Comment: In March, JCCOG will be completing Iowa City Transit's FY2003 Iowa Department of Transportation Consolidated Transit Funding Application. This application will contain FY2003 State Transit Assistance formula operating funds and a listing of projects programmed for Federal Transit Administration Section 5307 and/or 5309 operating and capital projects. A public hearing on the application is required by law, with a notice of the hearing published in advance. The grant application will be available for public review prior to the public hearing. (2) CONSIDER A RESOLUTION SETTING A PUBLIC HEARING FOR FEBRUARY 19 TO DISCUSS THE PROPOSED OPERATING BUDGET FOR THE FISCAL YEAR JULY 1, 2002 THROUGH JUNE 30, 2003, THE PROPOSED THREE-YEAR FINANCIAL PLAN, AND ALSO THE MULTI-YEAR CAPITAL IMPROVEMENTS PROGRAM THROUGH FISCAL YEAR 2006. Comment: This resolution sets a public hearing on February 19, 2002 to discuss the FY2003 Proposed Operating Budget, the three-year Financial Plan for FY2003 - FY2005 and multi-year Capital Improvements Program (CIP) through Fiscal Year 2006. Detailed information on the budget will be available for public inspection on February 8, 2002. Council approval tentatively slated for February 27. o,~- E, {~ (3) CONSIDER A RESOLUTION SETTING A PUBLIC HEARING FOR FEBRUARY 19 ON PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE PRAIRIE DU CHIEN ROAD TO DODGE STREET WATER MAIN PROJECT, DIRECTING CITY CLERK TO PUBLISH NOTICE OF SAID HEARING, AND DIRECTING THE CITY ENGINEER TO PLACE SAID PLANS ON FILE FOR PUBLIC INSPECTION. Comment: This project involves the installation of a 24" water main from Prairie du Chien Road to Dodge Street. Comment: This project will landscape Mormon Trek Boulevard from south of Melrose Avenue to the Iowa Interstate Railroad Bridge. This is a joint project with The University of Iowa. Comment: The Public Housing Authority is required to update the Annual Plan under the Quality Housing and Work Responsibility Act of 1998 ("QHWRA"). The Annual Plan will advise HUD, residents and members of the public of the Iowa City Housing Authority's mission for serving the needs of iow income and very Iow-income families, and the Housing Authority's strategy for addressing those needs. The QHWRA requires that the plans be made available to the public for review not later than 45 days before the public hearing is to take place. Notice to the public will be published no later than February 14, 2002. f. Resolutions. O~-~! (1) CONSIDER A RESOLUTION AUTHORIZING APPLICATION ON BEHALF OF THE CITY OF IOWA CITY WITH THE U.S. DOT FOR A GRANT UNDER 49 U.S.C. 5307 FOR TRANSIT OPERATING AND CAPITAL ASSISTANCE FOR FY2002. Comment: JCCOG is preparing the annual Federal Transit Administration [FTA] Section 5307 application on behalf of Iowa City Transit. Funding in the amount of $360,209 is being requested for FY2002 transit operations. This is an increase of 6% from the FY2001 FTA operating apportionment. In addition, the following capital projects programmed for FY2002 will be applied for. The amounts listed are the federal share of each project. Purchase one replacement paratransit vehicle [#6135] - $48,140. Re-seal floors in maintenance and storage areas at transit facility - $48,000. C>=3- - 'z'/-D. (2) CONSIDER A RESOLUTION ACCEPTING THE WORK FOR THE SOUTH SYCAMORE REGIONAL GREENSPACE AND STORMWATER PROJECT. Comment: See Engineer's Report. c~ ~- '~,~ (3) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO Al-rEST TO THE RELEASE OF LIEN REGARDING A MORTGAGE FOR THE PROPERTY LOCATED AT 1517 BURNS AVENUE, IOWA CITY, IOWA. Comment: The owners of the property located at 1519 Burns Avenue received assistance through the City's Downpayment Assistance Program totaling $3,000. Comment: The owners of the property located at 1019 Ginter Avenue received assistance through the City's Housing Rehabilitation Program in the amount of $6,681.70. The financing was in the form of conditional occupancy loans. The loans were paid off February 1, 2002; thus the lien can now be released. O.2-- ~ (5) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO A'I-rEST A PERMANENT DRAINAGE EASEMENT AGREEMENT IN CONNECTION WITH STONE BRIDGE ESTATES, PART ONE. Comment: Council approved the final plat of Stone Bridge Estates Part One, Iowa City, Iowa, by Resolution #01-228, on July 31, 2001. The City Public Works Department and developer have determined that another drainage easement is necessary in connection with the subdivision and surrounding development. Property owner Arlington Development, Inc. has executed permanent drainage easement granting to the City the necessary drainage easement. The City Public Works Department has reviewed the permanent easement agreement and recommends its execution by the City. This resolution authorizes execution of the easement agreement g. Consider~a motion setting a public hearir~j for February 19 on an ordinance to rezone approximately 2,800 square feet from Low Density Multi-Family Residential, RM-12, to High Density Multi-Family, RM-44, for properly located at the north end of West Benton Court. (REZ01-00027) Comment: Approval of this rezoning will allow a planned addition of Oaknoll Retirement Residence to expand into an approximate 2,800 square foot area now zoned RM-12. At its January 17 meeting, by a vote Of 7-0, the Planning and Zoning Commission recommended approval of the proposed rezoning, subject to the site plan proposed for the area being approved by the Planning and Zoning Commission, consistent with an existing Conditional Zoning Agreement. Staff recommended approval in a repod dated January 17. Action: b. Consider a rflotion setting a public hearing for 1~ vr, an ordinance to amend the Sensitive Areas Development Plan for lots 3 and 4 of a resubdivision of Lot 53 of Walden Hills, located at the intersection of Shannon Drive and Rohret Road. (REZ01-00026) Comment: Approval of this amendment will allow the construction of one two-stow 54-unit assisted living elderly housing building in lieu of two previously-approved three-story 30-unit elderly housing apartment buildings. At its January 17 meeting, by a vote of 7-0 the Planning and Zoning Commission recommended approval. Staff recommended approval in a report dated January 17, 2002. Consider a motion setting a public hearing for February 19 on an ordinance to amend Section 14-6E of the Zoning Ordinance in order to allow grocery stores in the Intensive Commercial Zone, C1-1, as a provisional use or as a special exception. Comment: At its January 17 meeting, by a vote of 2-5 (Shannon and Kopping voting for approval) the Planning and Zoning Commission recommended against amending the Zoning Ordinance. However, if the Council decides to amend the Code to allow this use in the Intensive Commercial Zone, the Commission recommends that the ordinance include language to address concerns regarding the potential incompatibility of retail uses with the intensive commercia~ and quasi-industrial uses intended for this zone. Public hearing on an ordinance to rezone approximately 0.63 acres located at 707 N. Dubuque Street from High Density Multi-Family, RM- 44, to High Density Multi-Family Sensitive Areas Overlay, OSNRM-44. (REZ01-00010) (~) Comment: Approval of this rezoning will allow for the prope~y at 707 N. Dubuque Street to be redeveloped with a 10-unit apadment building. A Sensitive Areas Overlay zone is required due to critical (25%-39%) and protected (40%+) slopes existing on the properly. At its JanuaW 3 meeting, by a vote of 7-0, the Planning and Zoning Commission recommended approval of the proposed rezoning subject to the City Engineer approving detailed plans. Staff recommended approval in a repod dated December 20, 2001. Action: ~ ~ ~ ~ e. Consider an ordinance to rezone 95 acres located be~een Cou~ Street and Lower West Branch Road from Low Density Single Family, RS-5, and Medium Density Single-Family, RS-8, to Sensitive Areas Overlay. (REZ01-00023/SUB01-00025) (First Consideration) Comment: Approval of this rezoning will allow the development L~n Subdivision, a 261-1ot residential subdivision. A sensitive areas overlay is required due to the presence of a wetland and stream corridor, which will be dedicated to the City for parkland. At its December 20 meeting, by a vote of 6-1 (Ehrhardt voting no) the Planning and Zoning Commission recommended approval. CONSIDER AN ORDINANCE AMENDING TITLE 14, ENTITLED "UNIFIED DEVELOPMENT CODE," CHAPTER 3, ENTITLED "CITY UTILITIES," ARTICLE E, ENTITLED "WASTEWATER TREATMENT WORKS INDIRECT DISCHARGE," SECTION 4, ENTITLED "PRETREATMENT STANDARDS," OF THE CITY CODE TO AMEND WASTEWATER TREATMENT PLANT INFLUENT STANDARDS. (FIRST CONSIDERATION) Comment: This ordinance establishes new influent limits on pollutants from industrial users of the City's Wastewater Treatment Facilities. The Iowa Department of Natural Resources (IDNR) has reviewed and approved the changes. The IDNR has provided a 45 day public comment period. No comments were received. These changes in limits reflect the level of contaminant removal at the new wastewater facilities, the City's desire to land apply wastewater sludges and the pollutants historically observed entering the City's wastewater stream. Public Works recommends adoption of the ordinance. ITEM NO. 11. CONSIDER A RESOLUTION AWARDING CONTRACT AND AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST A CONTRACT FOR CONSTRUCTION OF THE IOWA CITY LANDFILL SALVAGE BARN & FURNITURE PROJECT BUILDING PROJECT. Comment: The bid letting date for this project has been extended in order to clarify language in the specifications. The bid date has been deferred from January 31, 2002, to February 5, 2002. A notice of the later date has been published as required by law. Public Works and Engineering recommend deferral of this item until February 19, 2002.
