Comment: The owners of the property located at 229 South
Summit Street received assistance through the City's Rental
Rehabilitation Program in the amount of $7,300. The financing
was in the form of a ten-year declining balance loan. The terms of
the loan have been satisfied; thus the lien can now be released.

Comment: On October 8, 2001, Council adopted Resolution No.
01-322, approving the Agreement for Private Redevelopment with
Seabury & Smith and Southgate Development. Since that time,
Seabury & Smith has requested that the Council amend Section
5.1 of the Agreement regarding Insurance Requirements. These
amendments remove the unconditional obligation to rebuild the
structure in the event of destruction and provide that the structure
shall be rebuilt in the event of destruction as the result of an · ·
insurable casualty. Additionally, as Seabury and Southgate have
yet to formalize a lease agreement for the subject property, they
have also requested the addition of Section 12.9, 'Contingency".
This clause makes the agreement and its obligations to construct
on the subject property null and void should the parties fail to
execute a lease within 6 months. (See memorandum and
agreement pages attached).

Comment: Hawkeye State Bank, Iowa City, Iowa has requested
that the City approve a Subordination Agreement for 1204
Brookwood Drive. On August 23, 2001, the owner of the property
received a loan from the City of Iowa City's Housing Rehabilitation
Program the amount of $33,507. The property is appraised for
$150,000 which provides enough equity to cover the City's second

vote of 7-0, the Planning and Zoning Commission recommended

Comment: At its October 18 meeting, by a vote of 6-0, the Planning
and Zoning Commission recommended approval of the proposed
vacation. Vacating West Benton Court would allow Oaknoll
Retirement Center to acquire the right-of-way. Oaknoll Retirement
Center owns all property abutting West Benton Court. Staff
recommended approval in a report dated October 18.
c. Rezone 1.38 acres from High Density Multi-Family Residential, RM-44,
to Medium Density Multi-Family Residential, RM-20 for property
located at 1045-1075 W. Benton Street. (REZ01-00020)
Comment: This public hearing is being considered at the request of
members of the Harlocke-Weeber Neighborhood Association. The
property owners have submitted a protest of the proposed rezoning of
their property, which triggers a super-majority vote by the City Council
to approve the rezoning application. At its November 15 meeting, by a
vote of 5-2 (Hansen and Ehrhardt voting no), the Planning and Zoning
Commission recommended to deny the proposed rezoning. Staff
recommended denial in a report dated October 18. The property
owners have submitted a protest of the proposed rezoning of their
property, which triggers a super-majority vote of the City Council to
approve the rezoning.

Comment: The proposed vacation would allow the church to expand
their parking lot on property that is not needed for the street. At its
October 4 meeting, by a vote of 6-0, the Planning and Zoning
Commission recommended approval of the vacation. Staff

Comment: The proposed rezoning would permit the construction of 36
single-family houses. At its September 20 meeting, by a vote of 7-0,
the Planning and Zoning Commission recommended approval, subject
to no building permits being issued until the extension of First Avenue
is open to traffic. Staff recommended approval in a report dated
September 6.

ITEM NO. 6. CONSIDER AN ORDINANCE AMENDING TITLE 5, "BUSINESS
AND LICENSE REGULATIONS," CHAPTER 2, "VEHICLES FOR
HIRE," OF THE CITY CODE CLARIFYING DEFINITION OF
VEHICLES FOR HIRE, ADDING REQUIREMENTS FOR
CERTIFIED STATE OF IOWA CRIMINAL HISTORY INFORMATION
PRIOR TO ISSUANCE OF ANY DRIVING BADGE, REMOVING
THE REQUIREMENT FOR A DISTINCTIVE COLOR SCHEME FOR
VEHICLES FOR HIRE, AND PROVIDING LANGUAGE REQUIRING
A PERMIT FROM THE DIVISION OF ANIMAL CONTROL FOR
OPERATING A HORSE DRAWN VEHICLE. (FIRST
CONSIDERATION)
Comment: The vehicle for hire section of the City Code has not been
updated for a number of years. This ordinance would include limousines as
a vehicle for hire; require certified copies of criminal history records for all
drivers; remove the requirement for a distinctive color scheme for vehicles
for hire; and require a permit from the Division of Animal Control prior to
licensing as a horse drawn vehicle for hire.
ITEM NO. 7. CONSIDER AN ORDINANCE AMENDING TITLE 6 OF THE CITY CODE,
ENTITLED "PUBLIC HEALTH AND SAFETY" BY REPEALING CHAPTER
7, ENTITLED "SMOKING IN PUBLIC PLACES" AND ENACTING A NEW
CHAPTER 7, ENTITLED "SMOKING IN FOOD ESTABLISHMENTS."
(FIRST CONSIDERATION)
Comment: This ordinance would prohibit smoking in establishments where
food is prepared or served and intended for consumption on the premises
of the establishment and would prevent the designation of smoking areas
within such establishments. The ordinance would except those
establishments with sales of alcoholic beverages which exceed 50% of the
average monthly gross revenue of the establishments as determined over
a calendar year. Correspondence from PCD Director and public included

ITEM NO. 8. CONSIDER AN ORDINANCE AMENDING THE IOWA CITY UNIFIED
DEVELOPMENT CODE BY ESTABLISHING A TEMPORARY
MORATORIUM ON DEVELOPMENT WITHIN THE AREA ROUGHLY
CIRCUMSCRIBED BY MILLER AVENUE, U.S. HIGHWAY 1, HARLOCKE
STREET, AND BENTON STREET IN IOWA CITY, IOWA. (SECOND
CONSIDERATION)
Comment: The City is currently beginning its area study and development of
the Southwest District Plan, a distdct specific component of the
Comprehensive Plan. The guidelines and principles set forth in the
Comprehensive Plan are used to identify appropriate land-uses, guide
development and establish future development patterns within the City. The
area circumscribed by Miller Avenue, U.S. Highway 1, Harlocke Street and
Benton Street is located within the Southwest District and contains
undeveloped properties within established neighborhoods, environmentally
sensitive areas, high density zoning abutting low density zoning,
topographic and access limitations and has been the subject of recurring
and unresolved debates concerning appropriate development without the
benefit of district planning. This ordinance places a temporary moratorium
on development within the above area (excluding property subject to
moratorium pursuant to City Code within the last 12 months and property
that is the subject of pending litigation) until September 1, 2002 to allow for
the completion of the Southwest District Plan in an effort to establish
updated Comprehensive Plan guidelines and make appropriate land-use
decisions for this area of the City.

Comment: The adoption of the City-University Project I Tax Increment
Financing District Ordinance establishes the mechanism by which
incremental property tax revenue will be made available to the City for the
purposes of financing public infrastructure improvements and providing
financial assistance to qualifying projects.

VEHICLES AND TRAFFIC," CHAPTER 8, ENTITLED "BICYCLES,"
SECTION 6, ENTITLED "PARKING VIOLATIONS," SUBSECTION A,
ENTITLED "IMPOUNDMENT OF BICYCLES" TO ALLOW THE CITY TO
IMPOUND ABANDONED BICYCLES. (SECOND CONSIDERATION)
Comment: Bikes are occasionally abandoned by their owners leaving
them attached to bike racks. Because they are otherwise legally parked,
no current ordinance allows the City to impound these bicycles. The
proposed ordinance allows the City to impound a bicycle if it is legally
parked, but abandoned, for more than seven consecutive days. Before
impounding, the City will tag the bicycle for seven days and follow all other
current provisions when impounding a bicycle.

ITEM 11: CONSIDER A MOTION SETTING A PUBLIC HEARING FOR
~DECEMBER 11 ON AN ORDINANCE AMENDING CITY CODE
SECTION 1-9-3B OF THE CODE OF ORDINANCES ESTABLISHING
THE BOUNDARIES OF THE VOTING PRECINCTS.
Comment: A public hearing was held on July 31 on the new voting precincts,
and an ordinance adopted on August 21 and fonvarded to the Secretary of
State. On November 1 a fax was received from the Secretary of State
requesting slight revisions to the legal descriptions (not affecting the map or
any individuals) and first consideration was given to a revised ordinance on
November 13. However, a phone call was received from the Secretary of
State's office on November 20 requesting that the ordinance be amended to
include the township voters voting in City precincts.
In accordance with Chapter 49,6 of the State Code cities and counties have the
power to combine townships and city precincts as long as the population does
not exceed 3500 and the combined precinct is wholly within a legislative
district. A letter of agreement was approved for Precincts 12 and 22 at the
August 21 Council meeting. The ordinance has been revised to include the
amended legal descriptions for Precincts 12 and 22, and the map revised. The
City Attorney recommended that a public heating be held since the revisions
affect the map.
ITEM 25: CONSIDER A RESOLUTION RATIFYING SETTLEMENT OF
PENDING LITIGATION.
Comment: Depending on discussion during executive session scheduled for
the formal Council Meeting of November 27, 2001, the City Council may
approve a resolution ratifying settlement of pending litigation per a settlement
agreement.

Comment: These steps authorize issuance of up to $10,250,000 Sewer
Revenue Bonds which will be used to extend, improve and equip the
sanitary sewer utility of the City.

ITEM NO. 14. CONSIDER A RESOLUTION ESTABLISHING FEES FOR SERVICES
AND ACTIVITIES OF THE IOWA CITY HOUSING AND INSPECTION
SERVICES DEPARTMENT.
Comment: The City Council revenue goal for the Rental Housing
Inspection Division has historically been approximately 70% of division's
total budget. Under the current fee structure, FY 2002 Rental Housing
Inspection revenues will total 53.75% of its total budget. The Rental
Housing Inspection Division, for the second time in its twenty-year history,

Comment: A sanitary sewer extends under the residential structure located
at 438 Clark Street and the owners would like to add an addition to the
structure, a portion of which will extend over the existing sewer line.
Engineering has reviewed the request and recommends approval of the
permanent sanitary sewer easement which will allow the addition of the
structure.

register it has a vacant and abandoned building. Staff believes that the

attractive nuisance for vermin, children, and vagrants. Staff would like to
acquire the property in order to abate the public nuisance.

ITEM 11: CONSIDER A MOTION SETTING A PUBLIC HEARING FOR
DECEMBER 11 ON AN ORDINANCE AMENDING CITY CODE
SECTION 1-9-3B OF THE CODE OF ORDINANCES ESTABLISHING
THE BOUNDARIES OF THE VOTING PRECINCTS.
Comment: A public hearing was held on July 31 on the new voting precincts,
and an ordinance adopted on August 21 and forwarded to the Secretary of
State. On November 1 a fax was received from the Secretary of State
requesting slight revisions to the legal descriptions (not affecting the map or
any individuals) and first consideration was given to a revised ordinance on
November 13. However, a phone call was received from the Secretary of
State's office on November 20 requesting that the ordinance be amended to
include the township voters voting in City precincts.
In accordance with Chapter 49.6 of the State Code cities and counties have the
power to combine townships and city precincts as long as the population does
not exceed 3500 and the combined precinct is wholly within a legislative
district. A letter of agreement was approved for Precincts 12 and 22 at the
August 21 Council meeting. The ordinance has been revised to include the
amended legal descriptions for Precincts 12 and 22, and the map revised. The
City Attorney recommended that a public hearing be held since the revisions
affect the map.
~CONSIDER A RESOLUTION RATIFYING SETTLEMENT OF
PENDING LITIGATION.
Comment: Depending on discussion during executive session scheduled for
the formal Council Meeting of November 27, 2001, the City Council may
approve a resolution ratifying settlement of pending litigation per a settlement
agreement.
