The special circumstance which applies to this property is that the existing dwelling current sits l foot 3 inches inside the 20 foot required front yard setback. Architecturally, it would be best to keep the proposed addition in line with the existing plane of the house. The minor modification will not be detrimental to the public health, safety, or welfare. A large percentage of the dwellings in this neighborhood encroach into the 20 foot required setback which contributes to the character of the neighborhood. A modification in this instance would be in keeping with the surrounding properties. The minor modification conforms with the intent and purpose of the Zoning Ordinance. The minor modification does not exceed the standards authorized by the Zoning Ordinance (i.e., the standard allowed is a reduction of up to 15% of the required front yard setback and the request is a 6.25% reduction). The minor modification does not relieve the property owner from complying with all other applicable statutes, ordinances, laws or regulations. This document must be recorded at the Office of the Johnson County Recorder. Douglas ~r.
