We would also like members of City Voices to distribute information to other city officials and encourage them to contact la~nakers. In the upcoming weeks we will provide you with the League's eight legislative priorities. Each week we will provide one priority and background information. As the legislative session begins, we will also provide updates to bills the League is tracking. The format will be less formal than other League publications. We want it to have a "just the facts" feel. As always you will still receive the Legislative Bulletin and any action calls that are distributed, but you will be on the front lines with you City Voices subscription. If at anytime you would like to provide information on issues to other city officials on the network, please feel free to respond, but remember all the members of the City Voices comaunity will receive your message. We don't want anyone to leave City Voices because they are receiving too many emails. It's also possible to consider emails as open records, so please keep your responses constructive. The League believes that City Voices will make an impact in relations between state and local officials. As the network continues to grow, so does the unified voice of city officials. Disturbance Call/Disorderly House The following is a typjca} police response to a call for service requesting police intervention into a loud pady or disturbance incident. The call is typically dispatched via radio, however occasionally, in-person requests are made directly to a patrol officer. A police officer responds to the suspect address and makes an assessment regarding the legitimacy of the complaint. The officer typically uses an assessment that determines whether the noise or disturbance can be heard across property lines or from adjacent propedjes. The police officer makes contact with the person in charge of, or in control of the suspect residence. Typically this is a resident/residents of the suspect address. The officer notifies the person in charge of the residence of the fact that a noise complaint has been received and that the police have responded to make the resident(s) aware of that complaint. The officer also directs the resident(s) to take steps to cause the disturbance to cease and aleds the resident(s) that subsequent responses by the police department to founded noise or disturbance complaints can result in Disorderly House citations being issued to those resident(s) or persons in charge of that property. If officers are summoned to the property again, a misdemeanor City Code violation is issued to those person(s) identified as residents/persons in charge of the property. Typically, these citations are signed in the presence of the officer and the person(s) are released on their signature. Subsequent responses to the same address on founded complaints typically result in those residents/persons in charge being arrested and taken to the County Jail. Variations from the above "normal" response may include the resident of the suspect address requesting that officers assist them in clearing the property of party goers. This typically occurs when a resident realizes that their party has gotten out of control or larger than they are able to manage. In this case, the resident makes an announcement to persons in attendance that the event is over and that they are requested to move off the suspect properly. Failure to do so can result in the issuance of a criminal trespass citation to those who remain on the property. Obviously, repeat trips to addresses, that is, a chronically disruptive location, may not receive the courtesy notification referenced above. This is a discretionary call on the officers pad and is based on their knowledge of the existence of several prior calls to the suspect address. The scope of the disturbance may also cause the responding officer(s) to amend their "typical" response. Cc: R.J. Winkelhake Capt. Matt Johnson City Council mgr~memos/dLsorderly dec City of Iowa City MEMORANDUM November 6, 2001 To: Steve Atkins, City Manager From: Joe Fowler, D~rector Parking & Transit Chris O'Brien, Parking Manageri2~° Reference: Old Capitol Town Center Request October 25, 2001 Kerry Sanders, General Manager for Old Capitol Town Center, requested the no parking 6:00 a.m. to 10:00 a.m. parking restriction in the Capitol Street Ramp be reinstated. This restriction was implemented and eliminated in the past at the request of Old Capitol Town Center and the Downtown Association. This restriction eliminated parking on the bottom three levels of the facility Monday through Friday. It was enforced by issuing five-dollar no parking tickets to people who parked on the lower floors. The ticket was in addition to the regular fee for parking. August 7, 1992 the City implemented a parking restriction on the lower three levels of the Capitol Street Ramp at the request of the then owners of the Old Capitol Mall and the Downtown Association. This restriction was to reserve these levels for shoppers at 10:00 when the majority of the retail shops opened. This restriction was in place until April of 2000. At that time the new owners of Old Capitol Town Center and the Downtown Association requested it be eliminated. The DTA stated "this arrangement is no longer desirable and is confusing and even annoying to many customers." The Old Capitol Town Center stated "There are Old Capitol Town Center tenants and several downtown businesses that open earlier than 10:00 A.M. and we feel the change would better accommodate their customers. Lifting the restriction would not only relieve the need for it's administration for the garage staff, but also significantly reduce the number of tickets issued to Capitol Street ramp patrons." During the time the restriction was in place there was an overall reduction in usage. While ramp usage remained consistent while Old Capitol Mall was fully rented there was a decline in usage since 1998. The first month after the restriction was eliminated hourly revenue in the Capitol Street Ramp increased $7,000 representing an increase of 14,000 hours of parking. Park & Shop usage dropped about $800 per month but that is consistent with previous years. In addition to the revenue loss caused by the restriction the City received much negative publicity as a result of the tickets issued before 10:00 a.m. While the restriction was at the request of the merchants the City was blamed for it. When customers called the mall office they were told the mall had no control as the ramp was a City facility. During the time of the restriction merchants continually had sales that started before 10:00 further compounded the problem. Shoppers came ea~y, got tickets and complained that the stores opened early so the restriction should be waved. At the present time the Capitol Street Ramp serves over 2500 customers per day. The average stay per customer is two hours. These numbers indicate that each parking place in the facility turns over in excess of five times per day. There is an average of 300 of the 875 spaces in the Capitol Street Ramp vacant at 10:00 a.m. Monday through Friday. In a continuing effort to meet the needs of all users of the City of Iowa City's public parking system and because of the continued high turn over rate on parking spaces we recommend that there be no parking restriction placed on the lower levels of the Capitol Street Ramp. The City has previously implemented and eliminated this restriction at the request of memhants. During the time it was implemented there was constant confusion on the part of the public and many parking tickets were issued. This resulted in much negative publicity for the City as the Old Capitol Mall told customers there was nothing they could do about the tickets as it was a City facility. Additional problems were caused when merchants ran promotions that started before 10:00 a.m. In addition to the past problems with tickets the City has a financial obligation to our bondholders. Imposing any restriction on the Capitol Street Ramp that would negatively impact users and effect revenue would have an impact on our ability to meet our bonding obligations. The City is willing to continue to explore operational options with you but any changes can not result in negative publicity or substantial revenue loss to the parking system. This has an immediate, negative impact on our current Shoppers and Tenants and inhibits our ability to attract new Tenants and Shoppers to the area. Our fixture is an integral part of the donton fixture. We are proposing the closure of the lower three levels of the Clinton Sl~,et Parkade closest to the Center prior to the 2001 Sbeppiltg Season, specifically November 19, 200 1, This closure would take place until 10:00am, Monday through Friday. We hoped to discourage long term parking on the lower levels and have them free for the convenience of shceOpers. Recently we have found that this arrangemere is no longer desirable and is confusing and even annoying to many customers. We would like to ask that yon rescind the prohibition and allow parking throughout the ramp 24 hours a day. Thank you for your help in this matter. This is a full service company that will provide flight training, aircraft rental, fueling services, mechanic services and aircraft charter. The company does extensive charter in the health service industry, flying patients and donor organ flights fur hospitals throughout Illinois. They charter some flights with the University of Iowa Hospitals and would like to build on that parmership. Jet Air anticipates starting with four full-time employees and building to a staff of 12-15 within six months. They have 37 employees at their office in Galesburg and have been in business at the Galesburg Airport since 1969, Jet Air will lease of Fzces in the Terminal Building and use Building F for their aircraft storage, maintenance and avionics repair. Their lease begins on January 1, 2002, butthey would be ready to start sooner if the current FBO, IOW Aero, would like out of their lease sooner. lOW Aero will remain on the Airport and lease Building D. They will operate as an aero dub and may suboontraet some services from Jet Air. After Jet Air is in town and has a little time to get established, I would like the oppommity to introduce them to the Council, We could do that at a Council meeting or Jet Air will probably have an open house to introduce themselves to the community. Professor Drake explained Corps jurisdiction and those covered since the Supreme Court decision on the definition of jurisdictional wetlands. After discussion Council directed staff to redefine wetlands such that the Sensitive Areas Ordinance covered those wetlands under the Corps jurisdiction prior to the Supreme Court decision. STAFF ACTION: Draft a revised Sensitive Areas Ordinance definition for wetlands. If you wish to propose specific legislation for consideration before the Planning and Zoning Commission and subsequently the City Council, you should forward a draft copy to the Department of Planning and Community Development. Discussion Reqardinq Proposed Amendment to the CITY STEPS Plan to Increase the Earmark for Economic Development Activities to 9% David Schoon apprised the committee of a public hearing before the Housing and Community t Development Commission (HCDC) on the evening of October 18 h. The purpose of this hearing was to review an action from HCDC's last meeting where the group voted not to change the amount earmarked for economic development from 5% to 9%. This same item will appear on the agenda at the City Council's first meeting in November. Schoon stated that if the Council decides not to go with HCDC's recommendation, and instead decides to change the amount of CDBG funds earmarked for economic development from 5% to 9%, then the Council will need to decide from where the 4% increase for economic development will come. Schoon recommended that the Committee give some thought to that question. After some discussion of whet, her or not the Committee should discuss this issue, Lehman suggested that they wait until the Council has made its decision. If the Council decides to increase the percentage of funds for economic development, then the Council can decide the process by which it wilt be determined from where that percentage increase will come. Vanderhoef and Wilbum agreed. Presentation by Joe Raso, ICAD, Reclarding ICAD's Business Visitation Program and. The Council Economic Development Committee's Involvement Joe Raso, representing Iowa City, Area Development ({CAD), presented to the Committee general information about Synchronist, a survey tool being provided by MidAmerican Energy that provides an opportunity to gather information from local businesses thus revealing trends within the industries represented. The software system was developed by a psychologist and includes a set of non-threatening questions to be answered in interviews between business representatives and ICAE~ representatives. This tool has been used in such places as Dubuque and Davenport with great success. Nearby cities such as Waterloo and Cedar Falls are looking into this program as well. Raso explained the many strengths of this survey tool and distributed sample questionnaires as well as training manuals. The question was put to the Committee whether this was something that they would like to pursue and provide interviewers for. The answer came back an overwhelming affirmative. Discussion took place as to whether this would take the place of the Committee's current one on one interviews with businesses. After some thought, it was decided that both programs have their merits and have different goals. The Synchronist program reveals trends while the one on one interviews provide vital links to the community. It was decided that both would be implemented. Update - Business Outreach Proqram - Major Employer Visits Lehman commented that he enjoyed himself on these business calls far more than he had expected. Wilburn commented that he felt that they were beneficial because they put a face on the Council, to which Lehman responded that they also put a face with a major employer such as Oral B. Review of Any Business Development Proposal Not Previously Listed on the A,qenda None Other Business Arkins stated that he would distribute the State's 2010 report at the next meeting. Arkins pointed out the likelihood that State budget cuts would reveal a loss of state funding for Iowa City and all Iowa cities. Lehman responded that the universities are ~he single largest factor for building a stronger Iowa for the future, so he doesn't understand how the state can impose such large funding cuts on the universities.
