Comment: The Public Art Advisory Committee has submitted a grant application to the Iowa Dept. of Cultural Affairs for an American Spirit Project grant to enable the development of a program to place public art in Iowa City's neighborhoods. The grant request is for $24,000 with a local cash match of $10,640. The end result of this project would be the placement of public art in three Iowa City neighborhoods. The grant proposals were due November 1; this resolution ratifies the Council's support of the project. PLANNING AND ZONING MATTERS. a. Consider a motion setting a public hearing for November 27 on an ordinance to rezone .63 acres from General Industrial, I-1, to Intensive Commercial, C1-1, located on the south side of Highway 1 West, west of Ruppert Road. (RE01-00021) Comment: The proposed rezoning will allow commercial uses rather than industrial uses on this property. At its November I meeting, by a vote of 7-0, the Planning and Zoning Commission recommended approval subject to restrictions on highway access and design. Public hearing on an ordinance to vacate 11,800 square feet of undeveloped Kirkwood Avenue right-of-way located south of the Church of Christ parking lot at 1320 Kirkwood Avenue. (VAC01-00005) Comment: The proposed vacation would allow the church to expand their parking lot on property that is not needed for the street. At its October 4 meeting, by a vote of 6-0, the Planning and Zoning Commission recommended approval of the vacation. Staff recommended approval in a report dated September 21, 2001. h. Consider an ordinance to fezone approximately 3.07 acres from Medium Density Multifamily, RM-20, to Medium Density Single Family, RS-8, located at 747 W. Benton Street. (REZ01-00015) Comment: The proposed rezoning would allow a grocery store and other retail uses in the Scott-Six Industrial Park. At its September 20 meeting, by a vote of 6-1 (Shannon voting in the negative), the Planning and Zoning Commission recommended denial of the proposed rezoning. Consider an ordinance to fezone approximately 24.12 acres from Interim Development Single-Family, ID-RS, to Sensitive Areas Overlay Low Density Single-Family, SAO-5, located east of Hicko~ Trail. Consider an ordinance to rezone approximately 14.07 acres of property from Low Density Single Family Residential, RS-5, and Planned Development Overlay - Low Density Single Family Residential, OPDH-5, to OPDH-5, for approximately 14.07 acres of property located south of Village Road and north of Wintergreen Drive. (REZ01-00014) (First Consideration) Comment: The proposed rezoning would permit construction of 33 condominium dwellings and 11 single-family houses. At its September 6 meeting, by a vote of 6-0, the Planning and Zoning Commission recommended approval of the proposed rezoning. Staff recommended approval in a report dated August 16. m. Consider a resolution approving the prelimina~ and final plat of Subdivision, a 2.8-acre, 3-lot commercial subdivision located east of Riverside Drive south of Benton Street. (SUB01-00011 ) Comment: At its August 2 meeting by a vote of 7-0 the Planning and Zoning Commission recommended approval subject to approval of legal papers prior to Council consideration. Legal papers am being reviewed. Staff recommended approval in a memorandum dated July 12. Deferred August 21, September 11, and October 8. The applicant has requested indefinite deferml. n. Consider a resolution approving the prelimina~ plat and sensitive areas site plan of Dean Cakes Sixth Addition, a 30.11 acre, 18-1ot single family subdivision with one outlot located at the west end of Bristol Drive. (SUB01-00008) Comment: At its July 19 meeting, the Planning and Zoning Commission recommended approval of the prelimina~ plat and sensitive areas site plan. The Sensitive Areas Overlay Zone, OSA-5, for this properly was approved at the October 8 City Council meeting. Consider a resolution approving the preliminary plat of Wild Prairie Estates Part 4, a 35.86 acre, 22-1ot single family subdivision with two outlots, located at the north terminus of Wild Prairie Drive and the west terminus of Duck Creek Drive. (SUB01-00022) Comment: At its October 18 meeting, by a vote of 6-0, the Planning and Zoning Commission recommended approval of the preliminary plat. Approval of this plat will allow further residential lots in the Wild Prairie Estates. Staff recommended approval in a report dated October 18. AMENDING THE IOWA CITY UNIFIED DEVELOPMENT CO ESTABLISHING A TEMPORARY MORATORIUM ON DEVELOPMENT WITHIN THE AREA ROUGHLY CIRCUMSCRIBED BY MILLER AVENUE, U.S. HIGHWAY I, HARLOCKE STREET, AND BENTON STREET IN IOWA CITY, IOWA. Comment: The City is currently beginning its area study and development of the Southwest District Plan, a district specific component of the Comprehensive Plan. The guidelines and principles set forth in the Comprehensive Ran are used to identify appropriate land-uses, guide development and establish future development patterns within the City. The area circumscribed by Miller Avenue, U.S. Highway I, Harlocke Street and Benton Street is located within the Southwest District and contains undeveloped properties within established neighborhoods, environmentally sensitive areas, high density zoning abutting low density zoning, topographic and access limitations and has been the subiect of recurring and unresolved debates concerning appropriate development without the benefit of district planning. This ordinance places a temporary moratorium on development within the above area (excluding property subject to moratorium pursuant to City Code within the last 12 months and properly that is the subject of pending litigation) until September I, 2002 to allow for the completion of the Southwest District Plan in an effort to establish updated Comprehensive Plan guidefines and make appropriate land-use decisions for this area of the City. a. THE ISSUANCE OF $10,250,000 SEWER REVENUE BONDS OF IOWA CITY, IOWA. a. PUBLIC HEARING Comment: This public hearing is being held to receive public comment regarding the issuance of up to $10,250,000 Sewer Revenue Bonds. Bond proceeds will be used to extend, improve and equip the sanitary sewer utility of the City. r~ ~ ~, ol- 5~,?, b. CONSIDER A RESOLUTION INSTITUTING PROCEEDINGS TO TAKE ADDITIONAL ACTION FOR THE ISSUANCE OF NOT TO EXCEED $10,250,000 SEWER REVENUE BONDS. Comment: The resolution authorizes staff to proceed on behalf of the City with the sale of the bonds, and to take all action necessary to permit the sale of said bonds on a basis favorable to the City and acceptable to the City Council. OI- ~b4- c. CONSIDER A RESOLUTION DIRECTING THE SALE OF $10,250,000 SEWER REVENUE BONDS, SERIES 2001. Comment: Bids were received at 11:00 am on November 13 for the sale of $10,250,000 Sewer Revenue Bonds. This resolution ratifies and confirms the actions of the City Clerk and Finance Director in the determination of the most favorable bid. PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR CONSTRUCTION OF THE COURT HILL TRUNK SEWER IMPROVEMENTS PROJECT, ESTABLISHING AMOUNT OF BID SECURITY TO ACCOMPANY EACH BID, DIRECTING CITY CLERK TO PUBLISH ADVERTISEMENT FOR BIDS, AND FIXING TIME AND PLACE FOR RECEIPT OF BIDS. Comment: This project includes upgrading and repairing a sanitary sewer along Ralston Creek from Court Hill Park to Scott Park. In addition to the sanitary sewer a pedestrian walkway will be installed along Ralston Creek from Beech Street to Scott Boulevard. The estimated construction cost is $1,000,000 and will be funded by sewer revenues. a. PUBLIC HEARING Action: ~ ~ ~ ~ b.CONSIDER A RESOLUTION APPROVING Action: ITEM NO. 10. AMENDING TITLE 6 OF THE CITY CODE, ENTITLED "PUBLIC HEALTH AND SAFEr" BY REPEALING CHAPTER 7, ENTITLED "SMOKING IN PUBLIC PLACES" AND ENACTING A NEW CH~TER 7, ENTITLED "SMOKING IN FOOD ESTABLISHMENTS." Comment: This ordinance would prohibit smoking in establishments where food is prepared or se~ed and intended for consumption on the premises of the establishment and would prevent the designation of smoking areas within such establishments. The ordinance would except those establishments with sales of alcoholic beverages which exceed 35% of the average monthly gross revenue of the establishments as determined over a calendar year. CONSIDER A RESOLUTION DETERMINING AN AREA OF THE CITY TO BE AN ECONOMIC DEVELOPMENT AREA, AND THAT THE el - :~ ~,L, REHABILITATION, CONSERVATION, REDEVELOPMENT, DEVELOPMENT, OR A COMBINATION THEREOF, OF SUCH AREA IS NECESSARY IN THE INTEREST OF THE PUBLIC HEALTH, SAFETY OR WELFARE OF THE RESIDENTS OF THE CITY; DESIGNATING SUCH AREA AS APPROPRIATE FOR AN URBAN RENEWAL PROJECT; AND ADOPTING AN AMENDMENT TO THE CITY-UNIVERSITY PROJECT I (PROJECT NO. IA R-14) URBAN RENEWAL PLAN AND PLAN AREA THEREFOR. Comment: The proposed amendments to the City-University Project I Urban Renewal Plan would expand the urban renewal area, allow for the use of tax increment financing, and amend other portions of the Plan to make the Plan more current. At its regular meeting of October 4, 2001, the Planning and Zoning Commission found, by a vote of 6-0, that the Amended City- University Project I (Project No. IA R-14) Urban Renewal Plan conforms with the Iowa City Comprehensive Plan - 1997. Affected taxing entities were invited to a consultation on October 4, 2001, to discuss the proposed amendment to the Plan. No representatives from the affected taxing entities attended the consultation. ITEM NO. 12. CONSIDER AN ORDINANCE PROVIDING THAT GENERAL PROPERTY TAXES LEVIED AND COLLECTED EACH YEAR ON ALL PROPERTY LOCATED WITHIN THE CITY-UNIVERSITY PROJECT I (PROJECT NO. IA R-14) URBAN RENEWAL PLAN AREA OF THE CITY OF IOWA CITY, COUNTY OF JOHNSON, STATE OF IOWA, BY AND FOR THE BENEFIT OF THE STATE OF IOWA, (:;ITY OF IOWA CITY, COUNTY OF JOHNSON, IOWA CITY COMMUNITY SCHOOL DISTRICT AND OTHER TAXING DISTRICTS, BE PAID TO A SPECIAL FUND FOR PAYMENT Of PRINCIPAL AND INTEREST ON LOANS, MONIES ADVANCED TO AND INDEBTEDNESS, INCLUDING BONDS ISSUED OR TO BE ISSUED, INCURRED BY SAID CITY IN CONNECTION WITH THE AMENDED CITY- UNIVERSITY PROJECT I (PROJECT NO. IA R-14) URBAN RENEWAL REDEVELOPMENT PROJECT. (FIRST CONSIDERATION) Comment: The adoption of the City-University Project I Tax Increment Financing District Ordinance establishes the mechanism by which incremental property tax revenue will be made available to the City for the purposes of financing public infrastructure improvements and providing financial assistance to qualifying projects. CONSIDER AN ORDINANCE AMENDING TITLE 9, ENTITLED "MOTOR VEHICLES AND TRAFFIC," CHAPTER 8, ENTITLED "BICYCLES," SECTION 6, ENTITLED "PARKING VIOLATIONS," SUBSECTION A, ENTITLED "IMPOUNDMENT OF BICYCLES" TO ALLOW THE CITY TO IMPOUND ABANDONED BICYCLES. (FIRST CONSIDERATION) Bikes are occasionally abandoned by their owners leaving them attached to bike racks. Because they are otherwise legally parked, no current ordinance allows the City to impound these bicycles. The proposed ordinance allows the City to impound a bicycle if it is legally parked, but abandoned, for more than seven consecutive days. Before impounding, the City will tag the bicycle for seven days and follow all other current provisions when impounding a bicycle. ITEM NO. 14. CONSIDER AN ORDINANCE AMENDING SECTION 1-9-3B OF THE CODE OF ORDINANCES OF IOWA CITY, ESTABLISHING THE BOUNDARIES OF THE VOTING PRECINCTS IN IOWA CITY. (FIRST CONSIDERATION) Comment: New precinct boundaries are required after each Federal Census is completed. A public hearing was held on the Iowa City proposed boundaries on July 31 and an ordinance adopted August 21. After submission and review by the Secretary of State, minor discrepancies in the legal descriptions were noted which requires passage of a revised ordinance. These discrepancies do not affect the map or any individuals. ITEM NO. 15. CONSIDER A RESOLUTION AMENDING IOWA CITY'S 2001-2006 O[- ~> ~ '~ CONSOLIDATED PLAN (A.K.A. CITY STEPS). Comment: An amendment to the CITY STEPS plan has been proposed that would increase the funds set-aside for economic development. At their September 18 meeting, the Housing and Community Development Commission voted (6-1) to deny the proposed amendment. A staff memorandum is included in the Council packet. Action: I November 13, 2001 City of Iowa City Page 13 ITEM NO. 16. CONSIDER A RESOLUTION ESTABLISHING FEES FOR SERVICES AND ACTIVITIES OF THE IOWA CITY HOUSING AND INSPECTION SERVICES DEPARTMENT. Comment: The City Council revenue goal for the Rental Housing Inspection Division has historically been approximately 70% of division's total budget. Under the current fee structure, FY 2002 Rental Housing Inspection revenues will total 53.75% of its total budget. The Rental Housing Inspection Division, for the second time in its twenty-year history, seeks to increase its fees for services. The Apartment Owners Association Board of Directors has reviewed the fee schedule and their proposals have been incorporated into this resolution. The increase in fees on a typical twelve unit, two bedroom apartment complex would be $.38 cents per month, per apartment. For a single family three bedroom dwelling the increase in fees would be $.66 cents per month. The fee schedule would become effective August 1, 2002. Correspondence included in Council packet.
