ADDITION TO AGENDA
Council agreed to add the following items to their November 27 formal agenda:
· Resolution setting for hearing on development agreement with Seabury & Smith
(Item #3e5)
· Revised item #11 setting public hearing on voting boundaries
· Resolution ratifying settlement of litigation (Item #25)
· Class B Wine Permit for Linn Street Caf~
JOINT MEETING WITH PLANNING & ZONING
P&Z Commissioners Bovbjerg, Hansen, Chait, Shannon and Anciaux present for the joint
meeting on Scott-Six Industrial Park rezoning (Item #5d-Fareway Grocery). Majority of
Council were not in favor of delaying consideration of this request until after the Zoning
Code was reviewed. There was a majority of Council interested in pursuing some method
of having Fareway locate in the area, and indicated a desire to delay the rezoning request,
in consideration of other options such as provisional use or special exception. In response
to Chairperson Bovbjerg, the Mayor stated either option would be reviewed by Planning
and Zoning.
PLANNING & ZONING ITEMS
PCD Director present for discussion of the following items:
A. Public hearing on an ordinance to rezone .63 acres from General Industrial, I-1, to
Intensive Commercial, C1-1, located on the south side of Highway 1 West, west of
Ruppert Road. (RE01-00021) (Mayor Lehman left room; Mayor Pro tem O'Donnell
presiding.)
B. Public hearing on an ordinance to vacate West Benton Court north of Benton Street.
(Oaknoll/VAC01-00003) In response to Council Members Kanner and Pfab, a majority
of Council did not wish to pursue Oaknoll acquiring the utilities at this time.

C. (Mayor Lehman returned to meeting) Rezone 1.38 acres from High Density Multi-
Family Residential, RM-44, to Medium Density Multi-Family Residential, RM-20 for
property located at 1045-1075 W. Benton Street. (Benton Villa/REZ01-00020)
D. Rezone approximately 6.15 acres from Intensive Commercial, C1-1, to Community
Commercial, CC-2, located at Commerce Drive and Liberty Drive. (Fareway/REZ01-
00015)
E. Ordinance to rezone from Medium Density Single Family (RS-8) to Historic
Preservation Overlay (RS-8/OHP) for properties within the Longfellow Neighborhood
to establish the Longfellow Historic District. (REZ01-00019) (First Consideration)
F. Ordinance to rezone from Medium Density Single Family (RS-8) to Conservation
District Overly (RS-8/OCD) for properties within the Longfellow Neighborhood to
establish the Clark Street Conservation District. (REZ01-00019) (First Consideration)
G. Ordinance to rezone from Medium Density Single Family (RS-8) to Conservation
District Overly (RS-8/OCD) for properties within the Longfellow Neighborhood to
establish the Dearborn Street Conservation District. (REZ01-00019) (First

H. Ordinance to vacate 11,800 square feet of undeveloped Kirkwood Avenue right-of-way
located south of the Church of Christ parking lot at 1320 Kirkwood Avenue. (VAC01-

I. Ordinance to rezone approximately 3.07 acres from Medium Density Multifamily, RM-
20, to Medium Density Single Family, RS-8, located at 747 W. Benton Street.

J. Ordinance to rezone approximately 24.12 acres from Interim Development Single-
Family, ID-RS, to Sensitive Areas Overlay Low Density Single-Family, SAO-5, located
east of Hickory Trail. (First & Rochester, Parts 4-6/REZ01-00012) (Second
Consideration)
K. Rezoning ordinance to amend the OPDH plan for Village Green Part XVIII to permit
nine additional residential units on 4.33 acres of property located west of Scott
Boulevard and south of Wellington Drive. (REZ01-00018) (Second Consideration)
L. Ordinance to rezone approximately 14.07 acres of property from Low Density Single
Family Residential, RS-5, and Planned Development Overlay - Low Density Single
Family Residential, OPDH-5, to OPDH-5, for approximately 14.07 acres of property
located south of Village Road and north of Wintergreen Drive. (REZ01-00014)
(Second Consideration)
AGENDA ITEMS
1. (Item #6 - Ordinance....amending Title 5...Vehicles for hire...) In response to Council,
City Clerk Karr stated the only change in the horse drawn vehicle section of C1 (b)
requiring a permit from the Animal Control Department, and all provisions relating to
horse drawn vehicle were currently in the Code. Council Member Kanner expressed
his desire to retain the term "taxicab" and his intent to amend the ordinance to include

a City Council appeal process for applications denied by the Police Chief after review
of their criminal record.
2. (Consent Calendar #3f(1) - Letter from Mark Hollingsworth re Mental Illness and Law
Enforcement) In response to Council Member Kanner, the City Manager stated that
the Police do have formal training in the subject and stated he would furnish copies to
Council.
3. (Item #7 - Ordinance...Smoking In Restaurants) Council Member Vanderhoef stated
she would like to amend the ordinance to exclude cover charges from being figured
into the gross of either alcohol or food.

GAS AND ELECTRIC FRANCHISE
MidAmerican representatives Terry Smith, Mark Hewett, Greg Schaefer, and Jim Wilson
presented information. Asst. City Atty. Matthews present for discussion.
COUNCIL TIME
1. In response to Council Member Kanner, the City Manager stated he would furnish a
copy of the procedure for cutoff of City water and sewer, including the timelines.
2. Maiority of Council agreed to have Council Member Kanner attend the Academy for
Transportation Policy conference in Perry, IA, December 5-6.
3. (IP2 of 11/20 Info Packet - First Avenue extension update) In response to Council
concerns the City Manager reiterated the City would be installing a chain link fence at
both ends of First Avenue so that traffic is not allowed, but the desire was to leave the
sidewalk open to encourage walkers. Council requested the matter be monitored
closely.
