Comment: This resolution sets a public hearing for February 27
to receive public comment regarding the issuance of
$27,055,000 Sewer Revenue Bonds, and authorizes the City
Clerk to publish notice of hearing. These bonds are refunding
the 1993 Sewer Revenue Bonds. Our financial advisors
(Evensen Dodge Inc.) have calculated sewer debt service
savings of $2,393,603.

(7) CONSIDER RESOLUTION ACCEPTING THE WORK FOR THE
CIVIC CENTER RE-ROOF PHASE II PROJECT.
Comment: On August 21, 2000, a contract was entered into with
Academy Roofing of Ankeny, Iowa to remove and replace a
portion of the roof and insulation on the Civic Center project.
The total contract amount is $157,310.06; all work covered by
the contract has been completed, all required paperwork has
been submitted, and all invoices have been paid.
(8) CONSIDER A RESOLUTION APPROVING, AUTHORIZING,
AND DIRECTING THE MAYOR TO EXECUTE AND THE CITY
CLERK TO ATTEST AN AGREEMENT BY AND BETWEEN
THE CITY OF IOWA CITY AND MMS CONSULTANTS, INC. TO
PROVIDE ENGINEERING CONSULTANT SERVICES FOR THE
DESIGN OF THE SOUTH SYCAMORE REGIONAL
GREENSPACE LANDSCAPE AND TRAIL PROJECT.
Comment: This agreement authorizes MMS Consultants to
provide design engineering services related to the South
Sycamore Regional Greenspace Landscape and Trail Project.
The total cost of the services is $61,000 and will be funded by
GO bonds.
(9) CONSIDER A RESOLUTION APPROVING, AUTHORIZING
AND DIRECTING THE MAYOR TO SIGN AND THE CITY
CLERK TO ATTEST THE IOWA DEPARTMENT OF
TRANSPORTATION UNIFIED CERTIFICATION PROGRAM
AGREEMENT.
Comment: The new Disadvantaged Business Enterprise (DBE)
requirements included a provision for a "one-stop" certification
process. The Iowa Department of Transportation is the lead
agency in Iowa. Since the City receives federal funds, the City
must approve and comply with the Unified Certification Program.
If the City does not approve and comply, it may result in the loss
of federal funds.
(10) CONSIDER A RESOLUTION AUTHORIZING THE
MAYOR TO SIGN AND THE CITY CLERK TO
A'I-rEST A PERMANENT SANITARY SEWER EASEMENT
AGREEMENT IN CONNECTION WITH LOTS 39 AND 40,
WEST SIDE PARK, IOWA CITY, IOWA.
Comment: The City Public Works Department has determined
that a permanent sanitary sewer easement located on Lot 40,
West Side Park, Iowa City, Iowa, in favor of the City, is
necessary for City sanitary sewer service for Lots 39 and 40,
West Side Park, Iowa City, Iowa. Property owner A&L Holding
Company has executed the necessary easement agreement.
The Public Works Department has reviewed the easement
agreement and recommends .its execution by the City. This
resolution authorizes execution of the easement agreement.

a. Consider a motion setting a public hearing for March 19 on an
ordinance rezoning 18.2 acres from Low Density Single-Family, (RS-5)
to Sensitive Areas Overlay Low Density Single-Family (OSA-5) and a
preliminary plat of Hickory Heights, a 20-lot resident subdivision
located west of Scott Boulevard near its intersection with Dodge
Street. (REZ01-00028/SUB01-00031 )
Comment: At its February 7 meeting, by a vote of 6-0, the Planning
and Zoning Commission recommended approval of the proposed
rezoning and preliminary plat. Approval will allow the construction of
20 single-family homes. The sensitive areas plan minimizes the
development of slopes on this property. Staff recommended approval
in a report dated January 3

Comment: Approval of this rezoning will allow Oaknoll Retirement
Residence to expand into an approximate 2,800 square foot area now
zoned RM-12. At its January 17 meeting, by a vote Of 7-0, the
Planning and Zoning Commission recommended approval of the
proposed rezoning, subject to the site plan proposed for the area
being approved by the Planning and Zoning Commission, consistent
with an existing Conditional Zoning Agreement. Staff recommended

Comment: Approval of this amendment will allow the construction of

two previously-approved three-story 30-unit elderly housing apartment
buil0ings. At its January 17 meeting, by a vote of 7-0 the Planning
and Zoning Commission recommended approval. Staff recommended
approval in a report dated .January 17, 2002. Applicant requested
expedited consideration in correspondence included in February 5
Council packet.

d. Public hearing on an ordinance to amend Section 14-6E of the Zoning
Ordinance in order to allow grocery stores in the Intensive Commercial
Zone, C1-1, as a provisional use or as a special exception.
Comment: At its January 17 meeting, by a vote of 5-2 (Shannon and
Koppes voting no) the Planning and Zoning Commission
recommended against amending the Zoning Ordinance. However, if
the Council decides to amend the Code to a~low this use in the
Intensive Commercial Zone, the Commission recommends that the
ordinance include language to address concerns regarding the
potential incompatibility of retail uses with the intensive commercial
and quasi-industrial uses intended for this zone. Staff recommended
against amending the Zoning Ordinance in a memo dated December
12, 2001.

707 N. Dubuque Street from High Density Multi-Family, RM-44, to
High Density Multi-Family Sensitive Areas Overlay, OSNRM-44.
(REZ01-O0010) (First Consideration)
Comment: Approval of this rezoning will allow for the property at 707
N. Dubuque Street to be redeveloped with a 10-unit apartment
building. A Sensitive Areas Overlay zone is required due to critical
(25%-39%) and protected (40%+) slopes existing on the property. At
its January 3 meeting, by a vote of 7-0, the Planning and Zoning
Commission recommended approval of the proposed rezoning subject
to the City Engineer approving detailed plans. Staff recommended
approval in a report dated December 20, 2001.

f. Consider an ordinance to rezone 95 acres located between Court
Street and Lower West Branch Road from Low Density Single Family,
RS-5, and Medium Density Single-Family, RS-8, to Sensitive Areas

Comment: Approval of this rezoning will allow the development
Lindemann Subdivision, a 261-1ot residential subdivision. A sensitive
areas overlay is required due to the presence of a wetland and stream
corridor, which will be dedicated to the City for parkland. At its
December 20 meeting, by a vote of 6-1 (Ehrhardt voting no) the
Planning and Zoning Commission recommended approval. In a report
dated December 6, staff recommended approval.

Comment: This ordinance corrects a scrivener's error in the description of

Comment: This ordinance establishes new influent limits on pollutants
from industrial users of the City's Wastewater Treatment Facilities. The
Iowa Depa~ment of Natural Resources (IDNR) has reviewed and
approved the changes. The IDNR has provided a 45-day public comment
period. No comments were received. These changes in limits reflect the
level of contaminant removal at the new wastewater facilities, the City's
desire to land apply wastewater sludges and the pollutants historically
obse~ed entering the City's wastewater stream. Public Works
recommends adoption of the ordinance.

ITEM NO. 15. CONSIDER A RESOLUTION AUTHORIZING THE ACQUISITION OF
/,,,~ PROPERTY INTERESTS NECESSARY FOR CONSTRUCTION OF THE
HIGHWAY 6 RECREATIONAL TRAIL PROJECT.
Comment: The City of Iowa City must acquire easements to construct the
Highway 6 Recreational Trail Project. This resolution authorizes City staff
to negotiate and the Mayor to sign these documents, including
authorization of condemnation if necessary. Every effort will be made to
negotiate acceptable agreements without resorting to condemnation.
Prior to proceeding with condemnation, staff will notify Council.

ITEM NO. 16. CONSIDER A MOTION GRANTING A 30-DAY EXTENSION TO THE
POLICE CITIZENS REVIEW BOARD FOR THE FILING OF THE PUBLIC
REPORT WITH THE CITY COUNCIL ON COMPLAINT #01-06.
Comment: Ordinance 97-3792 establishes the Police Citizens Review
Board and sets forth mechanisms for complaints. The Ordinance also
provides the City Council to grant extensions of the 45-day reporting
requirement for good cause. At their meeting of February 5, 2002, the
Board unanimously requested an additional 30-day extension for the
reasons stated in the minutes. Correspondence included in the Council
packet. (See draft minutes on Consent Calendar.)
