Comment: This Resolution sets the time, date and place for hearings on proposed $300.00 civil penalties, authorized by Iowa Code section 453A.22(2), against Deadwood Tavern, 6 South Dubuque Street, and Quinton's Bar & Deli, 215 E. Washington Street. Iowa Code section 453A.22(2) authorizes a $300.00 civil penalty against a retail cigarette permit holder whose employee has been convicted of or pled guilty to selling or providing tobacco to a minor. f. Resolutions, o~. - I ~ (1) CONSIDER A RESOLUTION ACCEPTING THE WORK FOR THE IOWA CITY TRANSIT METHANE ABATEMENT PROJECT, PHASE I. Comment: See Engineer's Report. O~.~ /C~ (2) CONSIDER A RESOLUTION AUTHORIZING THE CITY'S PARKS AND RECREATION DIRECTOR TO FILE A NOTICE OF USE RESTRICTION TO BE IMPOSED BY STATE ADMINISTRATIVE RULE ON CERTAIN REAL ESTATE LOCATED IN LOWER CITY PARK AND USED AS THE RIVERSIDE FESTIVAL STAGE. Comment: As a condition of receiving grant funds from the Iowa Department of Natural Resources in the amount of $81,175 for use in constructing the Riverside Festival Stage, Iowa City is required to file with the County Recorder a Notice of Use Restriction, which notice requires that such funds granted be used only for the approved project purpose, and if not so used, or if such property passes from the control of the grantee, that such funds be returned to the department. This restriction would remain in force for a period of 25 years. Comment: This Resolution accepts payment of a $300.00 civil penalty, authorized by Iowa Code section 453A.22(2), from A & J Minimart, 2153 ACT Cimle. Section 453A.22(2) provides that a $300.00 civil penalty will be assessed to a retail cigarette permit holder when and if that permit holder's employee is convicted of or pleads guilty to selling or providing tobacco to a minor. Section 453A.22(2) provides that a $300.00 civil penalty will be assessed to a retail cigarette permit holder when and if that permit holder's employee is convicted of or pleads guilty to selling or providing tobacco to a minor. PLANNING AND ZONING MA'Iq'ERS. a. Consider a motion setting a public hearing for February 5 on an ordinance to rezone approximately 0.63 acres located at 707 N. Dubuque Street from High Density Multi-Family, RM-44, to Sensitive Areas Overlay, OSA/RM-44. (REZ01-00010) Comment: Approval of this rezoning will allow for the property at 707 N. Dubuque Street to be redeveloped with a 10-unit apartment building. A Sensitive Areas Overlay zone is required due to critical (25%~39%) and protected (40%+) slopes existing on the property. At its January 3 meeting, by a vote of 7-0, the Planning and Zoning Commission recommended approval of the proposed rezoning. Staff recommended approval in a report dated December 20, 2001. Public hearing on an ordinance to rezone 95 acres located between Court Street and Lower West Branch Road from Low Density Single Family, RS-5, and Medium Density Single-Family, RS-8, to Sensitive Areas Overlay. (REZ01-00023/SUB01-00025) Comment: Approval of this rezoning will allow the development Lindemann Subdivision, a 261-1ot residential subdivision. A sensitive areas overlay is required due to the presence of a wetland and stream corridor, which will be dedicated to the City for parkland. At its December 20 meeting, by a vote of 6-1 (Ehrhardt voting no) the Planning and Zoning Commission recommended approval. In a report dated December 6, staff recommended approval. (VAC01-00006) Comment: Approval of this vacation will allow the relocation of an unbuilt portion of Northgate Drive. At its December 20 meeting, by a vote of 7-0, the Planning and Zoning Commission recommended approval subject to the final plat of the re-subdivision of Highlander First Addition lots 8 to 14 being approved. (Pass and Adopt) Comment: At its June 21 meeting, by a vote of 7-0, the Planning and Zoning Commission recommended approval of the proposed rezoning, subject to approval of a conditional zoning agreement that addresses the general neighborhood design standards in the Northeast District Plan, general conformance to the concept plan submitted with the application, and the contribution of funds toward the reconstruction of Lower West Branch Road. Final reading of the ordinance was deferred at the Council meeting of September 25 awaiting approval from the City Development Board. Consider an ordinance amending the Zoning Chapter by changing the Zoning regulations of approximately 105.2 acres of property from Suburban Residential, County RS, to Low Density Single-Family Residential, RS-5 (45.08 acres), and Medium Density Single-Family Residential, RS-8 (60.13 acres) for property located north of Court Street, south of Lower West Branch Road, and east of Hummingbird Lane. (Pass and Adopt) Comment: At its June 21 meeting, by a vote of 7-0, the Planning and Zoning Commission recommended approval of the proposed rezoning, subject to approval of a conditional zoning agreement that addresses the general neighborhood design standards in the Northeast District Plan, the contribution of funds toward the reconstruction of Lower West Branch Road, and the dedication of sewer easements. Final reading of the ordinance was deferred at the Council meeting of September 25 awaiting approval from the City Development Board. Consider a resolution approving the final plat of Oakes Sixth Addition, a 30.11-acre, 18-1ot residential subdivision located at the western terminus of Bristol Avenue. (SUB01-00032) Comment: At its January 3 meeting, by a vote of 7-0, the Planning and Zoning Commission recommended approval of the proposed preliminary and final plat, subject to the approval of legal papers prior to City Council consideration, Legal papers have been approved, Staff recommended approval in a repod dated January 3, 2002. PLANS, SPECIFICATIONS, FORM OF CONTACT, AND ESTIM F COST FOR CONSTRUCTION OF THE HIGHWAY 6 RECREATIONAL T~IL PROJECT, ESTABLISHING AMOUNT OF BID SECURI~ TO ACCOMPANY EACH BID, DIRECTING CI~ CLERK TO PUBLISH ADVERTISEMENT FOR BIDS, AND FIXING TIME AND PLACE FOR RECEIPT OF BIDS. Comment: This project involves constructing a 10 foot wide concrete trail along the south side of US Highway 6 beginning at the Iowa River and terminating at the west end of Holl~ood Boulevard. CONSIDER A RESOLUTION AUTHORIZING CONVEYANCE OF THE 0~- $'~ PROPERTY KNOWN AS PENINSULA NEIGHBORHOOD, FIRST ADDITION, IN IOWA CITY, IOWA, TO TERRY L. STAMPER HOLDINGS, L.L.C. Comment: Pursuant to the Peninsula Neighborhood Development Agreement between the City of Iowa City and Terry L. Stamper Holdings, L.L.C. ("Stamper") approved by Resolution No. 00-231 of the City Council dated June 29, 2000, and amendments thereto ("Agreement"), Stamper has agreed to develop a tract of land known as the Peninsula Neighborhood. The City Council considered and approved the final plat of the Peninsula Neighborhood, First Addition, at its June 12, 2001 meeting. On May 8, 2001, the City Council adopted a Resolution declaring its intent to convey its interest in the parcel, authorizing the publication of public notice of the proposed conveyance, and setting the date and time of public hearing. Public hearing was held June 12, 2001. Pursuant to said Agreement, Stamper has agreed to purchase the Peninsula Neighborhood, First Addition, for a price equal to a per-unit base price of $3,171.00 multiplied by the total number of final site-plan approved units. This Resolution authorizes the City Council's conveyance of the above property to Stamper as contemplated in the Resolution of Intent to Convey. ITEM NO. 7. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND ~--.,.?1 THE CITY CLERK TO ATTEST AN ADDENDUM TO THE IOWA DEPARTMENT OF TRANSPORTATION FUNDING AGREEMENT FOR THE NORTH DODGE STREET PROJECT STP-I-5(69)--2C-52. Comment: This addendum allows the City to use its STP funds and local matching funds to purchase design engineering services for this project. The actual costs of these services shall be credited to the total City participation. The original agreement provided for the following: 80% state and 20% local funding for STP funds = $1,109,698 (lump sum) and DOT Primary Road Funds = $4,747,512 (estimated). This project will reconstruct North Dodge Street from the one way pair at Governor Street north to the 1- 80 interchange. The preliminary estimated construction, administration and right of way costs total $5,857,210. Any project expenditures exceeding the preliminary estimate will be borne entirely by the DOT. CONSIDER A RESOLUTION APPROVING, AUTHORIZING AND o~,-.~,~ DIRECTING THE MAYOR TO EXECUTE AND THE CITY CLERK TO AFl'EST AN AGREEMENT BY AND BETVVEEN THE CITY OF IOWA CITY, THE IOWA DEPARTMENT OF TRANSPORTATION AND HOWARD R. GREEN COMPANY, TO PROVIDE ENGINEERING CONSULTANT SERVICES FOR THE DESIGN OF THE NORTH DODGE STREET PROJECT, STP-1-5(69)--2C-52. Comment: This agreement authorizes Howard R. Green Company to provide design engineering services related to the North Dodge Street Project. The total cost of the services is $808,400. 80% federal STP funding and 20% local funding will be used for the contract. The City contribution will be funded by GO bonds and Road Use Taxes. This agreement is on file in the City Engineer's Office. ITEM NO. 9. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND ~. - ?,:~ THE CITY CLERK TO ATTEST AN AGREEMENT BETVVEEN THE CITY OF IOWA CITY AND THE IOWA DEPARTMENT OF TRANSPORTATION FOR THE IMPROVEMENT OF THE INTERSECTION OF IOWA HIGHWAY I AND SUNSET STREET. Comment: This $93,960 project is being funded 55% by the Urban-State Traffic Engineering Program (U-STEP) provided by the Iowa Department of Transportation, and 45% by the City of Iowa City. The improvements will widen the median opening on Iowa Highway 1, replace the traffic signal detection loops with video traffic signal detection, and provide re-striping for the southbound Sunset Street shared through/right turn lane and a separate southbound left turn bay. CONSIDER A RESOLUTION ESTABLISHING A REVISED SCHEDULE o;~- -~ H- OF FEES AND CHARGES FOR PARKS AND RECREATION SERVICES AND PROGRAMS. Comment: The Parks and Recreation Commission and staff review fees and charges annually, and increases are considered in order to help support the Recreation Division's budget. A three-year plan has been established, with FY03 fee increases being recommended for adoption at this time, and FY04 and 2005 fee increases tentatively identified. Some of the FY03 increases will actually be implemented in FY02 because the summer season begins in FY02, but continues into FY03. The Parks and Recreation Commission reviewed the proposed increases at their meeting of December 12, 2001 and adopted them at their meeting of January 9, 2002. Comment: A draft of this resolution was previously reviewed by Council. The resolution as adopted will be forwarded to various Iowa legislators in demonstration of Iowa City's support for legislation to retain and expand the Iowa Beverage Container Deposit Law. Comment: Ordinance 97-3792 establishes the Police Citizens Review Board and sets forth mechanisms for complaints. The Ordinance also provides the City Council to grant extensions of the 45-day reporting requirement for good c~use. At their meeting of January 8, 2002, the Board requested a 30-day extension for the reasons stated in the January 8 minutes which are included in Council packet.
