETLANDS REGULATION
PCD Director Franklin and Professor of Geology, Lon Drake, presented information. Professor
Drake explained Corps jurisdiction and those covered since the Supreme Court decision on the
definition of jurisdictional wetlands. After discussion Council directed staff to redefine wetlands
such that the Sensitive Areas Ordinance covered those wetlands under the Corps jurisdiction
prior to the Supreme Court decision.
STAFF ACTION: Draft a revised Sensitive Areas Ordinance definition for wetlands.

NEIGHBORHOOD HOUSING RELATIONS TASK FORCE (Agenda Item #15)
Neighborhood Council representatives Tim Walker and Jerry Hansen present for discussion.
Majority of Council agreed to amend the resolution and make the following appointments:
Three Neighborhood Council Representatives - Ann Freerks, Jerry Hansen, Tim Walker
Three Tenant Interest Representatives - Mike Carberry, Mike Newman, Nick Klenske
Three Landlord Interest Representatives - Ted Chambers, Larry Svoboda, Anne Vespa
One At-Large Representative and Chair - Hillary Sale
STAFF ACTION: Revised resolution adopted October 23% (Karr)
UNIVERSAL DESIGN HOUSE PLAN (Agenda Item #6)
HIS Director Boothroy and Urban Planner McCafferty presented information. Majority of Council
agreed to proceed with the project as presented.
COUNCIL TIME
1. Council Member Wilburn stated he had taken a 20 minute air flight over the City and viewed
projects form the air and noted the different perspective.
2. Council Member Kanner noted the Fiscal Year 2001 Annual Report of Boards and
Commissions and the reference made to the contract with the County regarding Animal
Control. He requested an update on that contract as well as the Parks & Recreation
Comprehensive Plan. Staff will report back.

3. Council Member Kanner questioned the status of discussions with the property owners on
First Avenue to install sidewalks. The City Manager reported that the property owner of the
apartment complex had agreed to install the first leg between the medical building and the
apartment building; and engineering estimates were being made for the part along the
hillside and should be available shortly. The Mayor stated he had not met with the individual
propen'y owner to the south yet but intends too.
4. Council Member Vanderhoef reported on the excellent Parks & Recreation tour of park
projects.
5. In response to Mayor Lehman, the City Manager stated that the new alcohol ordinance had
been reviewed with staff and enforcement was underway.
