Comment: The Resolution sets the date for a Public Hearing which is a requirement before the adoption of the updated Section 8 Administrative Plan can occur. Comment: This project is a Request for Proposals for a design- build project. The proposal shall provide engineering and construction services for the design loads to construct a 4,000 square foot metal building for the City of Iowa City Landfill. The building will provide storage facilities for the Salvage Barn, the Furniture Project and the Landfill. Comment: MDI Limited Partnership #65 is applying to the Iowa Finance Authority for financial assistance in the form of Low- Income Housing Tax Credits for the construction and acquisition of 24 affordable housing units for families, elderly persons and persons with special needs. MDI Limited Partnership #65 has asked the City Council for a resolution of support to assist them in meeting the scoring criteria for the Low-Income Housing Tax Credit program. o/- ~<~ (2) CONSIDER A RESOLUTION SUPPORTING THE DEVELOPMENT OF AFFORDABLE HOUSING IN IOWA CITY. Comment: Emerson Point Limited Partnership is applying to the Iowa Finance Authority for financial assistance in the form of Low- Income Housing Tax Credits for the construction of 54 units of affordable, assisted living units for the elderly and/or persons with disabilities. On August 26, 1992, the owner of the property received a loan from the City of Iowa City's Housing Rehabilitation Program in the amount of $7,450. Comment: Firstar Bank, Iowa City, Iowa has requested that the City approve a Subordination Agreement for 826 Rider Street for a Home Equity Loan. On March 8, 1996, the owners of the property received a loan from the City of Iowa City's Housing Rehabilitation Program in the amount of $14,900. The property is appraised for $123,500 which provides enough equity to cover the City's third lien position. Comment: The Englert Civic Theatre group will be submitting an application for Community Attraction and Tourism Development (CAT) Grant funding from the State of Iowa for renovation of the Englert Civic Theatre project. The application requires a resolution of support from the City Council of the community in which the project is located. PLANNING AND ZONING MATTERS. a. Consider an ordinance to rezone .63 acres from General Industrial, I- 1, to Intensive Commercial, C1-1, located on the south side of Highway I West, west of Ruppert Road. (RE01-00021) (First Consideration) Comment: The proposed rezoning will allow commercial uses rather than industrial uses on this property. At its November 1 meeting, by a vote of 7-0, the Planning and Zoning Commission recommended approval subject to restrictions on highway access and design. Staff recommended approval in a report dated October 18. Aetion: b.Consider an [o%ce to vacate West Benton Court north of Benton Street. (VAC01-00003) (First Consideration) Comment: At its October 18 meeting, by a vote of 6-0, the Planning and Zoning Commission recommended approval of the proposed vacation. Vacating West Benton Court would allow Oaknoll Retirement Center to acquire the right-of-way. Oaknoll Retirement Center owns all property abutting West Benton Court. Staff recommended approval in a report dated October 18. At its September 20 meeting, by a vote of 7-0, the Planning and Zoning Commission recommended approval of the proposed rezoning. Staff recommended approval in a report dated August 31. The proposed subdivision is a resubdivision of Outlot A of Village Green Part XVIII, and is associated with the amended OPDH plan for Viiage Green Part XVIII. (REZ01-00014) (Pass and Adopt) Comment: The proposed rezoning would permit construction of 33 condominium dwellings and 11 single-family houses. At its September 6 meeting, by a vote of 6-0, the Planning and Zoning Commission recommended approval of the proposed rezoning. Staff recommended approval in a report dated August 16. m. Consider a resolution for a preliminary plat of Village Green, Parts 19- 20, a 14.07-acre, 15-Lot residential subdivision located east between Village Road and Winter Green Drive. (SUB01-00017) Comment: At its September 6 meeting, by a vote of 6-0, the Planning and Zoning Commission recommended approval of the proposed subdivision. CONSIDER A RESOLUTION APPROVING DAVID DAHLQUIST AS THE o#- ~Jq'7 ARTIST FOR THE NEAR SOUTHSIDE TRANSPORTATION CENTER PROJECT, AND AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST AN AGREEMENT BETWEEN THE CITY OF IOWA CITY AND DAHLQUIST CLAYWORKS, INC. Comment: At their November 1, 2001 meeting the Public Art Advisory Committee recommended by a vote of 5-2 (Hudson and Klein) that David Dahlquist of Dahlquist Clayworks, Inc. in Des Moines be selected as the artist to complete the public art components of the Near Southside Transportation Center. This resolution approves that selection and an agreement with Mr. Dahlquist to complete this project. The total cost of the contract is $40,000, 80% of which comes from the FTA Grant for the Center and 20% from public art funds. ITEM NO. 7. A REVISED DEVELOPMENT AGREEMENT WITH SEABURY & SMITH, ol- Bcl ~ INC. AND SOUTHGATE DEVELOPMENT COMPANY, INC. Comment: On October 8, 2001, Council adopted Resolution No. 01-322, approving the Agreement for Private Redevelopment with Seabury & Smith and Southgate Development. Since that time, Seabury & Smith has requested that the Council amend Section 5.1 of the Agreement regarding Insurance Requirements. These amendments remove the unconditional obligation to rebuild the structure in the event of destruction and provide that the structure shall be rebuilt in the event of destruction as the result of an insurable casualty. Additionally, as Seabury and Southgate have yet to forrealize a lease agreement for the subject property, they have also requested the addition of Section 12.9, "Contingency." This clause makes the agreement and its obligations to construct on the subject property null and void should the parties fail to execute a lease within six months. a. PUBLIC HEARING Action: b.CONSIDER A RESOLUTION APPROVING AND AUTHORIZING EXECUTION OF Act,on: December 11, 2001 City of Iowa City Page 11 ITEM NO. 8. REPEALING 01-3980 AND AMENDING SECTION 1-9-3B OF THE CODE OF ORDINANCES OF IOWA CITY, ESTABLISHING THE BOUNDARIES OF THE VOTING PRECINCTS IN IOWA CITY. a. PUBLIC HEARING Comment: A public hearing was held on July 31 on the new voting precincts, and an ordinance adopted on August 21 and forwarded to the Secretary of State. On November I a fax was received from the Secretary of State requesting slight revisions to the legal descriptions (not affecting the map or any individuals) and first consideration was given to a revised ordinance on November 13. However, a phone call was received from the Secretary of State's office on November 20 requesting that the ordinance be amended to include the township voters voting in City precincts. The City Attorney recommended that a public hearing be held since the revisions affect the map. b. CONSIDER AN ORDINANCE (FIRST CONSIDERATION) Comment: In accordance with Chapter 49.6 of the State Code cities and counties have the power to combine townships and city precincts as long as the population does not exceed 3500 and the combined precinct is wholly within a legislative district. A letter of agreement was approved for Precincts 12 and 22 at the August 21 Council meeting. The ordinance has been revised to include the amended legal descriptions for Precincts 12 and 22, and the map revised. Action: ITEM NO. 9. CONSIDER AN ORDINANCE AMENDING TITLE 5, "BUSINESS AND LICENSE REGULATIONS," CHAPTER 2, ""VEHICLES FOR HIRE,"" OF THE CITY CODE CLARIFYING DEFINITION OF VEHICLES FOR HIRE, ADDING REQUIREMENTS FOR CERTIFIED STATE OF IOWA CRIMINAL HISTORY INFORMATION PRIOR TO ISSUANCE OF ANY APPLICATION AND/OR DRIVING BADGE, AND REMOVING THE REQUIREMENT FOR A DISTINCTIVE COLOR SCHEME FOR VEHICLES FOR HIRE. (SECOND CONSIDERATION) Comment: The vehicle for hire section of the City Code has not been updated for a number of years. This ordinance would include limousines as a vehicle for hire; require certified copies of criminal history records for all drivers; remove the requirement for a distinctive color scheme for vehicles for hire; and require a permit from the Division of Ani I Control prior to licensing as a horse dra,wn v~hicle for hir~.~,o ~ December 11, 2001 City of Iowa City Page 12 ITEM NO. 10. CONSIDER AN ORDINANCE AMENDING TITLE 6 OF THE CITY CODE, ENTITLED "PUBLIC HEALTH AND SAFETY" BY REPEALING CHAPTER 7, ENTITLED "SMOKING IN PUBLIC PLACES" AND ENACTING A NEW CHAPTER 7, ENTITLED "SMOKING IN FOOD ESTABLISHMENTS." (SECOND CONSIDERATION) Comment: This ordinance would prohibit smoking in establishments where food is prepared or served and intended for consumption on the premises of the, establishment and would prevent the designation of smoking areas within such establishments. The ordinance would except those establishments with sales of alcoholic beverages which exceed 50% of the average monthly gross revenue of the establishments as determined over a calendar year. CIRCUMSCRIBED BY MILLER AVENUE, U.S. HIGHWAY 1, HARLOCKE STREET, AND BENTON STREET IN IOWA CIW, IOWA. (PASS AND ADOPT) Comment: The City is currently beginning its area study and development of the Southwest District Plan, a district specific component of the Comprehensive Plan. The guidelines and principles set fo~h in the Comprehensive Plan are used to identify appropriate land-uses, guide development and establish future development patterns within the City. The area circumscribed by Miller Avenue, U.S. Highway 1, Harlocke Street and Benton Street is located within the Southwest District and contains undeveloped prope~ies within established neighborhoods, environmentally sensitive areas, high density zoning abutting low density zoning, topographic and access limitations and has been the subject of recurring and unresolved debates concerning appropriate development without the benefit of district planning. This ordinance places a tempora~ moratorium on development within the above area (excluding prope~y subject to moratorium pursuant to City Code within the last 12 months and prope~y that is the subject of pending litigation) until September 1, 2002, to allow for the completion of the Southwest District Plan in an effo~ to establish updated Comprehensive Plan guidelines and make appropriate land-use decisions for this area of the City. (PASS AND ADOPT) Comment: The adoption of the City-University Project I Tax Increment Financing District Ordinance establishes the mechanism by which incremental property tax revenue will be made available to the City for the purposes of financing public infrastructure improvements and providing financial assistance to qualifying projects. ITEM NO. 13. CONSIDER AN ORDINANCE AMENDING TITLE 9, ENTITLED MO OR ~/~ ~ VEHICLES AND TRAFFIC," CHAPTER 8, ENTITLED "BICYCLES," SECTION 6, ENTITLED "PARKING VIOLATIONS," SUBSECTION A, ENTITLED "IMPOUNDMENT OF BICYCLES" TO ALLOW THE CITY TO IMPOUND ABANDONED BICYCLES. (PASS AND ADOPT) Comment: Bikes are occasionally abandoned by their owners leaving them attached to bike racks. Because they are otherwise legally parked, no current ordinance allows the City to impound these bicycles. The proposed ordinance allows the City to impound a bicycle if it is legally parked, but abandoned, for more than seven consecutive days. Before impounding, the City will tag the bicycle for seven days and follow all other current provisions when impounding a bicycle. December 11, 2001 City of Iowa City Page 14 ITEM NO. 14. CONSIDER A RESOLUTION OF INTENT TO CONVEY A 140-FOOT BY 17.5-FOOT AREA OF THE VACATED KIRKWOOD AVENUE RIGHT-OF- WAY LOCATED EAST OF THE KIRKWOOD AVENUE/LOWER MUSCATINE ROAD INTERSECTION (HILL CREST PRICE'S ADDITION) TO THE KIRKWOOD AVENUE CHURCH OF CHRIST, AND SETTING A PUBLIC HEARING ON SAID CONVEYANCE FOR JANUARY 8, 2002. Comment: On January 8, 2002, the City Council will consider pass and adoption of an ordinance vacating the Kirkwood Avenue right-of-way located east of the Kirkwood Avenue/Lower Muscatine Road intersection. The Kirkwood Avenue Church of Christ, as owner of the adjacent property to the west and north (1320 Kirkwood Avenue), has offered the sum of $1.00 for a 140-foot by 17.5-foot area of the vacated right-of-way along the south side of its property. The Church believes the parcel has limited market value because the elevation of the area was changed as a result of the installation of a pedestrian/bike trail adjacent to the vacated right-of- way. This resolution declares the City Council's intent to convey the above property to the Kirkwood Avenue Church of Christ, subject to a 140-foot by 5-foot blanket utility easement in favor of the City and the condition that small shrubs be planted along the south property ~ine to screen the parcel and clearly demarcate it from the adjacent trail corridor, and sets a public hearing on the proposed conveyance for January 8, 2002. ITEM NO. 15. CONSIDER A RESOLUTION ADOPTING REVISED AND UPDATED CONTRACT COMPLIANCE PROGRAM. Comment: This resolution provides for an updated Contract Compliance Program for the City which will apply to contractors, consultants, and vendors. Outdated and illegal goal/quota requirements are eliminated and emphasis is placed on equal employment opportunity and non- discrimination practices on the part of those with whom the City does business. Comment: Some of the units in Longfellow Manor front onto Longfellow Place, a public street located in the center of the subdivision, and others front onto a 20' access easement, a private drive located on the perimeter of the development. Currently, refuse collection is performed by City crews utilizing Longfellow Manor only. This agreement will extend the collection of refuse utilizing the private drive in addition to Longfellow Place. Public Works and Engineering recommend approval of the agreement. Act.on: ITEM NO. 17. CONSIDER A RESOLUTION NAMING A PRIVATE DRIVE IN 'Y--o I LONGFELLOW MANOR. Comment: All units on lots located in Longfellow Manor currently have a Longfetlow Place address even though some of the units front onto a private drive which is located on the perimeter of the development across the backs of Lots 1-20. The Subdivision Owners Association for Longfellow Manor wants the private drive named in order to receive prompt response from the emergency services (police, fire and ambutance). This resolution names the private drive "Longfellow Court." Public Works and Engineering recommend approval of this resolution. ITEM NO. 18.
